147147 SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.10, as
148148 amended by Section 12, Chapter 251, O.S.L. 2022 (63 O.S . Supp. 2023,
149149 Section 427.10), is amended to read as follows:
150150 Section 427.10. A. Only licensed Oklahoma allopathic,
151151 osteopathic and podiatric physicians may provide a medical marijuana
152152 recommendation for a medical marijuana patient license u nder the
153153 Oklahoma Medical Marijuana and Patient Protection Act.
154154 B. A physician who has not completed his or her first residency
155155 shall not meet the definition of “physician” under this section and
156156 any recommendation for a medical marijuana patient license shall not
157157 be processed by the Oklahoma Medical Marijuana Authority.
158158 C. No physician shall be subject to arrest, prosecution or
159159 penalty in any manner or denied any right or privilege under state,
160160 municipal or county statute, ordinance or resolution, including
161161 without limitation a civil penalty or disciplinary action by the
162162 State Board of Medical Licensure and Supervision, the State Board of
163163 Osteopathic Examiners, the Board of Podiatric Medical Examiners or
164164 by any other business, occupation or professional licensing board or
165165 bureau, solely for providing a medical marijuana recommendation for
166166 a patient or for monitoring, treating or prescribing scheduled
167167 medication to patient s who are medical marijuana licensees. The
168168 provisions of this subsection shall not prevent the relevant
169169 professional licensing boards from sanctioning a physician for
170170 failing to properly evaluate the medical condition of a patient or

222222 for otherwise violati ng the applicable physician-patient standard of
223223 care.
224224 D. A physician who recommends use of medical marijuana shall
225225 not be located at the same physical address as a licensed medical
226226 marijuana dispensary.
227227 E. If the physician determines the continued use of medical
228228 marijuana by the patient no longer meets the requirements set forth
229229 in the Oklahoma Medical Mar ijuana and Patient Protection Act, the
230230 physician shall notify the Oklahoma Medical Marijuana Authority and
231231 the license shall be immediately void ed without right to an
232232 individual proceeding.
233233 F. The Authority shall create and maintain a registry of
234234 recommending physicians. Beginning January 1, 2025, to be eligible
235235 to provide a medical marijuana recommendation to a licensed patient ,
236236 a physician shall be registered with the Authority.
237237 G. To be registered with the Authority, a physician shall
238238 comply with the medical education and continuing medical education
239239 requirements described in subsection I of this section and shall
240240 meet all other requirements established by law or rule for
241241 recommending physicians.
242242 H. The Authority is hereby authorized to enter into contracts
243243 and agreements for the payment for food, lodging, and other
244244 authorized expenses as may be necessary to host, conduct, sponsor,
245245 or participate in conferences, meetings, or training sessions. The

297297 Authority may establish accounts as necessary for the co llection and
298298 distribution of funds, including funds of spon sors and registration
299299 fees, related to such conferences, meetings, and training sessions.
300300 Any expenses incurred may be paid directly to the contacting agency
301301 or business establishment.
302302 I. The Executive Director of the Authority shall promulgate
303303 rules to establish medical education and continuing medical
304304 education requirements for recommending physicians. In promulgating
305305 such rules, the Executive Director shall consult wit h the State
306306 Board of Medical Licensure and Supervision, the State Board of
307307 Osteopathic Examiners, and the Board of Podiatric Medical Examiners,
308308 and the Executive Director may consult with associations
309309 representing licensees of such boards.
310310 SECTION 2. AMENDATORY Section 3, Chapter 328, O.S.L.
311311 2022 (63 O.S. Supp. 202 3, Section 427.14b), is amended to read as
312312 follows:
313313 Section 427.14b. A. 1. Beginning January 1, 2024, the
314314 Oklahoma Medical Marijuana Authority shall require employees of a
315315 medical marijuana business licensee to apply for and receive a
316316 credential authorizing the employee to wor k in a licensed medical
317317 marijuana business.
318318 2. Beginning January 1, 2025, to be eligible for such
319319 credential, employees of medical marijuana disp ensaries shall comply
320320 with the education and continuing education requirements described

372372 in subsection G of this section and shall meet all other
373373 requirements established by law or rule for employees of a medical
374374 marijuana business licensee.
375375 B. The Authority may contract with one or more third-party
376376 vendors to provide the credentialing services necessary to carry out
377377 the provisions of this section.
378378 C. The Authority shall determine the services to be provided by
379379 such third-party vendor and shall establish costs and prices. If
380380 contracted for credentialing services, a third-party vendor shall on
381381 behalf of the Authority conduct the background checks and verify
382382 eligibility and suitability for any employees of a medical marijuana
383383 business license holder to obtain a credential.
384384 D. Upon successful completion by the third -party vendor of the
385385 statutorily required backgro und checks and verification of
386386 eligibility and suitability for a n employee, the third-party vendor
387387 shall issue a credential to the employee. The results of background
388388 checks and verificat ions shall be provided to the Authority by the
389389 third-party vendor.
390390 E. If the third-party vendor determines that an employee of a
391391 medical marijuana business holder does not meet the minimum
392392 statutory requirements for a credential, the applicant or empl oyee
393393 shall have no recourse against the third-party vendor but may appe al
394394 such adverse determination to the Authority.

446446 F. The third-party vendor shall not be civilly liable to an
447447 applicant, licensee, or employee of a licensee for any acts taken in
448448 good-faith compliance with the pr ovisions of Section 420 et seq. of
449449 Title 63 of the Oklahoma Statutes this title and the Oklahoma
450450 Medical Marijuana and Pat ient Protection Act and the rules
451451 promulgated by the Oklahoma Medical Marijuana Authority.
452452 G. 1. The Executive Director of the Authority may promulgate
453453 rules to implement the provisions of this section.
454454 2. Such rules shall include, but not be limited to , education
455455 and continuing education requirements for employees of medical
456456 marijuana dispensaries.
457457 SECTION 3. AMENDATORY 63 O.S. 2021, Section 427.21, as
458458 amended by Section 2 , Chapter 329, O.S.L. 2022 (63 O.S. Supp. 202 3,
459459 Section 427.21), is amended to read as follow s:
460460 Section 427.21. A. A medical marijuana busine ss shall not
461461 engage in advertising that is dec eptive, false or misleading.
462462 B. Medical marijuana advert ising shall not cont ain any
463463 statement or illustration that:
464464 1. Promotes overconsumption;
465465 2. Represents that the use of marijuana has curative or
466466 therapeutic effects; or
467467 3. Depicts a child or other person under legal age to consume
468468 marijuana, or includes :

520520 a. objects such as toys or cartoon or other characters ,
521521 which suggest the presence of a child, or any other
522522 depiction designed in any manner to be espe cially
523523 appealing to children or other persons under legal age
524524 to consume marijuana, or
525525 b. any manner or design that would be especially
526526 appealing to children or other persons unde r eighteen
527527 (18) years of age.
528528 C. Upon the effective date of this act Beginning on November 1,
529529 2022, all medical marijuana commercial gr ower licensees shall be
530530 required to post signag e at the site of the commercial grow
531531 operation. Signage shall be located at the perimeter of the
532532 property with dimensions measuri ng no less than eighteen (18) inches
533533 by twenty-four (24) inches with a font size of no less than two (2)
534534 inches. Information required to be displayed on the sign shall be
535535 in black standardized font on a white background. The Oklahoma
536536 Medical Marijuana Au thority shall promulgate rules as necessary
537537 regarding the size, placement, issu ance and specifications of the
538538 required signage. The following information shall be included on
539539 the required signage:
540540 1. Business name;
541541 2. Physical address of the licensed business;
542542 3. Phone number of the licensed business; and
543543 4. Medical marijuana business license nu mber.

595595 The required signage sha ll also comply with county regulations
596596 and local ordinances related to th e real property where the
597597 commercial grow operation is located. Failure to erect the proper
598598 signage within sixty (60) days after the re newal of each application
599599 for a medical marijua na commercial grower license in accordance with
600600 the provisions of this su bsection shall result in th e immediate
601601 revocation of the medical marijuana commercial grower license. Upon
602602 issuance of a temporary license, all medical marijuana commercial
603603 grower licensees shall be required to comply with the provisions of
604604 this subsection prior to the prelicensure inspection conducted by
605605 the Authority.
606606 D. It shall be unlawful to host or adverti se medical marijuana-
607607 related events requiring admission fees or open to the general
608608 public, other than for the purposes of pro viding education to a
609609 physician on the list of approved providers and as permitted by the
610610 appropriate licensing board. The Authority shall p romulgate rules
611611 to issue or deny permits for events not hosted by the A uthority and
612612 not related to education of provi ders.
613613 SECTION 4. This act shall become effective January 1, 202 5.
