7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 63 O.S. 2021, S ection 1-1939, is
7777 amended to read as follows:
7878 Section 1-1939. A. The owner and licensee are may be liable to
7979 a resident for any intentional or negligent act or omission of their
8080 agents or employees which injures the resident if the act or
8181 omission occurs within the scope of the employment or agency . In
8282 addition, any state employee that aids, ab ets, assists, or conspires
8383 with an owner or licensee to perform an act that causes injury to a
8484 resident shall be individually liable.
8585 B. A resident may maintain a n action under the Nursing Home
8686 Care Act for any other type of relief , including injunctive and
8787 declaratory relief, permitted by law.

139139 C. Any damages recoverable under this section , including
140140 minimum damages as provided by this section, may be recovered in any
141141 action which a court may authorize to be brought as a class action.
142142 The remedies provided in this section, are in addition to and
143143 cumulative with any other legal remedies available to a resident.
144144 Exhaustion of any available administrative remedies s hall not be
145145 required prior to commencement of suit hereunder.
146146 D. Any waiver by a resident or the legal representative of the
147147 resident of the right to commence an action under this sectio n,
148148 whether oral or in writing, shall be null and void, and without
149149 legal force or effect.
150150 E. Any party to an action brought under this section shall be
151151 entitled to a trial by jury and any waiver of the right to a trial
152152 by a jury, whether oral or in writin g, prior to the commencement of
153153 an action, shall be null and void, an d without legal force or
154154 effect.
155155 F. A licensee or its agents or employees shal l not transfer,
156156 discharge, evict, harass, dismiss , or retaliate against a resident,
157157 a resident’s guardian, or an employee or agent who makes a report,
158158 brings, or testifies in, a n action under this section, or files a
159159 complaint because of a report, testimony , or complaint.
160160 G. Any person, institution , or agency, under the Nursing Home
161161 Care Act, participating in good faith in the making of a report, or
162162 in the investigation of such a report shall not be deemed to have

214214 violated any privileged communication and shall have immunity from
215215 any liability, civil or criminal, or any other proceedings, civil or
216216 criminal, as a consequence of making such report. The good faith of
217217 any persons required, or permitted to report cases of suspected
218218 resident abuse or neglect under this act the Nursing Home Care Act
219219 shall be presumed.
220220 H. A facility employee or agent who becomes aware of abuse,
221221 neglect, or exploitation of a resident prohibited by the Nu rsing
222222 Home Care Act shall immediately rep ort the matter to the facility
223223 administrator. A facility administrator who becomes aware of abuse,
224224 neglect, or exploitation of a resident shall immediately act t o
225225 rectify the problem and shall make a report of the incident and its
226226 correction to the State Department of Health.
227227 I. 1. The facility shall be responsible for reporting the
228228 following serious incidents to the Department within twenty -four
229229 (24) hours:
230230 a. communicable diseases,
231231 b. deaths by unusual occurrence, including accidental
232232 deaths or deaths other than by na tural causes, and
233233 deaths that may be attributed to a medical device,
234234 c. missing residents. In addition, the facility shall
235235 make a report to local law enforcement agencies within
236236 two (2) hours if the resident is still missing,

288288 d. situations arising where a rape or a criminal act is
289289 suspected. Such situations shall also be reported to
290290 local law enforcement immediately. The facility shall
291291 make every effort to preserve the scene o f the
292292 suspected rape or crime until local law enforcement
293293 has arrived, and
294294 e. resident abuse, neglect, and misappropriation of the
295295 property of a resident.
296296 2. All other incident reports shall be made in accordance with
297297 federal law.
298298 3. All initial written reports of incidents o r situations shall
299299 be mailed to the Department within fiv e (5) working days after the
300300 incident or situation. The final report shall be filed with the
301301 Department when the full investigation is complete.
302302 SECTION 2. This act shall become effective November 1, 202 4.
