75 | 75 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

76 | 76 | | SECTION 1. AMENDATORY 63 O.S. 2021, S ection 1-1939, is |
---|
77 | 77 | | amended to read as follows: |

78 | 78 | | Section 1-1939. A. The owner and licensee are may be liable to |
---|
79 | 79 | | a resident for any intentional or negligent act or omission of their |
---|
80 | 80 | | agents or employees which injures the resident if the act or |
---|
81 | 81 | | omission occurs within the scope of the employment or agency . In |
---|
82 | 82 | | addition, any state employee that aids, ab ets, assists, or conspires |
---|
83 | 83 | | with an owner or licensee to perform an act that causes injury to a |
---|
84 | 84 | | resident shall be individually liable. |
---|
85 | 85 | | B. A resident may maintain a n action under the Nursing Home |
---|
86 | 86 | | Care Act for any other type of relief , including injunctive and |
---|
87 | 87 | | declaratory relief, permitted by law. |

150 | 150 | | E. Any party to an action brought under this section shall be |

151 | 151 | | entitled to a trial by jury and any waiver of the right to a trial |

152 | 152 | | by a jury, whether oral or in writin g, prior to the commencement of |

153 | 153 | | an action, shall be null and void, an d without legal force or |
---|
154 | 154 | | effect. |

155 | 155 | | F. A licensee or its agents or employees shal l not transfer, |
---|
156 | 156 | | discharge, evict, harass, dismiss , or retaliate against a resident, |
---|
157 | 157 | | a resident’s guardian, or an employee or agent who makes a report, |
---|
158 | 158 | | brings, or testifies in, a n action under this section, or files a |
---|
159 | 159 | | complaint because of a report, testimony , or complaint. |

160 | 160 | | G. Any person, institution , or agency, under the Nursing Home |
---|
161 | 161 | | Care Act, participating in good faith in the making of a report, or |
---|

220 | 220 | | H. A facility employee or agent who becomes aware of abuse, |

221 | 221 | | neglect, or exploitation of a resident prohibited by the Nu rsing |
---|
222 | 222 | | Home Care Act shall immediately rep ort the matter to the facility |
---|
223 | 223 | | administrator. A facility administrator who becomes aware of abuse, |
---|
224 | 224 | | neglect, or exploitation of a resident shall immediately act t o |
---|
225 | 225 | | rectify the problem and shall make a report of the incident and its |
---|
226 | 226 | | correction to the State Department of Health. |
---|
227 | 227 | | I. 1. The facility shall be responsible for reporting the |
---|
228 | 228 | | following serious incidents to the Department within twenty -four |
---|
229 | 229 | | (24) hours: |
---|
230 | 230 | | a. communicable diseases, |
---|
231 | 231 | | b. deaths by unusual occurrence, including accidental |
---|
232 | 232 | | deaths or deaths other than by na tural causes, and |
---|
233 | 233 | | deaths that may be attributed to a medical device, |
---|
234 | 234 | | c. missing residents. In addition, the facility shall |
---|
235 | 235 | | make a report to local law enforcement agencies within |
---|
236 | 236 | | two (2) hours if the resident is still missing, |
---|

291 | 291 | | make every effort to preserve the scene o f the |

292 | 292 | | suspected rape or crime until local law enforcement |

293 | 293 | | has arrived, and |
---|
294 | 294 | | e. resident abuse, neglect, and misappropriation of the |
---|
295 | 295 | | property of a resident. |
---|
296 | 296 | | 2. All other incident reports shall be made in accordance with |
---|
297 | 297 | | federal law. |
---|
298 | 298 | | 3. All initial written reports of incidents o r situations shall |
---|
299 | 299 | | be mailed to the Department within fiv e (5) working days after the |
---|
300 | 300 | | incident or situation. The final report shall be filed with the |
---|
301 | 301 | | Department when the full investigation is complete. |
---|
302 | 302 | | SECTION 2. This act shall become effective November 1, 202 4. |
