49	73		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
50	74		SECTION 1. AMENDATORY 37A O.S. 2021, Section 2-129, is
51	75		amended to read as follows:
52	76		Section 2-129. A. A charitable auction or charitable alcoholic
53	77		beverage event license may be issued to a charitable organization
54	78		exempt from taxation under Section 501(c)(3), (4), (5), (6), (7),
55	79		(8), (9), (10) or (19) of th e United States Internal R evenue Code.
56	80		The charitable alcoholic beverage event license shall authorize the
57	81		holder thereof to conduct a wine, spirit and/or beer event which may
58	82		consist of one or more of a wine, spirit and/or beer-tasting event,
59	83		a wine, spirit and/or beer dinner event or a wine, spirit and/or
60	84		beer auction, which may be either a live auction conducted by an
61	85		auctioneer or a silent auction for which:

89	137		1. Bid sheets are accepted from interested bidders at the
90	138		event;
91	139		2. The holders of tickets ar e allowed to bid online fo r a
92	140		period not exceeding thirty (30) days prior to the event; or
93	141		3. Both bid sheets are accepted at the event and online bids
94	142		are accepted pursuant to paragraph 2 of this subsection.
95	143		B. A charitable alcoholic beverage event shall be conducted
96	144		solely to raise funds for chari table purposes. A charitable
97	145		alcoholic beverage license shall allow the event attendees access to
98	146		tastings, samples, dinners and alcoholic beverages as parts part of
99	147		their entrance fee or ticket price. Wine, spiri ts and/or beer used
100	148		in, served or consumed at a charitable alcoholic beverage event may
101	149		be purchased by the charitable organization or donated by any person
102	150		or entity.
103	151		C. The charitable alcoholic beverage event license sh all be
104	152		issued for a period not exceeding four (4) days. Only eight such
105	153		licenses may be issued to an organization in any twelve -month
106	154		period; provided, that institutions of higher education in this
107	155		state shall not be restricted to the maximum number of event
108	156		licenses issued in any twelve-month period pursuant to this
109	157		subsection. The charitable organization holding a charitable
110	158		alcoholic beverage event license shall not be required to obtain a
111	159		special event license.

139	211		D. Charitable auction and charitable alcoh olic beverage event
140	212		license holders may also utilize a licensed caterer to prov ide
141	213		additional alcohol services at the event and on the premises.
142	214		E. The charitable auction license shall authorize the holder
143	215		thereof to auction wine, spirits and/or beer purc hased from a retail
144	216		package store or received as a gift from an individual if the
145	217		auction is conducted to raise funds for charitable pur poses. The
146	218		charitable auction license shall be issued for a period not to
147	219		exceed two (2) days. Only four such licenses shall be issued to an
148	220		organization in any twelve -month period; provided, that institutions
149	221		of higher education in this state shall not be restricted to the
150	222		maximum number of auction licenses issued in any twelve-month period
151	223		pursuant to this subsection. The maximum amount of wine, spiri ts
152	224		and/or beer auctioned pursuant to the charitable auction license
153	225		shall not exceed fif ty (50) gallons. All wines, beer and spirits
154	226		auctioned pursuant to the charitable auction l icense shall be
155	227		registered and all fees and taxes shall be paid in accordance with
156	228		the Oklahoma Alcoholic Beverage Control Act.
157	229		F. No charitable alcoholic beverage event license shall be
158	230		required for an organization, association or nonprofit corporation
159	231		which is an economic development chamber or similar entity, provided
160	232		the event is not conducted primarily for fundraising purposes, and
161	233		provided the services of a li censed caterer are used to provide and
162	234		distribute the alcoholic beverages at the event.
