1949 335, O.S.L. 2023 (69 O.S. Supp. 2023, Section 1 208),

3361 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3562 SECTION 1. AMENDATORY 69 O. S. 2021, Section 1208, as
3663 amended by Section 1, Chapter 335, O.S.L. 2023 (69 O.S. Supp. 2023,
3764 Section 1208), is amended to read as follows:

3965 Section 1208. (a) A. The rights-of-way acquired by the
4066 Department of Transportation or a county shall be held invi olate for

4295 functional encroachments or uses shall be permitted within such
4396 rights-of-way.

4597 (b) B. It shall be unlawful for any person to construct,
4698 maintain or operate any gasoline pump, dr iveway canopy, building,

4999 sign, fence, post, or any thing or structure on or overhanging any
50100 right-of-way, or upon or overhanging any street occupied by a
51101 designated state or federal highway, or county roads and the
52102 construction or maintaining of any such t hing or structure on or
53103 overhanging any federal or state highway or county roads shall
54104 constitute a public nuisance, which may be summarily aba ted by the
55105 Commission or board of county commissioners or its officers, agents,
56106 servants and employees in the man ner provided in this article.

58107 (c) C. This section shall not apply to the lawful use of such
59108 rights-of-way for the erection and operation of facilities of a
60109 public utility, or companies engaged in the activities defined in
61110 Section 137.1 of Title 52 of the Oklahoma Statutes.

63111 D. This section shall not apply to the placement, by the county
64112 commissioners or the board of directors of a fire protectio n
65113 district or the designees of either, of signage indicating that
66114 restrictions on outdoor burning are in effect pursuant to Section
67115 901.8 of Title 19 of the Oklahoma Statutes. Such signage may be
68116 placed on the right-of-way, provided such placement is made in
69117 coordination with the Department of Transportation. When
