7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A n ew section of law to be codified
7979 in the Oklahoma Statutes as Section 1005.11 of Title 56, unless
8080 there is created a duplication in numbering, reads as follows:
8181 A. For purposes of this section:
8282 1. “Provider” means a provider of services for compensation;
8383 2. “Affiliate” means an entity which licenses the use of a
8484 trademark or other recognized n ame to the provider, and which
8585 exercises control over the use of part or all of the pr ovider’s
8686 name, or any entity so l icensed or controlled; and
8787 3. a. “Gender transition procedures” means any medical or
8888 surgical service, including but not limited to

140140 physician’s services, inpatient and out patient
141141 hospital services, or pr escribed drugs related to
142142 gender transition that seeks to:
143143 (1) alter or remove physica l or anatomical
144144 characteristics or features that are typical for
145145 the individual’s biological sex, or
146146 (2) instill or create physiological o r anatomical
147147 characteristics that resemble a sex different
148148 from the individual’s biological sex, including
149149 but not limited to medical services that provide
150150 puberty-blocking drugs, cross -sex hormones, or
151151 other mechanisms to promote the development of
152152 feminizing or masculinizing features i n the
153153 opposite biological sex, or genital or nongenital
154154 gender reassignment surgery pe rformed for the
155155 purpose of assisting an individual with a gender
156156 transition.
157157 b. Gender transition proc edures do not include:
158158 (1) services to persons born with a medically
159159 verifiable disorder of sex development, including
160160 a person with external biological s ex
161161 characteristics that are irresolvably ambiguous,
162162 such as those born with 46 XX chromosomes with
163163 virilization, 46 XY chromosomes with

215215 undervirilization, or having both ovarian and
216216 testicular tissue,
217217 (2) services provided when a physician has otherwise
218218 diagnosed a disorder of sexual development by
219219 determining through genetic or biochemical
220220 testing that the person does not have normal sex
221221 chromosome structure, sex steroid hormone
222222 production, or sex steroid hormone action,
223223 (3) the treatment of any infection, injury, di sease,
224224 or disorder that has been caused by or
225225 exacerbated by the perform ance of gender
226226 transition procedures , whether or not the gender
227227 transition procedure was performed in acc ordance
228228 with state and federal law, or
229229 (4) any procedure undertaken because the individual
230230 suffers from a physical disorder, physic al
231231 injury, or physical illness that would, as
232232 certified by a physician, place the indivi dual in
233233 imminent danger of death or i mpairment of major
234234 bodily function unless surgery is performed.
235235 B. No provider shall be eligible for reimbursement through
236236 Medicaid or any other feder al or state program or any other fun ding
237237 from any political subdivision of this state including but not
238238 limited to cities, towns, municipalities , or counties, directly or

290290 by subcontract with any other party, if that provider, or any
291291 affiliate of that provid er, performs gender transition proc edures.
292292 C. Any providers found to be ineligible for reimbursement or
293293 other funding pursuant to this section shall be able to reapply
294294 after a period of five (5) years and a showing that they and their
295295 affiliates no longer participate in gender transition procedures.
296296 D. Within sixty (60) calendar days of receipt of a compla int of
297297 a violation under this section, the Oklahoma Health Care Authority
298298 shall publish the findings of its investigation of the co mplaint and
299299 issue a determination of whether a provider has committed a
300300 violation of the provisions of this section. Nothing in this
301301 section shall preclude other law enforcement entities or a party in
302302 qui tam litigation from initiat ing action regarding this section.
303303 SECTION 2. It being immediately necessary for the pr eservation
304304 of the public peace, health or sa fety, an emergency is hereby
305305 declared to exist, by reason whereof this act shall take effect and
306306 be in full force from and after it s passage and approval .
