77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A n ew section of law to be codified
79	79	in the Oklahoma Statutes as Section 1005.11 of Title 56, unless
80	80	there is created a duplication in numbering, reads as follows:
81	81	A. For purposes of this section:
82	82	1. “Provider” means a provider of services for compensation;
83	83	2. “Affiliate” means an entity which licenses the use of a
84	84	trademark or other recognized n ame to the provider, and which
85	85	exercises control over the use of part or all of the pr ovider’s
86	86	name, or any entity so l icensed or controlled; and
87	87	3. a. “Gender transition procedures” means any medical or
88	88	surgical service, including but not limited to

141	141	hospital services, or pr escribed drugs related to
142	142	gender transition that seeks to:
143	143	(1) alter or remove physica l or anatomical
144	144	characteristics or features that are typical for
145	145	the individual’s biological sex, or
146	146	(2) instill or create physiological o r anatomical
147	147	characteristics that resemble a sex different
148	148	from the individual’s biological sex, including
149	149	but not limited to medical services that provide
150	150	puberty-blocking drugs, cross -sex hormones, or
151	151	other mechanisms to promote the development of
152	152	feminizing or masculinizing features i n the
153	153	opposite biological sex, or genital or nongenital
154	154	gender reassignment surgery pe rformed for the
155	155	purpose of assisting an individual with a gender
156	156	transition.
157	157	b. Gender transition proc edures do not include:
158	158	(1) services to persons born with a medically
159	159	verifiable disorder of sex development, including
160	160	a person with external biological s ex
161	161	characteristics that are irresolvably ambiguous,
162	162	such as those born with 46 XX chromosomes with
163	163	virilization, 46 XY chromosomes with

215	215	undervirilization, or having both ovarian and
216	216	testicular tissue,
217	217	(2) services provided when a physician has otherwise
218	218	diagnosed a disorder of sexual development by
219	219	determining through genetic or biochemical
220	220	testing that the person does not have normal sex
221	221	chromosome structure, sex steroid hormone
222	222	production, or sex steroid hormone action,
223	223	(3) the treatment of any infection, injury, di sease,
224	224	or disorder that has been caused by or
225	225	exacerbated by the perform ance of gender
226	226	transition procedures , whether or not the gender
227	227	transition procedure was performed in acc ordance
228	228	with state and federal law, or
229	229	(4) any procedure undertaken because the individual
230	230	suffers from a physical disorder, physic al
231	231	injury, or physical illness that would, as
232	232	certified by a physician, place the indivi dual in
233	233	imminent danger of death or i mpairment of major
234	234	bodily function unless surgery is performed.
235	235	B. No provider shall be eligible for reimbursement through
236	236	Medicaid or any other feder al or state program or any other fun ding
237	237	from any political subdivision of this state including but not
238	238	limited to cities, towns, municipalities , or counties, directly or

290	290	by subcontract with any other party, if that provider, or any
291	291	affiliate of that provid er, performs gender transition proc edures.
292	292	C. Any providers found to be ineligible for reimbursement or
293	293	other funding pursuant to this section shall be able to reapply
294	294	after a period of five (5) years and a showing that they and their
295	295	affiliates no longer participate in gender transition procedures.
296	296	D. Within sixty (60) calendar days of receipt of a compla int of
297	297	a violation under this section, the Oklahoma Health Care Authority
298	298	shall publish the findings of its investigation of the co mplaint and
299	299	issue a determination of whether a provider has committed a
300	300	violation of the provisions of this section. Nothing in this
301	301	section shall preclude other law enforcement entities or a party in
302	302	qui tam litigation from initiat ing action regarding this section.
303	303	SECTION 2. It being immediately necessary for the pr eservation
304	304	of the public peace, health or sa fety, an emergency is hereby
305	305	declared to exist, by reason whereof this act shall take effect and
306	306	be in full force from and after it s passage and approval .
