8585 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8686 SECTION 1. NEW LAW A new section of law to be codified
8787 in the Oklahoma Statutes as Section 37-129 of Title 11, unless there
8888 is created a duplication in numbering, reads as follows:
8989 A. 1. The Oklahoma Water Resources Board shall establish and
9090 administer a Municipal Wa terworks Repair Grant Program. The Program
9191 shall include development of competitive grants to be awarded to
9292 municipalities seeking to maintain or repair existing w aterworks.

144144 The Board shall promulgate rules to effectuate the pr ovisions of
145145 this section and award criteria for the Grant Program.
146146 2. Grant applicants with a demonstrated lack of funds to
147147 effectuate needed maintenance or repair of existing waterworks shall
148148 be awarded a higher score in the grant awards process established by
149149 the Board.
150150 B. All grant awards authorized pursuant to the provisions of
151151 this section shall include a clawback provision. For purposes of
152152 this subsection, a “clawback provision” shall mean a condition
153153 precedent to participate in the Progra m whereby a grant recipient
154154 formally agrees to reimburse the Program all or part of a grant
155155 award upon the failure of the recipient to fulfill contract terms
156156 included in the grant award.
157157 C. A municipal governing body of a municipality shall notify
158158 the Oklahoma Water Resources Board, as well as the board of county
159159 commissioners of the county in which such municipality is located,
160160 if the municipal waterworks of the mun icipality are in need of
161161 maintenance or repair. Such notification shall be done either via
162162 mail or electronically. The Oklahoma Water Resources Board or the
163163 board of county commissioners shall provide assistance to the
164164 municipality in developing the application for the Program.
165165 SECTION 2. NEW LAW A new section of law to be codified

219219 There is hereby created in the State Treasury a revolving fund
220220 for the Oklahoma Water R esources Board to be designated the
221221 “Municipal Waterworks Repair Grant Program Revolving Fund”. The
222222 fund shall be a continuing fund, no t subject to fiscal year
223223 limitations, and shall consist of all mo nies apportioned pursuant to
224224 subsection D of Section 1353 of Title 68 of the Oklahoma Statutes.
225225 All monies accruing to the credit of the fund are hereby
226226 appropriated and may be budgeted and expended by the Board for the
227227 purposes provided in this act. Expenditures from the fund shall be
228228 made upon warrants issued by the State Treasurer against claims
229229 filed as prescribed by law with the Director of the Office of
230230 Management and Enterprise S ervices for approval and payment.
231231 SECTION 3. AMENDATORY 68 O.S. 2021, Section 1353, as
232232 last amended by Section 2, Chapter 290, O.S.L. 2023 (68 O .S. Supp.
233233 2023, Section 1353), is amended to read as follows:
234234 Section 1353. A. It is hereby declared to be the purpose of
235235 the Oklahoma Sales Tax Code to provide funds for the financing of
236236 the program provided for by the Oklahoma Social Security Act and to
237237 provide revenues for the support of the functions of the state
238238 government of Oklahoma, and for this purpose it is hereby expressly
239239 provided that, revenues derived pursuant to the provisions of the
240240 Oklahoma Sales Tax Code, subject to the apportionment requirements
241241 for the Oklahoma Tax Commission and Office of Management and

454454 ($5,000,000.00) in any fiscal year,
455455 (2) forty-four percent (44%) shall be placed to the
456456 credit of the Oklahoma Tourism Capital
457457 Improvement Revolving Fund, but in no event shall
458458 such apportionment exceed Nine Million Dollars
459459 ($9,000,000.00) in any fiscal year, and
460460 (3) thirty-two percent (32%) shall be placed to th e
461461 credit of the Oklahoma Route 66 Commission
462462 Revolving Fund, but in no event shall such

517517 b. any amounts which exceed the limitations of
518518 subparagraph a of this paragraph shall be placed to
519519 the credit of the General Revenue Fund; and
520520 5. For the fiscal year beginning July 1, 2015, and for each
521521 fiscal year thereafter, six one-hundredths percent (0.06%) shall be
522522 placed to the credit of the Oklahoma Historical Society Capital
523523 Improvement and Operations Revolving Fund, but in no event shall
524524 such apportionment exceed the total amount apportioned pursuant to
525525 this paragraph for the fiscal year ending on June 30, 2015. Any
526526 amounts which exceed the limitations of this paragraph shall be
527527 placed to the credit of the General Revenue Fund.
528528 B. Provided, for the fiscal year beginning July 1, 2007, and
529529 every fiscal year thereafter, an amount of revenue shall be
530530 apportioned to each municipality or county which levies a sales tax
531531 subject to the provisions of Section 1357.10 of this title and
532532 subsection F of Section 2701 of this title equal to the amount of
533533 sales tax revenue of such municipality or county exempted by the
534534 provisions of Section 1357.10 of this title and subsection F of
535535 Section 2701 of this title. The Oklahoma Tax Commission shall
536536 promulgate and adopt rules necessary to implement the provisions of
537537 this subsection.

603603 of the State Highway Construction and Maintenance Fund
604604 created in Section 1501 of Title 69 of the Oklahoma

606606 b. Two Million Dollars ($2,000,000.00) to the credit of
607607 the Oklahoma Railroad Maintenance Revolving Fund

739739 D. For the fiscal year ending June 30, 2025, and for subsequent
740740 fiscal years, before any other apportionment otherwise required by
741741 this section is made to the General Revenue Fund, there shall be
742742 apportioned to the Municipal Waterworks Repair Grant Program
743743 Revolving Fund created pursuant to Section 2 of this act the amount
744744 of Two Hundred Fifty Million Dollars ($250,000,000.00).
745745 SECTION 4. This act shall become effective July 1, 2024.
746746 SECTION 5. It being immediately necessary for the p reservation
747747 of the public peace, health or safety, an emergency is hereby
748748 declared to exist, by reason whereof thi s act shall take effect and
749749 be in full force from and after its passage and approval .
