7373 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7474 SECTION 1. AMENDATORY 21 O.S. 2 021, Section 1289.24e, is
7575 amended to read as follows:
7676 Section 1289.24e. A. The State Legislature hereby occupies and
7777 preempts the entire field of legislation by any agency of this state
7878 or any political subdivision in this state to infringe upon the
7979 rights of a citizen of the State of Oklahoma, the unalie nable right
8080 to keep and bear arms as guaranteed to them by the Second Amendment
8181 of the United States Constitution.
8282 B. 1. Any federal, state, county or municipal act, law,
8383 executive order, administrative order, court order, rule, policy or
8484 regulation ordering the buy-back, confiscation or s urrender of
8585 firearms, firearm accessories or ammunition from law -abiding
8686 citizens of this state shall be considered an infringement on the

138138 rights of citizens to keep and bear arms as guaranteed by the Second
139139 Amendment of the Constitution of the United Stat es and Article II,
140140 Section 26 of the Constitution of Oklahoma.
141141 2. An individual acting on behalf of any political subdivision
142142 in this state shall not engage in any voluntary buy-back of
143143 firearms. Such offense shall be considered a misdem eanor punishable
144144 by imprisonment in the county jail for a term not to exceed one (1)
145145 year and a fine equivalent to the cost of incarcerating such
146146 individual.
147147 C. It shall be the duty of the courts and law enforcement
148148 agencies of this state to protect the rights of law -abiding citizens
149149 to keep and to bear arms within t he borders of this state and to
150150 protect these rights from the infringement provided under the
151151 provisions of this act.
152152 D. The preemption provided in this act shall include:
153153 1. Any regulation of arms and ammuni tion, pursuant to the
154154 National Firearms Act of 1934, prohibited or regulated on or after
155155 the effective date of this act; and
156156 2. Any regulations or provision of the Gun Control Act of 1968,
157157 prohibited or regulated on or after the effective date of this act .
158158 E. For purposes of this section:
159159 1. “Arms” is defined as any firearm, firearm part, accessory or
160160 ammunition required to render that firearm operable and effective;

212212 2. “Infringement” shall mean any law that reduces, represses,
213213 diminishes or subverts th e right to keep and bear arms, ammunition,
214214 parts and accessories in any amount that is legal as of the
215215 effective date of this act of any citizen in this state; and
216216 3. “Law-abiding citizen” means a person who is not otherwise
217217 precluded under state law from possessing a firearm and shall not be
218218 construed to include anyone who is not legally present in t he United
219219 States or this state.
220220 SECTION 2. This act shall become effective November 1, 2024.
