73	73	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
74	74	SECTION 1. AMENDATORY 21 O.S. 2 021, Section 1289.24e, is
75	75	amended to read as follows:
76	76	Section 1289.24e. A. The State Legislature hereby occupies and
77	77	preempts the entire field of legislation by any agency of this state
78	78	or any political subdivision in this state to infringe upon the
79	79	rights of a citizen of the State of Oklahoma, the unalie nable right
80	80	to keep and bear arms as guaranteed to them by the Second Amendment
81	81	of the United States Constitution.
82	82	B. 1. Any federal, state, county or municipal act, law,
83	83	executive order, administrative order, court order, rule, policy or
84	84	regulation ordering the buy-back, confiscation or s urrender of
85	85	firearms, firearm accessories or ammunition from law -abiding
86	86	citizens of this state shall be considered an infringement on the

138	138	rights of citizens to keep and bear arms as guaranteed by the Second
139	139	Amendment of the Constitution of the United Stat es and Article II,
140	140	Section 26 of the Constitution of Oklahoma.
141	141	2. An individual acting on behalf of any political subdivision
142	142	in this state shall not engage in any voluntary buy-back of
143	143	firearms. Such offense shall be considered a misdem eanor punishable
144	144	by imprisonment in the county jail for a term not to exceed one (1)
145	145	year and a fine equivalent to the cost of incarcerating such
146	146	individual.
147	147	C. It shall be the duty of the courts and law enforcement
148	148	agencies of this state to protect the rights of law -abiding citizens
149	149	to keep and to bear arms within t he borders of this state and to
150	150	protect these rights from the infringement provided under the
151	151	provisions of this act.
152	152	D. The preemption provided in this act shall include:
153	153	1. Any regulation of arms and ammuni tion, pursuant to the
154	154	National Firearms Act of 1934, prohibited or regulated on or after
155	155	the effective date of this act; and
156	156	2. Any regulations or provision of the Gun Control Act of 1968,
157	157	prohibited or regulated on or after the effective date of this act .
158	158	E. For purposes of this section:
159	159	1. “Arms” is defined as any firearm, firearm part, accessory or
160	160	ammunition required to render that firearm operable and effective;

212	212	2. “Infringement” shall mean any law that reduces, represses,
213	213	diminishes or subverts th e right to keep and bear arms, ammunition,
214	214	parts and accessories in any amount that is legal as of the
215	215	effective date of this act of any citizen in this state; and
216	216	3. “Law-abiding citizen” means a person who is not otherwise
217	217	precluded under state law from possessing a firearm and shall not be
218	218	construed to include anyone who is not legally present in t he United
219	219	States or this state.
220	220	SECTION 2. This act shall become effective November 1, 2024.
