7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY Section 1, Chapter 11, O.S.L. 2022
7777 (63 O.S. Supp. 2023, Section 1 -731.4), is amended to read as
7878 follows:
7979 Section 1-731.4. A. As used in this section:
8080 1. The, the terms “abortion” and “unborn child” shall have the
8181 same meaning as provided by Section 1 -730 of Title 63 of the
8282 Oklahoma Statutes; and
8383 2. “Medical emergency” means a condition which cannot be
8484 remedied by delivery of the child in which an abortion is necessary
8585 to preserve the life of a pregnant woman w hose life is endangered by
8686 a physical disorder, p hysical illness or physical injury including a

138138 life-endangering physical condition caused by or arising from the
139139 pregnancy itself this title.
140140 B. 1. Notwithstanding any other provision of law, a person
141141 shall not purposely perform or attempt to perform an abortion except
142142 to save preserve the life of a pregnant woman in a medical
143143 emergency.
144144 2. C. 1. A person convicted of p erforming or attempting to
145145 perform an abortion shall be guilty of a felony punishable by a fine
146146 not to exceed One Hundred Thousand Dollars ($100,000.00), or by
147147 confinement in the custody of the D epartment of Correctio ns for a
148148 term not to exceed ten (10) years, or by such fine and imprisonment.
149149 3. 2. This section does no t:
150150 a. authorize the charging or conviction of a wom an with
151151 any criminal offense in the death of her own unborn
152152 child, or
153153 b. prohibit the sale, use, prescription or administration
154154 of a contraceptive measure, drug or chemical if the
155155 contraceptive measure, dr ug or chemical is
156156 administered before the time when a pregnancy could be
157157 determined through conventional medical testing and if
158158 the contraceptive measure, drug or chemical is sold,
159159 used, prescribed or administered in accordance with
160160 manufacturer instructio ns.

212212 4. 3. It is an affirmative defense to prosecution under this
213213 section if a licensed physician provi des medical treatment to a
214214 pregnant woman which results in the accidental or uninten tional
215215 injury or death to the unborn child.
216216 SECTION 2. It being immediately necessary for the preservation
217217 of the public peace, health or safety, an emergency is hereby
218218 declared to exist, by reason whereof this act shall take effect and
219219 be in full force from and after its passage and approval.
