7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 70 O.S. 2021, Section 13 -116, is
8181 amended to read as follows:
8282 Section 13-116. A. School district personnel shall be
8383 prohibited from using corporal punishment on students identified
8484 with the most significant cognitive disabilities according to
8585 criteria established by the State Department of Education unless
8686 addressed in an annual indiv idualized education program (IEP)
8787 developed in accordance w ith the Individuals with Disabilities
8888 Education Act (IDEA).

140140 B. A waiver to the provisions of subsection A of this section
141141 shall be granted if all of the parent parents or legal guardian
142142 guardians of a student provides provide written consent. The
143143 written consent shall be provided during a meeting of the IEP team
144144 members that is held no more than three (3) days from the
145145 disciplinary event that provoked the use of corporal punish ment.
146146 The IEP team shall review with the student ’s parents or legal
147147 guardians any evidence-based alternative disciplinary strategies
148148 that have been attempted or that could be attempted to improve the
149149 student’s behavior in a school setting. The written co nsent
150150 provided for in this subsection shall:
151151 1. Indicate that evidence-based alternative disciplin ary
152152 strategies reviewed by the IEP team with the student’s parents or
153153 legal guardians were not succe ssful;
154154 2. Include the name of the school employee author ized to
155155 administer corporal punishment;
156156 3. Indicate if a paddle will be used t o administer corporal
157157 punishment. If a paddle is to be used, the consent shall include a
158158 description of the weight, length, and thickness of the paddle to be
159159 used and how many times the student will be hit with the padd le; and
160160 4. Indicate if a school employee’s hand will be used to
161161 administer corporal punishment to hit, spank, slap, or administer
162162 any other physical force. If a hand is to be used, the consent
163163 shall include the name of the school employee, his or her size, his

216216 employee’s hand.
217217 C. As used in this section, “corporal punishment” means the
218218 deliberate infliction of physical pain by hitting, paddling,
219219 spanking, slapping, or any other physical force used as a means of
220220 discipline.
221221 SECTION 2. This act shall become effective July 1, 2024.
222222 SECTION 3. It being immediately nece ssary for the preservation
223223 of the public peace, he alth, or safety, an emergency is hereby
224224 declared to exist, by reason whereof th is act shall take effect and
225225 be in full force from and after its passage and approval.
