83	83	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
84	84	SECTION 1. AMENDATORY 63 O.S. 2021 , Section 1-740.16, is
85	85	amended to read as follows:
86	86	Section 1-740.16. As used in the Choosing Ch ildbirth Act:
87	87	1. “Abortion” means the use or prescription of any instrument,
88	88	medicine, drug or any other substance or device to intentionally:
89	89	a. kill the unborn child of a woman known to be pregnant,

142	142	b. terminate the pregnancy of a woman known to be
143	143	pregnant, with an intention other than:
144	144	(1) after viability of the unborn child, to produce a
145	145	live birth and preserve the life and health of
146	146	the child born alive , or
147	147	(2) to remove a dead unborn child;
148	148	2. “Unborn child” means an individual organism of the s pecies
149	149	Homo sapiens from fertilization until birth; and
150	150	3. “Grant-supervising entity” means a private entity which
151	151	approves all grants made under the Choosing Childbirth Act that are
152	152	not directly made to private organizations by the State Department
153	153	of Health for reimbursement of services provided under the Choosing
154	154	Childbirth Act and which:
155	155	a. is organized as a not-for-profit corporation in
156	156	Oklahoma and as a 501(c)3 501(c)(3) entity under the
157	157	federal Internal Revenue Code, and
158	158	b. does not encourage or cou nsel any woman to have an
159	159	abortion not necessary to prevent her death, to
160	160	provide her such an abortion or to refer her for such
161	161	an abortion, and does not acce pt funds or services
162	162	knowingly from any entity which performs abortions or
163	163	receives money for abor tions.
164	164	SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-740.17, is

217	217	Section 1-740.17. A. The State Department of Health shall make
218	218	grants, as directed in subsection B of this section , from funds
219	219	appropriated by the Legislature specifically for this purpose, to a
220	220	grant-supervising entity for the purpose of reimbursing for the
221	221	Choosing Childbirth Act.
222	222	B. The purpose of the gr ants shall be to reimburse private
223	223	organizations in Oklahoma this state for the reasonable expenses of
224	224	programs providing the following services: described in subsection C
225	225	of this section. The Department shall make grants either:
226	226	1. Directly to the private organizations;
227	227	2. To one or more grant-supervising entities , who shall
228	228	reimburse the private organizations ; or
229	229	3. Both directly to the private organizations and to one or
230	230	more grant-supervising entities , who shall reimburse the private
231	231	organizations.
232	232	C. Reimbursable services provided under the Choosing Childbirth
233	233	Act shall include:
234	234	1. Providing information on, referral to and a ssistance in
235	235	securing the services of relevant existing programs or agencies that
236	236	assist women in Oklahoma this state to carry their children to term,
237	237	and/or providing services that as sist women to carry their children
238	238	to term including, but not limited to, agencies and programs that
239	239	will provide medical attention for the pregnant woman for the
240	240	duration of her pregnancy, nutritional support s ervices, housing

293	293	and parenting education and support services ;
294	294	2. Providing women in Oklahoma this state, in person and
295	295	through community outreac h, information and/or services that
296	296	encourage and assist them to carry their children to term; and
297	297	3. Providing services including, but not limited to, healthcare
298	298	services to mothers and in fants up to three (3) years postpartum for
299	299	the purpose of reducing the rates of maternal mortality and infant
300	300	mortality in this state by three percent (3%) within five (5) years
301	301	of the effective date of this act not later than July 1, 2026;
302	302	provided, however, no funds shall be provided to an organi zation
303	303	that provides, or whose affiliates provide, abort ion services.
304	304	B. D. To be eligible for a service grant, an organization
305	305	shall:
306	306	1. Be registered with the Oklahoma Secretary of State as a not-
307	307	for-profit corporation located in Oklahoma;
308	308	2. Have the grant amount approved by a:
309	309	a. the grant-supervising entity, if the grant was
310	310	provided to the private organization by a grant-
311	311	supervising entity, or
312	312	b. the Department, if the grant was provided directly to
313	313	the private organization by the Department ;
314	314	3. For services described in paragraphs 1 and 2 of subsection A
315	315	C of this section, provide each pregnant w oman counseled with

368	368	children including offering the printed information described i n
369	369	Section 1-738.3 of Title 63 of the Oklahoma Statutes this title;
370	370	4. Assure that the grant’s sole purposes are to assist and
371	371	encourage women to carry their children to term and to maximize
372	372	their potentials thereafter as provided in paragraphs 1 and 2 of
373	373	subsection C of this section or to reduce the rat es of maternal
374	374	mortality and infant mortality in this state as provided in
375	375	paragraph 3 of subsection A C of this section; and
376	376	5. Assure that none of th e funds provided pursuant to the
377	377	Choosing Childbirth Act, nor any other funds or services provided by
378	378	the organization, are used to encourage or counsel a woman to have
379	379	an abortion not necessary to prevent her death, to provide her such
380	380	an abortion or to refer her for such an abortion.
381	381	SECTION 3. AMENDATORY 63 O.S. 2021, Section 1 -740.18, is
382	382	amended to read as follows:
383	383	Section 1-740.18. The State Department of Health shall make
384	384	grants to a grant-supervising entity under the Choosi ng Childbirth
385	385	Act from funds appropriated by the Legislature speci fically for this
386	386	purpose. The State Department of Health shall annually monitor and
387	387	review the any grant-supervising entity participating in the
388	388	Choosing Childbirth Act and any private organization directly
389	389	receiving a service grant from the Department to assure ensure that
390	390	the grant-supervising entity or private organization carefully

442	442	adheres to the purposes and requirements of the Choosing Childbirth
443	443	Act, and it. The Department shall cease funding a grant-supervising
444	444	entity or private organization that fails to do so adhere to such
445	445	purposes and requirements if the Department proves specific findings
446	446	of noncompliance, subject t o judicial review.
447	447	SECTION 4. This act shall become effective July 1, 202 4.
448	448	SECTION 5. It being immediately necessary for the preservation
449	449	of the public peace, health or safety, an emergency is hereb y
450	450	declared to exist, by reason whereof this act shall tak e effect and
451	451	be in full force from and after its passage and approval.
