8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. AMENDATORY 63 O.S. 2021 , Section 1-740.16, is
8585 amended to read as follows:
8686 Section 1-740.16. As used in the Choosing Ch ildbirth Act:
8787 1. “Abortion” means the use or prescription of any instrument,
8888 medicine, drug or any other substance or device to intentionally:
8989 a. kill the unborn child of a woman known to be pregnant,

142142 b. terminate the pregnancy of a woman known to be
143143 pregnant, with an intention other than:
144144 (1) after viability of the unborn child, to produce a
145145 live birth and preserve the life and health of
146146 the child born alive , or
147147 (2) to remove a dead unborn child;
148148 2. “Unborn child” means an individual organism of the s pecies
149149 Homo sapiens from fertilization until birth; and
150150 3. “Grant-supervising entity” means a private entity which
151151 approves all grants made under the Choosing Childbirth Act that are
152152 not directly made to private organizations by the State Department
153153 of Health for reimbursement of services provided under the Choosing
154154 Childbirth Act and which:
155155 a. is organized as a not-for-profit corporation in
156156 Oklahoma and as a 501(c)3 501(c)(3) entity under the
157157 federal Internal Revenue Code, and
158158 b. does not encourage or cou nsel any woman to have an
159159 abortion not necessary to prevent her death, to
160160 provide her such an abortion or to refer her for such
161161 an abortion, and does not acce pt funds or services
162162 knowingly from any entity which performs abortions or
163163 receives money for abor tions.
164164 SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-740.17, is

217217 Section 1-740.17. A. The State Department of Health shall make
218218 grants, as directed in subsection B of this section , from funds
219219 appropriated by the Legislature specifically for this purpose, to a
220220 grant-supervising entity for the purpose of reimbursing for the
221221 Choosing Childbirth Act.
222222 B. The purpose of the gr ants shall be to reimburse private
223223 organizations in Oklahoma this state for the reasonable expenses of
224224 programs providing the following services: described in subsection C
225225 of this section. The Department shall make grants either:
226226 1. Directly to the private organizations;
227227 2. To one or more grant-supervising entities , who shall
228228 reimburse the private organizations ; or
229229 3. Both directly to the private organizations and to one or
230230 more grant-supervising entities , who shall reimburse the private
231231 organizations.
232232 C. Reimbursable services provided under the Choosing Childbirth
233233 Act shall include:
234234 1. Providing information on, referral to and a ssistance in
235235 securing the services of relevant existing programs or agencies that
236236 assist women in Oklahoma this state to carry their children to term,
237237 and/or providing services that as sist women to carry their children
238238 to term including, but not limited to, agencies and programs that
239239 will provide medical attention for the pregnant woman for the
240240 duration of her pregnancy, nutritional support s ervices, housing

292292 assistance, adoption services, education and employment assistance,
293293 and parenting education and support services ;
294294 2. Providing women in Oklahoma this state, in person and
295295 through community outreac h, information and/or services that
296296 encourage and assist them to carry their children to term; and
297297 3. Providing services including, but not limited to, healthcare
298298 services to mothers and in fants up to three (3) years postpartum for
299299 the purpose of reducing the rates of maternal mortality and infant
300300 mortality in this state by three percent (3%) within five (5) years
301301 of the effective date of this act not later than July 1, 2026;
302302 provided, however, no funds shall be provided to an organi zation
303303 that provides, or whose affiliates provide, abort ion services.
304304 B. D. To be eligible for a service grant, an organization
305305 shall:
306306 1. Be registered with the Oklahoma Secretary of State as a not-
307307 for-profit corporation located in Oklahoma;
308308 2. Have the grant amount approved by a:
309309 a. the grant-supervising entity, if the grant was
310310 provided to the private organization by a grant-
311311 supervising entity, or
312312 b. the Department, if the grant was provided directly to
313313 the private organization by the Department ;
314314 3. For services described in paragraphs 1 and 2 of subsection A
315315 C of this section, provide each pregnant w oman counseled with

367367 accurate information on the develop mental characteristics of unborn
368368 children including offering the printed information described i n
369369 Section 1-738.3 of Title 63 of the Oklahoma Statutes this title;
370370 4. Assure that the grant’s sole purposes are to assist and
371371 encourage women to carry their children to term and to maximize
372372 their potentials thereafter as provided in paragraphs 1 and 2 of
373373 subsection C of this section or to reduce the rat es of maternal
374374 mortality and infant mortality in this state as provided in
375375 paragraph 3 of subsection A C of this section; and
376376 5. Assure that none of th e funds provided pursuant to the
377377 Choosing Childbirth Act, nor any other funds or services provided by
378378 the organization, are used to encourage or counsel a woman to have
379379 an abortion not necessary to prevent her death, to provide her such
380380 an abortion or to refer her for such an abortion.
381381 SECTION 3. AMENDATORY 63 O.S. 2021, Section 1 -740.18, is
382382 amended to read as follows:
383383 Section 1-740.18. The State Department of Health shall make
384384 grants to a grant-supervising entity under the Choosi ng Childbirth
385385 Act from funds appropriated by the Legislature speci fically for this
386386 purpose. The State Department of Health shall annually monitor and
387387 review the any grant-supervising entity participating in the
388388 Choosing Childbirth Act and any private organization directly
389389 receiving a service grant from the Department to assure ensure that
390390 the grant-supervising entity or private organization carefully

442442 adheres to the purposes and requirements of the Choosing Childbirth
443443 Act, and it. The Department shall cease funding a grant-supervising
444444 entity or private organization that fails to do so adhere to such
445445 purposes and requirements if the Department proves specific findings
446446 of noncompliance, subject t o judicial review.
447447 SECTION 4. This act shall become effective July 1, 202 4.
448448 SECTION 5. It being immediately necessary for the preservation
449449 of the public peace, health or safety, an emergency is hereb y
450450 declared to exist, by reason whereof this act shall tak e effect and
451451 be in full force from and after its passage and approval.
