7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law to be codified
7979 in the Oklahoma Statutes as Section 1-758 of Title 63, unless there
8080 is created a duplication in numbering, reads as follows:
8181 A. As used in this section:
8282 1. “Abortion drug” means any medicine, drug, or any other
8383 substance, or any combination of drugs, medicines, or substances,
8484 when it is used to intentionally:
8585 a. kill the unborn child of a woman known to be pregnant ,
8686 or
8787 b. terminate the pregnancy of a woman known to be
8888 pregnant, with an intention other than :

140140 (1) to produce a live birth , or
141141 (2) to remove a dead unbo rn child;
142142 2. “Attempts to provide” means conduct that, under the
143143 circumstances as the actor believes them to be, constitutes a
144144 substantial step in a course of conduct planned t o culminate in a
145145 chemical abortion;
146146 3. “Catch kit” means a collection container designed to catch
147147 and hold medical waste or infectious waste, often used for
148148 collecting samples for testing ;
149149 4. “Chemical abortion” refers to the use of an abortion drug to
150150 intentionally:
151151 a. kill the unborn child of a woman known to be pregnant ,
152152 or
153153 b. terminate the pregnancy of a woman known to be
154154 pregnant, with an intention other than :
155155 (1) to produce a live birth , or
156156 (2) to remove a dead unborn child ;
157157 5. “Health care provider” means any person licensed to
158158 prescribe prescription drugs under applicable federal and state
159159 laws;
160160 6. “Medical waste bag”, also referred to as an “infectious
161161 waste bag”, “health care waste bag”, or “biohazard waste bag”, means
162162 a red biohazardous waste container made to contain medical or
163163 biohazardous waste.

215215 a. Warning labels shall be affixed to the container
216216 stating “BIOHAZARD” and depicting the biohazard symbol
217217 recognized by the American National S tandards
218218 Institute.
219219 b. The container must either :
220220 (1) be fluorescent orange or orange-red, with
221221 lettering and symbols in a contrasting color , or
222222 (2) include such required warning labels in
223223 fluorescent orange or orange-red, with lettering
224224 and symbols in a contra sting color;
225225 7. “Provide” means to dispense or pr escribe an abortion drug,
226226 or to otherwise make an abortion drug available to a patient; and
227227 8. “Unborn child” means an individual organism of the species
228228 homo sapiens, beginning at conception, until the point of being born
229229 alive.
230230 B. A health care provider shall not knowingly provide or
231231 attempt to provide a chemical abortion , if such provision or attempt
232232 is in or affects interstate commerce, without:
233233 1. Physically examining the patient;
234234 2. Being physically present at the location of the chemical
235235 abortion;
236236 3. Scheduling a follow-up visit for the patient to occur not
237237 more than seven (7) days after the administration or use of the drug
238238 to assess the patient ’s physical condition; or

290290 4. Providing a catch kit and medical waste bag, including
291291 instructions for the patient to bring the catch kit and medical
292292 waste bag to the health care provider for proper disposal .
293293 C. A health care provider found in violation of subsection B of
294294 this section shall, upon conviction , be fined not more than Ten
295295 Thousand Dollars ($10,000.00) or imprisoned in the custody of the
296296 Department of Corrections not more than three (3) years, or receive
297297 both such fine and imprisonment.
298298 D. 1. This section shall not apply to a chemical abortion that
299299 is necessary to preserve the life of a mother whose life is
300300 endangered by a physical disorder, physical illness, or physical
301301 injury, including a life -endangering physical condition.
302302 2. A patient upon whom an abortion is performed may not be
303303 prosecuted for a violation of this section or a conspiracy to
304304 violate this section.
305305 3. Nothing in this section shall be construed to have any
306306 impact on the treatment of a verified ectopic pregnancy.
307307 E. The manufacturer of any abortion drug shall be responsible
308308 for proper disposal of discarde d abortion drugs and mitigation of
309309 the environmental effects of endocrine -disrupting chemical
310310 byproducts of chemical abortion drugs entering public waste systems
311311 due to the disposal of tainted human remains entering the wastewater
312312 system as a result of at -home abortions. If endocrine-disrupting
313313 chemicals from abortion drugs are found in wastewater, the

365365 manufacturer shall be responsible for cleanup, remediation, and
366366 further preventative measures. A violation of this subsection shall
367367 be punishable by a fine not more than Twenty Thousand Dollars
368368 ($20,000.00) per violation.
369369 SECTION 2. This act shall become effective November 1, 2024.
