77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 1-758 of Title 63, unless there
80	80	is created a duplication in numbering, reads as follows:
81	81	A. As used in this section:
82	82	1. “Abortion drug” means any medicine, drug, or any other
83	83	substance, or any combination of drugs, medicines, or substances,
84	84	when it is used to intentionally:
85	85	a. kill the unborn child of a woman known to be pregnant ,
86	86	or
87	87	b. terminate the pregnancy of a woman known to be
88	88	pregnant, with an intention other than :

141	141	(2) to remove a dead unbo rn child;
142	142	2. “Attempts to provide” means conduct that, under the
143	143	circumstances as the actor believes them to be, constitutes a
144	144	substantial step in a course of conduct planned t o culminate in a
145	145	chemical abortion;
146	146	3. “Catch kit” means a collection container designed to catch
147	147	and hold medical waste or infectious waste, often used for
148	148	collecting samples for testing ;
149	149	4. “Chemical abortion” refers to the use of an abortion drug to
150	150	intentionally:
151	151	a. kill the unborn child of a woman known to be pregnant ,
152	152	or
153	153	b. terminate the pregnancy of a woman known to be
154	154	pregnant, with an intention other than :
155	155	(1) to produce a live birth , or
156	156	(2) to remove a dead unborn child ;
157	157	5. “Health care provider” means any person licensed to
158	158	prescribe prescription drugs under applicable federal and state
159	159	laws;
160	160	6. “Medical waste bag”, also referred to as an “infectious
161	161	waste bag”, “health care waste bag”, or “biohazard waste bag”, means
162	162	a red biohazardous waste container made to contain medical or
163	163	biohazardous waste.

215	215	a. Warning labels shall be affixed to the container
216	216	stating “BIOHAZARD” and depicting the biohazard symbol
217	217	recognized by the American National S tandards
218	218	Institute.
219	219	b. The container must either :
220	220	(1) be fluorescent orange or orange-red, with
221	221	lettering and symbols in a contrasting color , or
222	222	(2) include such required warning labels in
223	223	fluorescent orange or orange-red, with lettering
224	224	and symbols in a contra sting color;
225	225	7. “Provide” means to dispense or pr escribe an abortion drug,
226	226	or to otherwise make an abortion drug available to a patient; and
227	227	8. “Unborn child” means an individual organism of the species
228	228	homo sapiens, beginning at conception, until the point of being born
229	229	alive.
230	230	B. A health care provider shall not knowingly provide or
231	231	attempt to provide a chemical abortion , if such provision or attempt
232	232	is in or affects interstate commerce, without:
233	233	1. Physically examining the patient;
234	234	2. Being physically present at the location of the chemical
235	235	abortion;
236	236	3. Scheduling a follow-up visit for the patient to occur not
237	237	more than seven (7) days after the administration or use of the drug
238	238	to assess the patient ’s physical condition; or

290	290	4. Providing a catch kit and medical waste bag, including
291	291	instructions for the patient to bring the catch kit and medical
292	292	waste bag to the health care provider for proper disposal .
293	293	C. A health care provider found in violation of subsection B of
294	294	this section shall, upon conviction , be fined not more than Ten
295	295	Thousand Dollars ($10,000.00) or imprisoned in the custody of the
296	296	Department of Corrections not more than three (3) years, or receive
297	297	both such fine and imprisonment.
298	298	D. 1. This section shall not apply to a chemical abortion that
299	299	is necessary to preserve the life of a mother whose life is
300	300	endangered by a physical disorder, physical illness, or physical
301	301	injury, including a life -endangering physical condition.
302	302	2. A patient upon whom an abortion is performed may not be
303	303	prosecuted for a violation of this section or a conspiracy to
304	304	violate this section.
305	305	3. Nothing in this section shall be construed to have any
306	306	impact on the treatment of a verified ectopic pregnancy.
307	307	E. The manufacturer of any abortion drug shall be responsible
308	308	for proper disposal of discarde d abortion drugs and mitigation of
309	309	the environmental effects of endocrine -disrupting chemical
310	310	byproducts of chemical abortion drugs entering public waste systems
311	311	due to the disposal of tainted human remains entering the wastewater
312	312	system as a result of at -home abortions. If endocrine-disrupting
313	313	chemicals from abortion drugs are found in wastewater, the

366	366	further preventative measures. A violation of this subsection shall
367	367	be punishable by a fine not more than Twenty Thousand Dollars
368	368	($20,000.00) per violation.
369	369	SECTION 2. This act shall become effective November 1, 2024.
