7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section of law to be codified
8181 in the Oklahoma Statutes as Section 2011.12 of Title 12, unless
8282 there is created a duplication in numbering, reads as follows:
8383 A. In an action for small claims pursuant to the Small Claims
8484 Procedure Act, Section 1751 et s eq. of Title 12 of the Oklahoma
8585 Statutes, or for forcible entry and detainer pursuant to Section
8686 1148.1 et seq. of Title 12 of the Ok lahoma Statutes, the court
8787 entering an order that dismisses the action prior to entry of a
8888 judgment or that enters a judgment in favor of the defendant shall
8989 issue an order sealing all records related to the case.

141141 B. The court shall order the sealing of a forcible entry a nd
142142 detainer case on the filing of a written stipulation by the parties
143143 to set aside a judgment for the plaintiff and seal the records of
144144 the case.
145145 C. Records that are sealed pursuant to this section sh all be
146146 removed from and shall not appear in any database available to the
147147 public.
148148 D. If the records in a small claims or forcible entry and
149149 detainer action are sealed, the defendant ’s case records shall only
150150 be available to the following:
151151 1. The person whose records are sealed and any part or any
152152 attorney who has made an appearance in the case where records are
153153 sealed;
154154 2. The court; and
155155 3. The court clerk or any department that is responsible for
156156 maintenance of records.
157157 In no event shall the defendant’s sealed case be sold or
158158 released as part of a bulk or individual records transf er to a third
159159 party.
160160 E. The provisions of this section shall apply to all records
161161 relating to an action for small claims or forcible entry and
162162 detainer that are maintained by t he court including but not limited
163163 to the complaint and any other pleadings, proof of service, any
164164 findings and orders of the court, and all other papers, records,
