79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
80	80	SECTION 1. NEW LAW A new section of law to be codified
81	81	in the Oklahoma Statutes as Section 2-6-404 of Title 27A, unless
82	82	there is created a duplication in numbering, reads as follows:
83	83	A. The Department of Environmental Quality shall require every
84	84	public and private wastewater treatment facility operating in this
85	85	state be subject to testing through an accredited or certified
86	86	environmental testing laborato ry as prescribed by this section . The
87	87	Department shall test:

139	139	1. Wastewater influent before entering a facility for
140	140	treatment, including influent derived from industrial, cooling,
141	141	leachate, return flow, surface runoff, and urban runoff sources;
142	142	2. Grit and debris separated before taken to a landfill;
143	143	3. Raw sewage;
144	144	4. Pre-treated sewage;
145	145	5. Biosolids;
146	146	6. Sludge produced in wastewater treatment;
147	147	7. Effluent departing the wastewater treatment facility;
148	148	8. Groundwater;
149	149	9. Surface water;
150	150	10. Water upon entering a drinking water treatment facility;
151	151	11. Treated water departing from a drinking water treatment
152	152	facility; and
153	153	12. Public drinking water .
154	154	B. The Department shall select testing locations that are
155	155	reasonably representative of the typical water systems in the
156	156	community and shall avoid non -representative locations. The
157	157	Department may conduct more than one test in a particular category
158	158	to ensure reasonably representative results.
159	159	C. Testing as described in subsection A of this section shall
160	160	occur at every wastewater treatment plant within ten (10) miles of
161	161	every city with a population of at least two hundred fifty thousand
162	162	(250,000) according to the most recent Federal Decennial Census.

214	214	D. Testing shall occur in no fewer than:
215	215	1. Ten wastewater treatment plants within ten (10) miles of
216	216	cities with populations between one hundred thousand (100,000) and
217	217	two hundred fifty thou sand (250,000);
218	218	2. Ten wastewater treatment plants within ten (10) miles of
219	219	cities with populations between twenty-five thousand (25,000) and
220	220	one hundred thousand (100,000); and
221	221	3. Ten wastewater treatment plants within ten (10) miles of
222	222	cities with populations below twenty-five thousand (25,000).
223	223	E. The Department shall conduct testing once each calendar
224	224	quarter.
225	225	F. The Department shall test for each of the following urinary
226	226	metabolites in the form of glucuronides:
227	227	1. Benzophenone;
228	228	2. Bisphenol A (BPA);
229	229	3. Estrone;
230	230	4. Ethinylestradiol;
231	231	5. Musk ketone;
232	232	6. Pregnanediol;
233	233	7. Testosterone;
234	234	8. Tonalide (AHTN);
235	235	9. Mifepristone; and
236	236	10. Any other organic substances as deemed necessary by the
237	237	Department.

289	289	G. In addition to records required to be kept in the normal
290	290	course of water testing, the Department shall keep detailed records
291	291	of all testing conducted under this section , including:
292	292	1. The date and location of sampling;
293	293	2. The date of testing; and
294	294	3. The results of testing in nanograms per liter.
295	295	H. The Department shall post quarterly on its website all
296	296	reports, test results, and records required under this section.
297	297	I. The Department shall promulgate rules to effectuate the
298	298	provisions of this section.
299	299	SECTION 2. It being immediately necessary for the preservation
300	300	of the public peace, health or safety, an emergency is hereby
301	301	declared to exist, by reaso n whereof this act shall take effect and
302	302	be in full force from and after its passage and appr oval.
