7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
8080 SECTION 1. NEW LAW A new section of law to be codified
8181 in the Oklahoma Statutes as Section 2-6-404 of Title 27A, unless
8282 there is created a duplication in numbering, reads as follows:
8383 A. The Department of Environmental Quality shall require every
8484 public and private wastewater treatment facility operating in this
8585 state be subject to testing through an accredited or certified
8686 environmental testing laborato ry as prescribed by this section . The
8787 Department shall test:

139139 1. Wastewater influent before entering a facility for
140140 treatment, including influent derived from industrial, cooling,
141141 leachate, return flow, surface runoff, and urban runoff sources;
142142 2. Grit and debris separated before taken to a landfill;
143143 3. Raw sewage;
144144 4. Pre-treated sewage;
145145 5. Biosolids;
146146 6. Sludge produced in wastewater treatment;
147147 7. Effluent departing the wastewater treatment facility;
148148 8. Groundwater;
149149 9. Surface water;
150150 10. Water upon entering a drinking water treatment facility;
151151 11. Treated water departing from a drinking water treatment
152152 facility; and
153153 12. Public drinking water .
154154 B. The Department shall select testing locations that are
155155 reasonably representative of the typical water systems in the
156156 community and shall avoid non -representative locations. The
157157 Department may conduct more than one test in a particular category
158158 to ensure reasonably representative results.
159159 C. Testing as described in subsection A of this section shall
160160 occur at every wastewater treatment plant within ten (10) miles of
161161 every city with a population of at least two hundred fifty thousand
162162 (250,000) according to the most recent Federal Decennial Census.

214214 D. Testing shall occur in no fewer than:
215215 1. Ten wastewater treatment plants within ten (10) miles of
216216 cities with populations between one hundred thousand (100,000) and
217217 two hundred fifty thou sand (250,000);
218218 2. Ten wastewater treatment plants within ten (10) miles of
219219 cities with populations between twenty-five thousand (25,000) and
220220 one hundred thousand (100,000); and
221221 3. Ten wastewater treatment plants within ten (10) miles of
222222 cities with populations below twenty-five thousand (25,000).
223223 E. The Department shall conduct testing once each calendar
224224 quarter.
225225 F. The Department shall test for each of the following urinary
226226 metabolites in the form of glucuronides:
227227 1. Benzophenone;
228228 2. Bisphenol A (BPA);
229229 3. Estrone;
230230 4. Ethinylestradiol;
231231 5. Musk ketone;
232232 6. Pregnanediol;
233233 7. Testosterone;
234234 8. Tonalide (AHTN);
235235 9. Mifepristone; and
236236 10. Any other organic substances as deemed necessary by the
237237 Department.

289289 G. In addition to records required to be kept in the normal
290290 course of water testing, the Department shall keep detailed records
291291 of all testing conducted under this section , including:
292292 1. The date and location of sampling;
293293 2. The date of testing; and
294294 3. The results of testing in nanograms per liter.
295295 H. The Department shall post quarterly on its website all
296296 reports, test results, and records required under this section.
297297 I. The Department shall promulgate rules to effectuate the
298298 provisions of this section.
299299 SECTION 2. It being immediately necessary for the preservation
300300 of the public peace, health or safety, an emergency is hereby
301301 declared to exist, by reaso n whereof this act shall take effect and
302302 be in full force from and after its passage and appr oval.
