8989 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9090 SECTION 1. AMENDATORY 2 O.S. 2021, S ection 6-604, is
9191 amended to read as follows:
9292 Section 6-604. A. Except as otherwise specified in the Feral
9393 Swine Control Act, any person with written permission of the owner

146146 daylight hours or at night. Any person who removes or attempts to
147147 remove feral swine pursuant to this section shall not be required to
148148 obtain a license to h unt wildlife issued by the Depart ment of
149149 Wildlife Conservation or a permit to control wildlife issued
150150 pursuant to Section 4-135 of Title 29 of the Oklahoma Statutes .
151151 B. Any person who intends to kill or attempt to kill feral
152152 swine at night shall obtain a permit issued by the Department of
153153 Wildlife Conservation pursuant to Section 4-135 of Title 29 of the
154154 Oklahoma Statutes and promulgated rules Any person who removes or
155155 attempts to removal feral swine pursuant to this section may use a
156156 motor-driven land conveyance to pursue or follow feral swine, may
157157 use a vehicle-mounted spotlight or other powerful light also known
158158 as a headlight, and may use night -vision equipment that uses either
159159 image enhancement technology or thermal imaging technology.
160160 SECTION 2. AMENDATORY 29 O.S. 2021, Section 4 -135, as
161161 last amended by Section 1, Chapter 198, O.S.L. 2023 (2 9 O.S. Supp.
162162 2023, Section 4-135), is amended to read as follows:
163163 Section 4-135. A. The Department of Wildlife Conservation is
164164 authorized to issue permits to landowners, agricultural lessees, or
165165 their designated agents with written permission of the land owner or
166166 agricultural lessee and to any entity of state, c ounty, or local
167167 government to control nuisance or damag e by any species of wildlife
168168 including, but not limited to, beaver, coyote, deer, bobcat, raccoon
169169 and crow under rules promulgated by the Oklah oma Wildlife

221221 Conservation Commission. The permits may be issued wit hout
222222 limitation by statewide season regulatio ns, bag limits or methods of
223223 taking. A permitted landowner, agricultural lessee or a designated
224224 agent with written permission of the landowner or agricultural
225225 lessee may, with a valid permit issued pu rsuant to this section,
226226 control the wildlife specified in this subsection and feral swine at
227227 night to protect marketable agricu ltural crops, livestock or
228228 processed feed, seed or other materials used in the production of an
229229 agricultural commodity.
230230 B. Except as otherwise specified in this subsection section,
231231 the permit to hunt at night shall be valid for a period of up to one
232232 (1) year from the date the permit was issued.
233233 C. Notwithstanding the provisions of Section 5-203.1 of this
234234 title, a landowner, agricultural lessee, or designated agent with
235235 written permission of the landowner and with a valid permit may use
236236 a headlight carried on the person while hunting at night. Nothing
237237 in this section shall authorize the use of a headlight mounted on a
238238 vehicle or the use of a headlight from a public roadway.
239239 D. Any person who has been convicted of, or pled guilty to, a
240240 violation of Section 5-203.1 or Section 5-411 of this title within
241241 the previous three (3) years shall not be eligible to receive a
242242 permit pursuant to this se ction. The permit can may be issued by

296296 Wildlife Conservation.
297297 E. It shall be lawful for an y private landowner or designated
298298 employee of the landowner or lessee to have a chamber-loaded firearm
299299 on property owned by the landowner, and to use the firearm for the
300300 purpose of controlling nuisance or damage by any wildlife or feral
301301 swine. Nothing in this section shall authorize any convicted felon
302302 to carry a firearm.
303303 SECTION 3. AMENDATORY 29 O.S. 2021, Section 5 -203.1, as
304304 amended by Section 2, Chapter 171, O.S.L. 2022 (29 O.S. Supp. 2023,
305305 Section 5-203.1), is amended to read as follows:
306306 Section 5-203.1. A. Except as provided in Section 3 of this
307307 act 4-135.2 of this title, no person may attempt to take, take,
308308 attempt to catch, ca tch, attempt to capture, capture, attempt to
309309 kill or kill any deer, feral animal or other wildlife except fish
310310 and, frogs, and feral swine as provided for in Section 6 -604 of
311311 Title 2 of the Oklahoma Statutes, by the use of a vehicle-mounted
312312 spotlight or other powerful light at night , by what is commonly
313313 known as “headlighting”. Provided, however, nothing in this section
314314 shall prevent one from po ssessing a .22 caliber rimfire rifle or .22
315315 pistol and a light car ried while in pursuit of furbearers with
316316 hounds during the legal, open furbearers season , while possessing a
317317 valid hunting license.

369369 B. It shall be illegal to hunt f rom a boat with a firear m from
370370 sunset until one-half (1/2) hour before sunrise. This shal l not
371371 pertain to hunting of waterfowl enroute from bank to blind with
372372 unloaded shotguns.
373373 C. Except as provided for in this section and, in Section 3 of
374374 this act 4-135.2 of this title, and except when removing feral swine
375375 as provided for in Sect ion 6-604 of Title 2 of the Oklahoma
376376 Statutes, no person may harass, attempt to capture, capture, attempt
377377 to take or take, kill or attempt to kill any wildlife or feral swine
378378 with the aid of any motor -driven land, air or water c onveyance. A
379379 nonambulatory person may hunt from said such conveyances with
380380 written permission of the Director of Wildlife Conservation. A
381381 person may hunt from an air conveyance if issued a permit pursuant
382382 to Section 4-107.2 of this title. Nothing in this section shall
383383 prevent the use of motor-driven land or water conveyances for
384384 following dogs in the act of hunting, when use is restricted to
385385 public roads or waterways. Motor-driven land or water conveyances
386386 may be used on private property for following dogs in the act of
387387 hunting with the permission of the landowner or occupant.
388388 D. Employees of the Okla homa Department of Agriculture, Food,
389389 and Forestry Wildlife Services Division and the United States
390390 Department of Agriculture Wildlife Services while engaged in
391391 wildlife management activities for the protection of agriculture,

443443 property, human health and safety and natural resources shall be
444444 exempt from the provisions of this secti on.
445445 E. Any person convicted o f violating the provisions of this
446446 section shall be guilty of a misdemeano r and shall be punished by a
447447 fine of not less than One Thousand Dollars ($1,000.00) for a first
448448 offense and not less than Two Thousand Dollars ($2,000.00) for a
449449 second offense or by imprisonment in the county jail for not less
450450 than ten (10) days nor more than one (1) year, and by confiscation
451451 pursuant to Section 5 -402 of this title or by such fine,
452452 imprisonment and confiscation.
453453 F. A district court, upon request by the district attor ney,
454454 shall order the hunting and fishing license pr ivileges of a person
455455 convicted of a violation of this section suspended, revoked, or
456456 denied for a period not less than one (1) year nor more than ten
457457 (10) years. Upon completion of the period of suspension,
458458 revocation, or denial of licensure, the person m ay apply for a new
459459 hunting or fishing licens e or request a reinstatement of a lifetime
460460 license, if the person previously held a lifetime license. The
461461 person applying for a n ew or reinstated license shall be required to
462462 pay a reinstatement fee of Two Hundr ed Dollars ($200.00) fo r
463463 residents of this state and a reinstatement fee of Five Hundred
464464 Dollars ($500.00) for no nresidents. This fee shall be in additio n
465465 to any other fees required for the hunting and fishing license.
