89	89	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
90	90	SECTION 1. AMENDATORY 2 O.S. 2021, S ection 6-604, is
91	91	amended to read as follows:
92	92	Section 6-604. A. Except as otherwise specified in the Feral
93	93	Swine Control Act, any person with written permission of the owner
94	94	may remove feral swine from pri vate or public property during

147	147	remove feral swine pursuant to this section shall not be required to
148	148	obtain a license to h unt wildlife issued by the Depart ment of
149	149	Wildlife Conservation or a permit to control wildlife issued
150	150	pursuant to Section 4-135 of Title 29 of the Oklahoma Statutes .
151	151	B. Any person who intends to kill or attempt to kill feral
152	152	swine at night shall obtain a permit issued by the Department of
153	153	Wildlife Conservation pursuant to Section 4-135 of Title 29 of the
154	154	Oklahoma Statutes and promulgated rules Any person who removes or
155	155	attempts to removal feral swine pursuant to this section may use a
156	156	motor-driven land conveyance to pursue or follow feral swine, may
157	157	use a vehicle-mounted spotlight or other powerful light also known
158	158	as a headlight, and may use night -vision equipment that uses either
159	159	image enhancement technology or thermal imaging technology.
160	160	SECTION 2. AMENDATORY 29 O.S. 2021, Section 4 -135, as
161	161	last amended by Section 1, Chapter 198, O.S.L. 2023 (2 9 O.S. Supp.
162	162	2023, Section 4-135), is amended to read as follows:
163	163	Section 4-135. A. The Department of Wildlife Conservation is
164	164	authorized to issue permits to landowners, agricultural lessees, or
165	165	their designated agents with written permission of the land owner or
166	166	agricultural lessee and to any entity of state, c ounty, or local
167	167	government to control nuisance or damag e by any species of wildlife
168	168	including, but not limited to, beaver, coyote, deer, bobcat, raccoon
169	169	and crow under rules promulgated by the Oklah oma Wildlife

221	221	Conservation Commission. The permits may be issued wit hout
222	222	limitation by statewide season regulatio ns, bag limits or methods of
223	223	taking. A permitted landowner, agricultural lessee or a designated
224	224	agent with written permission of the landowner or agricultural
225	225	lessee may, with a valid permit issued pu rsuant to this section,
226	226	control the wildlife specified in this subsection and feral swine at
227	227	night to protect marketable agricu ltural crops, livestock or
228	228	processed feed, seed or other materials used in the production of an
229	229	agricultural commodity.
230	230	B. Except as otherwise specified in this subsection section,
231	231	the permit to hunt at night shall be valid for a period of up to one
232	232	(1) year from the date the permit was issued.
233	233	C. Notwithstanding the provisions of Section 5-203.1 of this
234	234	title, a landowner, agricultural lessee, or designated agent with
235	235	written permission of the landowner and with a valid permit may use
236	236	a headlight carried on the person while hunting at night. Nothing
237	237	in this section shall authorize the use of a headlight mounted on a
238	238	vehicle or the use of a headlight from a public roadway.
239	239	D. Any person who has been convicted of, or pled guilty to, a
240	240	violation of Section 5-203.1 or Section 5-411 of this title within
241	241	the previous three (3) years shall not be eligible to receive a
242	242	permit pursuant to this se ction. The permit can may be issued by
243	243	the local game warden in the county for which the permit is to be

296	296	Wildlife Conservation.
297	297	E. It shall be lawful for an y private landowner or designated
298	298	employee of the landowner or lessee to have a chamber-loaded firearm
299	299	on property owned by the landowner, and to use the firearm for the
300	300	purpose of controlling nuisance or damage by any wildlife or feral
301	301	swine. Nothing in this section shall authorize any convicted felon
302	302	to carry a firearm.
303	303	SECTION 3. AMENDATORY 29 O.S. 2021, Section 5 -203.1, as
304	304	amended by Section 2, Chapter 171, O.S.L. 2022 (29 O.S. Supp. 2023,
305	305	Section 5-203.1), is amended to read as follows:
306	306	Section 5-203.1. A. Except as provided in Section 3 of this
307	307	act 4-135.2 of this title, no person may attempt to take, take,
308	308	attempt to catch, ca tch, attempt to capture, capture, attempt to
309	309	kill or kill any deer, feral animal or other wildlife except fish
310	310	and, frogs, and feral swine as provided for in Section 6 -604 of
311	311	Title 2 of the Oklahoma Statutes, by the use of a vehicle-mounted
312	312	spotlight or other powerful light at night , by what is commonly
313	313	known as “headlighting”. Provided, however, nothing in this section
314	314	shall prevent one from po ssessing a .22 caliber rimfire rifle or .22
315	315	pistol and a light car ried while in pursuit of furbearers with
316	316	hounds during the legal, open furbearers season , while possessing a
317	317	valid hunting license.

369	369	B. It shall be illegal to hunt f rom a boat with a firear m from
370	370	sunset until one-half (1/2) hour before sunrise. This shal l not
371	371	pertain to hunting of waterfowl enroute from bank to blind with
372	372	unloaded shotguns.
373	373	C. Except as provided for in this section and, in Section 3 of
374	374	this act 4-135.2 of this title, and except when removing feral swine
375	375	as provided for in Sect ion 6-604 of Title 2 of the Oklahoma
376	376	Statutes, no person may harass, attempt to capture, capture, attempt
377	377	to take or take, kill or attempt to kill any wildlife or feral swine
378	378	with the aid of any motor -driven land, air or water c onveyance. A
379	379	nonambulatory person may hunt from said such conveyances with
380	380	written permission of the Director of Wildlife Conservation. A
381	381	person may hunt from an air conveyance if issued a permit pursuant
382	382	to Section 4-107.2 of this title. Nothing in this section shall
383	383	prevent the use of motor-driven land or water conveyances for
384	384	following dogs in the act of hunting, when use is restricted to
385	385	public roads or waterways. Motor-driven land or water conveyances
386	386	may be used on private property for following dogs in the act of
387	387	hunting with the permission of the landowner or occupant.
388	388	D. Employees of the Okla homa Department of Agriculture, Food,
389	389	and Forestry Wildlife Services Division and the United States
390	390	Department of Agriculture Wildlife Services while engaged in
391	391	wildlife management activities for the protection of agriculture,

443	443	property, human health and safety and natural resources shall be
444	444	exempt from the provisions of this secti on.
445	445	E. Any person convicted o f violating the provisions of this
446	446	section shall be guilty of a misdemeano r and shall be punished by a
447	447	fine of not less than One Thousand Dollars ($1,000.00) for a first
448	448	offense and not less than Two Thousand Dollars ($2,000.00) for a
449	449	second offense or by imprisonment in the county jail for not less
450	450	than ten (10) days nor more than one (1) year, and by confiscation
451	451	pursuant to Section 5 -402 of this title or by such fine,
452	452	imprisonment and confiscation.
453	453	F. A district court, upon request by the district attor ney,
454	454	shall order the hunting and fishing license pr ivileges of a person
455	455	convicted of a violation of this section suspended, revoked, or
456	456	denied for a period not less than one (1) year nor more than ten
457	457	(10) years. Upon completion of the period of suspension,
458	458	revocation, or denial of licensure, the person m ay apply for a new
459	459	hunting or fishing licens e or request a reinstatement of a lifetime
460	460	license, if the person previously held a lifetime license. The
461	461	person applying for a n ew or reinstated license shall be required to
462	462	pay a reinstatement fee of Two Hundr ed Dollars ($200.00) fo r
463	463	residents of this state and a reinstatement fee of Five Hundred
464	464	Dollars ($500.00) for no nresidents. This fee shall be in additio n
465	465	to any other fees required for the hunting and fishing license.
