8585 BE IT ENACTED BY THE P EOPLE OF THE STATE OF OKLAHOMA:
8686 SECTION 1. AMENDATORY 19 O.S. 2021, Section 901.7, is
8787 amended to read as follows:
8888 Section 901.7. A. The board of directors of a fire protection
8989 district shall have the power and duty to:
9090 1. Manage and conduct the business affairs of such district;
9191 2. Make and execute all n ecessary contracts;

143143 3. Purchase or lease -purchase and maintain all necessary and
144144 convenient engines, hoses, hose carts , or other appliances and
145145 supplies for the full equipment of a fire company or department;
146146 4. Appoint fire company officers and employees, sufficient to
147147 maintain and operate the equipment owned by su ch district;
148148 5. Take by grant, purchase, condemnation, gift, devise , or
149149 lease, and to dispose of, real or personal property of every kind
150150 necessary for the operation of the district;
151151 6. Construct or otherwise acquire suitable firehouses and o ther
152152 buildings or structures suitable for t he housing of equipment and
153153 supplies of the district, or for carrying on its own bu siness and
154154 affairs;
155155 7. Employ such officers and employees as may be required, fix
156156 their compensation, and prescribe their duties;
157157 8. Establish rules and regulations for th e district and for the
158158 prevention of fires and conflagrations within the dis trict and for
159159 the protection of property at and during any fire;
160160 9. Prepare an annual budget and follow existing laws pertaining
161161 to the budget process such as public notices, publi c hearings,
162162 protest periods, and filing requirements in the same manner as they
163163 apply to other forms of government in Oklahoma this state;
164164 10. Determine vacancies of the board of directors, fill
165165 vacancies, and conduct board elections in t he event of a vacancy on
166166 the board of directors;

218218 11. Develop bylaws for the due and orderly admini stration of
219219 the affairs of the board of directors and for its responsibilities
220220 specified pursuant to this chapter, and may compel the attendance of
221221 absent members in the manner and under penalties as the board may
222222 prescribe; and
223223 12. Do any and all other t hings necessary and proper in the
224224 management and operation of the district for the purpose of
225225 protecting property within its boundaries from fire.
226226 B. A fire protection district, created pursuant to this chapter
227227 Section 901.1 et seq. of this title , shall be deemed a political
228228 subdivision of this s tate. The board may submit an applic ation to
229229 include the firefighters of the district in the Oklahoma
230230 Firefighters Pension and Retirement System. The application for
231231 affiliation shall be submitted in accordance w ith subsection A of
232232 Section 49-105.2 of Title 11 of the Oklahoma Statutes.
233233 C. The Board of Directors board of directors may acquire a
234234 certification or license to operate an emergency medical services
235235 agency from the State Department of Heal th or contract for services
236236 with a certified or licensed emergency medical s ervice agency. The
237237 district’s emergency medical service agency may respond outside of
238238 the district boundaries ;, provided, that the political subdivisions
239239 having jurisdiction over th e area provide to the Department proper
240240 documentation of their support.

292292 D. The board of directors may adopt any or all portions of the
293293 Ambulance Service Districts Act , as outlined in Section 4 of this
294294 act.
295295 SECTION 2. AMENDATORY 19 O.S. 2021, Section 901.19, is
296296 amended to read as follows:
297297 Section 901.19. A. Each year the board shall levy an
298298 assessment sufficient to raise the annual interest on the
299299 outstanding bonds or ot her evidences of indebtedness, and, in
300300 addition thereto, an amount equal to the amount of the bonds to be
301301 retired in said such year or the installment of principal to be
302302 amortized during said such year.
303303 B. 1. Except as otherwise provided by this subsection, the
304304 board shall also levy an annual assessment sufficient to care for
305305 the cost of operation of the district and the maintenanc e of the
306306 fire department and its equipment, and for payment of salaries of
307307 the officers and employees of the district ,; provided, that no such
308308 annual assessment for operation, maintenance, and sala ries shall
309309 exceed seven (7) mills on the dollar of assessed value of the
310310 property in the district.
311311 2. The board may levy an as sessment over seven (7) mills but
312312 not to exceed ten (10) mills with allowed increases o f no more than
313313 three (3) mills per ballot me asure for fire protection and other
314314 essential services pro vided by the fire protection district upon
315315 approval for such at an election held at such time and in such

367367 manner as provided by Section 901.5 of this title for elec tion of
368368 board members.
369369 3. The board may levy an assessment starting at seven (7) mills
370370 with allowed increases of no more than three (3) mills per ballot
371371 measure in order to form an ambulance service district upon approval
372372 of such at an election held at such time and in such manner a s
373373 provided by Section 901.5 of this title for election of board
374374 members.
375375 4. If a county approves an exem ption of household goods of the
376376 heads of families and livestock employed in support of the family
377377 pursuant to the provisions of subsection (b) B of Section 6 of
378378 Article X of the Oklahoma Co nstitution, the millage rate of any levy
379379 authorized by this section for the property located in a fire
380380 protection district which is in such county shall be adjusted by the
381381 millage adjustment factor set forth in subsection (b ) of Section 8A
382382 of Article X of the Oklahoma Constitution.
383383 C. All assessments levied under the authority of Sections 901.1
384384 through 901.50 of this title , shall be a lien against the tract of
385385 land on which they have been levied, until paid, and said such lien
386386 shall be coequal with the lien of ad valorem and other taxes,
387387 including special assessments, and prior and superior to all other
388388 liens.

440440 SECTION 3. NEW LAW A new section of law to be codified
441441 in the Oklahoma Statutes as Section 1210.1 of Title 19, unless there
442442 is created a duplication in numbering, reads as follows:
443443 A. Should a fire protection district, as established under the
444444 provisions of Section 901 .1 et seq. of Title 19 of the Oklahoma
445445 Statutes, adopt any or all of the provisions of the Ambulance
446446 Service Districts Act, s uch district may levy millage as needed for
447447 the formation and continued operation and expenses of the ambulance
448448 service district pursuant to Section 901.19 of Title 19 of the
449449 Oklahoma Statutes.
450450 B. An existing fire protection district , as established under
451451 the provisions of Section 901 .1 et seq. of Title 19 of the Oklahoma
452452 Statutes, may adopt any or all portions of the Ambulance Service
453453 Districts Act by resolution for its district boundaries pursuant to
454454 Section 901.7 of Title 19 of the Ok lahoma Statutes for the purpose
455455 of forming an ambulance service district.
456456 C. The board of directors of such fir e protection district
457457 shall serve as the governing body of the ambulance service district,
458458 according to the provisions of Section 1208 of Title 19 of the
459459 Oklahoma Statutes.
460460 D. Initial millage funding and increases for continued
461461 operations and expenses of the ambulance service district shall be
462462 approved by a simple majority vote of the citizens within the
