85	85	BE IT ENACTED BY THE P EOPLE OF THE STATE OF OKLAHOMA:
86	86	SECTION 1. AMENDATORY 19 O.S. 2021, Section 901.7, is
87	87	amended to read as follows:
88	88	Section 901.7. A. The board of directors of a fire protection
89	89	district shall have the power and duty to:
90	90	1. Manage and conduct the business affairs of such district;
91	91	2. Make and execute all n ecessary contracts;

143	143	3. Purchase or lease -purchase and maintain all necessary and
144	144	convenient engines, hoses, hose carts , or other appliances and
145	145	supplies for the full equipment of a fire company or department;
146	146	4. Appoint fire company officers and employees, sufficient to
147	147	maintain and operate the equipment owned by su ch district;
148	148	5. Take by grant, purchase, condemnation, gift, devise , or
149	149	lease, and to dispose of, real or personal property of every kind
150	150	necessary for the operation of the district;
151	151	6. Construct or otherwise acquire suitable firehouses and o ther
152	152	buildings or structures suitable for t he housing of equipment and
153	153	supplies of the district, or for carrying on its own bu siness and
154	154	affairs;
155	155	7. Employ such officers and employees as may be required, fix
156	156	their compensation, and prescribe their duties;
157	157	8. Establish rules and regulations for th e district and for the
158	158	prevention of fires and conflagrations within the dis trict and for
159	159	the protection of property at and during any fire;
160	160	9. Prepare an annual budget and follow existing laws pertaining
161	161	to the budget process such as public notices, publi c hearings,
162	162	protest periods, and filing requirements in the same manner as they
163	163	apply to other forms of government in Oklahoma this state;
164	164	10. Determine vacancies of the board of directors, fill
165	165	vacancies, and conduct board elections in t he event of a vacancy on
166	166	the board of directors;

218	218	11. Develop bylaws for the due and orderly admini stration of
219	219	the affairs of the board of directors and for its responsibilities
220	220	specified pursuant to this chapter, and may compel the attendance of
221	221	absent members in the manner and under penalties as the board may
222	222	prescribe; and
223	223	12. Do any and all other t hings necessary and proper in the
224	224	management and operation of the district for the purpose of
225	225	protecting property within its boundaries from fire.
226	226	B. A fire protection district, created pursuant to this chapter
227	227	Section 901.1 et seq. of this title , shall be deemed a political
228	228	subdivision of this s tate. The board may submit an applic ation to
229	229	include the firefighters of the district in the Oklahoma
230	230	Firefighters Pension and Retirement System. The application for
231	231	affiliation shall be submitted in accordance w ith subsection A of
232	232	Section 49-105.2 of Title 11 of the Oklahoma Statutes.
233	233	C. The Board of Directors board of directors may acquire a
234	234	certification or license to operate an emergency medical services
235	235	agency from the State Department of Heal th or contract for services
236	236	with a certified or licensed emergency medical s ervice agency. The
237	237	district’s emergency medical service agency may respond outside of
238	238	the district boundaries ;, provided, that the political subdivisions
239	239	having jurisdiction over th e area provide to the Department proper
240	240	documentation of their support.

292	292	D. The board of directors may adopt any or all portions of the
293	293	Ambulance Service Districts Act , as outlined in Section 4 of this
294	294	act.
295	295	SECTION 2. AMENDATORY 19 O.S. 2021, Section 901.19, is
296	296	amended to read as follows:
297	297	Section 901.19. A. Each year the board shall levy an
298	298	assessment sufficient to raise the annual interest on the
299	299	outstanding bonds or ot her evidences of indebtedness, and, in
300	300	addition thereto, an amount equal to the amount of the bonds to be
301	301	retired in said such year or the installment of principal to be
302	302	amortized during said such year.
303	303	B. 1. Except as otherwise provided by this subsection, the
304	304	board shall also levy an annual assessment sufficient to care for
305	305	the cost of operation of the district and the maintenanc e of the
306	306	fire department and its equipment, and for payment of salaries of
307	307	the officers and employees of the district ,; provided, that no such
308	308	annual assessment for operation, maintenance, and sala ries shall
309	309	exceed seven (7) mills on the dollar of assessed value of the
310	310	property in the district.
311	311	2. The board may levy an as sessment over seven (7) mills but
312	312	not to exceed ten (10) mills with allowed increases o f no more than
313	313	three (3) mills per ballot me asure for fire protection and other
314	314	essential services pro vided by the fire protection district upon
315	315	approval for such at an election held at such time and in such

369	369	3. The board may levy an assessment starting at seven (7) mills
370	370	with allowed increases of no more than three (3) mills per ballot
371	371	measure in order to form an ambulance service district upon approval
372	372	of such at an election held at such time and in such manner a s
373	373	provided by Section 901.5 of this title for election of board
374	374	members.
375	375	4. If a county approves an exem ption of household goods of the
376	376	heads of families and livestock employed in support of the family
377	377	pursuant to the provisions of subsection (b) B of Section 6 of
378	378	Article X of the Oklahoma Co nstitution, the millage rate of any levy
379	379	authorized by this section for the property located in a fire
380	380	protection district which is in such county shall be adjusted by the
381	381	millage adjustment factor set forth in subsection (b ) of Section 8A
382	382	of Article X of the Oklahoma Constitution.
383	383	C. All assessments levied under the authority of Sections 901.1
384	384	through 901.50 of this title , shall be a lien against the tract of
385	385	land on which they have been levied, until paid, and said such lien
386	386	shall be coequal with the lien of ad valorem and other taxes,
387	387	including special assessments, and prior and superior to all other
388	388	liens.

440	440	SECTION 3. NEW LAW A new section of law to be codified
441	441	in the Oklahoma Statutes as Section 1210.1 of Title 19, unless there
442	442	is created a duplication in numbering, reads as follows:
443	443	A. Should a fire protection district, as established under the
444	444	provisions of Section 901 .1 et seq. of Title 19 of the Oklahoma
445	445	Statutes, adopt any or all of the provisions of the Ambulance
446	446	Service Districts Act, s uch district may levy millage as needed for
447	447	the formation and continued operation and expenses of the ambulance
448	448	service district pursuant to Section 901.19 of Title 19 of the
449	449	Oklahoma Statutes.
450	450	B. An existing fire protection district , as established under
451	451	the provisions of Section 901 .1 et seq. of Title 19 of the Oklahoma
452	452	Statutes, may adopt any or all portions of the Ambulance Service
453	453	Districts Act by resolution for its district boundaries pursuant to
454	454	Section 901.7 of Title 19 of the Ok lahoma Statutes for the purpose
455	455	of forming an ambulance service district.
456	456	C. The board of directors of such fir e protection district
457	457	shall serve as the governing body of the ambulance service district,
458	458	according to the provisions of Section 1208 of Title 19 of the
459	459	Oklahoma Statutes.
460	460	D. Initial millage funding and increases for continued
461	461	operations and expenses of the ambulance service district shall be
462	462	approved by a simple majority vote of the citizens within the
