3965 An Act relating to the Oklahoma Wildlife Conservation

5581 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5682 SECTION 1. AMENDATORY 29 O.S. 20 21, Section 5-202, is
5783 amended to read as follows:
5884 Section 5-202. A. Except as otherwise pro vided, no person may
5985 hunt or take by any means or method upon t he land of another without
6086 the consent of the owner, lessee , or occupant of such land.
6187 B. For purposes of this section, consent shall be presumed to
6288 be valid for not more than one ( 1) year, unless the owner, lessee,
6389 or occupant specifically grants consent for a specified period of
6490 time.

92142 C. Excluding land primarily devoted to farming, ranching, or
93143 forestry purposes as set forth in Section 1835.2 of Tit le 21 of the
94144 Oklahoma Statutes, areas exempt from the provisions of subsection A
95145 of this section are lands belonging to this state which are not
96146 leased and occupied by a resident, excluding school l and.
97147 D. Any game warden investigating a hunter in the field has the
98148 does not have a duty, unless the landowner, lessee, or occupant has
99149 requested a game warden to do so, to inform the hunter that it is
100150 necessary to obtain the consent of the landowner, lessee , or
101151 occupant to hunt or take on the particular property. Prosecution
102152 for violations of the provisio ns of this section may be commenced
103153 only upon written complain t of such owner, lessee, or occupant filed
104154 before any court auth orized to punish such viol ation, or upon
105155 written complaint to any game warden or officer authorized to make
106156 arrest for such offenses.
107157 E. Unless otherwise requested by a proper ty owner, lessee, or
108158 tenant, a game warden shall not be authorized to enter private
109159 property on the suspicion of the possible possession or di scharge of
110160 a firearm or bow.
111161 F. Suspicion of the possible possession or discharge o f a
112162 firearm or bow shall not itself constitute sufficient probable cause
113163 for authorizing a game warden to enter private property.

141215 G. No person shall operate a motor -driven conveyance on lands
142216 that are fenced and posted or are in cultivation without permission
143217 of the landowner, lesse e, or occupant.
144218 F. H. The consent of any owner, lessee, or occupant of land
145219 authorizing a person to hunt, take, fish or engage in any
146220 recreational activity upon the land of any such owner, lessee , or
147221 occupant shall not be construed to create any additional d uty of
148222 care or impose any additional liability other than specified by
149223 Sections 16-71.2 and 16-71.3 of Title 2 of the Oklahoma Statutes.
150224 G. I. The obtaining of consent from any owner, les see, or
151225 occupant of land authorizing a person to hunt, take, fish o r engage
152226 in any recreational activity shall not relieve the authorized person
153227 using the land from any obligation which the person may have in the
154228 absence of obtaining such consent to exercise care in the use of
155229 such land and in activities thereon, or from th e legal consequences
156230 of failure to employ such care.
157231 H. J. 1. It shall be an affirmative d efense to prosecution
158232 under subsection A of this section that the accused had express or
159233 implied permission or legal authority to be on the property.
160234 2. If an accused reasonably believed he or she was upon
161235 property for which they he or she had permission to be upon , it
162236 shall be an affirmative defense to prosecution under subsection A of
163237 this section that the accused had with him or her, on his or her
164238 person, written permissio n from the surface owner, surface lessee,

192290 hunting lessee, or lawful occupant to be upon such person’s land
193291 while the accused was upon any adjoining property. This defense
194292 shall not be available to the accused if:
195293 a. the accused has previously pled guilty, nolo
196294 contendere, or has been convicted of any act of
197295 trespass or has been found civilly lia ble of any act
198296 of trespass, or
199297 b. the accused, while the accused was upon the adjoining
200298 property, does not have with him or her, on his or her
201299 person, the written p ermission specified in this
202300 paragraph.
203301 I. K. Any person convicted for the first time of vio lating any
204302 provisions of this section shall be guilty of a misdemeanor and
205303 punished by the impo sition of a fine of not less than Five Hundred
206304 Dollars ($500.00) nor more than One Thousand Five Hundred Dollars
207305 ($1,500.00), or by impr isonment in the county ja il for thirty (30)
208306 days, or by both fine and imprisonment.
209307 J. L. Any person convicted for the second or subsequent time of
210308 violating any provisions of this section shall be guilty of a
211309 misdemeanor and punished by the imposition of a fine of not less
212310 than One Thousand Five Hundred Dollars ($1,500.00) nor more than Two
213311 Thousand Five Hundred Dollars ( $2,500.00), or by imprisonment in the
214312 county jail for not less than s ix (6) months, or by both fine and
215313 imprisonment.
