75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHO MA:
76	76	SECTION 1. AMENDATORY 11 O.S. 2021, Section 22 -123, is
77	77	amended to read as follows:
78	78	Section 22-123. A. As used in this act, “vagrant” means a
79	79	person who is in, remains in, or wanders about a public or private
80	80	place for any of the following purposes:
81	81	1. Gambling with cards, dice, or other gambling paraphernali a;
82	82	2. Engaging in prostitution , soliciting prostitution , or
83	83	soliciting for an act of lewdness ;
84	84	3. Engaging in theft or breaking and entering into any
85	85	building, property, or automobile of another ;
86	86	4. Injuring, destroying, molesting, or defacing any property of

139	139	5. Begging or soliciting a lms, provided that such begging or
140	140	solicitation is not for a bona fide religious, c haritable, or
141	141	eleemosynary organization with the authorization of such
142	142	organization; or
143	143	6. Selling, purchasing, trading, or otherwise e xchanging,
144	144	procuring, or making available illegal drugs or contraband .
145	145	B. The municipal governing body may provide by ordinance for
146	146	the arrest, fine, and imprisonment of vagrants.
147	147	SECTION 2. NEW LAW A new section of law to be codified
148	148	in the Oklahoma Statutes as Secti on 22-123.1 of Title 11, unless
149	149	there is created a duplication in numbering, reads as follows:
150	150	A. The proprietor or manager o f any business has the right to
151	151	contact law enforcement to remove a vagrant if such vagrant is
152	152	within twelve (12) feet of a ny doorway of a retail or business
153	153	establishment, even if such vagrant is on public property.
154	154	B. Law enforcement officers, upon arrival, shall determine
155	155	whether the person accused of being a vagrant meets the definition
156	156	established in Section 22-123 of this title, through personal
157	157	observation or viewing of video footage. Upon determination that
158	158	such individual meets t he definition of a vagrant, the office rs
159	159	shall remove the vagrant to public property that is at least one -
160	160	half (1/2) mile away from the location of the business which made
161	161	the initial complaint. Such location for removal shall not be
