7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHO MA:
7676 SECTION 1. AMENDATORY 11 O.S. 2021, Section 22 -123, is
7777 amended to read as follows:
7878 Section 22-123. A. As used in this act, “vagrant” means a
7979 person who is in, remains in, or wanders about a public or private
8080 place for any of the following purposes:
8181 1. Gambling with cards, dice, or other gambling paraphernali a;
8282 2. Engaging in prostitution , soliciting prostitution , or
8383 soliciting for an act of lewdness ;
8484 3. Engaging in theft or breaking and entering into any
8585 building, property, or automobile of another ;
8686 4. Injuring, destroying, molesting, or defacing any property of

139139 5. Begging or soliciting a lms, provided that such begging or
140140 solicitation is not for a bona fide religious, c haritable, or
141141 eleemosynary organization with the authorization of such
142142 organization; or
143143 6. Selling, purchasing, trading, or otherwise e xchanging,
144144 procuring, or making available illegal drugs or contraband .
145145 B. The municipal governing body may provide by ordinance for
146146 the arrest, fine, and imprisonment of vagrants.
147147 SECTION 2. NEW LAW A new section of law to be codified
148148 in the Oklahoma Statutes as Secti on 22-123.1 of Title 11, unless
149149 there is created a duplication in numbering, reads as follows:
150150 A. The proprietor or manager o f any business has the right to
151151 contact law enforcement to remove a vagrant if such vagrant is
152152 within twelve (12) feet of a ny doorway of a retail or business
153153 establishment, even if such vagrant is on public property.
154154 B. Law enforcement officers, upon arrival, shall determine
155155 whether the person accused of being a vagrant meets the definition
156156 established in Section 22-123 of this title, through personal
157157 observation or viewing of video footage. Upon determination that
158158 such individual meets t he definition of a vagrant, the office rs
159159 shall remove the vagrant to public property that is at least one -
160160 half (1/2) mile away from the location of the business which made
161161 the initial complaint. Such location for removal shall not be
