8787 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8888 SECTION 1. NEW LAW A new section of law to be codified
8989 in the Oklahoma Statutes as Section 140.8 of Title 15, unless there
9090 is created a duplication in numbering, reads as fo llows:
9191 This act shall be known and may be cited as the “Oklahoma Motor
9292 Vehicle Repair Consume r Protection Act”.

144144 SECTION 2. NEW LAW A new section of law to be codified
145145 in the Oklahoma Statutes as Section 140.9 of Title 15, unless there
146146 is created a duplication in numbering, reads as follows:
147147 As used in this act:
148148 1. “Administrative charges” shall include, but not be limited
149149 to, file creation; repair orders; vehicle travel; parts and vehicle
150150 identification; software charges; communication with vehicle owners
151151 and insurance representatives and any other party involved in the
152152 repair or total loss determination ; pre-repair charges; prewashes;
153153 COVID-19 or bio-cleaning; charges related to pre-repair diagnostic
154154 scanning, photographs, electronic communic ations, parts
155155 identification, and preparation of a repair plan; any charges for
156156 work that is not a repair procedure for obtaining labor, parts, and
157157 materials; securing removed parts ; relocating parts back in a
158158 vehicle determined to be a total loss ; restocking fees; wrapping and
159159 tarping; and moving vehicles from d ifferent locations;
160160 2. “Customer” or “responsible party” means the owner, an agent
161161 of the owner, a family member of the owner, an employee of the
162162 power, insurance represe ntative, or any other perso n who is or will
163163 be responsible for charges inc urred at a motor vehicle repair
164164 facility as a result of repairs or charges incurred in d etermining a
165165 total loss of a motor vehicle as provided for in Section 1250.8 of
166166 Title 36 of the Oklahoma Statutes;

218218 3. “Motor vehicle” means every self-propelled vehicle intended
219219 primarily for use and operation on the p ublic streets and highways;
220220 4. “Motor vehicle repair facili ty” or “garage” means any
221221 commercial entity engaged in the business or occupation of
222222 performing repairs on a motor vehi cle, including any re pairs or
223223 replacement of body parts , and any mechanical repairs;
224224 5. “Service work” means all repairs, maintenance, painting,
225225 exterior body work, part replacements, evaluation to determine a
226226 total loss motor vehicle, pre-repair evaluation to determine
227227 anticipated service work to be performed, and diag nostic testing of
228228 a motor vehicle performed after the repair process has commenced;
229229 6. “Storage rates” means all charges and fees related to the
230230 motor vehicle repair fa cility retaining act ual physical possession
231231 of a motor vehicle during the time when the motor vehicle repair
232232 facility exercises control, supervision, and responsi bility over the
233233 motor vehicle; and
234234 7. “Tear-down process” means the disassembly of a damaged motor
235235 vehicle to a point where the motor vehicle repair facility can
236236 identify the extent of the damage and generate an itemized estimate
237237 for restoring the vehicle to its pre-loss condition.
238238 SECTION 3. NEW LAW A new section of law to be codified
239239 in the Oklahoma Statutes as Section 140.10 of Title 15, unless there
240240 is created a duplication in numbering, reads as follows:

292292 A. No service work shall be performed by any motor vehicle
293293 repair facility unless the motor vehicle repair facility obtains the
294294 written consent or d ocumented verbal consent of the customer or
295295 responsible party for the fees, charges, and costs, not including
296296 any applicable sales ta xes, to be incurred by the customer or
297297 responsible party prior to per forming the service wo rk.
298298 B. Prior to performing the service work, the motor vehicle
299299 repair facility shall prepare a written est imate of the proposed
300300 service work with an itemization of all fees, charges, and cos ts for
301301 the proposed service work, not including any appli cable sales taxes,
302302 and an estimated date of the completion of the service work.
303303 C. Prior to performi ng the service work, the motor vehicle
304304 repair facility shall record on the written estimate the type of
305305 communication, written or verbal, had with the customer or
306306 responsible party and whether the customer or responsible party
307307 consented to the proposed service work. The record shall include
308308 the date, time, manner of consent , verbal or written, telephone
309309 number called to speak with the customer or res ponsible party, if
310310 any, and the names of the persons giving and receiving such consent.
311311 D. The tear-down process shall neither excee d the billed rate
312312 of Sixty Dollars ($60.00) per hour nor exceed a four-hour maximum
313313 total time of completion. T he four-hour maximum total time of
314314 completion for the tear -down process shall not be a flat r ate
315315 charged by a motor vehicle repair facility, but shall be the time

367367 limit allowed, where necessary, based upon the amount of labor
368368 required and difficulty of the evaluation of the specific motor
369369 vehicle being assessed. Prior to per forming any of the tear-down
370370 process, the motor vehicle repair facility shall provide a written
371371 estimate to the customer or res ponsible party with an anticipated
372372 duration of the tear -down process.
373373 E. Administrative charges shall ne ither exceed the billed rate
374374 of Sixty Dollars ($6 0.00) per hour nor exceed a four -hour maximum
375375 total time of completion. The four -hour maximum total time of
376376 completion for the administrative charges shall not be a flat rate
377377 charged by a motor vehicle repair facility , but shall be the time
378378 limit allowed, where necessary, based upon the amount of labor and
379379 necessary supporting functions required for the r epair of the
380380 specific motor vehicle being service d.
381381 SECTION 4. NEW LAW A new section of law to be codified
382382 in the Oklahoma Statutes as Section 140.11 of Title 15, unless there
383383 is created a duplication in numbering, reads as follows:
384384 Regardless of the manner of delivery of a motor vehicle to a
385385 motor vehicle repair facility, whether a consensual or nonconsensual
386386 delivery, or whether the service work is for a total loss vehicle or
387387 a repairable vehicle , all administrative and no n-repair-related
388388 fees, charges, and costs, not including any applicable sales taxes,
389389 for storage to be incurred by the customer or responsible party for

448448 hour period, regardless of whether that twenty -four-hour period
449449 extends over more than one calendar day, are as follows:

531531 C. Storage charges shall neither accrue nor be charged on motor
532532 vehicles that are repaired.
533533 D. Storage charges shall neither accrue nor be charged on any
534534 motor vehicle deemed to be a total loss vehicle until the
535535 determination has been made by t he customer or responsible part y
536536 that the motor vehicle is a total loss vehicle. The total loss
537537 determination date shall serve as the date upon which storage
538538 charges shall start accruing.

590590 SECTION 6. NEW LAW A new section of law to be codif ied
591591 in the Oklahoma Stat utes as Section 140.13 of Title 15, unless there
592592 is created a duplication in numbering, reads as follows:
593593 A. Each motor vehicle repair facility shall provide written
594594 invoices and respond to requests for invoices concerning the pickup,
595595 release, or delivery of a motor vehicle on its premises within eight
596596 (8) business hours.
597597 B. All fees, charges, and costs, not including any applicable
598598 sales taxes, for service work, including minimum charges, shall be
599599 conspicuously posted and visible to the public on the mot or vehicle
600600 repair facility’s website or in writing in t he customer-accessible
601601 portion of the motor vehicle repair facility where a customer or
602602 responsible party would pay for service work in person if the
603603 customer or responsible party was physically present at the motor
604604 vehicle repair facility.
605605 SECTION 7. NEW LAW A new section of law to be codified
606606 in the Oklahoma Statutes as Section 140.14 of Title 15, unless there
607607 is created a duplication in numbering, reads as follows:
608608 A. A motor vehicle repair facility shall not increase any
609609 charges assessed by a wrecker or towing service licensed by the
610610 Department of Public Safety for a motor vehicle delivered to the
611611 motor vehicle repair facility and shall only pa ss on those charges
612612 without any markup. The charges asses sed by the wrecker or towing
613613 service are consider ed a sublet item and the receiving of such is

667667 B. A single additional fee of Fifty Dollars ($50.00) may be
668668 charged for an Oklahoma Title 42 Possessory Lien process over and
669669 above the allowed administrative charges only if the following
670670 requirements have been met:
671671 1. Documentation of the offic ial Oklahoma Title 42 Possessory
672672 Lien filing has been provided to the motor vehicle ’s registered
673673 owner in accordance with the proce dures mandated by the Oklahoma
674674 Title 42 Possessory Lien process; and
675675 2. Proof of notification that the official Oklahoma Title 42
676676 Possessory Lien filing has be en provided to the motor vehicle’s
677677 registered owner shall be documented and kep t by the filing person
678678 or business, showing the motor vehicle’s registered owner address,
679679 date upon which notification was made, and manner of notification
680680 made to the motor vehicle’s registered owner.
681681 SECTION 8. This act shall become effective November 1, 2024 .
