77	77		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78		SECTION 1. AMENDATORY 29 O.S. 2021, Section 4 -112, as
79	79		last amended by Section 1, Chapter 96, O.S.L. 2023 (29 O.S. Supp.
80	80		2023, Section 4-112), is amended to read as follows:
81	81		Section 4-112. A. Except as otherwise provided for in the
82	82		Oklahoma Wildlife Conservation Code or the Oklahoma Farmed Cervidae
83	83		Act, no person may hunt, pursue, trap, haras s, catch, kill, take or
84	84		attempt to take in a ny manner, use, have in possession, sell, or
85	85		transport all or any portion of any wildlife except fish, without
86	86		having first procure d a license from the Department of Wildlife
87	87		Conservation. The Wildlife Conservat ion Commission shall designate
88	88		a consecutive Saturday an d Sunday in September of each year as free

140	140		hunting days in which residents of this state may hunt without first
141	141		procuring a hunting license pursuant to the provisions of this
142	142		section.
143	143		B. The following legal residents of Oklahoma shall be exemp t
144	144		from the annual hunting license r equirement of paragraph 1 of
145	145		subsection F of this section and the following nonresidents shall b e
146	146		exempt from the annual nonresident hunting licenses required
147	147		pursuant to paragraphs 1 and 2 of subsection C of this section:
148	148		1. Legal residents under sixteen (16) years of age;
149	149		2. Legal residents sixty-five (65) years of age or older
150	150		provided they have obtained a senior citizen lifetime hunting or
151	151		combination hunting and fishing li cense pursuant to the provisions
152	152		of Section 4-114 of this title;
153	153		3. Legal residents born on or before Janua ry 1, 1923;
154	154		4. Legal resident veterans having a disability of sixt y percent
155	155		(60%) or more;
156	156		5. Legal resident owners or tenants who hunt on land ow ned or
157	157		leased by them;
158	158		6. Any nonresident under fourtee n (14) years of age;
159	159		7. Legal residents having a proven disability which renders
160	160		them nonambulatory and confines them to a wheelchair, as certified
161	161		by a physician licensed in this state or in any sta te which borders
162	162		this state;

214	214		8. Any legal resident or nonresident under eighte en (18) years
215	215		of age who is in the physical custody of a child care facility as
216	216		defined by Section 402 of Title 10 of the Oklahoma Statutes; and
217	217		9. Any legal resident or nonres ident hunting, pursuing,
218	218		trapping, harassing, catching, killing, taking, or attempting to
219	219		take in any manner any species of rattlesnake during an organized
220	220		rattlesnake-hunting event or festival and who has a rattlesnake
221	221		permit issued pursuant to Section 4 -143 of this title.
222	222		C. Except as otherwise p rovided for in the Oklahoma Wildlif e
223	223		Conservation Code, the nonresident hunting licenses issued pursuant
224	224		to this section and the fe e for each license shall be:
225	225		1. Annual hunting license for nonresidents hunting game other
226	226		than deer, antelope, elk or bear which expire s on December 31 of the
227	227		year purchased – One Hundred Forty-one Dollars ($141.00) Two Hundred
228	228		Eighty-two Dollars ($282.00). Nonresidents hunting big game,
229	229		combination big game and upland game or exotic wildlife in a
230	230		commercial hunting area shall be req uired to have this license;
231	231		2. Annual hunting license for nonresidents hunting game other
232	232		than deer, antelope, elk or bear which expires on June 30 of the
233	233		fiscal year purchased – One Hundred Seventy-five Dollars ($175.00)
234	234		Three Hundred Fifty Dollars ( $350.00). Nonresidents hunting big
235	235		game, combination big game and upland game or exoti c wildlife in a
236	236		commercial hunting area shall be required to have this license;
237	237		3. Gun hunting license for deer:

300	300		c. during deer gun seasons for nonresident s which shall
301	301		be valid for hunting all deer allowed during the
302	302		current calendar year deer gun season - Two Hundred
303	303		Ninety-nine Dollars ($299.00) Six Hundred Dollars
304	304		($600.00);
305	305		4. Archery hunting license f or deer for nonresidents which
306	306		shall expire on January 15 of the calendar year af ter the year
307	307		purchased or, if purchased during the deer arch ery season, it shall
308	308		expire at the end of that deer archery season:
309	309		a. during deer archery seasons for youth nonres idents
310	310		seventeen (17) years of age or younger which shall be
311	311		valid for hunting one antlerless deer allowed during

448	448		8. Five-day hunting license for nonresidents hunting game other
449	449		than deer, antelope, elk, quail, turkey or bear – Seventy-four
450	450		Dollars ($74.00). Nonresidents hunting big gam e, combination big
451	451		game and upland game or exotic wildlife in a commercial hunting area
452	452		shall be required to have this license;
453	453		9. Ten-day hunting license for nonresidents hunting small game
454	454		in a commercial hunting area – Five Dollars ($5.00) ; and
455	455		10. Five-day hunting license for n onresidents hunting winged
456	456		upland game, excluding wild turkey, in a commercial hunting area –
457	457		Fifteen Dollars ($15.00).
458	458		D. The Department of Wildl ife Conservation shall provide a
459	459		report to both the President Pro Tempore of the Senate and the
460	460		Speaker of the House of Represent atives by February 1 of 2019 and

512	512		2020 setting forth information rega rding licenses issued pursuant to
513	513		paragraphs 3, 4 and 5 of subsection C of this section, wh ich shall
514	514		include, but not be limited to:
515	515		1. The number of licenses issued during the most recent
516	516		respective deer hunting seasons; and
517	517		2. A fiscal analysis compari ng revenue generated from the fees
518	518		of the licenses issued d uring the most recent respective deer
519	519		hunting seasons compared to previous years and whether the deer
520	520		hunting license structure i s beneficial to the Department.
521	521		E. Of the fees collected pursuant t o the provisions of
522	522		subsection C of this section:
523	523		1. Five Dollars ($5.00) of the license f ee of each license
524	524		issued pursuant to paragraphs 1 through 7 of subsecti on C of this
525	525		section and Two Dollars and fifty cents ($2.50) of the license fee
526	526		for each license issued pursuant to paragraph 8 of subsection C of
527	527		this section shall be deposited in the Wildlife Land Acquisition
528	528		Fund created pursuan t to the provisions of S ection 4-132 of this
529	529		title; and
530	530		2. Five Dollars ($5.00) of the license fee for each license
531	531		issued pursuant to paragraphs 1 through 8 o f subsection C of this
532	532		section shall be for the Oklahoma Wildlife Land Stamp and shall be
533	533		deposited in the Oklahoma Wil dlife Land Fund created pursuant to the
534	534		provisions of Section 4 -141 of this title.

587	587		issued pursuant to this section and the fee for each license shall

589	589		1. Annual hunting license for residents eighteen (18) years of
590	590		age and older which expires on December 31 of the year purchased -
591	591		Twenty-four Dollars ($24.00);
592	592		2. Annual hunting license for residents eighteen (18) years o f
593	593		age and older which expires on June 30 of the fiscal year purchased
594	594		– Thirty-one Dollars ($31.00);
595	595		3. Annual hunting license for residents sixteen (16) or
596	596		seventeen (17) years of age which expires on December 31 of the ye ar
597	597		purchased - Four Dollars ($4.00);
598	598		4. Annual hunting license for residents si xteen (16) or
599	599		seventeen (17) years of age which e xpires on June 30 of the fiscal
600	600		year purchased – Six Dollars ($6.00);
601	601		5. Ten-day hunting license for residents for small game in a
602	602		commercial hunting area - Five Dollars ($5.00);
603	603		6. Five-year disability hunting license for residents of this
604	604		state for at least six (6) months who are receiving Social Security
605	605		Disability benefits, Supplemental Security Income benefits or
606	606		disability benefits under the Railroad Retirement Act, 45 U.S.C.A.,
607	607		Section 231a, or resid ents who are one-hundred-percent disabled and
608	608		are receiving disability payments from the Multiple Injury Trust

666	666		States Department of Vet erans Affairs or its
667	667		successor, certifying that the person is a disabled
668	668		veteran in receipt of compensation at the one -hundred-
669	669		percent rate, and
670	670		b. residents hunting in big game or combination big game
671	671		and upland game commercial hunting are as;
672	672		8. Gun hunting license for deer for residen ts under eighteen
673	673		(18) years of age – Nine Dollars ($9.00);
674	674		9. Archery hunting licens e for deer for residents eighteen (18)
675	675		years of age or older - Nineteen Dollars ($19.00). The following
676	676		persons shall be exempt:
677	677		a. residents with proper certification from the United
678	678		States Department of Veterans Aff airs or its
679	679		successor, certifying that the person is a disabled

809	809		for residents - Nineteen Dollars ($19.00). The following persons
810	810		shall be exempt:
811	811		a. residents with proper c ertification from the United
812	812		States Department of Veterans Affairs or its
813	813		successor, certifying that the person is a disabled
814	814		veteran in receipt of compensation at the one-hundred-
815	815		percent rate, and
816	816		b. residents hunting in big game or combination big game
817	817		and upland game commercial hunting area s.
818	818		G. Residents hunting big game, combination big game and upland
819	819		game or exotic wildlife in a commercial hunting area shall be
820	820		required to have one of the following license s:
821	821		1. An annual hunting license issued pu rsuant to paragraph 1, 2,
822	822		3 or 4 of subsection F of this section;
823	823		2. An annual hunting and fishing combination license issued
824	824		pursuant to Section 4-113 of this title;
825	825		3. A five-year hunting license or five -year combination hunting
826	826		and fishing license i ssued pursuant to Section 4 -113.1 of this
827	827		title; or
828	828		4. A lifetime hunting license or lifetime comb ination hunting
829	829		and fishing license issued pursuant to Section 4 -114 of this title.
830	830		H. Of the fees collected pursuan t to the provisions of
831	831		paragraphs 1 and 2 of subsection F of this section, Five Dollars

884	884		Stamp and shall be deposited in the Oklahoma Wild life Land Fund
885	885		created pursuant to the provision s of Section 4-141 of this title.
886	886		I. The provisions of this section shall not be cons trued to
887	887		require a hunting license, resident or nonresi dent, of any person
888	888		merely because the person participates, as owner or handler of an
889	889		entry, as an official, or as a sp ectator in the conduct of a field
890	890		trial or performance test of dogs, whether a resident or no nresident
891	891		of the State of Oklahoma . No license to hunt shall be required of
892	892		any person engaged in training or working dogs, provided that person
893	893		is in no way engaged in hunting and does not take or a ttempt to take
894	894		in any manner any game.
895	895		J. 1. Any person arrested for hunting game other than deer ,
896	896		antelope, elk, bear or turkey without a valid hunting license as
897	897		required by the provisions of subsection A of this se ction may
898	898		purchase a substitute temp orary thirty-day license from the
899	899		arresting game warden i n lieu of posting bond . Proof of hunter
900	900		safety certification will not be required for the temporary
901	901		substitute license. The fee for a substitute license purc hased
902	902		pursuant to the provisions of this subsection shall be:
903	903		a. for legal residents, Fifty Dollars ($50.00), and
904	904		b. for nonresidents, One Hundred Forty-five Dollars
905	905		($145.00).

957	957		2. Except as otherwise provided for by this su bsection, the
958	958		fees from licenses pur chased pursuant to the provisions of this
959	959		subsection shall be deposited in the Wildlife Conse rvation Fund to
960	960		be used exclusively for developing, managing, preserving, and
961	961		protecting wildlife and wildlife habitat.
962	962		K. Any person producing proof in court that a current hunting
963	963		license issued by the Department of Wildlife Conservation to t hat
964	964		person was in force at the time of the allege d offense shall be
965	965		entitled to dismissal of a charge of violating this section upon
966	966		payment of court costs. If proof of a current hunting license
967	967		issued by the Department to the person that was in force at the time
968	968		of the alleged offense is presented to t he court or district
969	969		attorney within seventy-two (72) hours after the vio lation, the
970	970		charge shall be dismissed without pa yment of court costs.
971	971		L. Unless a substitute license is purchased as provided for by
972	972		subsection J of this section, any resident convi cted of violating
973	973		the provisions of this section shall be punished by the imposition
974	974		of a fine of not less than Twenty -five Dollars ($25.00) nor more
975	975		than Two Hundred Dollars ($200.00), or by imprisonment in the county
976	976		jail for a period not to exceed thirt y (30) days, or by both.
977	977		M. Unless a substitute license is purchased as p rovided for by
978	978		subsection J of this section, any nonresident convicted of violatin g
979	979		the provisions of this section shall be punished b y the imposition
980	980		of a fine of not less than Two Hundred Dollars ($200.00) nor more

1033	1033		county jail for a period not to exceed six (6) months, or by both.
1034	1034		SECTION 2. AMENDATORY 29 O.S. 2021, Section 5 -401, is
1035	1035		amended to read as follows:
1036	1036		Section 5-401. A. The Wildlife Conservation Commission is
1037	1037		authorized to declare an open season on wildl ife in any counties or
1038	1038		parts of counties of this state where, in the judgment of the
1039	1039		Commission, such wildlife exists in sufficient quantity to warrant
1040	1040		such open season, and suc h open season shall be declared by
1041	1041		Commission resolution not less than ten (10) days before the season
1042	1042		is opened.
1043	1043		B. The Commission may designate any two (2) consecutive days
1044	1044		after the open season declared for hunting deer to be senior
1045	1045		citizen’s hunting days. During those two (2) days only legal
1046	1046		residents of Oklahoma who are sixty -four (64) years of age or older
1047	1047		may hunt deer provided the person has a valid license as otherwise
1048	1048		provided by law.
1049	1049		C. The Commission is further authorized to declare an open
1050	1050		season on mountain lions and black bears.
1051	1051		D. Except as provided in subsection E of this section, the
1052	1052		Commission is further authorized to prescribe rules necessary to the
1053	1053		proper conduct and policing of such open season, the amount and kind
1054	1054		of wildlife that may be taken, and the dates and time limits of such
1055	1055		season.

1107	1107		E. Any bowfishing season set for nongame fish by the Commission
1108	1108		for the Upper Illinois River shall inclu de the following:
1109	1109		1. Upstream from the Horseshoe Bend boat ramp to where State
1110	1110		Highway 51 crosses the Illinois River bowfishing is permitted from
1111	1111		June 1 to March 31; and
1112	1112		2. Upstream from where State Highway 51 crosses the Illinois
1113	1113		River bowfishing is permitted from Dece mber 1 through March 31.
1114	1114		F. The Commission is further authorize d to require any person
1115	1115		participating in such open season or hunting in open areas during
1116	1116		open season to procure, under rules prescribed by the Commission, a
1117	1117		special permit or license to participate in such season or hunt in
1118	1118		such areas during open season and to charg e residents not to exceed
1119	1119		Twenty Dollars ($20.00), nonresidents not to exceed Seventy -five
1120	1120		Dollars ($75.00) and further providing that Five Dollars ($5.00) of
1121	1121		this fee shall be set aside for compensation to Oklahoma surface
1122	1122		holders participating in the Acres for Wildlife Program at a rate to
1123	1123		be determined by the Wildlife Conservation Commission. No
1124	1124		exemptions shall be permitted.
1125	1125		G. Open seasons, closed seasons, bag limits, catch limits,
1126	1126		possession limits and territorial limitations set forth in the
1127	1127		statutes of this state, pertaining to wildlife of every sort, are
1128	1128		hereby declared to be based on the existence of a normal population
1129	1129		of such species of wildlife, compatible with and not damaging to the
1130	1130		proper agricultural use of the lands of the stat e; provided, that

1183	1183		not exceed more than half of the limit established for resident
1184	1184		hunters.
1185	1185		H. Such seasons, catch limits, bag limits, possession limits
1186	1186		and territorial limitations as set by statute s hall prevail and be
1187	1187		in full force and effect for each and every species of wildlife to
1188	1188		which they pertain so long as the population or numbers of such
1189	1189		wildlife species remain normal or are not damaging or endangering
1190	1190		crops or proper agricultural use of the lands of the state.
1191	1191		I. The Commission in session, and after having given ten (10)
1192	1192		days’ public notice of such meeting being called and the purp ose of
1193	1193		such meeting, the species of wildlife to be considered and the
1194	1194		reasons therefor, shall have the right to determine if there does or
1195	1195		does not exist a normal population of the wildlife species under
1196	1196		consideration, which does or does not endanger the crops of the
1197	1197		state or of any certain areas, or the agricultural use of the lands
1198	1198		therein. In the event the cons ideration is other than statewide,
1199	1199		the Commission shall meet at the most conven ient place to the people
1200	1200		of the area in the area being considered. All meetings shall be
1201	1201		open to the public and proper records of those appearing and
1202	1202		testifying shall be made. If the Commission, after hearing and
1203	1203		after investigation, finds that the populations of the wildlife
1204	1204		species under hearing are not normal or that they are not compatible
1205	1205		to the agricultural use of the lands or are damaging or endangering

1258	1258		make the necessary changes by e ither extending, shortening, opening
1259	1259		or closing such seasons, and change such bag limits, catch limits
1260	1260		and possession limits, and regulate methods or devices for taking,
1261	1261		killing or capturing of the wildlife species affected in any area or
1262	1262		areas covered by the notice of meeting and hearing, except as
1263	1263		otherwise set by the Legislature.
1264	1264		J. Such administrative order shall take effect after
1265	1265		publication in at least one newspaper of gen eral state circulation,
1266	1266		or in a newspaper having circulation in the territory a ffected. A
1267	1267		copy of all such orders shall, before publication, be filed with the
1268	1268		Secretary of State, and such order shall not be construed as
1269	1269		authorizing the Commission to chang e any penalty for violating any
1270	1270		game law or regulation or change the amount of any license
1271	1271		established by the Legislature.
1272	1272		SECTION 3. This act shall become effective November 1, 2024.
