85	85	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
86	86	SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-740.16, is
87	87	amended to read as follows:
88	88	Section 1-740.16. As used in the Choosing Childbi rth Act:
89	89	1. “Abortion” means the use or prescription of any instrument,
90	90	medicine, drug or an y other substance or device to intentionally:
91	91	a. kill the unborn child of a woman known to be pregnant,

144	144	b. terminate the pregnancy of a woman known to be
145	145	pregnant, with an intention other than:
146	146	(1) after viability of the unborn child, to produce a
147	147	live birth and preserve the life and health of
148	148	the child born alive, or
149	149	(2) to remove a dead unborn child;
150	150	2. “Unborn child” means an individual organism of the specie s
151	151	Homo sapiens from fertiliza tion until birth; and
152	152	3. “Grant-supervising entity” means a private entity which
153	153	approves all grants made under the Choosing Childbirth Act that are
154	154	not directly made to privat e organizations by the State Department
155	155	of Health for reimbursement of services provided under the Choosing
156	156	Childbirth Act and which:
157	157	a. is organized as a not-for-profit corporation in
158	158	Oklahoma and as a 501(c)3 501(c)(3) entity under the
159	159	federal Internal Revenue Code, and
160	160	b. does not encourage or counsel any woman to have an
161	161	abortion not necessary to prevent her death, to
162	162	provide her such an ab ortion or to refer her for such
163	163	an abortion, and does not acce pt funds or services
164	164	knowingly from any entity which performs abortions or
165	165	receives money for abortions.
166	166	SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-740.17, is
167	167	amended to read as follows:

219	219	Section 1-740.17. A. The State Department of Health shall make
220	220	grants, as directed in subse ction B of this section , from funds
221	221	appropriated by the Legislature specifically for this purpose, to a
222	222	grant-supervising entity for the purpose of reimbursing for the
223	223	Choosing Childbirth Act.
224	224	B. The purpose of the gr ants shall be to reimburse private
225	225	organizations in Oklahoma this state for the reasonable expenses of
226	226	programs providing the following services: listed in subsection C of
227	227	this section. The Department shall make grants either:
228	228	1. Directly to the private organizations;
229	229	2. To one or more grant-supervising entities , who shall
230	230	reimburse the private organizations ; or
231	231	3. Both directly to the private organizations and to one or
232	232	more grant-supervising entities , who shall reimburse the private
233	233	organizations.
234	234	C. Reimbursable services provided under the Choosing Childbirth
235	235	Act shall include:
236	236	1. Providing information on, referral to and a ssistance in
237	237	securing the services of re levant existing programs or agenc ies that
238	238	assist women in Oklahoma this state to carry their children to term,
239	239	and/or providing services that assist women to carry their children
240	240	to term including, but not limited to, agencies and programs that
241	241	will provide:

293	293	a. medical attention for the pregnant woman for the
294	294	duration of her pregnancy including, but not limited
295	295	to, obstetric ultrasounds,
296	296	b. mental health and substance abuse services,
297	297	c. nutritional support s ervices,
298	298	d. housing assistance,
299	299	e. transportation assistance,
300	300	f. adoption services,
301	301	g. education and employment assistance, and
302	302	h. parenting education and support services ;
303	303	2. Providing women in Oklahoma this state, in person and
304	304	through community outrea ch, information and/or services that
305	305	encourage and assist them to carry their children to term; and
306	306	3. Providing services including, but not limited to, healthcare
307	307	services to mothers and infants up to three (3) years postpartum for
308	308	the purpose of reducing the rates of maternal mortality and infant
309	309	mortality in this state by three pe rcent (3%) within five (5) years
310	310	of the effective date of this act not later than July 1, 2026;
311	311	provided, however, no funds shall be provided to an organi zation
312	312	that provides, or whose affiliates provide, abort ion services.
313	313	B. D. To be eligible for a service grant, an organization
314	314	shall:
315	315	1. Be registered with the Oklahoma Secretary of State as a not-
316	316	for-profit corporation located in Oklahoma;

368	368	2. Have the grant amount approved by a:
369	369	a. the grant-supervising entity, if the grant was
370	370	provided to the private organization by a grant-
371	371	supervising entity, or
372	372	b. the Department, if the grant was provided directly to
373	373	the private organization by the Department ;
374	374	3. For services described in paragraphs 1 and 2 of subsection A
375	375	C of this section, provide each pregnant w oman counseled with
376	376	accurate information on the develop mental characteristics of unborn
377	377	children including offering the printed information described i n
378	378	Section 1-738.3 of Title 63 of the Oklahoma Statutes this title;
379	379	4. Assure that the grant’s sole purposes are to assist and
380	380	encourage women to carry their children to term and to maximize
381	381	their potentials thereafter as provided in paragraphs 1 and 2 of
382	382	subsection C of this section or to reduce the rat es of maternal
383	383	mortality and infant mortality in this state as provided in
384	384	paragraph 3 of subsection A C of this section; and
385	385	5. Assure that none of th e funds provided pursuant to the
386	386	Choosing Childbirth Act, nor any other funds or services provided by
387	387	the organization, are used to encourage or c ounsel a woman to have
388	388	an abortion not necessary to prevent her death, to provide her such
389	389	an abortion or to refer her for such an abortion.
390	390	SECTION 3. AMENDATORY 63 O.S. 2021, Section 1 -740.18, is

443	443	Section 1-740.18. The State Department of Health shall make
444	444	grants to a grant-supervising entity under the Choosi ng Childbirth
445	445	Act from funds appropriated by the Legislature speci fically for this
446	446	purpose. The State Department of Health shall annually monitor and
447	447	review the any grant-supervising entity participating in the
448	448	Choosing Childbirth Act and any private organization directly
449	449	receiving a service grant from the Department to assure ensure that
450	450	the grant-supervising entity or private organization carefully
451	451	adheres to the purposes and requirements of the Choosin g Childbirth
452	452	Act, and it. The Department shall cease funding a grant-supervising
453	453	entity or private organization that fails to do so adhere to such
454	454	purposes and requirements if the Department proves specific findings
455	455	of noncompliance, subject to judicial r eview.
456	456	SECTION 4. This act shall become effective July 1, 202 4.
457	457	SECTION 5. It being immediately necessary for the preservation
458	458	of the public peace, health or safety, an emergency is hereb y
459	459	declared to exist, by reason whereof this act shall tak e effect and
460	460	be in full force from and after its passage and a pproval.
