37+An Act relating to alcoholic beverages; amending 37A
38+O.S. 2021, Section 6 -102, as last amended by Section
39+8, Chapter 338, O.S.L. 2023 (37A O .S. Supp. 2023,
40+Section 6-102), which relates to prohibited acts of
41+licensees; prohibiting the selling of alcoholic
42+beverages through an automated system; and providing
43+an effective date.

4447 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4548 SECTION 1. AMENDATORY 37A O.S. 2021, Section 6 -102, as
4649 last amended by Section 8, Chapter 338, O.S.L. 2023 (37A O.S. Supp.
4750 2023, Section 6-102), is amended to read as follows:
4851 Section 6-102. A. No licensee of the ABLE Commission shall:
4952 1. Receive, possess or sell any alcohol ic beverage except as
5053 authorized by the Oklahoma Alcoholic Beverage Control Act and by th e
5154 license or permit which the licensee holds;
5255 2. Employ any person under eighteen (18) years of age in the
5356 selling of beer or wine or employ any person under twenty-one (21)
5457 years of age in the selling of spirits. Provided:
5558 a. a mixed beverage, beer and wine, caterer, public
5659 event, special event, bottle club, retail wine or
5760 retail beer licensee may employ servers or sales
5861 clerks who are at least eighteen (18) years of age,

8589 except persons under twenty-one (21) years of age may
8690 not serve in designated bar o r lounge areas, and
8791 b. a mixed beverage, beer and wine, caterer, public
8892 event, special event or bottle club licensee may
8993 employ or hire musical bands who have musician s who
9094 are under eighteen (18) years of age if each such
9195 musician is either accompanied by a parent or legal
9296 guardian or has on their person, to be made available
9397 for inspection upon demand by any employee of the ABLE
9498 Commission or law enforcement officer, a written,
9599 notarized affidavit from the parent or legal guardian
96100 giving the underage musi cian permission to perform in
97101 designated bar or lounge areas;
98102 3. Give any alcoholic beverage as a prize, premium or
99103 consideration for any lottery, game of chance or s kill or any type
100104 of competition;
101105 4. Use any of the following means or inducements to sti mulate
102106 the consumption of alcoholic beverages, including but not limited
103107 to:
104108 a. deliver more than two drinks to one person at one
105109 time, except:
106110 (1) as provided for serving tasting flights defined
107111 in Section 6-102.1 of this title, or

134139 (2) up to six (6) bottles or cans of beer in the
135140 original packaging for on-premises consumption
136141 may be delivered to one person at one time in a
137142 reusable container, including but not limited to
138143 a bucket or insulated cooler which may be cooled
139144 by ice or another cooling method,
140145 b. sell or offer to sell to any person or group of
141146 persons any drinks at a price that is less than six
142147 percent (6%) below the markup of the cost to the mixed
143148 beverage licensee; provided, a mixed beverage licensee
144149 shall be permitted to offer these drink specials on
145150 any particular hour of any particular day and shall
146151 not be required to offer these drink specials for an
147152 entire calendar week or from open to close, and shall
148153 not be required to offer such drink specials at all
149154 venues operating under the same mixed beverage
150155 license; provided, a mixed beverage licensee selling
151156 wine, beer, or cocktails to-go shall be permitted to
152157 offer these to-go drinks at a different price than on-
153158 premises drinks,
154159 c. sell or offer to sell to any person an unlimited
155160 number of drinks during any set period of time for a
156161 fixed price, except at priv ate functions not open to
157162 the public,

184190 d. sell or offer to sell drinks to any person or group of
185191 persons on any one day or portion thereof at prices
186192 less than those charged the general public on that
187193 day, except at private functions not open to the
188194 public,
189195 e. increase the volume of alcoholic beverages contained
190196 in a drink without increasing proportionately the
191197 price regularly charged for such drink during the same
192198 calendar week, or
193199 f. encourage or permit, on the licensed premises, any
194200 game or contest which i nvolves drinking or the
195201 awarding of drinks as prizes.
196202 Provided, that the provisions of this paragraph shall not
197203 prohibit the advertising or offering of food, entertainment or
198204 bottle service in li censed establishments;
199205 5. Permit or allow any patron or person to exit the licensed
200206 premises with an open container of any alcoholic beverage.
201207 Provided, this prohibition shall not be applicable to closed
202208 original containers of alcoholic beverages which a re carried from
203209 the licensed premises of a bottle club by a p atron, closed original
204210 wine containers removed from the premises of restaurants, hotels and
205211 motels, or to closed original containers of alcoholic beverages
206212 transported to and from the place of bu siness of a licensed caterer
207213 by the caterer or an employee of th e caterer;

234241 6. Serve or sell alcoholic beverages with an expired license
235242 issued by the ABLE Commission;
236243 7. Permit any person to be drunk or intoxicated on the
237244 licensee’s licensed premises; or
238245 8. Permit or allow any patron to serve or pour himself or
239246 herself any alcoholic beverage, except a licensee may offer a patron
240247 self-pour service of beer or wine, or both, from automated devices
241248 on licensed premises so long as:
242249 a. the licensee monitors an d has the ability to control
243250 the dispensing of such beer or wine , or both, from the
244251 automated devices. “Automated device” shall mean any
245252 mechanized device capable of dispensing wine or beer,
246253 or both, directly to a patron in exchange for
247254 compensation that a licensee has received directly
248255 from the patron, and
249256 b. each licensee offering a patron self-pour service of
250257 wine or beer, or both, from any automated device shall
251258 provide constant video monitoring of the automated
252259 device at all times during which the lic ensee is open
253260 to the public. The licensee shall keep recorded
254261 footage from the video monitoring for at least sixty
255262 (60) days, and shall provide the footage, upon
256263 request, to any agent of the Director of the ABLE

285293 9. Permit or allow any customer to purchase alcoholic beverages
286294 for himself or herself through the use of an on-premises customer-
287295 operated, automated, or self-checkout machine.
288296 B. 1. The compensation required by subparagraph a o f paragraph
289297 8 of subsection A of this section shall be in the form of a radio
290298 frequency identification (RFID) device, mobile application or any
291299 other technology approved by the ABLE Commission containing a fixed
292300 amount of volume of thirty-two (32) ounces for beer and ten (10)
293301 ounces for wine that may be directly exchanged for beer or wine
294302 dispensed from the automated device:
295303 a. RFID devices may be assigned, used or reactivated only
296304 during a business day,
297305 b. each RFID device shall be obtained from the licens ee
298306 by a patron,
299307 c. a licensee shall not issue more than one active RFID
300308 device to a patron, and
301309 d. an RFID device shall be deemed active if the RFID
302310 device contains volume credit or has not yet been used
303311 to dispense ten (10) ounces of wine or thirty -two (32)
304312 ounces of beer.
305313 2. In order to obtain an RFID device from a licensee, each
306314 patron shall produce a valid driver license, identification card or

333342 other government-issued document that contains a photograph of the
334343 individual and demonstrates that the indiv idual is at least twenty-
335344 one (21) years of age. Each RFID device shall be programmed to
336345 require the production of the patron’s valid identification before
337346 the RFID device can be used for the first time during any business
338347 day or for any subsequent reactiv ation.
339348 3. Each RFID device shall become inactive at the end of each
340349 business day.
341350 4. Each RFID device shall be programmed to allow the dispensing
342351 of no more than ten (10) ounces of wine or thirty-two (32) ounces of
343352 beer to a patron:
344353 a. once an RFID device has been used to dispense ten (10)
345354 ounces of wine or thirty-two (32) ounces of beer to a
346355 patron, the RFID device shall become inactive, and
347356 b. any patron in possession of an inactive RFID device
348357 may, upon production of the patron’s valid
349358 identification to the licensee or licensee’s employee,
350359 have the RFID device reactivated to allow the
351360 dispensing of an additional ten (10) ounces of wine or
352361 thirty-two (32) ounces of beer from an automated
353362 device.
354363 Paragraphs 1, 2, 3 and 4 of this subsection shall not apply to wine
355364 or beer that is dispensed directly to the licensee or the licensee’s
356365 agent or employee.

383393 C. A mixed beverage or beer and wine licensee shall not be
384394 deemed to have violated the provisions of paragraph 5 of subsection
385395 A of this section if it allowed a patron to leave the licensed
386396 premises with an open container of beer or wine only and:
387397 1. The otherwise prohibited act was committed during the hours
388398 of 8 a.m. to midnight on the day of a scheduled home football game
389399 of institutions within The Oklahoma State System of Higher
390400 Education, and the establishment is located within two thousand
391401 (2,000) feet of the institution;
392402 2. The licensee is participating by invitation in a municipally
393403 sanctioned art, music or sporting event within city limits when the
394404 municipality has provided written notice of the event and a list of
395405 invited licensees to the ABLE Commission at least five (5) days
396406 prior to the event; or
397407 3. The patron remains on the connected, physical property of
398408 the licensee or in a public area adjacent to the physical property
399409 of the licensee with prior municipal approval; provided, that
400410 written notice of the use of the connected, physical property of the
401411 licensee or public area shall be provided to the ABLE Commission at
402412 least five (5) days prior to suc h use.
403413 SECTION 2. This act shall become effective Nove mber 1, 2024.
