6565 An Act relating to schools; prohibiting c ertain

8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new section of law to be codified
8383 in the Oklahoma Statutes as Section 16-130 of Title 70, unless there
8484 is created a duplication in numbering, reads as follows:
8585 A. No public school district, public charter school, or public
8686 school library shall maintain in its inventory or promote books that
8787 make as their primary subject the study of sex, sexual lifestyles,
8888 or sexual activity, or books that are of a predominantly sexual
8989 nature that a reasonable parent or legal guardian would want to know
9090 of or approve of prior to his or her child being exposed to it.

142142 B. 1. The parent or legal guardian of a student who believes a
143143 public school district, public charter school, or public school
144144 library is maintaining book(s) in violation of subsecti on A of this
145145 section may submit a written request to the school district
146146 superintendent or charter school administrator to remove the book(s)
147147 from the public school district, public charter schoo l, or public
148148 school library.
149149 2. Within thirty (30) days of receiving a written request to
150150 remove a book, the school district superintendent or charter school
151151 administrator shall either remove the book from the public school
152152 district, public charter sch ool, or public school library or submit
153153 to the parent or legal guardian a written explanation for denying
154154 the request.
155155 C. If a written request to remove a book is denied pursuant to
156156 paragraph 2 of subsection B of this section , a parent or legal
157157 guardian shall have a cause of action against a public school
158158 district or public charter school . If a court determines the book
159159 is of a nature that a reasonable parent or legal guardian would want
160160 to know of or approve of prior to his or her child being exposed to
161161 it, the court may grant injunctive relief by ordering the removal of
162162 the book from the public school dist rict, public charter school, or
163163 public school library.
164164 SECTION 2. This act shall become effective July 1, 2024.

216216 SECTION 3. It being immediately necessary for the preservation
217217 of the public peace, health , or safety, an emergency is hereby
218218 declared to exist, by reason whereof thi s act shall take effect and
219219 be in full force from and after its passage and approval.
