45101 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1 -159, is

56108 SECTION 2. AMENDATORY 47 O.S. 2021, Section 11-203, is
57109 amended to read as follows:

59110 Section 11-203. Whenever special pedestrian-control signals
60111 exhibiting the words “Walk” or “Wait” a flashing “Don’t Walk” or
61112 “Don’t Walk” the WALKING PERSON or UPRAISED HAND symbols are in
62113 place, such signals shall indicate as follows:

64114 1. Walk. Pedestrians facing such signal ma y proceed across the
65115 roadway in the direction of the signal and shall be given the right
66116 of way right-of-way in the direction of the signal by the dr ivers of
67117 all vehicles.;

69118 2. Wait or Flashing Don’t Walk or flashing UPRAISED HAND . No
70119 pedestrian shall sta rt to cross the roadway in the direction of such
71120 signal, but any pedestrian who has partially completed his or her

104170 1. A vehicle shall be driven as nearly as prac ticable entirely

109201 then given a signal, not less than the last o ne hundred (100) feet
110202 traveled by the vehicle, of his or her intention to change lanes .;

112203 3. Upon a roadway which is divided into three lanes, a vehicle
113204 shall not be driven in the center lane except when overtaking and
114205 passing another vehicle where the roa dway is clearly visible and the
115206 center lane is clear of traffic within a safe distance, or in
116207 preparation for a left turn or where the center lane is at the time
117208 allocated exclusively to traffic moving in the direction the vehicle
118209 is proceeding and is sign posted to give notice of the allocation.

120210 4. A two-way left-turn lane is a lane near the center of the
121211 highway set aside for use by vehicles making left turns in both
122212 directions from or into the roadway. Two -way left-turn lanes shall
123213 be designated by dist inctive roadway markings consisting of parallel
124214 double yellow lines, interior line dashed and exterior line solid,
125215 on each side of the lane. A vehicle shall not be driven in a
126216 designated two-way left-turn lane except when preparing for or
127217 making a left turn from or into a roadway. Vehicles turning left
128218 from the roadway shall not be driven in the two -way left-turn lane
129219 for more than two hundred (200) feet while preparing for and making
130220 the turn. A vehicle turning left onto the roadway may utilize the
131221 two-way left-turn lane as a staging area by stopping and waiting for
132222 traffic proceeding in the same direction t o clear before merging
133223 into the adjacent lanes of travel. A left turn shall not be made
134224 from any other lane where a two -way left-turn lane has been

138253 driving across a two -way left-turn lane when moving from a service
139254 drive onto such marked roadway .;

141255 5. 4. A vehicle shall not be driven in the left lane of a
142256 roadway except when overtaking an d passing another vehicle;
143257 provided, however, this paragraph shall not prohibit driving in the
144258 left lane when traffic conditions, flow or road configuration, such
145259 as the potential of merging traffic, require requires the use of the
146260 left lane to maintain sa fe traffic conditions; provided further,
147261 this paragraph shall not prohibit driving in the left lane of a
148262 roadway within the city limits of a municipality or upon a county
149263 road as long as such roadway is not part of the National System of
150264 Interstate and Defense Highways or a turnpike .; and

152265 6. 5. Official signs may be erected directing slow -moving
153266 traffic to use a designated lane or designating those lanes to be
154267 used by traffic moving in a particular direction regardless of the
155268 center of the roadway, and dri vers of vehicles shall obey the
156269 directions of every such sign.

158270 Any person convicted of violating any provis ion of this section
159271 shall be punished as provided for in Section 17 -101 of this title.

161272 SECTION 5. AMENDATORY 47 O.S. 2021, Section 11-803, is
162273 amended to read as fol lows:

164274 Section 11-803. A. Whenever local authorities in their

166303 and traffic investigation that the maximum speed permitted under
167304 this article is greater or less than is reasonable and safe under
168305 the conditions found to exist upon a highway or part of a highwa y,
169306 the local authority may determine and declare a reasonable and safe
170307 maximum limit thereon which:

172308 1. Decreases the limit at intersections; or
173-
174309 2. Increases the limit within an urban dis trict, but not to
175310 more than sixty-five (65) miles per hour; or
176-
177311 3. Decreases the limit outside an urban district, but not to
178312 less than thirty (30) miles per hour.

182313 B. Local authorities in their respective jurisdiction s shall
183314 determine by an engineering and traffic investigation the proper
184315 maximum speed for all arterial str eets and shall declare a
185316 reasonable and safe maximum limit thereon which may be greater or
186317 less than the maximum speed permitted under Section 1 -101 et seq. of
187318 this title for an urban dist rict.

189319 C. Any altered limit established as hereinabove authorized
190320 shall be effective at all times or during hours of darkness or at
191321 other times as may be determined when appropriate signs giving
192322 notice thereof are ere cted upon such street or highway.

194323 D. As to streets and highways within the corporate limits which
195324 have been constructed or reconstructed with state or federal funds
196325 are maintained by the Department of Transportation , local
197326 authorities shall have joint aut hority with the Transportation

198354 Commission to establish or alter speed limits; provided, however,
199355 the speed limit on an interstate highway within such corporate
200356 limits shall not be decreased to less than sixty (60) miles per
201357 hour; and provided further, that no local authority shall impose
202358 speed limits on any such street or highway substantially lower than
203359 those justified by the highway design, capacity, and traffic volume
204360 as determined by engineering studies.

206361 E. Not more than six such alterations as hereina bove authorized
207362 shall be made per mile along a street or highway except in the case
208363 of reduced limits at in tersections, and the difference between
209364 adjacent limits shall not be more than ten (10) miles per hour.

211365 SECTION 6. AMENDATORY 69 O.S. 2021, Section 241, is
212366 amended to read as follows:

214367 Section 241. The portion of the roadway conti guous with the
215368 traveled way for accommodation of stopped vehicles, for emergency
216369 use, for travel under certain conditions, and for lateral support of
217370 base and surface courses.

219371 SECTION 7. AMENDATORY 69 O.S. 2021, Section 242, is
220372 amended to read as follows:

229404 SECTION 8. AMENDATORY 69 O.S. 2021, Section 301, is
230405 amended to read as follows:

232406 Section 301. (a) A. There is hereby created a Depart ment of
233407 Highways Transportation and a State Highway Transportation
234408 Commission in and for the State of Oklahoma this state, pursuant to
235409 the provisions of Section 1 , of Article 16, XVI of the Oklahoma
236410 Constitution of the State of Oklahoma , and such departmen t shall be
237411 governed by the State Highway Director of the Department of
238412 Transportation, provided for by Sect ion 305 of this Code title,
239413 under such reasonable rules, regulations and policies and road
240414 improvement programs as may be prescribed by the Commissio n. Such
241415 rules and regulations and amen dments thereto as adopted by the
242416 Commission shall be filed and recor ded in the office Office of the
243417 Secretary of State.

245418 (b) B. The Department and the Commission created by the
246419 preceding paragraph subsection A of this section and the State
247420 Highway Director of the Department of Transportation provided for by
248421 Section 305 of this Code title shall be the legal successors of, and
249422 unless and except as otherwise provided by this Code title shall
250423 also have the powers and dutie s vested by other laws in, and shall
251424 take immediate charge of all equipment, supplies and property now in
252425 the possession of, the Department, Commission and Director,
253426 respectively, created and provided for by 69 O.S. 1961, Sections
