8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new section of law to be codified
8383 in the Oklahoma Statutes as Section 37-129 of Title 11, unless there
8484 is created a duplication in numbering, reads as follows:
8585 A. As used in this section , “unauthorized camp” means any tent,
8686 shelter, or bedding constructed or arranged for the purpose of, or
8787 in such a way to permit, overnight use on a property not designated
8888 as a campsite without the permission of the property holder.
8989 B. A municipality shall have fourteen (14) days following a
9090 report of an unauthorized camp to the political subdivison to

142142 conduct an inspection of such camp within a municipal district that
143143 has water run-off entering a municipal sewer system , drainage
144144 system, or drinking water reservoir . The inspection shall determine
145145 whether the unauthorized camp is up to building codes establ ished by
146146 the Oklahoma Uniform Building Code Commission. If the inspected
147147 unauthorized camp is determined to be out of compliance with
148148 building codes, the inspector shall inform any inhabita nts with
149149 written notice that describes any code violations and provides any
150150 other information deemed necessary by the inspector . If an
151151 inspected unauthorized camp does not meet applicable building codes
152152 fourteen (14) days after notice was provided, the municipality shall
153153 remove any structure or accumulated property at the unauthorized
154154 camp. Any removed property shall be available for claim by affected
155155 persons for ten (10) days after removal. Any unclaimed property
156156 shall be disposed of after ten (10) days have elapsed.
157157 C. Any municipality that fails to inspect an unauthorized camp
158158 within a municipal district that has water run-off entering a
159159 municipal sewer system, drainage system, or drinking water reservoir
160160 within the fourteen (14) days after the credible report of an
161161 unauthorized camp, or that fails to remove an inspected unauthorized
162162 camp determined to not be up to building codes established by the
163163 Oklahoma Uniform Building Code Commission fourteen (14) days after
164164 notice was provided, shall be liable for any water borne
165165 contamination or disease that results from the presence of an

217217 unauthorized camp. Determination that a waterborne contamination or
218218 disease originated from the presence of an unauthorized camp shall
219219 be made by a court of law. Any person affected by any water borne
220220 contamination or disease determined to result from the presence of
221221 an unauthorized camp shall be awarded up to Ten Thousand Dollars
222222 ($10,000.00) from the municipality.
223223 SECTION 2. This act shall become effective November 1, 2024.
