78	131		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

80	132		SECTION 1. AMENDATORY 59 O.S. 2021, Section 328.3, as
81	133		amended by Section 1, Chapter 220, O.S.L. 2023 (59 O.S. Supp. 2023,
82	134		Section 328.3), is amended to read as follows:
83		-
84	135		Section 328.3. As used in the State Dental Act, the following
85	136		words, phrases, or terms, unless the context otherwise indicates,
86	137		shall have the following meanings:
87		-
88	138		1. “Accredited dental college ” means an institution whose
89	139		dental educational program is accre dited by the Commission on Dental
90	140		Accreditation of the American Dental Association;

94	168		2. “Accredited dental hygiene program ” means a dental hygiene
95	169		educational program which is accredited by the Commission on Dental
96	170		Accreditation of the American Dental Association;

98	171		3. “Accredited dental assisting program or class” means a
99	172		dental assisting program which is accredited by the Commissio n on
100	173		Dental Accreditation of the American Dental Association or a class
101	174		approved by the Board of Dentistr y;

103	175		4. “Advanced procedure” means a dental procedure for which a
104	176		dental hygienist has received special training in a course of study
105	177		approved by the Board;

107	178		5. “Board” means the Board of Dentistry;

109	179		6. “Certified dental assistant ” means a dental assistant who
110	180		has earned and maintains current certified dental assistant
111	181		certification from the Dental Assisting National Board (DANB);
112		-
113	182		7. “Coronal polishing” means a procedure limited to the removal
114	183		of plaque and stain from exposed tooth surfaces, utilizing a slo w
115	184		speed hand piece wit h a prophy/polishing cup or brush and polishing
116	185		agent and is not prophylaxis. To be considered prophylaxis,
117	186		examination for calc ulus and scaling must be done by a dental
118	187		hygienist or dentist;

120	188		8. “Deep sedation” means a drug-induced depression of
121	189		consciousness during which patients cannot be easily aroused but
122	190		respond purposefully following repeated or painful stimulation. The
123	191		ability to independently maintain ventilator function may be

128	222		9. “Dentistry” means the practice of dentistry in all of its
129	223		branches;

131	224		10. “Dentist” means a graduate of an accredited dental colle ge
132	225		who has been issued a license by the Board to practice dentistry as
133	226		defined in Section 328.19 of this title;

137	227		11. “Dental ambulatory surgical center (DASC)” means a facility
138	228		that operates exclusively for the purpose of furnishing outpatient
139	229		surgical services to patients. A DASC shall have the same
140	230		privileges and requirements as a dental office and additionally must
141	231		be an accredited facility by the ap propriate entity;

143	232		12. “Dental office” means an establishment owned and operated
144	233		by a dentist for the pra ctice of dentistry, which may be composed of
145	234		reception rooms, business offices, private offices, laboratories,
146	235		and dental operating rooms where dental operations are performed;
147		-
148	236		13. “Dental hygiene” means the science and practice of the
149	237		promotion of oral health and prevention a nd treatment of oral
150	238		disease through the provision of educational, therapeutic, clinical,
151	239		and preventive services;

153	240		14. “Dental hygienist” means an individual who has fulfilled
154	241		the educational requirements and is a graduate of an accr edited
155	242		dental hygiene program and who has passed an examination and has

157	271		dental hygiene as hereinafter defined in this section;

159	272		15. “Dental assistant” or “oral maxillofacial surgery
160	273		assistant” means an individual working for a dentist, under the
161	274		dentist’s direct supervision or direct visual supervision, and
162	275		performing duties in the dent al office or a treatment facility
163	276		including the limited treatment of patients in accordance with the
164	277		provisions of the State Dental Act. A dental assistant or oral
165	278		maxillofacial surgery assistant may assist a dentist with the
166	279		patient; provided, this shall be done only under the direct
167	280		supervision or direct visual supervision and control of the dentist
168	281		and only in accordance with the educational requirements and rules
169	282		promulgated by the Board;

171	283		16. “Dental laboratory” means a location, whether in a dental
172	284		office or not, where a dentist or a dental laboratory technician
173	285		performs dental laboratory technology;

175	286		17. “Dental laboratory technician ” means an individual whose
176	287		name is duly filed in the official records of the Board, which
177	288		authorizes the technician, u pon the laboratory prescription of a
178	289		dentist, to perform dental laboratory technology, which services

181	290		must be rendered only to the prescribing dentist and not to the
182	291		public;

184	292		18. “Dental laboratory technology ” means using materials and
185	293		mechanical devices f or the construction, reproduction or repair of

189	323		19. “Dental specialty” means a specialized practice of a branch
190	324		of dentistry, recognized by the Board, where the dental college an d
191	325		specialty program are accredited by the Commission on Dental
192	326		Accreditation (CODA), or a dental specialt y recognized by the Bo ard,
193	327		requiring a minimum number of hours of approved education and
194	328		training and/or recognition by a nationally recognized associa tion
195	329		or accreditation board;
196		-
197	330		20. “Direct supervision” means the supervisory dentist is in
198	331		the dental office or treatment facility and, during the appointment,
199	332		personally examines the patient, diagnoses any conditions to be
200	333		treated, and authorizes the proc edures to be performed by a dental
201	334		hygienist, dental assistant, or oral maxillofacial surgery
202	335		assistant. The supervising denti st is continuously on -site and
203	336		physically present in the dental office or treatment facility while
204	337		the procedures are being perfo rmed and, before dismissal of the
205	338		patient, evaluates the results of the dental treatment;

207	339		21. “Direct visual supervision” means the supervisory dentist
208	340		has direct ongoing visual oversight which shall be maintained at all
209	341		times during any procedure authori zed to be performed by a dental
210	342		assistant or an oral maxillofacial surgery assistant;

212	370		22. “Expanded duty” means a dental proce dure for which a dental
213	371		assistant has received special training in a course of study
214	372		approved by the Board;

216	373		23. “Fellowship” means a program designed for post -residency
217	374		graduates to gain knowledge and experience in a specialized fiel d;
218		-
219	375		24. “General anesthesia” means a drug-induced loss of
220	376		consciousness during which patients are not arousable, even by
221	377		painful stimulation. The abil ity to independently maintain
222	378		ventilator function is often impaired. Patients often require
223		-

225	379		assistance in maintaining a patent airway, and positive pressure
226	380		ventilation may be required because of depressed spontaneous
227	381		ventilation or drug-induced depression of neuromuscular function.
228	382		Cardiovascular function may be impaired;

230	383		25. “General supervision” means the supervisory dentist has
231	384		diagnosed any conditions to be treated within the past thirteen (13)
232	385		months, has personally authorized the procedures to be performed by
233	386		a dental hygienist, and will evaluate the results of the dental
234	387		treatment within a reasonabl e time as determined b y the nature of
235	388		the procedures performed, the needs of the patient, and the
236	389		professional judgment of the supervisory dentist. Ge neral
237	390		supervision may only be used to supervise a dental hygienist and may
238	391		not be used to supervise an or al maxillofacial surgery assistant or
239	392		dental assistant except as provided by Section 7 328.58 of this act

242	421		26. “Indirect supervision ” means the supervisory dentist is in
243	422		the dental office or treatment facility and has personally diagnosed
244	423		any conditions to be treated, au thorizes the procedures to be
245	424		performed by a dental hygienist, remains in the dental office or
246	425		treatment facility while the proce dures are being performed, and
247	426		will evaluate the results of the dental treatment within a
248	427		reasonable time as determined by the nature of the procedures
249	428		performed, the needs of the patient, and the professional judgment
250	429		of the supervisory dentist. Indirect supervision may not be used
251	430		for an oral maxillofacial surgery assistant or a dental assistant;

253	431		27. “Investigations” means an investigation proceeding,
254	432		authorized under Sections 328.15A and 328.43a of this title, to
255	433		investigate alleged violations of the S tate Dental Act or the rules
256	434		of the Board;

258	435		28. “Laboratory prescription ” means a written description,
259	436		dated and signed by a dentist, of dental laboratory technology to be
260	437		performed by a dental laboratory technician;
261		-
262	438		29. “Minimal sedation” means a minimally depressed level of
263	439		consciousness, produced by a pharmacological method, that retains
264	440		the patient’s ability to independently and continuously maintain an
265	441		airway and respond normally to tactile stimulation and verbal
266	442		command. Although cognitive function and coordination may be

269	443		modestly impaired, ventilator and cardiovascular functions are
270	444		unaffected;

272	472		30. “Mobile dental anesthesia provider ” means a licensed and
273	473		anesthesia-permitted dentist, physician or Certified Registered
274	474		Nurse Anesthetist (CRNA) that h as a mobile dental unit and provides
275	475		anesthesia in dental offices and facilities in the state;
276		-
277	476		31. “Mobile dental clinic” means a permitted motor vehicle or
278	477		trailer utilized as a dental clinic, and/or that contains dental
279	478		equipment and is used to provide dental services to patients on -site
280	479		and shall not include a mobile dental anesthesia provider. A mobile
281	480		dental clinic shall also mean and include a volunteer mobile dental
282	481		facility that is directly affiliated with a church or religious
283	482		organization as defined by Section 501(c)(3) or 501(d) of the United
284	483		States Internal Revenue Code, the church or religious o rganization
285	484		with which it is affiliated is clearly indicated on the exterior of
286	485		the volunteer mobile dental facility, and such facility does not
287	486		receive any form of payment either directly or indirectly for work
288	487		provided to patients other than donations th rough the affiliated
289	488		church or religious organization; provided, that the volunteer
290	489		mobile dental facility shall be exempt from any registration fee
291	490		required under the State Dental Act;
292		-
293	491		32. “Moderate sedation” means a drug-induced depression of
294	492		consciousness during which patie nts respond purposefully to verbal
295	493		commands, either alone or accompanied by light tactile stimulation.

302	526		and subgingival surfaces of human teeth, utilizing instrumentation
303	527		by scaler or periodontal curette on the c rown and root surfaces of
304	528		human teeth including rotary or power -driven instruments. This
305	529		procedure may only be performed by a dentist or dental hygien ist;

307	530		34. “Patient” or “patient of record” means an individual who
308	531		has given a medical history and has be en examined and accepted by a
309	532		dentist for dental care;

313	533		35. “Residencies” are programs designed for advanced clinical
314	534		and didactic training in general dentistry or other specialties or
315	535		other specialists at the post -doctoral level recognized by the
316	536		Commission on Dental Accredita tion (CODA) or the Board;

318	537		36. “Supervision” means direct supervision, direct visual
319	538		supervision, indirect supervision or general supervision;

321	539		37. “Teledentistry” means the remote delivery of dental patient
322	540		care via telecommunication s and other technology for the exchange of
323	541		clinical information and images for dental consultation, preliminary
324	542		treatment planning and patient monitori ng; and

326	543		38. “Treatment facility” means:

328	544		a. a federal, tribal, state or local public health

359	588		SECTION 2. AMENDATORY 59 O.S. 2021, Section 328.15, as
360	589		amended by Section 1, Chapter 158, O.S.L. 20 22 (59 O.S. Supp. 2023,
361	590		Section 328.15), is amended to read as follows:

363	591		Section 328.15. A. Pursuant to and in compliance with Article
364	592		I of the Administrative Procedures Act, the Board of Dentistry shall
365	593		have the power to formulate, adopt, and promulgate rules as may be
366	594		necessary to regulate the practice of dentistry in this state and to
367	595		implement and enforce the provisions of the State Dental Act.

369	596		B. The Board is authorized and empowered to:

374	626		2. Affiliate by contract or cooperative agreement with another
375	627		state or combination of states for the purpos e of conducting
376	628		simultaneous regional examinations of applicants for a license to
377	629		practice dentistry, den tal hygiene, or a dent al specialty;

379	630		3. Maintain a list of the name, current mailing address and
380	631		official address of all persons who hold a license or permit issued
381	632		by the Board;

383	633		4. Account for all receipts and expenditures of the monies of
384	634		the Board including annually preparing and publishing a statement of
385	635		receipts and expenditures of the Board for each fiscal year;

387	636		5. Within limits prescribed in the State Dental Act, set all
388	637		fees and administrative penalties to be imposed and collected by the
389	638		Board as provided by rules;

391	639		6. Employ an Executive Director, legal counsel and other
392	640		advisors to the Board including advisory committees;

640	1033		advanced procedure of therapeutic use of lasers upon submission of

643	1035		4. All advanced procedures shall be added to the dental hygiene
644	1036		license upon approval.

646	1037		J. All licensees and permit holders shall display the current
647	1038		permit or license in a visible place with in the dental office or
648	1039		treatment facility.

650	1040		K. The Board shall have the authority to temporarily change
651	1041		requirements of an examination due to availabi lity or changes in the
652	1042		examination format, not to exceed one (1) year.

654	1043		L. During a year in which governm ental officials have d eclared
655	1044		a health pandemic, a state or federal disaster, or other natural or
656	1045		man-made disaster, the Board shall have the authority through a
657	1046		resolution to change or make allowances in requirements of all

715	1145		requirements to be eligible for a special volunteer license:

736	1190		and indigent persons in this state;

738	1191		4. Acknowledgement and documentation that the dentist or dental
739	1192		hygienist will not receive or have the expectation to receive any
740	1193		payment or compensation, either direct or indirect, for any dental
741	1194		services rendered under the special volunteer license; and

743	1195		5. A listing of all locations and dates that the person will be
744	1196		completing volunteer work under the special volunteer license.

748	1197		C. D. The Board of Dentistry shall have jurisdiction over
749	1198		dentists, dental hygienists, dental assistants and dental
750	1199		technicians who volunteer their professional services in the state.

754	1202		D. E. Dental assistants may be issued a volunteer permit at the
755	1203		request of an entity that provides dental services to the needy.

766	1241		dental assistant permits sha ll be limited to specific dates and
767	1242		locations of services to be provided.

769	1243		E. F. All persons providing care shall do so under the
770	1244		provisions specified in Section 328.1 et seq. of this title or rules
771	1245		promulgated by the Board. Only tho se functions authorized by law or
772	1246		administrative rule shall be performed by the named person approved
773	1247		by the Board.

775	1248		F. G. Volunteers shall not use sed ation or general anesthesia
776	1249		during volunteer procedures.

778	1250		G. H. Volunteers shall use a form to be provide d by the Board
779	1251		for any patient with clear instructions for any and all follow -up

798	1291		SECTION 5. AMENDATORY 59 O.S. 2021, Se ction 328.24, as
799	1292		amended by Section 4, Chapter 220, O.S.L. 2023 (59 O.S. Supp. 2023,
800	1293		Section 328.24), is amended to read as follows:

802	1294		Section 328.24. A. No person shall practice as a dental
803	1295		assistant or oral maxillofacial surgery assistant for more than o ne
804	1296		(1) day in a calendar year without having applied for a permit as a
805	1297		dental assistant or oral maxillofacial surgery assistant from the
806	1298		Board of Dentistry within thirty (30) days of beginning employment.
807	1299		During this time period, the dental assistant shal l work under the
808	1300		direct visual supervision of a dentist at all times.

810	1301		B. The application shall be made to the Board in writing and
811	1302		shall be accompanied by the fee established by the Board, together
812	1303		with satisfactory proof that the applicant passes a backg round check
813	1304		with criteria established by the Board.

815	1305		C. Beginning January 1, 2020, every dental assistant receiving
816	1306		a permit shall complete a class on infection control as approved by

827	1343		on Dental Accreditation (CODA) or a course tha t has been approved by
828	1344		the Board:

830	1345		1. Radiation safety;

832	1346		2. Coronal polishing and topical fluoride;

860	1390		from a dental assisting program accredited by CODA and has passed
861	1391		the jurisprudence test examination shall receive all expanded duty
862	1392		permits provided for in subsection D of this section if the course
863	1393		materials approved by the Board are covered in the program.

865	1394		G. A dental assistant who holds an out -of-state dental
866	1395		assistant permit with expanded dut ies may apply for credentialing
867	1396		and reciprocity for a dental assistant permit including any expanded
868	1397		duty by demonstrating the following:

870	1398		1. The dental assistant has had a valid dental assistant permit
871	1399		in another state for a minimum of two (2) years and i s in good
872	1400		standing;

874	1401		2. The dental assistant has had a valid expanded duty in
875	1402		another state for a minimum of one (1) year; and

898	1445		SECTION 6. AMENDATORY 59 O.S. 202 1, Section 328.31b, is

901	1447		Section 328.31b. A. Every dental office or treatment facility,
902	1448		whether individual, group or multi -doctor practice operating under a
903	1449		name, trade name or other professional entity shall maintain written
904	1450		records on each patient treated at the facility and shall make these
905	1451		records available to the Board of Dentistry and other regulatory
906	1452		entities or be subject to the penalties as set forth in Section
907	1453		328.44a of this title.

909	1454		B. Each licensed dentist shall maint ain written records on each
910	1455		patient that shall contain, at a minimum, the following information

931	1496		C. Whenever patient records a re released or transfe rred, the
932	1497		dentist releasing or transferring the records shall maintain either
933	1498		the original records or copies thereof and a notati on shall be made
934	1499		in the retained records indicating to whom the records were released
935	1500		or transferred.

937	1501		D. All claims being submitted for insurance must be signed,
938	1502		stamped or have an electronic signature by the treating dentist.

940	1503		E. Patient records may be k ept in an electronic data format,
941	1504		provided that the dentist maintains a backup copy of information
942	1505		stored in the data processin g system using disk, tape or other
943	1506		electronic back-up system and that backup is updated on a regular
944	1507		basis, at least weekly, to a ssure that data is not lost due to
945	1508		system failure. Any electronic data system shall be capable of
946	1509		producing a hard copy on demand.

1339	2155		the license or permit will be officially cancele d as of April 1
1340	2156		pursuant to subsection M of Section 328.21 of this title. A list of
1341	2157		canceled licenses or permits not otherwise renewed shall be
1342	2158		published at the following meeting of the Board.

1344	2159		F. Any dentist, dental hygienist, dental assistant or oral
1345	2160		maxillofacial surgery as sistant whose license or permit is
1346	2161		automatically canceled by reason of failure, neglect or refusal to
1347	2162		secure the renewal certific ate may be reinstated by the Board at any
1348	2163		time within one (1) year from the date of the expiration of the
1349	2164		license, upon payment of the annual renewal fee and a penalty fee
1350	2165		established by the rules of the Board. If the dentist, dental
1351	2166		hygienist, dental ass istant, or oral maxillofacial surgery assistant
1352	2167		does not apply for renewal of the license or permit and p ay the

1369	2207		thereof, the Board may issue a duplicate, charging therefor a fee

1372	2209		I. A dentist, dental hygienist, oral maxillofacial surgery
1373	2210		assistant or dental assistant that is in good standing and not under
1374	2211		investigation that notifies the Board in writing of a voluntary
1375	2212		nonrenewal of license or r equests retirement sta tus shall have a
1376	2213		right to renew or reinstate his or her license within five (5) years
1377	2214		from the date of notice. The Board may req uire any training or
1378	2215		continuing education requirements to be met prior to reinstatement.

1381	2217		assistant or dental assistant that has not had an active license or
1382	2218		permit in excess of five (5) years shall be required to apply as a

1551	2507		Entity Act or the State Dental Act has committed any of the acts or
1552	2508		occurrences set forth in Sections 328.29, 328.29a, 32 8.32, 328.33,
1553	2509		328.39 and 328.39a of this title prohibited by the State Dental Act

1556	2511		1. Refusal to issue a license or permit, or a renewal thereof,
1557	2512		provided for in the State Dental Act;

1559	2513		2. Suspension of a license or permit issued by t he Board for a
1560	2514		period of time deemed appropriate by the Board;

1562	2515		3. Revocation of a license or permit issu ed by the Board;

1564	2516		4. Imposition of an administrative penalty not to exceed One
1565	2517		Thousand Five Hundred Dollars ($1,500.00) per violation;

1569	2519		6. Placement on probation for a period of time and under such
1570	2520		terms and conditions as deemed appropriate by the Bo ard;

1585	2557		provisions of this section, shall have the right to seek a judicial
1586	2558		review of such order pursuant to Article II of the Administrat ive
1587	2559		Procedures Act.

1589	2560		C. The Board may issue a summary suspension on a licensee or
1590	2561		permit holder who is fo und guilty of a felony charge and is
1591	2562		sentenced to incarceration in a state or federal facility.

1593	2563		D. 1. A licensee or permit holder may petition the Bo ard to
1594	2564		reopen and withdraw an order after the expiration of seven (7) years
1595	2565		from the date of issue if:

1597	2566		a. the order does not in clude allegations or a finding of
1598	2567		direct patient harm,
1599		-
1600	2568		b. the licensee has maintained an active full -time
1601	2569		practice in good standi ng and has not received an
1602	2570		additional order or private reprimand since the issue
1603	2571		of the order,

1605	2572		c. the licensee has not been the subject of any
1606	2573		settlement reports in the National Practitioner Data
1607	2574		Bank within the previous seven (7) years, and

1609	2575		d. the order concerns an administrative violation and

1614	2606		2. Upon receipt of a motion to reopen and withdraw an order,
1615	2607		the president of the Board sh all assign a panel for review and
1616	2608		investigation to be brought to the Board. The Board shall take into
1617	2609		consideration the issues causing the order; any changes to laws
1618	2610		relevant to the order since its issue that may have resulted in a

1621	2611		different outcome if su ch laws had been in place at the time of the
1622	2612		complaint; any actions by the licensee to better his or her
1623	2613		abilities as a practic ing licensee; current patient outcomes;
1624	2614		service to his or her community or state; and any other issues,
1625	2615		testimony, or other infor mation relating to the licensee found
1626	2616		during an investigation or submitted to the Board.

1628	2617		3. The panel and the president may make a determination that
1629	2618		the case is not appropriate to bring before the Board and shall have
1630	2619		the authority to summarily deny the order and, if appropriate, to
1631	2620		advise the licensee of requirements to complete for future
1632	2621		consideration. The panel may choose t o keep the matter pending
1633	2622		while the licensee completes the requirements advised.

1635	2623		4. Upon a case brought before the Board, the Bo ard shall vote
1636	2624		to withdraw or stay the order. If the order is withdrawn, it shall
1637	2625		revert to a private se ttlement agreement pursuant to Section 328.43a
1638	2626		of this title.

1643	2656		Section 328.44b. A. A holder of a license, a permit, or
1644	2657		certificate granted by the Board of Dentistry shall have the right
1645	2658		to surrender the license, permit, or certificate, in writing,
1646	2659		notarized, to the Board if the holder is in good standing with the
1647	2660		Board as determined, in its discretion, by the Board. The Board
1648	2661		shall accept such sur render in writing after approval at a regular
1649	2662		or special Board meeting with the statement that the holder is in
1650	2663		good standing with the Board. Any hold er who has surrendered a
1651	2664		license, permit, or certificate issued by the Board and who shall
1652	2665		apply for a license, permit, or cert ificate after surrender shall be
1653	2666		subject to all statutes and rules of the Board applicable at the
1654	2667		time of the new application.

1656	2668		B. A holder of a license, permit, or certificate shall not be
1657	2669		considered to be in good standing if an inve stigation of a complaint
1658	2670		is pending against the holder. The Board shall not accept a
1659	2671		surrender until a complaint is dismissed by the review panel, a
1660	2672		settlement agreement an agreed order or agreed order of surrender is
1661	2673		entered, or the Board determines that an individual proceed ing shall
1662	2674		be initiated pursuant to Section 328.43a of this title.

1667	2676		surrender the license, permit, or certificate during the pendency of

1678	2713		license, permit, or certificate for all disciplinary matters pending
1679	2714		at the time surrender is sought by the holder or o ver any person
1680	2715		that does not renew his or her license while an investigation is
1681	2716		pending.

1683	2717		E. All surrenders of licenses, permit s, or certificates,
1684	2718		whether the holder is or is not in good standing, shall be reported
1685	2719		to the national practitioner data bank National Practitioner Data
1686	2720		Bank with the notation in good standing or pending disciplinary
1687	2721		action.

1689	2722		SECTION 12. This act shall become effective November 1, 2024.
