80132 SECTION 1. AMENDATORY 59 O.S. 2021, Section 328.3, as
81133 amended by Section 1, Chapter 220, O.S.L. 2023 (59 O.S. Supp. 2023,
82134 Section 328.3), is amended to read as follows:

84135 Section 328.3. As used in the State Dental Act, the following
85136 words, phrases, or terms, unless the context otherwise indicates,
86137 shall have the following meanings:

88138 1. “Accredited dental college ” means an institution whose
89139 dental educational program is accre dited by the Commission on Dental
90140 Accreditation of the American Dental Association;

94168 2. “Accredited dental hygiene program ” means a dental hygiene
95169 educational program which is accredited by the Commission on Dental
96170 Accreditation of the American Dental Association;

98171 3. “Accredited dental assisting program or class” means a
99172 dental assisting program which is accredited by the Commissio n on
100173 Dental Accreditation of the American Dental Association or a class
101174 approved by the Board of Dentistr y;

103175 4. “Advanced procedure” means a dental procedure for which a
104176 dental hygienist has received special training in a course of study
105177 approved by the Board;

107178 5. “Board” means the Board of Dentistry;

109179 6. “Certified dental assistant ” means a dental assistant who
110180 has earned and maintains current certified dental assistant
111181 certification from the Dental Assisting National Board (DANB);

113182 7. “Coronal polishing” means a procedure limited to the removal
114183 of plaque and stain from exposed tooth surfaces, utilizing a slo w
115184 speed hand piece wit h a prophy/polishing cup or brush and polishing
116185 agent and is not prophylaxis. To be considered prophylaxis,
117186 examination for calc ulus and scaling must be done by a dental
118187 hygienist or dentist;

120188 8. “Deep sedation” means a drug-induced depression of
121189 consciousness during which patients cannot be easily aroused but
122190 respond purposefully following repeated or painful stimulation. The
123191 ability to independently maintain ventilator function may be

128222 9. “Dentistry” means the practice of dentistry in all of its

131224 10. “Dentist” means a graduate of an accredited dental colle ge
132225 who has been issued a license by the Board to practice dentistry as
133226 defined in Section 328.19 of this title;

137227 11. “Dental ambulatory surgical center (DASC)” means a facility
138228 that operates exclusively for the purpose of furnishing outpatient
139229 surgical services to patients. A DASC shall have the same
140230 privileges and requirements as a dental office and additionally must
141231 be an accredited facility by the ap propriate entity;

143232 12. “Dental office” means an establishment owned and operated
144233 by a dentist for the pra ctice of dentistry, which may be composed of
145234 reception rooms, business offices, private offices, laboratories,
146235 and dental operating rooms where dental operations are performed;

148236 13. “Dental hygiene” means the science and practice of the
149237 promotion of oral health and prevention a nd treatment of oral
150238 disease through the provision of educational, therapeutic, clinical,
151239 and preventive services;

153240 14. “Dental hygienist” means an individual who has fulfilled
154241 the educational requirements and is a graduate of an accr edited
155242 dental hygiene program and who has passed an examination and has

156270 been issued a license by the Board and who is authorized to practice
157271 dental hygiene as hereinafter defined in this section;

159272 15. “Dental assistant” or “oral maxillofacial surgery
160273 assistant” means an individual working for a dentist, under the
161274 dentist’s direct supervision or direct visual supervision, and
162275 performing duties in the dent al office or a treatment facility
163276 including the limited treatment of patients in accordance with the
164277 provisions of the State Dental Act. A dental assistant or oral
165278 maxillofacial surgery assistant may assist a dentist with the
166279 patient; provided, this shall be done only under the direct
167280 supervision or direct visual supervision and control of the dentist
168281 and only in accordance with the educational requirements and rules
169282 promulgated by the Board;

171283 16. “Dental laboratory” means a location, whether in a dental
172284 office or not, where a dentist or a dental laboratory technician
173285 performs dental laboratory technology;

175286 17. “Dental laboratory technician ” means an individual whose
176287 name is duly filed in the official records of the Board, which
177288 authorizes the technician, u pon the laboratory prescription of a
178289 dentist, to perform dental laboratory technology, which services

181290 must be rendered only to the prescribing dentist and not to the
182291 public;

184292 18. “Dental laboratory technology ” means using materials and
185293 mechanical devices f or the construction, reproduction or repair of

187322 human mouth;

189323 19. “Dental specialty” means a specialized practice of a branch
190324 of dentistry, recognized by the Board, where the dental college an d
191325 specialty program are accredited by the Commission on Dental
192326 Accreditation (CODA), or a dental specialt y recognized by the Bo ard,
193327 requiring a minimum number of hours of approved education and
194328 training and/or recognition by a nationally recognized associa tion
195329 or accreditation board;

197330 20. “Direct supervision” means the supervisory dentist is in
198331 the dental office or treatment facility and, during the appointment,
199332 personally examines the patient, diagnoses any conditions to be
200333 treated, and authorizes the proc edures to be performed by a dental
201334 hygienist, dental assistant, or oral maxillofacial surgery
202335 assistant. The supervising denti st is continuously on -site and
203336 physically present in the dental office or treatment facility while
204337 the procedures are being perfo rmed and, before dismissal of the
205338 patient, evaluates the results of the dental treatment;

207339 21. “Direct visual supervision” means the supervisory dentist
208340 has direct ongoing visual oversight which shall be maintained at all
209341 times during any procedure authori zed to be performed by a dental
210342 assistant or an oral maxillofacial surgery assistant;

212370 22. “Expanded duty” means a dental proce dure for which a dental
213371 assistant has received special training in a course of study
214372 approved by the Board;

216373 23. “Fellowship” means a program designed for post -residency
217374 graduates to gain knowledge and experience in a specialized fiel d;
218-
219375 24. “General anesthesia” means a drug-induced loss of
220376 consciousness during which patients are not arousable, even by
221377 painful stimulation. The abil ity to independently maintain
222378 ventilator function is often impaired. Patients often require

225379 assistance in maintaining a patent airway, and positive pressure
226380 ventilation may be required because of depressed spontaneous
227381 ventilation or drug-induced depression of neuromuscular function.
228382 Cardiovascular function may be impaired;

230383 25. “General supervision” means the supervisory dentist has
231384 diagnosed any conditions to be treated within the past thirteen (13)
232385 months, has personally authorized the procedures to be performed by
233386 a dental hygienist, and will evaluate the results of the dental
234387 treatment within a reasonabl e time as determined b y the nature of
235388 the procedures performed, the needs of the patient, and the
236389 professional judgment of the supervisory dentist. Ge neral
237390 supervision may only be used to supervise a dental hygienist and may
238391 not be used to supervise an or al maxillofacial surgery assistant or
239392 dental assistant except as provided by Section 7 328.58 of this act

242421 26. “Indirect supervision ” means the supervisory dentist is in
243422 the dental office or treatment facility and has personally diagnosed
244423 any conditions to be treated, au thorizes the procedures to be
245424 performed by a dental hygienist, remains in the dental office or
246425 treatment facility while the proce dures are being performed, and
247426 will evaluate the results of the dental treatment within a
248427 reasonable time as determined by the nature of the procedures
249428 performed, the needs of the patient, and the professional judgment
250429 of the supervisory dentist. Indirect supervision may not be used
251430 for an oral maxillofacial surgery assistant or a dental assistant;
252-
253431 27. “Investigations” means an investigation proceeding,
254432 authorized under Sections 328.15A and 328.43a of this title, to
255433 investigate alleged violations of the S tate Dental Act or the rules
256434 of the Board;
257-
258435 28. “Laboratory prescription ” means a written description,
259436 dated and signed by a dentist, of dental laboratory technology to be
260437 performed by a dental laboratory technician;
261-
262438 29. “Minimal sedation” means a minimally depressed level of
263439 consciousness, produced by a pharmacological method, that retains
264440 the patient’s ability to independently and continuously maintain an
265441 airway and respond normally to tactile stimulation and verbal
266442 command. Although cognitive function and coordination may be

269443 modestly impaired, ventilator and cardiovascular functions are
270444 unaffected;

272472 30. “Mobile dental anesthesia provider ” means a licensed and
273473 anesthesia-permitted dentist, physician or Certified Registered
274474 Nurse Anesthetist (CRNA) that h as a mobile dental unit and provides
275475 anesthesia in dental offices and facilities in the state;
276-
277476 31. “Mobile dental clinic” means a permitted motor vehicle or
278477 trailer utilized as a dental clinic, and/or that contains dental
279478 equipment and is used to provide dental services to patients on -site
280479 and shall not include a mobile dental anesthesia provider. A mobile
281480 dental clinic shall also mean and include a volunteer mobile dental
282481 facility that is directly affiliated with a church or religious
283482 organization as defined by Section 501(c)(3) or 501(d) of the United
284483 States Internal Revenue Code, the church or religious o rganization
285484 with which it is affiliated is clearly indicated on the exterior of
286485 the volunteer mobile dental facility, and such facility does not
287486 receive any form of payment either directly or indirectly for work
288487 provided to patients other than donations th rough the affiliated
289488 church or religious organization; provided, that the volunteer
290489 mobile dental facility shall be exempt from any registration fee
291490 required under the State Dental Act;

293491 32. “Moderate sedation” means a drug-induced depression of
294492 consciousness during which patie nts respond purposefully to verbal
295493 commands, either alone or accompanied by light tactile stimulation.

300524 33. “Prophylaxis” means the removal of any and all calcareous
301525 deposits, stains, accretions or concretions from the supragingival
302526 and subgingival surfaces of human teeth, utilizing instrumentation
303527 by scaler or periodontal curette on the c rown and root surfaces of
304528 human teeth including rotary or power -driven instruments. This
305529 procedure may only be performed by a dentist or dental hygien ist;

307530 34. “Patient” or “patient of record” means an individual who
308531 has given a medical history and has be en examined and accepted by a
309532 dentist for dental care;

313533 35. “Residencies” are programs designed for advanced clinical
314534 and didactic training in general dentistry or other specialties or
315535 other specialists at the post -doctoral level recognized by the
316536 Commission on Dental Accredita tion (CODA) or the Board;

318537 36. “Supervision” means direct supervision, direct visual
319538 supervision, indirect supervision or general supervision;

321539 37. “Teledentistry” means the remote delivery of dental patient
322540 care via telecommunication s and other technology for the exchange of
323541 clinical information and images for dental consultation, preliminary
324542 treatment planning and patient monitori ng; and

326543 38. “Treatment facility” means:

328544 a. a federal, tribal, state or local public health

359588 SECTION 2. AMENDATORY 59 O.S. 2021, Section 328.15, as
360589 amended by Section 1, Chapter 158, O.S.L. 20 22 (59 O.S. Supp. 2023,
361590 Section 328.15), is amended to read as follows:

363591 Section 328.15. A. Pursuant to and in compliance with Article
364592 I of the Administrative Procedures Act, the Board of Dentistry shall
365593 have the power to formulate, adopt, and promulgate rules as may be
366594 necessary to regulate the practice of dentistry in this state and to
367595 implement and enforce the provisions of the State Dental Act.

380631 official address of all persons who hold a license or permit issued

384634 the Board including annually preparing and publishing a statement of

407677 9. Conduct, in a uniform and reasonable manner, inspections of
408678 dental offices and dental laboratories and business records of
409679 dental offices and dental laboratories;

411680 10. Establish guidelines for courses of study necessary for
412681 dental assistants, oral maxillofacial surgery a ssistants and, when
413682 appropriate, issue permits authorizing dental assistants or oral
414683 maxillofacial surger y assistants to perform expanded duties;

416684 11. Establish continuing education requirements for dentists,
417685 dental hygienists, dental assistants and oral m axillofacial surgery
418686 assistants who hold permits issued by the Board;
419-
420687 12. Recognize the parameters and s tandards of care established
421688 and approved by the American Dental Association or another
422689 nationally recognized medical or dental association that establ ishes
423690 guidelines for health care as it relates to dentistry. The Board
424691 shall have the sole authority to determine scope of pra ctice of
425692 licensees considering these standards and guidelines ;

427693 13. Formulate, adopt, and promulgate rules, pursuant to Article
428694 I of the Administrative Procedures Act, as may be necessary to
429695 implement and enforce the provisions of the Oklahoma Dental
430696 Mediation Act;

432697 14. Seek and receive advice and assistance of the Office of the
433698 Attorney General of this state;

16562668 B. A holder of a license, permit, or certificate shall not be
16572669 considered to be in good standing if an inve stigation of a complaint
16582670 is pending against the holder. The Board shall not accept a
16592671 surrender until a complaint is dismissed by the review panel, a
16602672 settlement agreement an agreed order or agreed order of surrender is
16612673 entered, or the Board determines that an individual proceed ing shall
16622674 be initiated pursuant to Section 328.43a of this title.
