8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new section of law to be codified
8383 in the Oklahoma Statutes as Section 284.3 of Title 74, unless there
8484 is created a duplication in numbe ring, reads as follows:
8585 A. For the purposes of this act, “public employer” means any
8686 state or local government, municipal, or government corporation,
8787 government agency, government commission, government
8888 instrumentality, government board, government department, government
8989 branch, government authority, sch ool board of a district, any other

141141 political subdivision of this state, or special p urpose department,
142142 or organization that employs one or more pers ons in any capacity.
143143 B. The following categories of payro ll deductions by public
144144 employers are permitted fo r all public employees:
145145 1. Those deductions required by law including, but not limited
146146 to, federal and state income ta xes, federal social security, and
147147 Medicare taxes;
148148 2. Those for the benefit of charitable organizations described
149149 in Section 501 (c)(3) of the Internal Revenue Co de; and
150150 3. Those which primarily fund savings , insurance, and other
151151 similar benefits including, but not limited to, United States
152152 Savings Bonds, deferred compensation, and disability, life, hea lth,
153153 and retirement benefits; provided, programs in this paragraph shall
154154 include only those permissible for an employee benefit plan as
155155 defined in 29 U.S.C., Section 1002(3).
156156 C. A signed, written prior authorization from the employee is
157157 required for any deduction pursuant to para graphs 2 or 3 of
158158 subsection B of this section and that authorization may be revoked
159159 in writing at any time and shall take effect on the second payr oll
160160 deduction occurring after the public employer receives the written
161161 revocation notice.
162162 D. Payroll deduction for any other purpose or organi zation is
163163 unlawful and prohibited. A public employer may develop guidelines
164164 and policies governing deductions for paragraph 2 or 3 of s ubsection

216216 B of this section in order to avoid u nduly burdensome financial or
217217 administrative costs resulting from authorized reduc tions.
218218 E. Notwithstanding any other statute, regulation, contract, or
219219 practice, nothing in this or any other law of this state shall
220220 permit payroll deductions of any kind , except as provided in
221221 subsection B of this section. Nothing in this section or any other
222222 law of this state shall prevent a public employee from personally
223223 and voluntarily contributing to an organization or entity direct ly
224224 for which payroll deductions are prohibited in subsection D of this
225225 section.
226226 F. Payroll deductions currently author ized shall terminate one
227227 month following the effective date of this act unless the recipient
228228 of such deducted amount is certified by the public employer as
229229 qualified to receive payroll deductions under subsection B of this
230230 section.
231231 G. Any person, corporation, association, organization, entity,
232232 or public employer who violat es any provisions of this act shall be
233233 assessed a civil penalty not less than One Hundre d Dollars ($100.00)
234234 nor more than One Thousand Dollars ($1,000.00) for the first
235235 violation and an amount no less than Five Hundred Dollars ( $500.00)
236236 nor more than Five Thou sand Dollars ($5,000.00) for each subse quent
237237 violation. Each act of violation shall constit ute a separate
238238 violation.

290290 H. Any person, corporation, association, organization, entity,
291291 or public employer who directly or indirectly violates any portion
292292 of this section shall be guilty of a misdemeanor.
293293 I. Any person aggrieved as a result of any v iolation or
294294 threatened violation of any provision of this section may seek
295295 abatement of the vio lation or threatened violation by petitioning a
296296 court of competent jurisdiction within one (1) year from the date of
297297 the alleged violation for injunctive relief and shall be entitled to
298298 costs and reasonable attorney fees if h e or she prevails in the
299299 action.
300300 J. Any person aggrieved as a result of any violation or
301301 threatened violation of this section may bring an action in a court
302302 of competent jurisdiction within one (1) year from the date of the
303303 alleged violation to recover al l damages resulting from the
304304 violation or threatened violation and shall be entitle d to costs and
305305 reasonable attorney fees if he or she prevails in the action.
306306 K. If any provisions of this section , or the application of th e
307307 provisions to any person or circumstance, shall be held invalid, the
308308 remainder of this section, and the applic ation of the provisions to
309309 persons or circumstance o ther than those to which it is invalid,
310310 shall not be affected.
311311 SECTION 2. This act shall become effective No vember 1, 2024.
