147147 SECTION 1. NEW LAW A new section of law to be codified
148148 in the Oklahoma Statutes as Section 11-105.2 of Title 70, unless
149149 there is created a dupl ication in numbering, reads as follows:
150150 A. This act shall be known and may be cited as the “Oklahoma
151151 Sexual Education Reform and Parental Rights Protection Act ”.
152152 B. As used in this act:
153153 1. “Comprehensive sexual education ” or “sexual risk reduction ”
154154 means any educational program that includes, endorses, or promotes
155155 any of the following:
156156 a. the advocacy of sexual a ctivity outside of marriage,
157157 b. the advocacy or promotion of any form of sexual
158158 activity that deviates from the understanding of
159159 sexual norms within a traditional family structure,
160160 c. the provision of information about contraceptive
161161 methods without emphasizing their potential risks and
162162 failure rates,
163163 d. the endorsement or promotion of non-heterosexual
164164 orientations as equally valid or preferable to
165165 heterosexual orientations,
166166 e. the teaching of explicit sexual techniques without a
167167 focus on abstinence as the preferred choice ,
168168 f. the inclusion of materials that may be consid ered
169169 obscene or harmful to minors,

222222 outside the binary concept of male and female, without
223223 emphasizing the biological basis of sex,
224224 h. rights-based, pleasure-based sexual response system,
225225 i. teaching of consent and negotiation skills for sexual
226226 activity,
227227 j. sexually transmitted infections (STIs) presented as
228228 normal or common,
229229 k. instruction segmented for students of different sexual
230230 orientation and gend er identity,
231231 l. abortion presented as a safe, repr oductive health care
232232 choice and a right, and
233233 m. the undermining of the parent relationship, knowledge,
234234 and relevancy with students encouraged to seek other
235235 help; and
236236 2. “Optimal sexual health education ” or “sexual risk avoidance”
237237 means an educational prog ram that emphasizes the following:
238238 a. the importance of monogamous, heterosexual
239239 relationships within the context of marriage,
240240 b. the benefits of abstaining from sexual a ctivity,
241241 c. the physical, psychological, and emotional risks and
242242 consequences of engag ing in premarital sexual
243243 activity,

296296 discipline,
297297 e. the positive aspects of healthy relationships
298298 including communication skills, mu tual respect, and
299299 emotional intimacy,
300300 f. the development of decision -making skills and setting
301301 personal boundaries,
302302 g. the understanding of the potential social, emotional,
303303 and physical consequences of e arly sexual activity,
304304 h. science-based, health-based information about the
305305 reproductive system,
306306 i. refusal and resistance ski lls for sexual avoidance,
307307 j. sexually transmitted infections (STIs) can cause
308308 serious health concerns and can and should be avoided,
309309 k. information provided and risk avoidance promoted for
310310 all students, regardless of sexual orientation or
311311 gender identity,
312312 l. abortion, if discussed, is presented in the context of
313313 state law and physical and emotional risks , and
314314 m. parental involvement, communication, and authority are
315315 upheld and family values are supported.
316316 SECTION 2. AMENDATORY 25 O.S. 2021, Section 2003, is

369369 Section 2003. A. The board of education of a school district,
370370 in consultation with parents, teachers , and administrators, shall
371371 develop and adopt a policy to promote the invo lvement of parents and
372372 guardians of children enrolled in the schools within the school
373373 district, including:
374374 1. A plan for parent participation in the schools which is
375375 designed to improve parent and teacher cooperation in such ar eas as
376376 homework, attendance , and discipline;
377377 2. Procedures by which parents may learn about the course of
378378 study for their children and review learning materials, including
379379 the source of any supplemental educational materials;
380380 3. Procedures by which parents who object to any learnin g
381381 material or activity on the basis that it is harmful may withdraw
382382 their children from the a ctivity or from the cl ass or program in
383383 which the material is used. Objection to a learning material or
384384 activity on the basis that it is harmful includes objectio n to a
385385 material or activity because it questions beli efs or practices in
386386 sex, morality, or religion;
387387 4. If a school district offers any sex education curricula
388388 pursuant to Section 11 -105.1 of Title 70 of the Oklahoma Statutes or
389389 pursuant to any rules adopt ed by the State Board of Education,
390390 procedures to opt out of a school district from providing sex
391391 education require written consent from a parent for a child to
392392 participate in comprehensive sexual education or sexual risk

444444 reduction instruction to a child if the child ’s parent provides
445445 written objection to the child ’s participation in the sex education
446446 curricula or optimal sexual health education or sexual risk
447447 avoidance instruction, as defined in Section 1 of this act ;
448448 5. Procedures by which parents will be notified in advance o f
449449 and given the opportunity to withdraw their children from provide
450450 written consent for a child to participate in any instruction or
451451 presentations regarding sexuality in courses other than formal sex
452452 comprehensive sexual education or sexual risk reduction curricula or
453453 optimal sexual health edu cation or sexual risk a voidance curricula
454454 pursuant to Section 11 -105.1 of Title 70 of the Oklahoma Statutes;
455455 6. Procedures by which parents may learn about the nature and
456456 purpose of clubs and activities that are part of the school
457457 curriculum, as well as extracurricular clubs and activities that
458458 have been approved by the school; and
459459 7. Procedures by which parents may learn about parental rights
460460 and responsibilities und er the laws of this state, including the
461461 following:
462462 a. the right to opt out of in to a sex comprehensive
463463 sexual education or sexual risk reduction curriculum
464464 or an optimal sexual health education or sexual risk
465465 avoidance curriculum if one such a course or course s
466466 is provided by the school district,
467467 b. open enrollment rights,

521521 d. the right to be exempt from the immunization laws of
522522 the state pursuant to Section 1210.192 o f Title 70 of
523523 the Oklahoma Statutes,
524524 e. the promotion requirements prescrib ed in Section
525525 1210.508E of Title 70 of the Oklahoma Statutes,
526526 f. the minimum course of study and competency
527527 requirements for graduation from high schoo l
528528 prescribed in Section 11 -103.6 of Title 70 of the
529529 Oklahoma Statutes,
530530 g. the right to opt out of instruc tion on the acquired
531531 immune deficiency syndrome pursuant to Section 11 -
532532 103.3 of Title 70 of th e Oklahoma Statutes,
533533 h. the right to review test results,
534534 i. the right to participate i n gifted programs purs uant
535535 to Sections 1210.301 through 1210.308 of Title 7 0 of
536536 the Oklahoma Statutes,
537537 j. the right to inspect instructional materials use d in
538538 connection with any research or experimentation
539539 program or project pursuant to Section 11 -106 of Title
540540 70 of the Oklahoma Statutes,
541541 k. the right to receive a school report card,

593593 l. the attendance requirements prescribed in Section 10 -
594594 106 of Title 70 of the Oklahoma Statutes,
595595 m. the right to public review of courses of study and
596596 textbooks,
597597 n. the right to be excused from sc hool attendance for
598598 religious purposes,
599599 o. policies related to parental involvement pursuant to
600600 this section,
601601 p. the right to participate in parent-teacher
602602 associations and organizations that are sanction ed by
603603 the board of education o f a school district, a nd
604604 q. the right to opt out of any data collection ins trument
605605 at the district level that would capture data for
606606 inclusion in the state longitudinal student data
607607 system except what is necessary and essential for
608608 establishing a student ’s public school record.
609609 B. The board of education of a school district may adopt a
610610 policy to provide to parents the information required by this
611611 section in an electronic form.
612612 C. A parent shall submit a written request for in formation
613613 pursuant to this sec tion during regular bu siness hours to either the
614614 school principal at the sc hool site or the superintendent of the
615615 school district at the office of the school district. Within ten
616616 (10) days of receiving the request for information, the school

668668 principal or the superintendent of the school district shall either
669669 deliver the requeste d information to the parent or submit to the
670670 parent a written explanation of th e reasons for the denial of the
671671 requested information. If the request f or information is denied or
672672 the parent does not rece ive the requested information within fifteen
673673 (15) days after submitting the request for information, the parent
674674 may submit a written request for th e information to the board of
675675 education of a school district, which shall formally con sider the
676676 request at the next scheduled public meeting of the board if the
677677 request can be properly noticed on the agenda. If the request
678678 cannot be properly noticed on the agenda, the board of education of
679679 a school district sha ll formally consider the reque st at the next
680680 subsequent public meeting of the board.
681681 SECTION 3. AMENDATORY 70 O.S. 2021, Section 11 -105.1, is
682682 amended to read as follows:
683683 Section 11-105.1. A. All curriculum and materials including
684684 supplementary materials which will be used to teach o r will be used
685685 for or in connection with a sex comprehensive sexual education or
686686 sexual risk reduction class or program which is designed for the
687687 exclusive purpose of discussing sexual behavior or attitudes or an
688688 optimal sexual health education or sexual risk avoidance class or
689689 program, as defined in Section 1 of this act, or any test, survey or
690690 questionnaire whose primary purpose is to elicit responses on sexual
691691 behavior or attitudes shall be available on the school district ’s

744744 district for inspection by parents and guardians of the student who
745745 will be involved with t he class, program or, test, survey, or
746746 questionnaire. Such curriculum, materials, classes, programs,
747747 tests, surveys, or questionnaires shall include information about
748748 consent and shall have as one of its primary purposes the teaching
749749 of or informing students about the practice of abstinence. For the
750750 purposes of this section, “consent” shall have the same meaning as
751751 that provided by Section 113 of Title 21 of the Ok lahoma Statutes.
752752 The superintendent or a designee of the school district shall
753753 provide prior written notification to the paren ts or guardians of
754754 the students involved of their right to inspect the curriculum and
755755 material, the right to inspect a detailed outline of the curriculum,
756756 and of their obligation to notify the right of parents or guardians
757757 to provide the school in writing written consent if they do not want
758758 their child to participate in the class, program, test, survey, or
759759 questionnaire. Each local board of education shall determine the
760760 means of providing written notification to the paren ts and guardian
761761 which will ensure effective notice in an efficient and appropriate
762762 manner including a reasonable time period for the parent or guardian
763763 to review the curriculum . No student shall be required to
764764 participate in a sex comprehensive sexual education or sexual risk
765765 reduction class or program or an optimal sexual health educa tion or
766766 sexual risk avoidance class or progra m which discusses sexual

818818 behavior or attitudes if a parent or guardian of the student objects
819819 in writing to does not provide writ ten consent for such
820820 participation. If the type of program referred to in this section
821821 is a part of or is taught during a credit course, a student may be
822822 required to enroll in the course but shall not be required to
823823 receive instruction in or participate in the program if a paren t or
824824 guardian objects in writing does not provide written consent.
825825 B. The superintendent or a designee of a school district in
826826 which sex a comprehensive sexual education or sexual risk reduction
827827 class or program or an optimal sexua l health education or sexual
828828 risk avoidance class or program is taught or a program is offered
829829 which is designed for the exclusive purpose of discussing sexual
830830 behavior or attitudes shall approve all curriculum and materials
831831 which will be used for such education and any test, survey or
832832 questionnaire whose primary purpose is to elicit re sponses on sexual
833833 behavior or attitudes used in the school prior to their use in the
834834 classroom or school. The teacher i nvolved in the class, program,
835835 testing or survey shall submit the curriculum, materials, tests or
836836 surveys to the superintendent or a designee for approval prior to
837837 their use in the classroom or school. This section shall not apply
838838 to those students enrolled in classes, programs, testings , or
839839 surveys offered through an alternative education program.
840840 C. A comprehensive sexual education or sexual risk reduction
841841 class or program or an optimal sexual health education or sexual

894894 pursuant to this section shall only be taught by a certified teacher
895895 who is employed by the school district. Outside organizations
896896 including, but not limited to, county health departments and city -
897897 county health departments shall be prohibited from leading such a
898898 class or program.
899899 D. Only textbooks and other instructional materials included in
900900 the list of textbooks selected by the State T extbook Committee
901901 pursuant to Section 16 -110 of this title shall be used in a
902902 comprehensive sexual education or sexual risk reduction class or
903903 program or an optimal sexual health education or sexual risk
904904 avoidance class or program offered pursuant to this section. A
905905 school district shall be prohibited from using state fu nds to
906906 purchase textbooks or other instructional materials not included in
907907 the list of textbooks selected by the State Textbook Committee.
908908 SECTION 4. This act shall become effective July 1, 2024.
909909 SECTION 5. It being immediately necessary for the preservation
910910 of the public peace, health , or safety, an emergency is hereby
911911 declared to exist, by reason whereof thi s act shall take effect and
912912 be in full force from and after its passage and approval.
