15	45		An Act relating to schools; amending 70 O.S. 2021,
16	46		Section 5-130, which relates to use of school
17	47		buildings and properties; allowing a school district
18	48		board of education to enter into an agreement with a
19	49		church for use of certain building or property for
20	50		certain purposes; providing an effective date; and
21	51		declaring an emergency.

28	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

30	58		SECTION 1. AMENDATORY 70 O.S. 2021, Section 5 -130, is
31	59		amended to read as follows:

33	60		Section 5-130. A. The board of education of any school
34	61		district may, under such regulations and conditions as it may
35	62		prescribe, encourage increased community involvement in th e public
36	63		schools. These regulations and conditions may include:

38	64		1. Open any school building and permit the use of any property
39	65		belonging to such dist rict for religious, political, literary,
40	66		community, cultural, scientific, mechanical, agricultural , or

41	94		parental involvement purposes, and other purposes of general public
42	95		interest including the provision of public library services pursuant
43	96		to agreements with governing boards or commissions of public
44	97		libraries or library systems;

48	98		2. Contract to provide transp ortation equipment as defined in
49	99		Section 9-104 of this title for any purpose specified in paragraph 1
50	100		of this subsection; and

52	101		3. Make a reasonable cha rge to cover the cost of the use of
53	102		such building, property , or transportation equipment.

55	103		B. The State Board of Education shall encourage each board of
56	104		education to inquire into and promote the use of its school
57	105		buildings and property for the purposes pro vided in subsection A of
58	106		this section for such activities both before and after regular
59	107		school hours.

61	108		C. Any youth group listed in Title 36 of the United States Code
62	109		as a patriotic society shall be allowed the use of any school
63	110		building or property to pro vide services allowing students to
64	111		participate in activities provided by the groups at times other than
65	112		instructional time during the school day.

67	113		D. Nothing in this section shall prohibit a school district
68	114		board of education from entering into an agreemen t with a church to
69	115		utilize a church building or any property belonging to such church
70	116		for political, literary, community, cultural, scientific,
71	117		mechanical, agricultural, or parental involvement purposes.

73	145		SECTION 2. This act shall become ef fective July 1, 2024.

75	146		SECTION 3. It being immediately necessary for the preservation
76	147		of the public peace, health, or safety, an emergency is hereby
77	148		declared to exist, by reason whereof this act shall take effect and
78	149		be in full force from a nd after its passage and approval.
