7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 22 O.S. 2021, Section 991a, as
7979 amended by Section 4, Chapter 310, O.S.L. 2023 (22 O.S. Supp. 2023,
8080 Section 991a), is amended to read as follows:
8181 Section 991a. A. Except as otherwise provided in the Elder ly
8282 and Incapacitated Victim ’s Protection Program, when a defendant is
8383 convicted of a crime and no death sentence is imposed, the court
8484 shall either:
8585 1. Suspend the execution of sentence in whole or in part, with
8686 or without probation. The court, in addition , may order the
8787 convicted defendant at the time of sentencing or at any time during
8888 the suspended sentence to do one or more of the following:

140140 a. to provide restitution to the victim as provided by
141141 Section 991f et seq. of this title or according to a
142142 schedule of payments established by the sentencing
143143 court, together with in terest upon any pecuniary sum
144144 at the rate of twelve percent (12%) per annum, if the
145145 defendant agrees to pay such res titution or, in the
146146 opinion of the court, if the defendant is able to pay
147147 such restitution without imposing manifest hardship on
148148 the defendant or the immediate family and if the
149149 extent of the damage to the victim is determinable
150150 with reasonable certainty . The court shall prior itize
151151 an order for payments of restitution to t he victim to
152152 the extent feasible,
153153 b. to reimburse any state agency for amounts paid by the
154154 state agency for hospital and medical expenses
155155 incurred by the victim or victims, as a result of the
156156 criminal act for which such person was convicted,
157157 which reimbursement shal l be made directly to the
158158 state agency, with interest accruing thereon at the
159159 rate of twelve percent (12%) per annum,
160160 c. to engage in a term of community service without
161161 compensation, according to a schedule consistent with
162162 the employment and fam ily responsibilities of the

215215 d. to pay a reasonable su m into any trust fund
216216 established pursuant to the provisions of Se ctions 176
217217 through 180.4 of Title 60 of the Oklaho ma Statutes and
218218 which provides restitution payments by convicted
219219 defendants to victims of crimes committed within this
220220 state wherein such victim has incurred a financial
221221 loss,
222222 e. to confinement in the county jail for a period not to
223223 exceed six (6) months,
224224 f. to confinement as provided by law together with a term
225225 of post-imprisonment community supervision for not
226226 less than three (3) years of th e total term allowed by
227227 law for imprisonment, with or without rest itution;
228228 provided, however, the authority of this provision is
229229 limited to Section 843.5 of Title 21 of the Oklahoma
230230 Statutes when the offense involved sexual abuse or
231231 sexual exploitation; Sections 681, 741 and 843.1 of
232232 Title 21 of the Okla homa Statutes when the offense
233233 involved sexual abuse or sexual expl oitation; and
234234 Sections 865 et seq., 885, 886, 888, 891, 1021,
235235 1021.2, 1021.3, 1040.13a, 1087, 1088, 1 111.1, 1115 and
236236 1123 of Title 21 of the Oklahoma Statutes,
237237 g. to repay the reward or part of the reward p aid by a
238238 local certified crime stoppers program an d the

290290 Oklahoma Reward System. In determining whether the
291291 defendant shall repay the reward or part of the
292292 reward, the court shall consider the ability of the
293293 defendant to make the payment, the financial hardship
294294 on the defendant to make the required paymen t and the
295295 importance of the information to the prosecution of
296296 the defendant as provided by the arrest ing officer or
297297 the district attorney wi th due regard for the
298298 confidentiality of the records of the local certified
299299 crime stoppers program and the Oklahoma Reward System.
300300 The court shall assess this repayment against the
301301 defendant as a cost of prosecution. The term
302302 “certified” means crime stoppers organizations that
303303 annually meet the certifi cation standards for crime
304304 stoppers programs established by the Okl ahoma Crime
305305 Stoppers Association to the extent those standards do
306306 not conflict with state statutes. The term “court”
307307 refers to all municipa l and district courts withi n
308308 this state. The “Oklahoma Reward System” means the
309309 reward program established by Secti on 150.18 of Title
310310 74 of the Oklahoma Statutes,
311311 h. to reimburse the Oklahoma St ate Bureau of
312312 Investigation for costs incurred by that agency during
313313 its investigation of the crime for which the defendant

365365 pleaded guilty, nolo contendere or was convicted
366366 including compensation for laboratory, technical or
367367 investigation service s performed by the Bureau if, in
368368 the opinion of the court, the defendan t is able to pay
369369 without imposing manifest hardship on the defenda nt,
370370 and if the costs incurred by the Bureau during the
371371 investigation of the defendant ’s case may be
372372 determined with reasonable ce rtainty,
373373 i. to reimburse the Oklahoma State Bureau of
374374 Investigation and any authorized law enforcement
375375 agency for all costs incurred by that agency for
376376 cleaning up an illegal dr ug laboratory site for which
377377 the defendant pleaded guilty, nolo conte ndere or was
378378 convicted. The court clerk shall collect the amount
379379 and may retain five percent (5 %) of such monies to be
380380 deposited in the Court Clerk’s Revolving Fund to cover
381381 administrative costs and shall remit the remainder to
382382 the Oklahoma State Bureau of Investig ation to be
383383 deposited in the OSBI Revolving Fund established by
384384 Section 150.19a of Tit le 74 of the Oklahoma St atutes
385385 or to the general fund wherein the other law
386386 enforcement agency is located,
387387 j. to pay a reasonable sum to the Crime Victims
388388 Compensation Board, created by Sectio n 142.2 et seq.

442442 k. to reimburse the court fund for amounts paid to court -
443443 appointed attorneys for representing the defendant in
444444 the case in which the person is bei ng sentenced,
445445 l. to participate in an assessment and evaluation by an
446446 assessment agency or assessment personne l certified by
447447 the Department of Mental Health and Substance Abuse
448448 Services pursuant to Section 3 -460 of Title 43A of the
449449 Oklahoma Statutes and, as determined by the
450450 assessment, participate in an alcohol and drug
451451 substance abuse course or treatment program or both,
452452 pursuant to Sections 3-452 and 3-453 of Title 43A of
453453 the Oklahoma Statutes, or as ordered by the court,
454454 m. to be placed in a victims imp act panel program, as
455455 defined in subsection H of this section, or
456456 victim/offender reconciliation program and p ayment of
457457 a fee to the program of Seventy -five Dollars ($75.00)
458458 as set by the governing authority of the program to
459459 offset the cost of p articipation by the defendant .
460460 Provided, each victim/offender reconcil iation program
461461 shall be required to obtain a written consent form
462462 voluntarily signed by the victim and defendant tha t
463463 specifies the methods to be used to resolve the

515515 issues, the obligations and r ights of each person and
516516 the confidentiality of the proceedings. Volunteer
517517 mediators and employees of a victi m/offender
518518 reconciliation program shall be immune from liability
519519 and have rights of confidentiality as provided in
520520 Section 1805 of Title 12 of the Oklahoma Statutes,
521521 n. to install, at the expense of the defe ndant, an
522522 ignition interlock device approved by the Board of
523523 Tests for Alcohol and Drug Influence. The device
524524 shall be installed upon every motor vehicle operated
525525 by the defendant, and the court shall require that a
526526 notation of this restriction be affixed to the
527527 defendant’s driver license. The restrict ion shall
528528 remain on the driver license not exceeding two (2)
529529 years to be determined by the court. The restriction
530530 may be modified or re moved only by order of the c ourt
531531 and notice of any modification order s hall be given to
532532 Service Oklahoma. Upon the expiration of the per iod
533533 for the restriction, Service Oklahoma shall re move the
534534 restriction without further court order. Failure to
535535 comply with the order to install an ignition interlock
536536 device or operating any vehicle without a device
537537 during the period of re striction shall be a violation
538538 of the sentence and may be punished as deemed proper

590590 by the sentencing court. As used in this paragraph,
591591 “ignition interlock device ” means a device that,
592592 without tampering or intervention by another person,
593593 would prevent the defendant from o perating a motor
594594 vehicle if the defendant has a bl ood or breath alcohol
595595 concentration of two -hundredths (0.02) or greater,
596596 o. to be confined by electronic monitoring administered
597597 and supervised by the Department of Corrections or a
598598 community sentence provider, and payment of a
599599 monitoring fee to the superv ising authority, not to
600600 exceed Three Hundred Dollars ($300.00) per mo nth. Any
601601 fees collected pursuant to this subparagraph shall be
602602 deposited with the appropriate supervising authority.
603603 Any willful violation of an order of the court for the
604604 payment of the monitoring fee shall be a violation of
605605 the sentence and may be punished as de emed proper by
606606 the sentencing court. As used in this paragraph,
607607 “electronic monitoring ” means confinement of the
608608 defendant within a specified location or locations
609609 with supervision by means of an electronic device
610610 approved by the Department of C orrections which is
611611 designed to detect if the defendant is in the court -
612612 ordered location at the required times and which

665665 supervisory agency or person,
666666 p. to perform one or more courses of treatment, education
667667 or rehabilitation for any conditions, behaviors,
668668 deficiencies or disorders which may contribu te to
669669 criminal conduct including but not limited to alcohol
670670 and substance abuse, mental h ealth, emotional health,
671671 physical health, propensity for violence, an tisocial
672672 behavior, personality or attitudes, deviant sexual
673673 behavior, child development, parenting assistance, job
674674 skills, vocational-technical skills, domestic
675675 relations, literacy, educa tion or any other
676676 identifiable deficiency which may be treated
677677 appropriately in the community and for which a
678678 certified provider or a program recognized by the
679679 court as having significant p ositive impact exists in
680680 the community. Any treatment, education o r
681681 rehabilitation provider required to be certified
682682 pursuant to law or rule shall be certified b y the
683683 appropriate state agency or a national organization,
684684 q. to submit to periodic testing for alcohol,
685685 intoxicating substance or controlled dangerous
686686 substances by a qualified laboratory,

739739 supervision, participation in a program or any
740740 combination thereof as determined by the court, based
741741 upon the defendant’s ability to pay the fees or costs,
742742 s. to be supervised by a Department of Corrections
743743 employee, a private supervision provid er or other
744744 person designated by the court,
745745 t. to obtain positive behav ior modeling by a trained
746746 mentor,
747747 u. to serve a term of confinemen t in a restrictive
748748 housing facility available in t he community,
749749 v. to serve a term of confinement in the county jail at
750750 night or during weekends pursuant to Section 991a -2 of
751751 this title or for work release,
752752 w. to obtain employment or parti cipate in employment-
753753 related activities,
754754 x. to participate in manda tory day reporting to
755755 facilities or persons for services, payments, d uties
756756 or person-to-person contacts as specified by the
757757 court,
758758 y. to pay day fines not to exceed fifty percent (50%) of
759759 the net wages earned. For purposes of this paragraph,
760760 “day fine” means the offender is ordered to pay an
761761 amount calculated as a percentage of net daily wages

813813 earned. The day fine shall be paid to the local
814814 community sentencing system as reparation to the
815815 community. Day fines shall be used to support the
816816 local system,
817817 z. to submit to blood or saliva testing as required by
818818 subsection I of this section,
819819 aa. to repair or restore property damaged by the
820820 defendant’s conduct, if the court determines the
821821 defendant possesses suffi cient skill to repair or
822822 restore the property and the victim consents to the
823823 repairing or restoring of the property,
824824 bb. to restore damaged property in kind or payment of out -
825825 of-pocket expenses to the victim, if the court is able
826826 to determine the actual out-of-pocket expenses
827827 suffered by the victim,
828828 cc. to attend a victim-offender reconciliation program if
829829 the victim agrees to participate and the offende r is
830830 deemed appropriate for participati on,
831831 dd. in the case of a person convicted of prostitution
832832 pursuant to Section 1029 of Title 21 of the Oklahom a
833833 Statutes, require such person to receive counseling
834834 for the behavior which may have caused such person to
835835 engage in prostitution activities. Such person may be

888888 not limited to alcohol and substance ab use, sexual
889889 behavior problems or domestic abuse or child abuse
890890 problems,
891891 ee. in the case of a sex offender s entenced after November
892892 1, 1989, and required by law to register pursuant to
893893 the Sex Offender Registratio n Act, the court shall
894894 require the person to comply with sex offender
895895 specific rules and conditions of supervision
896896 established by the Department of Corrections and
897897 require the person to participate in a treatment
898898 program designed for the t reatment of sex offenders
899899 during the period of time while t he offender is
900900 subject to supervision by the Department of
901901 Corrections. The treatment program shall include
902902 polygraph examinations specifically des igned for use
903903 with sex offenders for purposes of supervision and
904904 treatment compliance, and shall be administ ered not
905905 less than each six (6) months during the period of
906906 supervision. The examinati on shall be administered by
907907 a certified licensed polygraph examiner. The
908908 treatment program must be approved b y the Department
909909 of Corrections or the Department of Mental Health and
910910 Substance Abuse Services. Such treatment shall be at

962962 the expense of the defendant based on the d efendant’s
963963 ability to pay,
964964 ff. in addition to other sentencing powers of the court,
965965 the court in the case of a defendant being sentenced
966966 for a felony conviction for a violation of Section 2 -
967967 402 of Title 63 of the Oklahoma Statutes whi ch
968968 involves marijuana may require the person to
969969 participate in a drug court program, if available. If
970970 a drug court program is not available, the defendant
971971 may be required to participate in a community
972972 sanctions program, if available,
973973 gg. in the case of a person convicted of an y false or
974974 bogus check violation, as de fined in Section 1541.4 of
975975 Title 21 of the Oklahoma Statutes, impo se a fee of
976976 Twenty-five Dollars ($25.00) to the victim for each
977977 check, and impose a bogus check fee to be paid to the
978978 district attorney. The bogus check fee paid to the
979979 district attorney shall be equal to the amount
980980 assessed as court cost s plus Twenty-five Dollars
981981 ($25.00) for each check upon f iling of the case in
982982 district court. This money shall be deposited in the
983983 Bogus Check Restitution Program Fund as established in
984984 subsection B of Sect ion 114 of this title.

10381038 bogus check or checks that have been submitted to the
10391039 Bogus Check Restitution Program, and
10401040 hh. any other provision specifically ordered by the court.
10411041 However, any such order for r estitution, community service,
10421042 payment to a local certi fied crime stoppers program, payment to the
10431043 Oklahoma Reward System or confinement in the county jail, or a
10441044 combination thereof, shall be made in conjunc tion with probation and
10451045 shall be made a condition of the suspended sentence.
10461046 However, unless under the supervision o f the district attorney,
10471047 the offender shall be required to pay Forty Dollars ($ 40.00) per
10481048 month to the district attorney during the first two (2) years of

10531053 any part of this requirement in the bes t interests of justice. The
10541054 court shall not waive , suspend, defer or dismiss the costs of
10551055 prosecution in its entirety. However, if the court determines that
10561056 a reduction in the fine, costs and costs of prosecution is
10571057 warranted, the court shall equally apply the same percentage
10581058 reduction to the fine, cost s and costs of prosecution owed by the

12741274 The restriction shall remain on the driver licens e for
12751275 such period as the court shall determine. The
12761276 restriction may be modified or removed by order of the
12771277 court and notice of the order sh all be given to
12781278 Service Oklahoma. Upon the expiration of the peri od
12791279 for the restriction, Service Oklahoma shall rem ove the
12801280 restriction without further court order. Failure to
12811281 comply with the order to install an ignition interlock

14161416 the court, in the case of a sex offender sentenced after November 1,
14171417 1989, and required by law to register pursuant to t he Sex Offenders
14181418 Registration Act, shall require the defendant to participate i n a
14191419 treatment program designed specifically for th e treatment of sex
14201420 offenders, if available. The treatment p rogram will include
14211421 polygraph examinations specifically designed fo r use with sex
14221422 offenders for the purpose of supervision and treatment compliance,
14231423 provided the examination is administered by a c ertified licensed
14241424 polygraph examiner. The treatment program must be approved by the
14251425 Department of Corrections or the Departmen t of Mental Health and
14261426 Substance Abuse Services. Such treatment shall be at th e expense of
14271427 the defendant based on the ability of the defendant to pay;
14281428 11. In addition to the other sentenc ing powers of the court,
14291429 the court, in the case of a person convict ed of abuse or neglect of
14301430 a child, as defined in Section 1 -1-105 of Title 10A of the Oklahoma
14311431 Statutes, may require the person t o undergo treatment or to

14901490 medical care and any boarding costs of victimized animals;
14911491 13. In addition to the oth er sentencing powers of the court, a
14921492 sex offender who is habitual or aggravated as defined by Section 584
14931493 of Title 57 of the Oklah oma Statutes and who is required to register
14941494 as a sex offender pursuant to the Sex Offenders Registration Act
14951495 shall be supervised by the Department of Corrections for the
14961496 duration of the registration period and shall be assigned to a
14971497 global position monito ring device by the Department of Corrections
14981498 for the duration of the registration period. The cost o f such
14991499 monitoring device shall be reimbursed by the offender;
15001500 14. In addition to the other sentencing po wers of the court, in
15011501 the case of a sex offender w ho is required by law to register
15021502 pursuant to the Sex Offenders Registration Ac t, the court may
15031503 prohibit the person from acce ssing or using any Internet social
15041504 networking website that has t he potential or likelihood of allowing
15051505 the sex offender to have con tact with any child who is under the age
15061506 of eighteen (18) years;

15621562 information, instant message, chat or other Internet communicatio n
15631563 name or identity information that the person uses or intends to use
15641564 while accessing the Internet or used for other purposes of soc ial
15651565 networking or other similar Internet communication; or
15661566 16. In addition to the other sentencing p owers of the court,
15671567 and pursuant to the terms and conditions of a written plea
15681568 agreement, the court may p rohibit the defendant from entering,
15691569 visiting or residing within the judicial district in which the
15701570 defendant was convicted until after completion of his or her
15711571 sentence; provided, however, the court shall ensure that the
15721572 defendant has access to those services or programs for which the
15731573 defendant is required to participate as a condition of probation.
15741574 When seeking to enter the prohibited judicial distric t for personal
15751575 business not related to his or her criminal case, the defendant
15761576 shall be required to obtai n approval by the court.
15771577 B. Notwithstanding any o ther provision of law, any person who
15781578 is found guilty of a violation of any pro vision of Section 761 or
15791579 11-902 of Title 47 of the Oklahoma Statu tes or any person pleading
15801580 guilty or nolo contendere for a violation of any provision of such
15811581 sections shall be ordered to participate in, prior to sentencing, an

16341634 or assessment personnel certified by the Department of Mental Health
16351635 and Substance Abuse Services for the purpose of evaluating the
16361636 receptivity to treatment and prognosis of the person. The court
16371637 shall order the pers on to reimburse the agency or assessor for the
16381638 evaluation. The fee shall be the amount provided in subsection C of
16391639 Section 3-460 of Title 43A of the Oklahoma Statutes. The eva luation
16401640 shall be conducted at a certified assessment agency, the offi ce of a
16411641 certified assessor or at another location as ordered by the court.
16421642 The agency or assessor shall, within seventy -two (72) hours from the
16431643 time the person is assessed, submit a writ ten report to the court
16441644 for the purpose of assisting the court in its final sen tencing
16451645 determination. No person, agency o r facility operating a n alcohol
16461646 and drug substance abuse evaluation program certified by the
16471647 Department of Mental Health and Substance Abuse Services shall
16481648 solicit or refer any person evaluated pursuant to this subsection
16491649 for any treatment program or alcoh ol and drug substance abuse
16501650 service in which such person, agency or facility has a v ested
16511651 interest; however, this provision shall not be construed to prohibit
16521652 the court from ordering participation in or any person from
16531653 voluntarily utilizing a treatment pro gram or alcohol and dr ug
16541654 substance abuse service offered by such pe rson, agency or facility.
16551655 If a person is sentenced to the custody of the Department of

17151715 refuses to comply with an order of the c ourt to obtain the
17161716 evaluation required by this subsec tion.
17171717 C. When sentencing a person convicted of a crime, the court
17181718 shall first consider a program of restitution for the victim, as
17191719 well as imposition of a fine or incarceration of the offender. The
17201720 provisions of paragraph 1 of subsection A of this secti on shall not
17211721 apply to defendants being sentenced upon their third or subsequent
17221722 to their third conviction of a felony or, beginning Jan uary 1, 1993,
17231723 to defendants being sentenced for their second or subse quent felony
17241724 conviction for violation of Section 11-902 of Title 47 of the
17251725 Oklahoma Statutes, except as otherwise provided in this subsec tion.
17261726 In the case of a person being sentenced for his or her second or
17271727 subsequent felony conviction for violation of Section 11 -902 of
17281728 Title 47 of the Oklahoma Statutes, the court may sentence the person
17291729 pursuant to the provisions of para graph 1 of subsection A of this

17881788 D. When sentencing a person convicted of a crime, the judge
17891789 shall consider any victim impact statements if submitted to the
17901790 jury, or the judge in the event a jury is waived.
17911791 E. Probation, for purposes o f subsection A of this section, is
17921792 a procedure by which a defendant fou nd guilty of a crime, whether
17931793 upon a verdict or plea of guilty or upon a plea of nolo contendere,
17941794 is released by the court subject to conditions imposed by the court
17951795 and subject to supervision by the Department of Corrections, a
17961796 private supervision provider or other person designated by the
17971797 court. Such supervision shall be initiated upon an order of
17981798 probation from the court, and shall not exceed two (2) years, unless
17991799 a petition alleging a violation of any condition of deferred
18001800 judgment or seeking revocatio n of the suspended sentence is filed
18011801 during the supervision, or as otherwise provided by law. In the
18021802 case of a person convicted of a sex offense, supervision shall begin
18031803 immediately upon release from incarceration or if parole is gran ted
18041804 and shall not be limited to two (2) years. Provided further, any
18051805 supervision provided for in this section may be extended for a
18061806 period not to exceed the expiration of the maximum term or terms of

18621862 F. The Department of Corrections, or such o ther agency as the
18631863 court may designate, shall be responsible for the monitoring and
18641864 administration of the rest itution and service programs provided for
18651865 by subparagraphs a, c and d of paragraph 1 of subsection A of this
18661866 section, and shall ensure t hat restitution payments are for warded to
18671867 the victim and that service a ssignments are properly performed.
18681868 G. 1. The Department of Corre ctions is hereby authorized,
18691869 subject to funds avai lable through appropriation by the Legislature,
18701870 to contract with counties for t he administration of county Community
18711871 Service Sentencing Programs.
18721872 2. Any offender eligible to participate in the Program pursuant
18731873 to this section shall be eligible to particip ate in a county
18741874 Program; provided, participation in county -funded Programs shall not
18751875 be limited to offenders who would otherwise be sentence d to
18761876 confinement with the Department of Corrections.
18771877 3. The Department shall establis h criteria and specifications
18781878 for contracts with counties for such Programs. A county may apply
18791879 to the Department for a contract for a county -funded Program for a
18801880 specific period of time. The Department shall be respo nsible for
18811881 ensuring that any contract ing county complies in full wi th

19341934 set appropriate compensation to the county for services to the
19351935 Department.
19361936 4. The Department is hereby authorized to provide technica l
19371937 assistance to any county in establishing a Progr am, regardless of
19381938 whether the county enters into a contract pursuant to this
19391939 subsection. Technical assistance shall include appropriate
19401940 staffing, development of community resources, sponso rship,
19411941 supervision and any other req uirements.
19421942 5. The Department s hall annually make a report to the Governor,
19431943 the President Pro Tempor e of the Senate and the Speaker of the House
19441944 on the number of such Prog rams, the number of participating
19451945 offenders, the success rates of each Program according to criteria
19461946 established by the Department and the costs of each Program.
19471947 H. As used in this section:
19481948 1. “Ignition interlock device ” means a device that, without
19491949 tampering or intervention by another person, would pr event the
19501950 defendant from operatin g a motor vehicle if the defendant has a
19511951 blood or breath alcohol concentration of two -hundredths (0.02) or
19521952 greater;
19531953 2. “Electronically monitored home detention ” means
19541954 incarceration of the defendant within a specified location or
19551955 locations with monitoring by means of a device approved by t he

20092009 3. “Victims impact panel program ” means a program conducted by
20102010 a corporation registered with the Secretary of St ate in Oklahoma for
20112011 the sole purpose of operating a victims impact panel program. The
20122012 program shall include live presentations from pres enters who will
20132013 share personal stories with participants about how alcohol, drug
20142014 abuse, the operation of a motor vehicle while using an electronic
20152015 communication device or the illegal conduct of others has personally
20162016 impacted the lives of the presenters. A victims impact panel
20172017 program shall be attended by persons who have committed the offens e
20182018 of driving, operating or bein g in actual physical control of a mo tor
20192019 vehicle while under the influence of alcohol or other intoxicatin g
20202020 substance, operating a motor v ehicle while the ability of the person
20212021 to operate such vehicle was impaired due to the consumption of
20222022 alcohol or any other substance or operating a motor v ehicle while
20232023 using an electronic device or by persons who have been convicted o f
20242024 furnishing alcoholic beverage to persons under twenty -one (21) years
20252025 of age, as provided in Sections 6 -101 and 6-120 of Title 37A of the
20262026 Oklahoma Statutes. Persons attending a victims impact panel program
20272027 shall be required to pay a fee of Seve nty-five Dollars ($75.00) to
20282028 the provider of the program. A certificat e of completion shall be
20292029 issued to the person upon satisfying the attendance and fee

20872087 pecuniary interest in a victims im pact panel program. The provider
20882088 of the victims impact panel prog ram shall carry general liability
20892089 insurance and maintain an accurate accounting of all business
20902090 transactions and funds received i n relation to the victims impact
20912091 panel program. Beginning Oct ober 1, 2020, and each October 1
20922092 thereafter, the provider of the victims impact panel program shall
20932093 provide to the District Attorneys Council the following:
20942094 a. proof of registration wi th the Oklahoma Secretary of
20952095 State,
20962096 b. proof of general liability insur ance,
20972097 c. end-of-year financial statements prepared by a
20982098 certified public accountant,
20992099 d. a copy of federal income tax returns filed with the
21002100 Internal Revenue Service,
21012101 e. a registration fee of One Thousand Dollars
21022102 ($1,000.00). The registration fee shall be d eposited
21032103 in the District Attorneys Council Revol ving Fund
21042104 created in Section 215.28 of Title 19 of the Oklahoma

22332233 Database. Any defendant sentenced to prob ation shall be required t o
22342234 submit to testing within thirty (30) days of sentencing either to
22352235 the Department of Corrections or to the coun ty sheriff or other
22362236 peace officer as directed by t he court. Defendants who are
22372237 sentenced to a term of incarceration shall submit to testing in
22382238 accordance with Section 530.1 of Title 57 of th e Oklahoma Statutes,
22392239 for those defendants who en ter the custody of the Department of
22402240 Corrections or to the county s heriff, for those defendants sentenced
22412241 to incarceration in a county j ail. Convicted individua ls who have
22422242 previously submitted to DNA testin g under this section and for whom
22432243 a valid sample is on file in the OSBI Combined DNA Index System
22442244 (CODIS) Database at the time of sentencing shall not be required to
22452245 submit to additional testing. Except as required by the Sex
22462246 Offenders Registration Act, a deferred judgment does not require
22472247 submission to DNA testing.
22482248 Any person who is incarcerated in the custody of the Department
22492249 of Corrections after July 1, 1996, and who has not been re leased
22502250 before January 1, 2006, shall provide a blood or saliva sample p rior
22512251 to release. Every person subject to DNA testing after Januar y 1,
22522252 2006, whose sentence does not include a term of confinement with the
22532253 Department of Corrections shall submit a blood or saliv a sample.

23092309 J. Samples of blood or saliva for D NA testing required by
23102310 subsection I of this sect ion shall be taken by employees or
23112311 contractors of the Department o f Corrections, peace officers, or the
23122312 county sheriff or employees or contractors of the sheriff ’s office.
23132313 The individuals shall be properly trained to collect blood or saliva
23142314 samples. Persons collecting blood or saliva for DNA testing
23152315 pursuant to this section shall be immune from civil liabilities
23162316 arising from this activity. All collectors of DNA samples shall
23172317 ensure the collection of samples are mailed to the Oklahoma State
23182318 Bureau of Investigation within ten (10) days of the time the subject
23192319 appears for testing or within ten (10) days of the date the s ubject
23202320 comes into physical custody to serve a term of incarceration. All
23212321 collectors of DNA samples shall use sample kits provided by the OSBI
23222322 and procedures promulgated by the OSBI. Perso ns subject to DNA
23232323 testing who are not received at the Lexington Ass essment and
23242324 Reception Center shall be required to pay a fee of Fiftee n Dollars
23252325 ($15.00) to the agency collecting the sample for submission t o the
23262326 OSBI Combined DNA Index System (CODIS) Database. Any fees c ollected
23272327 pursuant to this subsection shall be depo sited in the revolving
23282328 account or the service fee account of the collection age ncy or
23292329 department.

23822382 that would subject that pers on to the provisions of the Sex
23832383 Offenders Registration Act, neither the court nor the district
23842384 attorney shall be allowed to waive or exe mpt such person from t he
23852385 registration requirements of the Sex Offenders Registration Act.
23862386 SECTION 2. AMENDATORY 22 O.S. 2021, Section 991b, is
23872387 amended to read as follows:
23882388 Section 991b. A. Whenever a sentence has been suspended by the
23892389 court after conviction of a person for any crime, the suspended
23902390 sentence of the person may not be revoked, in whole or part, for any
23912391 cause unless a petition setting forth the ground s for such
23922392 revocation is filed by the district attorney with the clerk of the
23932393 sentencing court and competent evidence justi fying the revocation of
23942394 the suspended sentence is present ed to the court at a heari ng to be
23952395 held for that purpose within twenty (20) days after the entry of t he
23962396 plea of not guilty to the petition, unless waived b y both the state
23972397 and the defendant. The State of Oklahoma may dismiss the petition
23982398 without prejudice one time upon good cause shown to the court,
23992399 provided that any successor pe tition must be filed within forty -five
24002400 (45) days of the date of the dismissal of the petiti on.

24682468 C. “Technical violation” as used in this section means a
24692469 violation of the court -imposed rules and conditions of probation,
24702470 other than:
24712471 1. Committing or being arrested for a new crime;
24722472 2. Attempting to falsify a drug screen, or three or more failed
24732473 drug or alcohol screens within a three -month period;
24742474 3. Failing to pay restitution;
24752475 4. Tampering with an electronic monitoring device;
24762476 5. Failing to initially rep ort or missing assigned reporting
24772477 requirements for an excess of sixty (60) days;
24782478 6. Unlawfully contacting a victim, code fendant or criminal

25342534 D. 1. The Department of Correcti ons shall develop a matrix of
25352535 technical violations and sanctions to address violations committed
25362536 by persons who are being supervised by the Department. The
25372537 Department shall be authorized to use a violation response and
25382538 intermediate sanction process based on the sanct ion matrix to apply
25392539 to any technical violations of probationers. Within four (4)
25402540 working days of the discovery of the violation, the probation
25412541 officer shall initiat e the violation response and intermediate
25422542 sanction process. The sentencing jud ge may authorize any
25432543 recommended sanctions, which may include, but are not limited to:
25442544 short-term jail or lockup, day treatment, program attendance,
25452545 community service, outpatie nt or inpatient treatment, monetary
25462546 fines, curfews, ignition interlock devices on vehicles, or a one-
25472547 time referral to a t erm of confinement of six (6) months in an
25482548 intermediate revocation facility operated by the Department of
25492549 Corrections; provided, upon a pproval of the district attorney, a
25502550 person may be sanctioned to serve additiona l terms of confinement in
25512551 an intermediate revocation facility. The probation officer shall
25522552 complete a sanction form, which shall specify the technical
25532553 violation, sanction, and the action plan to correct the noncompliant

26112611 The Department of Corrections shall develop a sanction matrix,
26122612 forms, policies and procedures necessary to implement this
26132613 provision. The Department of Corrections shall e stablish procedures
26142614 to hear responses to technical violations and review sanction plans
26152615 including the following:
26162616 a. hearing officers shall report through a chain of
26172617 command separate from that of the supervising
26182618 probation officers,
26192619 b. the Department shall provide the offender written
26202620 notice of the violation, the evidence relied upon, and
26212621 the reason the sanction was imposed,
26222622 c. the hearing shall be held unless the offen der waives
26232623 the right to the hearing,
26242624 d. hearings shall be electronically recorded, and
26252625 e. the Department shall provide to judges and district
26262626 attorneys a record of all violations a nd actions taken
26272627 pursuant to this subsection.
26282628 2. The hearing officer shall determine based on a preponderance
26292629 of the evidence whether a technical violatio n occurred. Upon a

26882688 revocation proceeding. If an offender does not voluntarily accept
26892689 the recommended sanction plan, the Department shall either impose
26902690 the sanction and allow the offender to appeal to the district court,
26912691 or request a revocation proceeding as provided by law. Every
26922692 administrative hearing and sanctio n imposed by the Department sh all
26932693 be appealable to the district court.
26942694 3. Absent a finding of willful nonpayment b y the offender, the
26952695 failure of an offender to pay fines and costs may not serve as a
26962696 basis for revocation, excluding restitution.
26972697 E. 1. Where one of the grounds for revocation is the failure
26982698 of the defendant to make restitution as ordered, the Department of
26992699 Corrections shall forward to the district atto rney all information
27002700 pertaining to the failure of the defendant to make timely
27012701 restitution as ordered by the court, and t he district attorney shall
27022702 file a petition setting forth th e grounds for revocation.

27612761 restitution as ordered by the court, the court will hear evidence
27622762 and if it appears to the satisfacti on of the court from such
27632763 evidence that the terms of the order of restitution create a
27642764 manifest hardship on the defendant or the immediate family of the
27652765 defendant, the court may cancel all or any part of the amount still
27662766 due, or modify the terms or method of payment ; provided, however,
27672767 the court shall continue to prioritize an order for payments of
27682768 restitution to the victim to the exten t feasible. Provided, if the
27692769 court determines that a reduction in the restitution still due is
27702770 warranted, the court shall equally apply the same percentage
27712771 reduction to any court-ordered monetary obligation owed by the
27722772 defendant including, but not lim ited to, fines, court costs and
27732773 costs of incarceration.
27742774 F. The court may revoke a portion of the sentence and leave the
27752775 remaining part not revoked, but suspended for the remain der of the
27762776 term of the sentence, and under the provisions applying to it. The
27772777 person whose suspended sentence is being c onsidered for revocation
27782778 at the hearing shall have the right to be represented by cou nsel, to

28322832 court revoking the suspended sentence, in whole or in part, shall be
28332833 subject to review on appeal, as in other appeals of criminal cases.
28342834 Provided, however, that if t he crime for which the suspended
28352835 sentence is given was a felony, the defendant may be allowed ba il
28362836 pending appeal. If th e reason for revocation be that the defendant
28372837 committed a felony, the defendant shall not be allowed bail pending
28382838 appeal.
28392839 G. Notwithstanding the provisions of subsections A and B of
28402840 this section, when the suspende d sentence of a person is being
28412841 considered for revocation for an offense where the penalty has
28422842 subsequently been lowered to a misdemeanor, the sentence shall be
28432843 modified to a term that does not exceed the current maximum
28442844 sentence.
28452845 SECTION 3. AMENDATORY 22 O.S. 2021, Section 991f, is
28462846 amended to read as follows:
28472847 Section 991f. A. For the purposes of any pr ovision of Title 22
28482848 of the Oklahoma Statutes relat ing to criminal sentencing and
28492849 restitution orders and for the Restitution and D iversion Program:
28502850 1. “Restitution” means the sum to be paid by the defendant to
28512851 the victim of the criminal act to compensate that victim for up to
28522852 three times the amount of the economic loss suffered as a direct
28532853 result of the criminal act of the defendant;

29052905 2. “Victim” means any person, partnership, corporation or legal
29062906 entity that suffers an economic loss as a direct result of t he
29072907 criminal act of another person; and
29082908 3. “Economic loss” means actual financial detriment suffered by
29092909 the victim consisting of medical expenses actually incurred, dama ge
29102910 to or loss of real and personal property and any other out -of-pocket
29112911 expenses, including loss of earnings, reasonably incurred as the
29122912 direct result of the cr iminal act of the defendant. No other
29132913 elements of damage shall be included as an economic loss for
29142914 purposes of this sect ion.
29152915 B. In all criminal prosecutions and juvenile proceedings in
29162916 this state, when the court shall prioritize an order for payments of
29172917 restitution to the victim to the exten t feasible. When the court
29182918 enters an order directing the offender to pay restitution to any
29192919 victim for economic loss or to pay to the state any fines, fees or
29202920 assessments, the order, for purpose s of validity and collection,
29212921 shall not be limited to the maximum term of imprisonment for which
29222922 the offender could have been sente nced, nor limited to any term of
29232923 probation, parole, or extension thereof, nor expire until fully
29242924 satisfied. The court order for restitution, fines, fees or
29252925 assessments shall remain a continuing obligatio n of the offender
29262926 until fully satisfied, and the obligation shall not be considered a
29272927 debt, nor shall the obligation be dischargeable in any bankruptcy
29282928 proceeding. The court or der shall continue in full force and effect

29802980 with the supervision of the state until fully satisfied, and the
29812981 state shall use all me thods of collection authorized by law.
29822982 C. 1. Upon conviction for any crime wherein property has been
29832983 stolen, converted or otherwise unlawfully obtained, or its value
29842984 substantially decreased as a direct result of the crime, or wherein
29852985 the crime victim suffered injury, loss of income, or out -of-pocket
29862986 loss, the individuals criminally responsible shall be sentenced to
29872987 make restitution. Restitution may be ordered in addition to the
29882988 punishments prescribed by law.
29892989 2. The court shall order full restitution bas ed upon the
29902990 following considerations:
29912991 a. the nature and amount of restitution shall be
29922992 sufficient to restore the c rime victim to the
29932993 equivalent economic status existing prior to the
29942994 losses sustained as a direct result of the crime, and
29952995 may allow the crime victim to receive payment in
29962996 excess of the losses sustained; provided, the excess
29972997 amount of restitution shall not be more tha n treble
29982998 the actual economic loss incurred, and
29992999 b. the amount of restitution shall be established
30003000 regardless of the financial resou rces of the offender.
30013001 3. The court:
30023002 a. may direct the return of property to be made as soon
30033003 as practicable and ma ke an award of restitution in the

30563056 a direct result of the crime, including out -of-pocket
30573057 expenses and loss of earnings incurred as a result of
30583058 damage to or loss of use of the property, the cost to
30593059 return the property to the victim or to restore the
30603060 property to its pre-crime condition whichever may be
30613061 appropriate under the circumstances,
30623062 b. may order restitution in a lump sum or by such
30633063 schedules as may be established and thereafter
30643064 adjusted by agreement c onsistent with the order of the
30653065 court,
30663066 c. shall have the authority to amend or alter any o rder
30673067 of restitution made pursuant to this section providing
30683068 that the court shall state its reasons and conclusions
30693069 as a matter of record for any change or amendment to
30703070 any previous order,
30713071 d. may order interest upon any ordered restitution sum to
30723072 accrue at the rate of twelve percent (12%) per annum
30733073 until the restitution is paid in full. The court may
30743074 further order such interest to be paid to the victims
30753075 of the crime or proportion the interest payment
30763076 between the victims and the court fund, and/or the
30773077 Restitution and Diversion Program, in the discretion

31313131 defendant, including, but not limited to, orders
31323132 imposed under civil and criminal proceedings.
31333133 D. If restitution to more than one person, agency or entity is
31343134 set at the same time, the c ourt shall establish the following
31353135 priorities of payment:
31363136 1. The crime victim or victims; and
31373137 2. Any other government agency which has provided reimbursement
31383138 to the victim as a result of the offender ’s criminal conduct.
31393139 E. 1. The district attorney ’s office shall present the crime
31403140 victim’s restitution claim to the court at the time of the
31413141 conviction of the offender or the res titution provisions shall be
31423142 included in the written plea agreement presented to the court, in
31433143 which case, the restitution claim sh all be reviewed by the judge
31443144 prior to acceptance of the plea agreement.
31453145 2. At the initiation of the prosecution o f the defendant, the
31463146 district attorney’s office shall provide all identifiable crime
31473147 victims with written and oral information explaining their rights
31483148 and responsibilities to receive restitution established under this
31493149 section.
31503150 3. The district attorney ’s office shall provide all crime
31513151 victims, regardless of whether the crime victim makes a specific
31523152 request, with an official request for restituti on form to be
31533153 completed and signed by the crime victim, and to include all

32063206 earnings and out-of-pocket loss. This form shall be filed with any
32073207 victim impact statement to be included in the judgment and sentence.
32083208 Every crime victim receiving the restitution claim form shall be
32093209 provided assistance and direction to properly complete the form.
32103210 4. The official restitution request form shall be presented in
32113211 all cases regardless of whether the case is brought to trial. In a
32123212 plea bargain, the district attorney in every case where the victim
32133213 has suffered economic loss, shall, as a part of the plea bargain,
32143214 require that the offender pay restitution t o the crime victim. The
32153215 district attorney shall be authorized to act as a clearing house for
32163216 collection and disbursement of restitution payments made pursuant to
32173217 this section, and shall assess a fee of One Dollar ($1.00) per
32183218 payment received from the defendant, except when the defendant is
32193219 sentenced to incarceration in the Department of Corrections.
32203220 F. The crime victim shall provide all documentation and
32213221 evidence of compensation or reimbursement from insurance companies
32223222 or agencies of this state, any othe r state, or the federal
32233223 government received as a direct result of the crime for injury, loss
32243224 of earnings or out-of-pocket loss.
32253225 G. The court shall, upon motion by the crime victim, redact
32263226 from the submitted documentation all personal information relating
32273227 to the crime victim that does not directly and neces sarily establish

32803280 of the restitution claim.
32813281 H. The unexcused failure or refusal of the crime victim to
32823282 provide all or part of the requi site information prior to the
32833283 sentencing, unless disclosure is deferred by the court, shall
32843284 constitute a waiver of any grounds to appeal or seek future
32853285 amendment or alteration of the restitution order predicated on the
32863286 undisclosed available information. The court shall order the
32873287 offender to submit either a s part of the pre-sentence investigation
32883288 or assessment and evaluation required for a community sentence or,
32893289 if no pre-sentence investigation is conducted, in advance of the
32903290 sentencing proceeding such info rmation as the court may direct and
32913291 finds necessary to be disclosed for the purpose of ascertaining the
32923292 type and manner of restitution to be ordered.
32933293 I. The willful failure or refusal of the offender to provide
32943294 all or part of the requisite information prior to the sentencing,
32953295 unless disclosure is deferred by the court shall not deprive the
32963296 court of the authority to set restitution or set the schedule of
32973297 payment. The willful failure or refusal of the offender to provide
32983298 all or part of the requisite informa tion prior to the sentencing,
32993299 unless disclosure is deferred by the court, shall constitute a
33003300 waiver of any grounds to appeal or seek future amendment or
33013301 alteration of the restitution order predicated on the undisclosed

33573357 J. The court shall conduct such hearings or proceedings as it
33583358 deems necessary to set restitution and payment schedules at the time
33593359 of sentencing or may bifurcate the sentencing and defer the hearing
33603360 or proceedings relating to the imposition of restitution as justice
33613361 may require. Amendments or alterations to the restitution order may
33623362 be made upon the court ’s own motion, petition by the crime victim or
33633363 petition by the offender.
33643364 K. An offender who files a meritless or frivolous petition for
33653365 amendment or alteration to the restitution order shall pay the costs
33663366 of the proceeding on the petition and shall have added to the
33673367 existing restitution order the additional loss of earnings and out -
33683368 of-pocket loss incurred by the crime victim in responding to the
33693369 petition.
33703370 L. The restitution request form shall be promulgated by the
33713371 District Attorneys Council and provided to all district attorney
33723372 offices.
33733373 M. If a defendant who is financially able refuses or neglects
33743374 to pay restitution as ordered by this section , payment may be

34273427 1. By contempt of court as provided in subsection A of Section
34283428 566 of Title 21 of the Oklahoma Statutes with imprisonment or fine
34293429 or both;
34303430 2. In the same manner as prescribed in subsection N of this
34313431 section for a defendant who is without means to make such
34323432 restitution payment; or
34333433 3. Revocation of the criminal sentence if the sentence impose d
34343434 was a suspended or defer red sentence or a community sentence.
34353435 N. If the defendant is without means to pay the restitution,
34363436 the judge may direct the total amount due, or any portion thereof,
34373437 to be entered upon the court minutes and to be certified in the
34383438 district court of the county where it shall then be entered upon the
34393439 district court judgment docket and shall have the full force and
34403440 effect of a district court judgment in a civil case. Thereupon the
34413441 same remedies shall be available for the enforcement of the judgment
34423442 as are available to enforce other judgments; provided, however, the
34433443 judgment herein prescribed shall not be considered a deb t nor
34443444 dischargeable in any bankruptcy proceeding.
34453445 O. Whenever a person has been ordered t o pay restitution as
34463446 provided in this section or any section of the Oklahoma Statutes for
34473447 a criminal penalty, the judge may order the defendant to a term of
34483448 community service, w ith or without compensation, to be credited at a
34493449 rate of Five Dollars ($5.00) per day against the total a mount due
34503450 for restitution. If the defendant fails to perform the required

35083508 shall be used by the court as sanctions and means of collection for
35093509 criminal restitution orders and restitution orders that have been
35103510 reduced to judgment.
