75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 26 O.S. 2021, Section 14 -118, is
77	77	amended to read as foll ows:
78	78	Section 14-118. A. When an application for an absentee ballot
79	79	pursuant to Section 14-142 of this title is received by the
80	80	secretary of a county election board, it shall be the duty of the
81	81	secretary to transmit by United States mail, by facsimile dev ice as
82	82	defined in Section 1862 of Title 21 of the Oklahoma Statutes, or as
83	83	provided in subsection B of this section the ballots which the
84	84	elector has requested and is entitled to receive. When an
85	85	application for an absentee ballot is received at least for ty-five
86	86	(45) days before an election involving state or federal offices, the
87	87	absentee ballot shall be transmitted by mail, by electronic mail, or

140	140	section, or by facsimile device as provided in Section 14-118.1 of
141	141	this title, not less than forty -five (45) days preceding the
142	142	election. When an application for an absentee ballot for an
143	143	election involving state or federal offices is received less than
144	144	forty-five (45) days preceding the election, th e absentee ballot
145	145	shall be transmitted by mail, by electronic mail, or by other means
146	146	of electronic communication, as provided in this section, or by
147	147	facsimile device as provided in Section 14 -118.1 of this title,
148	148	within forty-eight (48) hours of receipt o f the application.
149	149	B. The secretary of the county election board may transmit
150	150	balloting materials for any state or federal election, or for any
151	151	other election as designated by the Secretary of the State Election
152	152	Board as provided in subsection D of this s ection, by electronic
153	153	mail or by other means of electronic communication in a f orm and
154	154	manner prescribed by the Secretary of the State Election Board, if
155	155	the voter:
156	156	1. Is a Federal Post Card Application registrant and is
157	157	eligible to receive an absentee ba llot as provided by law;
158	158	2. Provides an electronic mail address; and
159	159	3. Requests that balloting materials be sent by electronic
160	160	mail.
161	161	If the secretary of the county election board transmits a ballot
162	162	to a voter by electronic mail or by other means of elec tronic

214	214	communication as provided in this subsection, the secretary shall
215	215	amend the voter’s federal postcard application for future elections
216	216	to include the voter ’s electronic mail address.
217	217	C. An electronic mail address provided under this section is
218	218	confidential and does not constitute public information for purposes
219	219	of the Oklahoma Open Records Act. The secretary of the county
220	220	election board shall ensure that an electronic mail address provided
221	221	under this section is excluded from disclosure.
222	222	D. The Secretary of the State Election Board shall determine if
223	223	balloting materials for an y election other than a state or federal
224	224	election may be produced in a form which w ould allow them to be
225	225	transmitted by electronic mail or by other means of electronic
226	226	communication. If so, the Secretary shall so designate them. If
227	227	such designation is not made, the balloting materials may be
228	228	transmitted to the voter as provided in subsection A of this
229	229	section.
230	230	E. All other provisions of this title that would normally apply
231	231	to a ballot voted under this title apply to a ballot provided
232	232	pursuant to the prov isions of subsection B of this section.
233	233	F. The Secretary of the State Election Boa rd may suspend the
234	234	provisions of subsection B of this section if the Secretary
235	235	determines that electronic transmission of balloting materials is
236	236	not in the best interest of the people of this state due to a
237	237	potential problem with the security of the balloting materials.

290	290	section shall be returned by hand delivery, United States mail, or
291	291	by a private mail service t o the county election board as required
292	292	pursuant to Section 14-108 of this title.
293	293	SECTION 2. This act shall become effective January 1, 2025.
