7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 26 O.S. 2021, Section 14 -118, is
7777 amended to read as foll ows:
7878 Section 14-118. A. When an application for an absentee ballot
7979 pursuant to Section 14-142 of this title is received by the
8080 secretary of a county election board, it shall be the duty of the
8181 secretary to transmit by United States mail, by facsimile dev ice as
8282 defined in Section 1862 of Title 21 of the Oklahoma Statutes, or as
8383 provided in subsection B of this section the ballots which the
8484 elector has requested and is entitled to receive. When an
8585 application for an absentee ballot is received at least for ty-five
8686 (45) days before an election involving state or federal offices, the
8787 absentee ballot shall be transmitted by mail, by electronic mail, or

139139 by other means of electronic communication, as provided in this
140140 section, or by facsimile device as provided in Section 14-118.1 of
141141 this title, not less than forty -five (45) days preceding the
142142 election. When an application for an absentee ballot for an
143143 election involving state or federal offices is received less than
144144 forty-five (45) days preceding the election, th e absentee ballot
145145 shall be transmitted by mail, by electronic mail, or by other means
146146 of electronic communication, as provided in this section, or by
147147 facsimile device as provided in Section 14 -118.1 of this title,
148148 within forty-eight (48) hours of receipt o f the application.
149149 B. The secretary of the county election board may transmit
150150 balloting materials for any state or federal election, or for any
151151 other election as designated by the Secretary of the State Election
152152 Board as provided in subsection D of this s ection, by electronic
153153 mail or by other means of electronic communication in a f orm and
154154 manner prescribed by the Secretary of the State Election Board, if
155155 the voter:
156156 1. Is a Federal Post Card Application registrant and is
157157 eligible to receive an absentee ba llot as provided by law;
158158 2. Provides an electronic mail address; and
159159 3. Requests that balloting materials be sent by electronic
160160 mail.
161161 If the secretary of the county election board transmits a ballot
162162 to a voter by electronic mail or by other means of elec tronic

214214 communication as provided in this subsection, the secretary shall
215215 amend the voter’s federal postcard application for future elections
216216 to include the voter ’s electronic mail address.
217217 C. An electronic mail address provided under this section is
218218 confidential and does not constitute public information for purposes
219219 of the Oklahoma Open Records Act. The secretary of the county
220220 election board shall ensure that an electronic mail address provided
221221 under this section is excluded from disclosure.
222222 D. The Secretary of the State Election Board shall determine if
223223 balloting materials for an y election other than a state or federal
224224 election may be produced in a form which w ould allow them to be
225225 transmitted by electronic mail or by other means of electronic
226226 communication. If so, the Secretary shall so designate them. If
227227 such designation is not made, the balloting materials may be
228228 transmitted to the voter as provided in subsection A of this
229229 section.
230230 E. All other provisions of this title that would normally apply
231231 to a ballot voted under this title apply to a ballot provided
232232 pursuant to the prov isions of subsection B of this section.
233233 F. The Secretary of the State Election Boa rd may suspend the
234234 provisions of subsection B of this section if the Secretary
235235 determines that electronic transmission of balloting materials is
236236 not in the best interest of the people of this state due to a
237237 potential problem with the security of the balloting materials.

289289 G. Any absentee ballot received by a method authorized by this
290290 section shall be returned by hand delivery, United States mail, or
291291 by a private mail service t o the county election board as required
292292 pursuant to Section 14-108 of this title.
293293 SECTION 2. This act shall become effective January 1, 2025.
