8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. AMENDATORY 62 O.S. 2021, Section 2004, is
8383 amended to read as follows:
8484 Section 2004. A. The monies appropriated to the Rural Economic
8585 Action Plan Fund shall be subject to all of the requirements of
8686 Sections 2006 through 2013 of this title.
8787 B. In a fiscal year for which the amount appropriated to the
8888 Rural Economic Action Plan Fund is less than or equa l to the sum of
8989 Fifteen Million Five Hundred Thousand Dollars ($15,500,000.00),

142142 Section 2006 of this title the sum of one-tenth (1/10) of the amount
143143 appropriated to the Rural Economic Action Plan Fund with the
144144 exception of one account which shall be divided equally into two
145145 subaccounts. One of the two subaccounts shal l be available to one
146146 and only one of the entities described by subsection B o f Section
147147 2007 of this title for loans or distribution to cities or towns
148148 within the respective jurisdiction of the entity if the population
149149 of such city or town does not exceed seven thousand (7,000) persons
150150 according to the latest Federal Decennial Census or for the benefit
151151 of an unincorporated area. Funds may also be loaned or expended for
152152 any city or town with a population below seven thousand (7,000)
153153 persons based upon the c urrent population estimate according to the
154154 U.S. Census Bureau. Funds may be loaned or expended for such cities
155155 and towns until the next following Federal Decennial Census .
156156 Provided, for any fiscal year following the first fiscal year that
157157 the provisions of subsection D of this section have taken effect ,
158158 funds appropriated to the Rural Economic Action Plan Fund shall be
159159 deposited as provided in subsection D of this section and the
160160 provisions of this subsection shall not be in effect.
161161 C. In a fiscal year for which the amount appropriated to the
162162 Rural Economic Action Plan Fund is gr eater than Fifteen Million Five
163163 Hundred Thousand Dollars ($15,500,000.00), but less than Seventeen
164164 Million Fifty Thousand Dollars ($17,050,000.00), there shall be
165165 deposited into each of nine separate accounts for the entities

218218 One Million Five Hundred Fifty Thousand Dollars ($1,550,000.00).
219219 There shall be divided equally between two additional accounts for
220220 the use and benefit of the entities described by subsectio n B of
221221 Section 2007 of this title the balance of any such appropriation in
222222 excess of Thirteen Million Nine Hundred Fifty Thousand Dollars
223223 ($13,950,000.00), but less than Seventeen Million Fifty Thousand
224224 Dollars ($17,050,000.00).
225225 D. In the first fiscal yea r for which the amount appropriated
226226 to the Rural Economic Action Plan Fund equals or exceeds the sum of
227227 Seventeen Million Fifty Thousand Dollars ($17,050,000.00), and in
228228 every subsequent fiscal year, there shall be deposited an equal
229229 amount to each of elev en accounts created for the use and benefit of
230230 the entities described by subsec tions A and B of Section 2007 of
231231 this title.
232232 E. Regardless of the number of accounts created based upon the
233233 appropriation amount to the Rural Economic Action Plan Fund, all
234234 loans and expenditures from all accounts shall be gov erned by the
235235 limitations imposed pursuant to Sections 2002 through 2013 of this
236236 title, including the limitations applicable to loans and
237237 expenditures for the benefit of cities or towns based upon
238238 population limits or loans and expenditures for the benefit of
239239 unincorporated areas.

291291 SECTION 2. AMENDATORY 62 O.S. 2021, Section 2006, is
292292 amended to read as follows:
293293 Section 2006. A. There is hereby established a fund within the
294294 State Treasury to be known as the Rural Economic Action Plan Fund,
295295 to be administered by the Oklahoma Department of Commerce. The fund
296296 shall be a continuing fund not subject to fiscal year limitations.
297297 Within the Rural Economic Action Plan Fund there shall be
298298 established separate accounts a s prescribed by Section 2004 of this
299299 title into which shall be deposited such funds as may be pro vided by
300300 law.
301301 B. Except as otherwise provided by Section 2004 of this title,
302302 one of nine accounts shall be available to each entit y described in
303303 subsection A of Section 2007 of this title.
304304 C. Except as otherwise provided by Section 2004 of this title,
305305 one account shall be divided equally into two subaccounts. One of
306306 the two subaccounts shall be available to each of the entities
307307 described by subsection B of Se ction 2007 of this title for loans or
308308 distribution to any city or town within the respective jurisdiction
309309 of the entity if the population of such city or town does not exceed
310310 seven thousand (7,000) persons according to the lates t Federal
311311 Decennial Census or for the benefit of an unincorporated area.
312312 Funds may also be loaned to or expended for any city or town with a
313313 population below seven thousand (7,000) persons based upon the

366366 Funds may be loaned to or expended for such cities and towns unt il
367367 the next following Federal Decennial Census.
368368 D. No funds deposited into one a ccount or subaccount s hall be
369369 transferred to any other account. No entity may access any more
370370 than one account per fiscal year and the total loans or expenditure
371371 from any one account for each fiscal year may not exceed the amount
372372 of funds available to each account as may be provided by law.
373373 E. The repayment of principal and interest income for loans
374374 distributed from an accoun t or subaccount shall accrue to the
375375 balance of the account or subaccount.
376376 F. No monies in the Rural Economic Action Plan Fund shall be
377377 used for the payment of administrative expenses, salaries , or any
378378 other continuing obligatio n of the Oklahoma Department of Commerce.
379379 SECTION 3. AMENDATORY 62 O.S. 2021, Section 2007, is
380380 amended to read as follows:
381381 Section 2007. A. A voluntary association of Oklahoma lo cal
382382 governmental jurisdictions or another legal en tity, including a
383383 public trust or a nonprofit corporation or other entity which
384384 performs functions for the benefit of or which exists for the
385385 primary benefit of Oklahoma local governmental jurisdictions and
386386 which is not described in subsection B of this se ction, shall be
387387 eligible to obtain funding for rural economic development projects
388388 as authorized by Section 2004 of this title or as authorized by
389389 subsection B of Section 2006 of this title.

441441 B. A voluntary association of Oklahoma local governmental
442442 jurisdictions containing at least one municipality with a population
443443 in excess of three hundred fifty thousand (350,000) persons
444444 according to the latest Federal Decennial Census, shall be eligible
445445 to obtain funding as authorized by Section 2004 of this title or as
446446 authorized by subsection C of Section 2 006 of this title.
447447 C. The entities described in subsection A or B of this sect ion
448448 and which are eligible f or any funds authorized by Section 2006 of
449449 this title shall be prohibited from providing loans and making
450450 expenditures on behalf of or from providing loans and making payment
451451 directly to any city or town with a population in excess of seven
452452 thousand (7,000) persons using any funds deposited to the Rural
453453 Economic Action Plan Fund created by Section 2006 of this title.
454454 Funds may also be expended for or loaned to any city or town with a
455455 population below seven thousand (7,000) persons based upon the
456456 current population estimate accordi ng to the U.S. Census Bureau.
457457 Funds may be expended for or loaned to such cities and towns until
458458 the next following Federal Decennial Census.
459459 D. An organization described in subsection A or B of this
460460 section shall be authorized to make payment of funds obtained
461461 pursuant to Section 2006 of this title directly to a county if the
462462 funds are used for the benefit of an unincorporated area located
463463 within the county to which payment is made if the area benefited
464464 does not contain a population in excess of seven thousand (7,0 00)

516516 persons. After the county has provided a request to an organization
517517 described in subsection A or B of this section for funds to benefit
518518 an unincorporated area of the county, together with a statement that
519519 the county has conducted a review of the needs of unincorporated
520520 areas located within the county and that the funding requested is
521521 consistent with the evaluation of priorities for funds by the
522522 county, the funds requested may be paid to the county. Any funds
523523 loaned or paid to a county pursuant to the provisions of this
524524 subsection shall be expended by the county exclusive ly for the
525525 purpose identified in the request.
526526 E. No county to which funds are loaned or paid pursuant to the
527527 provisions of subsection D of this section shall be liable to any
528528 person or other legal entity for damages arising out of any
529529 condition, act, omis sion or other cause alleged to have arisen as a
530530 result of a project upon which funds expended pursuant to the
531531 authority of subsection D of this section were paid to the county.
532532 SECTION 4. AMENDATORY 62 O.S. 2021, Section 2008, is
533533 amended to read as follows :
534534 Section 2008. A. The governing board of an entity described by
535535 subsection A or B of Section 2007 of this title shall develop a plan
536536 for the use of available funds for the economic development of areas
537537 included within its respe ctive jurisdiction. For purposes of this
538538 act, “economic development ” shall include, but shall not be limited
539539 to, the following purposes:

591591 1. Rural water quality projects, including acquisition,
592592 treatment, distribution and recovery of water for consumption by
593593 humans or animals or b oth;
594594 2. Rural solid waste disposal, treatment or sim ilar projects;
595595 3. Rural sanitary sewer construction or improvement projects;
596596 4. Rural road or street construction or improvement projects;
597597 5. Provision of rural fire protecti on services and public
598598 safety services;
599599 6. Expenditures designed to increase the employment level
600600 within the jurisdiction of the entity;
601601 7. Provision of health care services, including emergency
602602 medical care, in rural areas;
603603 8. Construction or improveme nt of telecommunication fa cilities
604604 or systems;
605605 9. Improvement of municipal ene rgy distribution systems; and
606606 10. Community buildings, courthouses, town halls, senior
607607 nutrition centers, meeting rooms or similar public facilities.
608608 B. Effective July 1, 2010 , at least eighty percent (80%) of any
609609 funds distributed to an entity as provided by this section shall be
610610 loaned or expended for assets described in paragraphs 1 through 6 of
611611 subsection A of this section. The remaining amount of any funds
612612 distributed to an entity as provided by t his section may be loaned
613613 or expended on assets or purposes described in paragraphs 7 through
614614 10 of subsection A of this section .

666666 C. Upon the effective date of this act, up to ten percent (10%)
667667 of the balance of an account or sub account available to each of the
668668 entities described by Section 2007 of this title may be loaned to
669669 private entities, government subdivisions, or tribal g overnments for
670670 the purposes described in subsection A of this section.
671671 D. Not later than July 31, each entity described by Section
672672 2007 of this title shall transmit, i n such electronic form as may be
673673 prescribed by the Oklahoma Department of Commerce for purposes of
674674 access to such information on the website maintained by the
675675 Department, a summary of each pr oject upon which funds received by
676676 the entity from the Rural Economic Action Plan Fund were expended or
677677 loaned during the fiscal year endin g on the June 30 date immediately
678678 preceding the July 31 reporting date.
679679 SECTION 5. AMENDATORY 62 O.S. 2021, Section 2010, is
680680 amended to read as follows:
681681 Section 2010. No entity which qualifies for funds pursuant to
682682 Section 2006 of this title shall be required to provide matching
683683 funds or to provide equivalent value in order to obtain available
684684 funds or funds for planning loans and expenditures.
685685 SECTION 6. This act shall become effective November 1, 2024.
