4142 An Act relating to the Oklahoma Juvenile Code ;
4243 amending 10A O.S. 2021, Section 2 -8-224, as amended

4647 products by those under 21 ; broadening entities who
4748 may conduct certain program; authorizing enactment
4849 and enforcement of certain municipal ordinan ces;
4950 limiting amount of certain fine; requiring offender
5051 to complete certain educational program; granting
5152 certain powers to municipal judge; and providing an
5253 effective date.

5758 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5859 SECTION 1. AMENDATORY 10A O.S. 2021, Section 2 -8-224, as
5960 amended by Section 1, Chapter 26 1, O.S.L. 2022 (10A O.S. Supp. 2022,
6061 Section 2-8-224), is amended to read as follows:
6162 Section 2-8-224. A. It is unlawful for a person who is under
6263 twenty-one (21) years of age to purchase, receive, or have in his or
6364 her possession a tobacco product, nicotine product or vapor product,
6465 or to present or offer to any person any purported proof of age
6566 which is false or fraudulent, for the purpose of purchasi ng or
66-receiving any tobacco product, nicotine product or vapor product.

93+receiving any tobacco product, nicotine product or vapor product.
9494 It shall not be unlawful for an employe e under twenty-one (21) years
9595 of age to handle tobacco products, nicotine products or vapor
9696 products when required in the performance of the emp loyee’s duties.
9797 B. When a person violates subsection A of this section, the
9898 Alcoholic Beverage Laws Enforcement (ABLE) Commission shall require
9999 the violator to shall complete an education or tobacco use cessation
100100 program conducted by:
101101 1. The Alcoholic Beverage Laws Enforcement ( ABLE) Commission
102102 and approved by the State Department of Health ; or
103103 2. A municipality.
104104 C. The ABLE Commission shall establish r ules to provide for
105105 notification to a parent or guardian of any minor cited for a
106106 violation of this section.
107107 D. Cities and towns may enact ordinances prohibiting and
108108 penalizing conduct in violation of subsection A of this section.
109109 Any fine imposed for a violation of subsection A of this section
110110 shall not exceed Fifty Dollars ($50.00) for a first offense or One
111111 Hundred Dollars ($100.00) for a subsequent offense. An offender
112112 found to be in violation of subsection A of this section shall
113113 complete an educational program designed to deter the unlawful
114114 conduct. The municipal judge may order the offender to complete
115115 community service or to undergo services as determined by the judge.

143142 E. For the purposes of this section, the term “vapor products”
144143 shall have the same meanin g as provided in the Prevention of Youth
145144 Access to Tobacco Act.
146145 SECTION 2. This act shall become effective November 1, 2023.
