7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
7878 SECTION 1. AMENDATORY 59 O.S. 202 1, Section 567.4, is
7979 amended to read as follows:
8080 Section 567.4. A. The Oklahoma Board of Nursing is hereb y
8181 established in the State of Oklahom a this state. The Board shall
8282 consist of eleven (1 1) members who shall be citizens of the United
8383 States of America, and residents o f Oklahoma, for at least the
8484 previous three (3) years. Six of the members shall be Reg istered
8585 Nurses, in good standing unde r the provisions of the Oklahoma
8686 Nursing Practice Act, currently engaged in the practice of nursing
8787 as a Registered Nurse and shall have had no less than five (5) years
8888 of experience as a Registered Nurse. At least two of the Registered

140140 Nurses shall be from the field of nursing education, actively
141141 associated with a recognized school of nursing in Oklahoma, and who
142142 hold an organization al role of administration/management and who are
143143 accountable for strategic, operational and/or performance outcomes.
144144 At least two of the Registered Nurses who hold an organiz ational
145145 role of administration/management and who are account able for
146146 strategic, operational and/or performance outcomes shall represent
147147 nursing service. At least one of the Registered Nurses shall be
148148 currently engaged in the practice of nursing as an Adv anced Practice
149149 Registered Nurse. Three of the members shall be Licensed Practica l
150150 Nurses in good standing under the provisions of the Oklahoma Nursing
151151 Practice Act and currently engaged in the practice of practical
152152 nursing as a Licensed Practical Nurse an d shall have had no less
153153 than five (5) years of experience as a Licensed Practical Nurse.
154154 One of the licensed nurses must be employed in the field of long -
155155 term care. One of the licensed nurses shall be e mployed in the area
156156 of acute care. Two members sha ll represent the public and shall be
157157 eligible voters of this state, knowledgeable in consumer health
158158 concerns, and shall neither be nor ever have been associated with
159159 the provision of health care, nor be e nrolled in any health -related
160160 educational program. The public members shall be appointed by the
161161 Governor to serve coterminously wit h the Governor. At least one
162162 Registered Nurse Board member, one Licensed Practical Nur se Board

214214 member and one public Board member shall be appointed from a county
215215 with a population of less than forty thousand (40,000).
216216 B. For the purpose of nominating, a ppointing or reappointing
217217 members to the Board, this state shall be divided into eight
218218 geographical districts, consisting of counties within the districts
219219 as follows:
220220 District No. 1 Cimarron, Texas, Beaver, Harper, Woods, Alfalfa,
221221 Grant, Kay, Ellis, Woodwa rd, Major, Garfield,
222222 Noble, Dewey, Blaine, Kingfisher and Logan;
223223 District No. 2 Roger Mills, Custer, Beckham, Washita, Caddo ,
224224 Greer, Kiowa, Harmon, Jackson, Comanche, Tillman
225225 and Cotton;
226226 District No. 3 Canadian, Grady, McClain, Garvin, Stephens,
227227 Murray, Jefferson, Carter and Love;
228228 District No. 4 Oklahoma;
229229 District No. 5 Lincoln, Okfuskee, Cl eveland, Pottawatomie,
230230 Seminole, Hughes, Pontotoc, Coal, Johnston,
231231 Marshall and Bryan;
232232 District No. 6 Creek and Tulsa;
233233 District No. 7 Osage, Washington, Nowata, Craig, O ttawa,
234234 Pawnee, Payne, Rogers, Mayes and Delaware; and
235235 District No. 8 Wagoner, Cherokee, Adair, Okmulgee, Muskogee,

290290 Not more than one Reg istered Nurse and on e Licensed Practical
291291 Nurse and one public member shall be appointed from any one
292292 geographical district.
293293 C. The Governor shall appoint the Registered Nurse Board
294294 members from a list of names submitted by the Oklahoma Nurses
295295 Association and Oklahoma chapter s of nationally recognized
296296 Registered Nurse organizations. The Governor shall appoint the
297297 Licensed Practical Nurse Board members from a list of names
298298 submitted by the Oklahoma chapters of nationally recognized nursing
299299 organizations. Individuals who are m embers of the Oklahoma Board of
300300 Nursing prior to September 1, 1991, shall be allowed to fulfill
301301 their terms and be eligible for reappointment.
302302 In selecting appointees, the Governor may consider
303303 recommendations from a statewide organization representin g nurses, a
304304 state chapter of a natio nal organization representing nurses, or
305305 other groups or individuals in this state .
306306 D. The Governor shall appoint the Registered Nurse and Licensed
307307 Practical Nurse members shall be appointed for terms of five (5)
308308 years. Upon the death, re signation, or removal of any member, a
309309 list from the aforementioned orga nizations shall be submitted to the
310310 Governor who shall appoint a member to fill the vacancy.

362362 1. In addition to the groun ds for removal by th e Governor of
363363 members appointed to the Boar d provided in Section 2 of Title 74 of
364364 the Oklahoma Statutes, it is a gr ound for removal if a member :
365365 a. does not have at the time of app ointment the
366366 qualifications required by subsection A of this
367367 section,
368368 b. is not employed in nursing for a period of twe lve (12)
369369 consecutive months during the term for which the
370370 member was appointed,
371371 c. is absent from more than half of the regularly
372372 scheduled Board meetings that the member is eligible
373373 to attend during a calendar ye ar, unless the absence
374374 is excused by a majo rity vote of the Board, or
375375 d. cannot discharge the duties as a Board mem ber for a
376376 substantial portion of the term for which the member
377377 is appointed because of illness or disability.
378378 2. The validity of an action o f the Board is not affected by
379379 the fact that it is taken when a ground for removal of a Board
380380 member exists.
381381 3. If the president of the Board has knowledge that a potential
382382 ground for removal exists, the president shall then notify the
383383 Governor that a potential ground for removal exists.
384384 E. A quorum shall be a majority of the Board which must include
385385 at least three Registered Nurses and one Lic ensed Practical Nurse.

437437 F. The members of the Board shall annually elect from their
438438 number a president, vic e-president and a secretary who shall also be
439439 the treasurer, and other such officers as necessary to conduct the
440440 business of the Board. It shall hol d six regular business meetings
441441 during each calendar year. Special meetings may be cal led by the
442442 president or secretary with five (5) days ’ notice to each member of
443443 the Board. The Board shall have a seal; it shall make and ado pt all
444444 necessary rules not i nconsistent with the laws of th is state, the
445445 United States, or with the Oklahoma Nursin g Practice Act; and it
446446 shall perform the duties and transact the busi ness required under
447447 the provisions of the act. The Board shall cause to be kept a
448448 record of all meetings of the Board and give not ice of all meetings
449449 in accordance with the Administrativ e Procedures Act and the
450450 Oklahoma Open Meeting Act. A list of all persons dul y licensed and
451451 qualified under this act the Oklahoma Nursing Practi ce Act shall be
452452 maintained by the Board. Each member of the Board sha ll receive, in
453453 addition to actual and necessary tr avel expenses as provided in the
454454 State Travel Reimburs ement Act, compensation of One Hundred Dollars
455455 ($100.00) for each regular scheduled mon thly meeting attended, not
456456 to exceed more than six meetings per y ear. All monies received by
457457 the Board shall be he ld by the treasurer of the Board for meeting
458458 the expenses of the Board and for the promotion of nursing
459459 education, to employ an attorney to a ssist the Board and other state
460460 and county officials in carrying out the provisions of the Ok lahoma

512512 Nursing Practice Act, and such other purposes which the Board may
513513 determine, and shall be disbursed as directed by the Board. The
514514 Board is authorized to ad opt and revise rules, not inconsistent with
515515 the provisions of the Oklahoma Nursing Practice A ct, as may be
516516 necessary to enable it to carry into effect the provisions of the
517517 act, including rules establishing fees, charg es and reimbursement
518518 costs. The Board shall appoint and employ a qualified person, who
519519 shall be a Registered Nurse to serve as Exe cutive Director, and
520520 shall fix the compensation, notwithstanding any other p rovision of
521521 law including Section 3601.2 of Title 74 of the Oklahoma Statutes,
522522 in an amount not in excess of the maximum salary proposed for the
523523 Oklahoma Board of Nursing and set f orth in the most recen t
524524 Compensation Report prepared by or for the Office of Management and
525525 Enterprise Services, require a sa tisfactory bond, and define the
526526 duties of the Executive Director to include:
527527 1. The authority and resp onsibility for the operation s and
528528 administration of the agency and such additional powers and duties
529529 as prescribed by the Board. As chief executive of t he Board, the
530530 Executive Director shall manage all aspects of the agency, including
531531 personnel, financial and other resources, in sup port of the Oklahoma
532532 Nursing Practice Act, its rules and policies, and the B oard’s
533533 mission and strategic plan;
534534 2. The authority to accept orders as set forth in p aragraph 3
535535 of this subsection on behalf of the Board and where ra tification by

588588 summaries of dispositions to the Board at its regular meetings; and
589589 3. a. Orders issued under Section 2 of this act 567.8a of
590590 this title,
591591 b. Agreed disciplinary orders requiring an applicant or
592592 licensee to enter and comply with t he Peer Assistance
593593 Program peer assistance program ,
594594 c. Agreed disciplinary orders for the reinstatem ent or
595595 endorsement of a license/certificate/recog nition when
596596 the applicant has practiced witho ut an active Oklahoma
597597 license/certificate/recognition, and
598598 d. Agreed disciplinary orde rs for the voluntary surrender
599599 of a license/certification/recognition.
600600 SECTION 2. This act shall become effective No vember 1, 2023.
