77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
78	78	SECTION 1. AMENDATORY 59 O.S. 202 1, Section 567.4, is
79	79	amended to read as follows:
80	80	Section 567.4. A. The Oklahoma Board of Nursing is hereb y
81	81	established in the State of Oklahom a this state. The Board shall
82	82	consist of eleven (1 1) members who shall be citizens of the United
83	83	States of America, and residents o f Oklahoma, for at least the
84	84	previous three (3) years. Six of the members shall be Reg istered
85	85	Nurses, in good standing unde r the provisions of the Oklahoma
86	86	Nursing Practice Act, currently engaged in the practice of nursing
87	87	as a Registered Nurse and shall have had no less than five (5) years
88	88	of experience as a Registered Nurse. At least two of the Registered

140	140	Nurses shall be from the field of nursing education, actively
141	141	associated with a recognized school of nursing in Oklahoma, and who
142	142	hold an organization al role of administration/management and who are
143	143	accountable for strategic, operational and/or performance outcomes.
144	144	At least two of the Registered Nurses who hold an organiz ational
145	145	role of administration/management and who are account able for
146	146	strategic, operational and/or performance outcomes shall represent
147	147	nursing service. At least one of the Registered Nurses shall be
148	148	currently engaged in the practice of nursing as an Adv anced Practice
149	149	Registered Nurse. Three of the members shall be Licensed Practica l
150	150	Nurses in good standing under the provisions of the Oklahoma Nursing
151	151	Practice Act and currently engaged in the practice of practical
152	152	nursing as a Licensed Practical Nurse an d shall have had no less
153	153	than five (5) years of experience as a Licensed Practical Nurse.
154	154	One of the licensed nurses must be employed in the field of long -
155	155	term care. One of the licensed nurses shall be e mployed in the area
156	156	of acute care. Two members sha ll represent the public and shall be
157	157	eligible voters of this state, knowledgeable in consumer health
158	158	concerns, and shall neither be nor ever have been associated with
159	159	the provision of health care, nor be e nrolled in any health -related
160	160	educational program. The public members shall be appointed by the
161	161	Governor to serve coterminously wit h the Governor. At least one
162	162	Registered Nurse Board member, one Licensed Practical Nur se Board

216	216	B. For the purpose of nominating, a ppointing or reappointing
217	217	members to the Board, this state shall be divided into eight
218	218	geographical districts, consisting of counties within the districts
219	219	as follows:
220	220	District No. 1 Cimarron, Texas, Beaver, Harper, Woods, Alfalfa,
221	221	Grant, Kay, Ellis, Woodwa rd, Major, Garfield,
222	222	Noble, Dewey, Blaine, Kingfisher and Logan;
223	223	District No. 2 Roger Mills, Custer, Beckham, Washita, Caddo ,
224	224	Greer, Kiowa, Harmon, Jackson, Comanche, Tillman
225	225	and Cotton;
226	226	District No. 3 Canadian, Grady, McClain, Garvin, Stephens,
227	227	Murray, Jefferson, Carter and Love;
228	228	District No. 4 Oklahoma;
229	229	District No. 5 Lincoln, Okfuskee, Cl eveland, Pottawatomie,
230	230	Seminole, Hughes, Pontotoc, Coal, Johnston,
231	231	Marshall and Bryan;
232	232	District No. 6 Creek and Tulsa;
233	233	District No. 7 Osage, Washington, Nowata, Craig, O ttawa,

293	293	C. The Governor shall appoint the Registered Nurse Board
294	294	members from a list of names submitted by the Oklahoma Nurses
295	295	Association and Oklahoma chapter s of nationally recognized
296	296	Registered Nurse organizations. The Governor shall appoint the
297	297	Licensed Practical Nurse Board members from a list of names
298	298	submitted by the Oklahoma chapters of nationally recognized nursing
299	299	organizations. Individuals who are m embers of the Oklahoma Board of
300	300	Nursing prior to September 1, 1991, shall be allowed to fulfill
301	301	their terms and be eligible for reappointment.
302	302	In selecting appointees, the Governor may consider
303	303	recommendations from a statewide organization representin g nurses, a
304	304	state chapter of a natio nal organization representing nurses, or
305	305	other groups or individuals in this state .
306	306	D. The Governor shall appoint the Registered Nurse and Licensed
307	307	Practical Nurse members shall be appointed for terms of five (5)
308	308	years. Upon the death, re signation, or removal of any member, a
309	309	list from the aforementioned orga nizations shall be submitted to the
310	310	Governor who shall appoint a member to fill the vacancy.

362	362	1. In addition to the groun ds for removal by th e Governor of
363	363	members appointed to the Boar d provided in Section 2 of Title 74 of
364	364	the Oklahoma Statutes, it is a gr ound for removal if a member :
365	365	a. does not have at the time of app ointment the
366	366	qualifications required by subsection A of this
367	367	section,
368	368	b. is not employed in nursing for a period of twe lve (12)
369	369	consecutive months during the term for which the
370	370	member was appointed,
371	371	c. is absent from more than half of the regularly
372	372	scheduled Board meetings that the member is eligible
373	373	to attend during a calendar ye ar, unless the absence
374	374	is excused by a majo rity vote of the Board, or
375	375	d. cannot discharge the duties as a Board mem ber for a
376	376	substantial portion of the term for which the member
377	377	is appointed because of illness or disability.
378	378	2. The validity of an action o f the Board is not affected by
379	379	the fact that it is taken when a ground for removal of a Board
380	380	member exists.
381	381	3. If the president of the Board has knowledge that a potential
382	382	ground for removal exists, the president shall then notify the
383	383	Governor that a potential ground for removal exists.
384	384	E. A quorum shall be a majority of the Board which must include
385	385	at least three Registered Nurses and one Lic ensed Practical Nurse.

437	437	F. The members of the Board shall annually elect from their
438	438	number a president, vic e-president and a secretary who shall also be
439	439	the treasurer, and other such officers as necessary to conduct the
440	440	business of the Board. It shall hol d six regular business meetings
441	441	during each calendar year. Special meetings may be cal led by the
442	442	president or secretary with five (5) days ’ notice to each member of
443	443	the Board. The Board shall have a seal; it shall make and ado pt all
444	444	necessary rules not i nconsistent with the laws of th is state, the
445	445	United States, or with the Oklahoma Nursin g Practice Act; and it
446	446	shall perform the duties and transact the busi ness required under
447	447	the provisions of the act. The Board shall cause to be kept a
448	448	record of all meetings of the Board and give not ice of all meetings
449	449	in accordance with the Administrativ e Procedures Act and the
450	450	Oklahoma Open Meeting Act. A list of all persons dul y licensed and
451	451	qualified under this act the Oklahoma Nursing Practi ce Act shall be
452	452	maintained by the Board. Each member of the Board sha ll receive, in
453	453	addition to actual and necessary tr avel expenses as provided in the
454	454	State Travel Reimburs ement Act, compensation of One Hundred Dollars
455	455	($100.00) for each regular scheduled mon thly meeting attended, not
456	456	to exceed more than six meetings per y ear. All monies received by
457	457	the Board shall be he ld by the treasurer of the Board for meeting
458	458	the expenses of the Board and for the promotion of nursing
459	459	education, to employ an attorney to a ssist the Board and other state
460	460	and county officials in carrying out the provisions of the Ok lahoma

513	513	determine, and shall be disbursed as directed by the Board. The
514	514	Board is authorized to ad opt and revise rules, not inconsistent with
515	515	the provisions of the Oklahoma Nursing Practice A ct, as may be
516	516	necessary to enable it to carry into effect the provisions of the
517	517	act, including rules establishing fees, charg es and reimbursement
518	518	costs. The Board shall appoint and employ a qualified person, who
519	519	shall be a Registered Nurse to serve as Exe cutive Director, and
520	520	shall fix the compensation, notwithstanding any other p rovision of
521	521	law including Section 3601.2 of Title 74 of the Oklahoma Statutes,
522	522	in an amount not in excess of the maximum salary proposed for the
523	523	Oklahoma Board of Nursing and set f orth in the most recen t
524	524	Compensation Report prepared by or for the Office of Management and
525	525	Enterprise Services, require a sa tisfactory bond, and define the
526	526	duties of the Executive Director to include:
527	527	1. The authority and resp onsibility for the operation s and
528	528	administration of the agency and such additional powers and duties
529	529	as prescribed by the Board. As chief executive of t he Board, the
530	530	Executive Director shall manage all aspects of the agency, including
531	531	personnel, financial and other resources, in sup port of the Oklahoma
532	532	Nursing Practice Act, its rules and policies, and the B oard’s
533	533	mission and strategic plan;
534	534	2. The authority to accept orders as set forth in p aragraph 3
535	535	of this subsection on behalf of the Board and where ra tification by
