75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 59 O.S. 2021, Section 353.24, is
77	77	amended to read as follows:
78	78	Section 353.24. A. It shall be unlawful for any licensee or
79	79	other person to:
80	80	1. Forge or increase the quantity of drug in any prescription,
81	81	or to present a prescription bearing forged , fictitious or altere d
82	82	information or to possess any drug secured by such forged,
83	83	fictitious or altered prescription;
84	84	2. Sell, offer for sale, barter or give a way any unused
85	85	quantity of drugs obtained by prescription, except through a program
86	86	pursuant to the Utilization of Un used Prescription Medications Act
87	87	or as otherwise provided by the State Board of Pharmacy;

139	139	3. Sell, offer for sale, barter or give away an y drugs damaged
140	140	by fire, water, or other causes without first obt aining the written
141	141	approval of the Board or the Stat e Department of Health;
142	142	4. No person, firm or business establishment shall offer to the
143	143	public, in any manner, their services as a “pick-up station” or
144	144	intermediary for the purpose of having prescription s filled or
145	145	delivered, whether for profit or gratuit ously. Nor may the owner of
146	146	any pharmacy or drug store authorize any person, firm or business
147	147	establishment to act for them in this manner with these exceptions:
148	148	a. patient-specific filled prescriptions may be delivered
149	149	or shipped to a prescriber’s clinic for pick-up by
150	150	those patients whom the prescriber has individually
151	151	determined and documented do not have a permanent or
152	152	secure mailing address,
153	153	b. patient-specific filled prescriptions for drugs which
154	154	require special handling written by a prescriber may
155	155	be delivered or shipped to the prescriber’s clinic for
156	156	administration or pick -up at the prescriber ’s office,
157	157	c. patient-specific filled pres criptions, including
158	158	sterile compounded drugs, may be delivered o r shipped
159	159	to a prescriber’s clinic where they shall be
160	160	administered,
161	161	d. patient-specific filled prescriptions for patients
162	162	with end-stage renal disease (ESRD) may be delivered

215	215	or final delivery to the patient,
216	216	e. patient-specific filled prescriptions fo r
217	217	radiopharmaceuticals may be delivered or shipped to a
218	218	prescriber’s clinic for administration or pick -up, or
219	219	f. patient-specific filled prescriptions may be delivered
220	220	or shipped by an Indian Health Services Service (IHS)
221	221	or federally recognized tribal health organization
222	222	operating under the IHS in the delivery of the
223	223	prescriptions to a pharmacy operated by the IHS or a
224	224	federally recognized tribal health organization for
225	225	pick-up by an IHS or tribal patient.
226	226	However, nothing in this paragrap h shall prevent a pharmacist or
227	227	an employee of the pharmacy from personally receiving a prescription
228	228	or delivering a legally filled prescrip tion to a residence, office
229	229	or place of employment of the patient for whom the pre scription was
230	230	written. Provided f urther, the provisions of this paragr aph shall
231	231	not apply to any Department of Mental Health and Substance Abuse
232	232	Services employee or any per son whose facility contracts with the
233	233	Department of Mental Health and Substance Ab use Services whose
234	234	possession of any dangerous drug, as defined in Sect ion 353.1 of
235	235	this title, is for the purpose of delivery of a mental health
236	236	consumer’s medicine to the consumer’s home or residence. Nothing in
237	237	this paragraph shall prevent veterinary p rescription drugs from

290	290	distributor registered with the Oklahoma State Board of Veterinary
291	291	Medical Examiners to a clie nt; provided, such drugs may be dispensed
292	292	only on prescription of a licensed veterinarian and only when an
293	293	existing veterinary-client-patient relationship exists. Nothing in
294	294	this paragraph shall prevent dialysate and peritoneal dialysis
295	295	devices from being shipped directly from an Oklahoma licensed
296	296	manufacturer, wholesaler or dist ributor to an ESRD patient or
297	297	patient’s designee, consistent with subsection F of Section 353.18
298	298	of this title;
299	299	5. Sell, offer for sale or barter or buy any professional
300	300	samples except through a program pursuant to the Utilization of
301	301	Unused Prescription M edications Act;
302	302	6. Refuse to permit o r otherwise prevent members of the Bo ard
303	303	or such representatives thereof from entering and inspecting any and
304	304	all places, including premises, vehicles, equipment, contents, and
305	305	records, where drugs, medicine, chemicals or poisons are stored,
306	306	sold, vended, given away, compounded, dispensed, re packaged,
307	307	transported, or manufactured;
308	308	7. Interfere, refuse to participate in, impede or otherwise
309	309	obstruct any inspection, investigation or disciplinary pro ceeding
310	310	authorized by the Oklahoma Pharmacy Act;
311	311	8. Possess dangerous drugs without a valid pr escription or a
312	312	valid license to possess such drugs; provided, however, this

364	364	provision shall not apply to a ny Department of Mental Health and
365	365	Substance Abuse Services employee or any person whose facility
366	366	contracts with the Department of Mental Health and Substance Abuse
367	367	Services whose possession of any dangerous drug, as defined in
368	368	Section 353.1 of this title, is for the purpose of delivery of a
369	369	mental health consumer’s medicine to the consumer’s home or
370	370	residence;
371	371	9. Fail to establish and maintain effec tive controls against
372	372	the diversion of drugs for any other purpose than legitimate
373	373	medical, scientific or in dustrial uses as provided by state, federal
374	374	and local law;
375	375	10. Fail to have a written drug diversion detectio n and
376	376	prevention policy;
377	377	11. Possess, sell, offer for sale, barter or give away any
378	378	quantity of dangerous drugs not listed as a scheduled drug pu rsuant
379	379	to Sections 2-201 through 2-212 of Title 63 of the Oklahoma Statutes
380	380	when obtained by prescription bea ring forged, fictitious or altered
381	381	information.
382	382	a. A first violation of this section shall constitute a
383	383	misdemeanor and upon conviction shall be pu nishable by
384	384	imprisonment in the county jail for a term not more
385	385	than one (1) year and a fine in an amount no t more
386	386	than One Thousand Dollars ($1,000.00).

438	438	b. A second violation of this section shall constitute a
439	439	felony and upon conviction shall be punishabl e by
440	440	imprisonment in the Department of Corrections for a
441	441	term not exceeding five (5) years and a fine in an
442	442	amount not more than Two Thousand Dollars ($2,000.00);
443	443	12. Violate a Board order or agreed order;
444	444	13. Compromise the security of licensure examina tion materials;
445	445	or
446	446	14. Fail to notify the Board, in w riting, within ten (10 ) days
447	447	of a licensee or perm it holder’s address change.
448	448	B. 1. It shall be unlawful for any person o ther than a
449	449	licensed pharmacist or physician to certify a prescription before
450	450	delivery to the patient or the patient ’s representative or
451	451	caregiver. Dialysate and peritoneal dialysis devices supplied
452	452	pursuant to the provisions of subsection F of Section 35 3.18 of this
453	453	title shall not be required to be certified by a pharmacist prior to
454	454	being supplied by a manufacturer, wholesaler or dis tributor.
455	455	2. It shall be unlawful for any person to institute or manage a
456	456	pharmacy unless such person is a licensed pharma cist or has placed a
457	457	licensed pharmacist in charge of such pharmacy.
458	458	3. No licensed pharmacist shall manage, supervise or be in
459	459	charge of more than one ph armacy.
460	460	4. No pharmacist being requested to sell, furnish or compound
461	461	any drug, medicine, chemical o r other pharmaceutical preparation, by

514	514	substituted for it, without authori ty of the prescriber o r
515	515	purchaser, any like drug, medicine, chemical or pharmaceutical
516	516	preparation.
517	517	5. No pharmacy, pharma cist-in-charge or other person shall
518	518	permit the practice of pharmacy except by a licensed pharmacist or
519	519	assistant pharmacist.
520	520	6. No person shall subvert t he authority of the pharmacist-in-
521	521	charge of the pharmacy by impeding the management of the
522	522	prescription department to act in compliance with federal and state
523	523	law.
524	524	C. 1. It shall be unlawful for a pharmacy to resell dangerous
525	525	drugs to any wholesale distr ibutor.
526	526	2. It shall be unlawful for a whol esale distributor to purchase
527	527	drugs from a pharmacy.
528	528	D. Unless the pharmacy is in violation of applicable state or
529	529	federal laws or is in violation of terms of the contract with the
530	530	wholesale distributor including but not limited to financial terms ,
531	531	or unless the drug is under a method of distribution or allocation
532	532	by the wholesale distributor or manufacturer or is under a supply
533	533	constraint, it shall be unlawful for a wholesale distributor to :
534	534	1. Prevent a licensed pharmacy under contract with the
535	535	wholesale distributor from purchasing drugs that the wholesale
536	536	distributor sells; or
