7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 59 O.S. 2021, Section 353.24, is
7777 amended to read as follows:
7878 Section 353.24. A. It shall be unlawful for any licensee or
7979 other person to:
8080 1. Forge or increase the quantity of drug in any prescription,
8181 or to present a prescription bearing forged , fictitious or altere d
8282 information or to possess any drug secured by such forged,
8383 fictitious or altered prescription;
8484 2. Sell, offer for sale, barter or give a way any unused
8585 quantity of drugs obtained by prescription, except through a program
8686 pursuant to the Utilization of Un used Prescription Medications Act
8787 or as otherwise provided by the State Board of Pharmacy;

139139 3. Sell, offer for sale, barter or give away an y drugs damaged
140140 by fire, water, or other causes without first obt aining the written
141141 approval of the Board or the Stat e Department of Health;
142142 4. No person, firm or business establishment shall offer to the
143143 public, in any manner, their services as a “pick-up station” or
144144 intermediary for the purpose of having prescription s filled or
145145 delivered, whether for profit or gratuit ously. Nor may the owner of
146146 any pharmacy or drug store authorize any person, firm or business
147147 establishment to act for them in this manner with these exceptions:
148148 a. patient-specific filled prescriptions may be delivered
149149 or shipped to a prescriber’s clinic for pick-up by
150150 those patients whom the prescriber has individually
151151 determined and documented do not have a permanent or
152152 secure mailing address,
153153 b. patient-specific filled prescriptions for drugs which
154154 require special handling written by a prescriber may
155155 be delivered or shipped to the prescriber’s clinic for
156156 administration or pick -up at the prescriber ’s office,
157157 c. patient-specific filled pres criptions, including
158158 sterile compounded drugs, may be delivered o r shipped
159159 to a prescriber’s clinic where they shall be
160160 administered,
161161 d. patient-specific filled prescriptions for patients
162162 with end-stage renal disease (ESRD) may be delivered

214214 or shipped to a prescriber ’s clinic for administration
215215 or final delivery to the patient,
216216 e. patient-specific filled prescriptions fo r
217217 radiopharmaceuticals may be delivered or shipped to a
218218 prescriber’s clinic for administration or pick -up, or
219219 f. patient-specific filled prescriptions may be delivered
220220 or shipped by an Indian Health Services Service (IHS)
221221 or federally recognized tribal health organization
222222 operating under the IHS in the delivery of the
223223 prescriptions to a pharmacy operated by the IHS or a
224224 federally recognized tribal health organization for
225225 pick-up by an IHS or tribal patient.
226226 However, nothing in this paragrap h shall prevent a pharmacist or
227227 an employee of the pharmacy from personally receiving a prescription
228228 or delivering a legally filled prescrip tion to a residence, office
229229 or place of employment of the patient for whom the pre scription was
230230 written. Provided f urther, the provisions of this paragr aph shall
231231 not apply to any Department of Mental Health and Substance Abuse
232232 Services employee or any per son whose facility contracts with the
233233 Department of Mental Health and Substance Ab use Services whose
234234 possession of any dangerous drug, as defined in Sect ion 353.1 of
235235 this title, is for the purpose of delivery of a mental health
236236 consumer’s medicine to the consumer’s home or residence. Nothing in
237237 this paragraph shall prevent veterinary p rescription drugs from

289289 being shipped directly from an Oklahoma licensed wholesaler or
290290 distributor registered with the Oklahoma State Board of Veterinary
291291 Medical Examiners to a clie nt; provided, such drugs may be dispensed
292292 only on prescription of a licensed veterinarian and only when an
293293 existing veterinary-client-patient relationship exists. Nothing in
294294 this paragraph shall prevent dialysate and peritoneal dialysis
295295 devices from being shipped directly from an Oklahoma licensed
296296 manufacturer, wholesaler or dist ributor to an ESRD patient or
297297 patient’s designee, consistent with subsection F of Section 353.18
298298 of this title;
299299 5. Sell, offer for sale or barter or buy any professional
300300 samples except through a program pursuant to the Utilization of
301301 Unused Prescription M edications Act;
302302 6. Refuse to permit o r otherwise prevent members of the Bo ard
303303 or such representatives thereof from entering and inspecting any and
304304 all places, including premises, vehicles, equipment, contents, and
305305 records, where drugs, medicine, chemicals or poisons are stored,
306306 sold, vended, given away, compounded, dispensed, re packaged,
307307 transported, or manufactured;
308308 7. Interfere, refuse to participate in, impede or otherwise
309309 obstruct any inspection, investigation or disciplinary pro ceeding
310310 authorized by the Oklahoma Pharmacy Act;
311311 8. Possess dangerous drugs without a valid pr escription or a
312312 valid license to possess such drugs; provided, however, this

364364 provision shall not apply to a ny Department of Mental Health and
365365 Substance Abuse Services employee or any person whose facility
366366 contracts with the Department of Mental Health and Substance Abuse
367367 Services whose possession of any dangerous drug, as defined in
368368 Section 353.1 of this title, is for the purpose of delivery of a
369369 mental health consumer’s medicine to the consumer’s home or
370370 residence;
371371 9. Fail to establish and maintain effec tive controls against
372372 the diversion of drugs for any other purpose than legitimate
373373 medical, scientific or in dustrial uses as provided by state, federal
374374 and local law;
375375 10. Fail to have a written drug diversion detectio n and
376376 prevention policy;
377377 11. Possess, sell, offer for sale, barter or give away any
378378 quantity of dangerous drugs not listed as a scheduled drug pu rsuant
379379 to Sections 2-201 through 2-212 of Title 63 of the Oklahoma Statutes
380380 when obtained by prescription bea ring forged, fictitious or altered
381381 information.
382382 a. A first violation of this section shall constitute a
383383 misdemeanor and upon conviction shall be pu nishable by
384384 imprisonment in the county jail for a term not more
385385 than one (1) year and a fine in an amount no t more
386386 than One Thousand Dollars ($1,000.00).

438438 b. A second violation of this section shall constitute a
439439 felony and upon conviction shall be punishabl e by
440440 imprisonment in the Department of Corrections for a
441441 term not exceeding five (5) years and a fine in an
442442 amount not more than Two Thousand Dollars ($2,000.00);
443443 12. Violate a Board order or agreed order;
444444 13. Compromise the security of licensure examina tion materials;
445445 or
446446 14. Fail to notify the Board, in w riting, within ten (10 ) days
447447 of a licensee or perm it holder’s address change.
448448 B. 1. It shall be unlawful for any person o ther than a
449449 licensed pharmacist or physician to certify a prescription before
450450 delivery to the patient or the patient ’s representative or
451451 caregiver. Dialysate and peritoneal dialysis devices supplied
452452 pursuant to the provisions of subsection F of Section 35 3.18 of this
453453 title shall not be required to be certified by a pharmacist prior to
454454 being supplied by a manufacturer, wholesaler or dis tributor.
455455 2. It shall be unlawful for any person to institute or manage a
456456 pharmacy unless such person is a licensed pharma cist or has placed a
457457 licensed pharmacist in charge of such pharmacy.
458458 3. No licensed pharmacist shall manage, supervise or be in
459459 charge of more than one ph armacy.
460460 4. No pharmacist being requested to sell, furnish or compound
461461 any drug, medicine, chemical o r other pharmaceutical preparation, by

513513 prescription or otherwise, shall substit ute or cause to be
514514 substituted for it, without authori ty of the prescriber o r
515515 purchaser, any like drug, medicine, chemical or pharmaceutical
516516 preparation.
517517 5. No pharmacy, pharma cist-in-charge or other person shall
518518 permit the practice of pharmacy except by a licensed pharmacist or
519519 assistant pharmacist.
520520 6. No person shall subvert t he authority of the pharmacist-in-
521521 charge of the pharmacy by impeding the management of the
522522 prescription department to act in compliance with federal and state
523523 law.
524524 C. 1. It shall be unlawful for a pharmacy to resell dangerous
525525 drugs to any wholesale distr ibutor.
526526 2. It shall be unlawful for a whol esale distributor to purchase
527527 drugs from a pharmacy.
528528 D. Unless the pharmacy is in violation of applicable state or
529529 federal laws or is in violation of terms of the contract with the
530530 wholesale distributor including but not limited to financial terms ,
531531 or unless the drug is under a method of distribution or allocation
532532 by the wholesale distributor or manufacturer or is under a supply
533533 constraint, it shall be unlawful for a wholesale distributor to :
534534 1. Prevent a licensed pharmacy under contract with the
535535 wholesale distributor from purchasing drugs that the wholesale
536536 distributor sells; or

588588 2. Restrict the amount of a particular drug to a licensed
