7171 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7272 SECTION 1. AMENDATORY 10 O.S. 2021, Section 7503-2.6, is
7373 amended to read as follo ws:
7474 Section 7503-2.6. A. 1. A mother or putative father at least
7575 sixteen (16) years of age, of a minor born out of wedlock who is not
7676 an Indian child, as defined by the Oklahoma Indian Child Welfa re
7777 Act, may execute an extrajudicial consent before a notary public in
7878 which the mother or putative father waives any legal interest in the
7979 minor, disclaims any legal rights with resp ect to the minor, and
8080 consents to the adoption of the minor. An extrajud icial consent may
8181 be executed by a mother or putative father before or after the birth
8282 of the minor.
8383 2. A man who is the legal husband of the mother of a mi nor who
8484 is not an Indian child, as defined by the Oklahoma India n Child
8585 Welfare Act, may execute an extrajudicial consent before a notary

137137 public in which he waives any legal interest in the minor, disclaims
138138 any legal rights with respect to the minor, and c onsents to the
139139 adoption of the minor. An extrajudicial consent may be executed by
140140 the father only after the birth of the minor.
141141 B. The extrajudicial conse nt shall contain:
142142 1. The date, place, and time of the execution of the consent;
143143 2. The name, current mailing address, teleph one number, date of
144144 birth, and social security number of the mother or putative father
145145 executing the consent;
146146 3. Instructions tha t the consent is revocab le for any reason
147147 for fifteen (15) days after the execution of the consent, the manner
148148 in which it may be revoked, and that thereafter the c onsent is
149149 irrevocable, except upon the specific grounds specified in Section
150150 7503-2.7 of this title;
151151 4. A statement that the mother or putative father is executing
152152 the document voluntarily and is unequivocally c onsenting to the
153153 adoption of the minor, and that the mother or putative father
154154 understands that the consent is final, and except for fra ud or
155155 duress or the other grounds set forth in Section 7503-2.7 of this
156156 title, may not be revoked for any reason more than fif teen (15) days
157157 after execution of the document;
158158 5. A statement that the mother or putative father executing
159159 consent is represente d by counsel or has waived the right to

212212 6. A statement that the mother or putative father understands
213213 that the execution of the extrajudicia l consent does not terminate
214214 any duty of the pers on executing the extrajudicial consent to
215215 support the mother or the minor until the adoption is completed;
216216 7. A statement that the mother or putative father executing the
217217 consent is not a member of an Indian tribe an d that the minor is
218218 not, through her or him, eligible for membership in an Indian tribe;
219219 8. A statement that the mother or putative father believes that
220220 the adoption of the minor is in t he minor’s best interests;
221221 9. A statement that the mother or putative father has been
222222 advised that an adult adopted person born in Oklahoma, whose decree
223223 of adoption is finalized after November 1, 1997, may obtain a copy
224224 of such person’s original certificate of bir th unless affidavits of
225225 nondisclosure have been filed pursuant to Section 7503-2.5 of this
226226 title and that the consenting mother or putative father may file an
227227 affidavit of nondisclosure;
228228 10. A statement that the mother or putative father has not
229229 received or been promised any money or any thing of value for the
230230 extrajudicial consent, except for payment s authorized by law; and
231231 11. A statement that the mother or putative father is not under
232232 the influence of alcohol or medication or other substance that
233233 affects his competence at the time of the signing of the
234234 extrajudicial consent.

286286 C. An extrajudicial co nsent shall be revocable for any reason
287287 for fifteen (15) calendar days after the execution of the consent
288288 before the notary public. To For a putative father to revoke the
289289 extrajudicial consent, the consenting person must file a notice of
290290 revocation and an intent to claim paternity, an acknowledgem ent of
291291 paternity, or a notice of his desire to receive notice of adoption
292292 proceedings or proceedings to terminate his parental rights, with
293293 the Paternity Registry of the Department of Human Services pursuant
294294 to Section 7506-1.1 of this title, and must prov ide a copy of this
295295 notice to the birth mother at the time of filing the notice with the
296296 Paternity Registry of the Department of Human Servic es.
297297 D. The execution of an ex trajudicial consent does not
298298 extinguish any duty of the mother or putative father to support the
299299 mother or the minor until the adoption is completed.
300300 E. Where no notice of revocation is filed in the time period
301301 specified in subsection C of this section, the execu tion of the
302302 extrajudicial consent s hall operate as a waiver of the consenting
303303 person’s right to notice and participation in any adoption
304304 proceedings or termination of parental rights proceedings regarding
305305 the minor referenced in the extrajudicial consent.
306306 SECTION 2. This act shall become effective November 1, 2023.
