8585 BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
8686 SECTION 1. NEW LAW A new sec tion of law to be codified
8787 in the Oklahoma Statutes as Section 18-114.15 of Title 70, unless
8888 there is created a duplication in numb ering, reads as follows:
8989 A. Beginning with the 2023 -2024 school year, certified
9090 personnel, as defined in Section 26 -103 of this title, in the public
9191 schools of Oklahoma shall r eceive in salary and/or fringe ben efits
9292 not less than the amounts specified in the following schedule:

305305 B. 1. When determining the Minimum Salary Schedule, “fringe
306306 benefits” shall mean all or part of reti rement benefits, excluding
307307 the contributions made pursuant to subsection A of Section 17-108.1
308308 of this title and the flexible benefit allowance pursuant to Section
309309 26-105 of this title from the f lexible benefit allowan ce funds
310310 disbursed by the State Board of Education an d the State Board of
311311 Career and Technology Education pursuant to Section 26-104 of this
312312 title.
313313 2. If a school district intend s to provide retirement b enefits
314314 to a teacher such that the teacher ’s salary would be less than the
315315 amounts set forth in the minim um salary schedule specified in
316316 subsection A of this section, the d istrict shall be require d to

370370 thirty (30) days prior to the date the district elects to provide
371371 retirement benefits such that t he teacher’s salary would be less
372372 than the minimum salary s chedule.
373373 C. Any of the degrees referred to in this section shall be from
374374 a college recognized by the State Board of Education. The Board
375375 shall accept teaching experience from out -of-state school districts
376376 that are accredited by the state board of education or appropriate
377377 state accrediting agency for the districts. The Board shall accept
378378 teaching experience from out-of-country schools that are accredited
379379 or otherwise endorsed by the appropriate na tional or regional
380380 accrediting or endorsement authority. Out-of-country certification
381381 documentation in a language other than English sh all be analyzed by
382382 an educational credential evaluati on service in accordance with
383383 industry standards and guidelines and approved by the State
384384 Department of Education. The person seeking to have credit g ranted
385385 for out-of-country teaching experience shall be responsible for all
386386 costs of the analysis by a cre dential evaluation service. The Board
387387 shall accept teaching experi ence from primary and se condary schools
388388 that are operated by the United States Depar tment of Defense or are
389389 affiliated with the United S tates Department of State.
390390 D. For the purpose of sta te salary increments and retirement,
391391 no teacher shall be granted cr edit for more than five (5) years of
392392 active duty in the mil itary service or out -of-state or out-of-

444444 country teaching experience as a cert ified teacher or its
445445 equivalent. Nothing in this section shall prohibit boards of
446446 education from crediting more years o f experience on district salary
447447 schedules than those allowe d for state purposes.
448448 E. The State Board of Education shall recognize, for p urposes
449449 of certification and salary increments, all t he years of experience
450450 of a:
451451 1. Certified teacher who teaches in t he educational program o f
452452 the Department of Corrections, be ginning with fiscal year 1981;
453453 2. Vocational rehabilitation counselor under the Department of
454454 Human Services if the counselor was employed as a certified teacher
455455 by the State Department of Educati on when the Division of Vocational
456456 Rehabilitation was trans ferred from the State Boa rd of Career and
457457 Technology Education or the State B oard of Education to the Oklahoma
458458 Public Welfare Commission on July 1, 1968;
459459 3. Vocational rehabilitation counselor whi ch were completed
460460 while employed by the Department of Human Services if such counsel or
461461 was certified as a teacher or was eligible for ce rtification as a
462462 teacher in Oklahoma;
463463 4. Certified teacher which were completed while employed by the
464464 Child Study Center located at University Hospital, if the teacher
465465 was certified as a teacher in Oklah oma; and
466466 5. Certified school psychologist or psycho metrist which were
467467 completed while employed as a doct oral intern, psychological

520520 if the experience primarily inv olved work with persons o f school- or
521521 preschool-age and if the person was, at the time the experience was
522522 acquired, certified as, or eligible for certification as, a school
523523 psychologist or psychome trist.
524524 F. The provisions of this section shall not apply t o teachers
525525 who have entered into postretirement employment with a public scho ol
526526 in Oklahoma and are still receiving a monthly reti rement benefit.
527527 G. If a person employed as certified personnel, as defined in
528528 Section 26-103 of this title, by a school district during t he 2017-
529529 2018 school year was receiving a salary above the step le vel
530530 indicated by the State Minimum Salary Schedule fo r the 2017-2018
531531 school year, the pers on shall receive a salary increase amount equal
532532 to the amount indicated in subsection A of this section for the step
533533 level indicated for the person, provided they rem ain employed by the
534534 same district, unless the hours or the duties of the certified
535535 personnel are reduced p roportionately.
536536 SECTION 2. NEW LAW A new section of law to be codified
537537 in the Oklahoma Statutes as Section 18-114.16 of Title 70, unless

12051205 B. 1. When determining the Minimum Salary Schedule, “fringe
12061206 benefits” shall mean all or part of retirement benefits, exclu ding

12701270 thirty (30) days prior to the date th e district elects to pr ovide
12711271 retirement benefits such that the teacher’s salary would be less
12721272 than the minimum salary s chedule.
12731273 C. Any of the degrees referred to in this section shall be from
12741274 a college recognized by the State Board of Education. The Board
12751275 shall accept teaching experience from out-of-state school districts
12761276 that are accredited by the state board of educati on or appropriate
12771277 state accrediting agency for the districts. The Board shall accept
12781278 teaching experience from out -of-country schools that are accredited
12791279 or otherwise endorsed by the a ppropriate national or regional
12801280 accrediting or endorsement authority. Out-of-country certification
12811281 documentation in a language other than English shall be a nalyzed by
12821282 an educational credential evaluation serv ice in accordance with
12831283 industry standards and g uidelines and approved by the State
12841284 Department of Education. The person seeking to have credit granted
12851285 for out-of-country teaching experience shall be respo nsible for all
12861286 costs of the analysis by a credential evaluation service. The Board
12871287 shall accept teaching experience from primary and se condary schools
12881288 that are operated by the United States Department of Defense or are
12891289 affiliated with the United States De partment of State.
12901290 D. For the purpose of state sala ry increments and retir ement,
12911291 no teacher shall be granted credit for more than five (5) years of
12921292 active duty in the mil itary service or out -of-state or out-of-

13451345 equivalent. Nothing in this section sh all prohibit boards of
13461346 education from crediting more years of experience on district salary
13471347 schedules than those allowe d for state purposes.
13481348 E. The State Board of Education shall recognize, for purposes
13491349 of certification and salary increments, all the year s of experience
13501350 of a:
13511351 1. Certified teacher who teaches in the educational program o f
13521352 the Department of Corrections, be ginning with fiscal year 1981;
13531353 2. Vocational rehabilitation counselor under the Depa rtment of
13541354 Human Services if the counselor was employ ed as a certified teach er
13551355 by the State Departme nt of Education when the Division of Vocational
13561356 Rehabilitation was trans ferred from the State Board of Career and
13571357 Technology Education or the State Board of Education to the Oklahoma
13581358 Public Welfare Commission on July 1, 1968;
13591359 3. Vocational rehabilitation counselor which were completed
13601360 while employed by the Department of Human Services if such counselor
13611361 was certified as a teacher or was eligible for certificat ion as a
13621362 teacher in Oklahoma;
13631363 4. Certified teacher which were completed wh ile employed by the
13641364 Child Study Center located at University Hospital, if the teacher
13651365 was certified as a teacher in Oklahoma; and
13661366 5. Certified school psychologist or psychometrist which were
13671367 completed while employed as a doctoral in tern, psychological

14201420 if the experience primarily inv olved work with persons of school - or
14211421 preschool-age and if the person was, at the tim e the experience was
14221422 acquired, certified as, or elig ible for certification as, a school
14231423 psychologist or psychometrist.
14241424 F. The provisions of this section shall not apply t o teachers
14251425 who have entered into postretirement employment with a public school
14261426 in Oklahoma and are still receiving a monthly retirement benefit.
14271427 G. If a person employed as certified personnel, as defined in
14281428 Section 26-103 of this title, by a school district during the 2017 -
14291429 2018 school year was receiving a salary above the step level
14301430 indicated by the State Mini mum Salary Schedule for the 2017-2018
14311431 school year, the pers on shall receive a salary increase amount equal
14321432 to the amount indicated in subsection A of this section for the step
14331433 level indicated for the person, provided they remain empl oyed by the
14341434 same district, unless the h ours or the duties of the certified
14351435 personnel are reduced p roportionately.
14361436 SECTION 4. This act shall become effective July 1, 2023.
14371437 SECTION 5. It being immediately necessary for the p reservation
14381438 of the public peace, health or safety, an emergency is hereby
14391439 declared to exist, by reason whereof thi s act shall take effect and
14401440 be in full force from and after its passage and approval.
