85	85		BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
86	86		SECTION 1. NEW LAW A new sec tion of law to be codified
87	87		in the Oklahoma Statutes as Section 18-114.15 of Title 70, unless
88	88		there is created a duplication in numb ering, reads as follows:
89	89		A. Beginning with the 2023 -2024 school year, certified
90	90		personnel, as defined in Section 26 -103 of this title, in the public
91	91		schools of Oklahoma shall r eceive in salary and/or fringe ben efits
92	92		not less than the amounts specified in the following schedule:

305	305		B. 1. When determining the Minimum Salary Schedule, “fringe
306	306		benefits” shall mean all or part of reti rement benefits, excluding
307	307		the contributions made pursuant to subsection A of Section 17-108.1
308	308		of this title and the flexible benefit allowance pursuant to Section
309	309		26-105 of this title from the f lexible benefit allowan ce funds
310	310		disbursed by the State Board of Education an d the State Board of
311	311		Career and Technology Education pursuant to Section 26-104 of this
312	312		title.
313	313		2. If a school district intend s to provide retirement b enefits
314	314		to a teacher such that the teacher ’s salary would be less than the
315	315		amounts set forth in the minim um salary schedule specified in
316	316		subsection A of this section, the d istrict shall be require d to
317	317		provide written notification t o the teacher prior to hi s or her

369	369		employment or, if already employed by the d istrict, no later than
370	370		thirty (30) days prior to the date the district elects to provide
371	371		retirement benefits such that t he teacher’s salary would be less
372	372		than the minimum salary s chedule.
373	373		C. Any of the degrees referred to in this section shall be from
374	374		a college recognized by the State Board of Education. The Board
375	375		shall accept teaching experience from out -of-state school districts
376	376		that are accredited by the state board of education or appropriate
377	377		state accrediting agency for the districts. The Board shall accept
378	378		teaching experience from out-of-country schools that are accredited
379	379		or otherwise endorsed by the appropriate na tional or regional
380	380		accrediting or endorsement authority. Out-of-country certification
381	381		documentation in a language other than English sh all be analyzed by
382	382		an educational credential evaluati on service in accordance with
383	383		industry standards and guidelines and approved by the State
384	384		Department of Education. The person seeking to have credit g ranted
385	385		for out-of-country teaching experience shall be responsible for all
386	386		costs of the analysis by a cre dential evaluation service. The Board
387	387		shall accept teaching experi ence from primary and se condary schools
388	388		that are operated by the United States Depar tment of Defense or are
389	389		affiliated with the United S tates Department of State.
390	390		D. For the purpose of sta te salary increments and retirement,
391	391		no teacher shall be granted cr edit for more than five (5) years of
392	392		active duty in the mil itary service or out -of-state or out-of-

444	444		country teaching experience as a cert ified teacher or its
445	445		equivalent. Nothing in this section shall prohibit boards of
446	446		education from crediting more years o f experience on district salary
447	447		schedules than those allowe d for state purposes.
448	448		E. The State Board of Education shall recognize, for p urposes
449	449		of certification and salary increments, all t he years of experience
450	450		of a:
451	451		1. Certified teacher who teaches in t he educational program o f
452	452		the Department of Corrections, be ginning with fiscal year 1981;
453	453		2. Vocational rehabilitation counselor under the Department of
454	454		Human Services if the counselor was employed as a certified teacher
455	455		by the State Department of Educati on when the Division of Vocational
456	456		Rehabilitation was trans ferred from the State Boa rd of Career and
457	457		Technology Education or the State B oard of Education to the Oklahoma
458	458		Public Welfare Commission on July 1, 1968;
459	459		3. Vocational rehabilitation counselor whi ch were completed
460	460		while employed by the Department of Human Services if such counsel or
461	461		was certified as a teacher or was eligible for ce rtification as a
462	462		teacher in Oklahoma;
463	463		4. Certified teacher which were completed while employed by the
464	464		Child Study Center located at University Hospital, if the teacher
465	465		was certified as a teacher in Oklah oma; and
466	466		5. Certified school psychologist or psycho metrist which were
467	467		completed while employed as a doct oral intern, psychological

519	519		assistant, or psychologist with any agen cy of the State of Oklah oma
520	520		if the experience primarily inv olved work with persons o f school- or
521	521		preschool-age and if the person was, at the time the experience was
522	522		acquired, certified as, or eligible for certification as, a school
523	523		psychologist or psychome trist.
524	524		F. The provisions of this section shall not apply t o teachers
525	525		who have entered into postretirement employment with a public scho ol
526	526		in Oklahoma and are still receiving a monthly reti rement benefit.
527	527		G. If a person employed as certified personnel, as defined in
528	528		Section 26-103 of this title, by a school district during t he 2017-
529	529		2018 school year was receiving a salary above the step le vel
530	530		indicated by the State Minimum Salary Schedule fo r the 2017-2018
531	531		school year, the pers on shall receive a salary increase amount equal
532	532		to the amount indicated in subsection A of this section for the step
533	533		level indicated for the person, provided they rem ain employed by the
534	534		same district, unless the hours or the duties of the certified
535	535		personnel are reduced p roportionately.
536	536		SECTION 2. NEW LAW A new section of law to be codified
537	537		in the Oklahoma Statutes as Section 18-114.16 of Title 70, unless
538	538		there is created a du plication in numbering, reads as foll ows:
539	539		A. Beginning with the 202 6-2027 school year, certifi ed
540	540		personnel, as defined in Section 26 -103 of this title, in the public
541	541		schools of Oklahoma shall receive in salary and/ or fringe benefits

974	974		F. The provisions of this section shall not app ly to teachers
975	975		who have entered into postretirement employm ent with a public school
976	976		in Oklahoma and are still r eceiving a monthly retirement benefit.
977	977		G. If a person employed as certified personnel, as defined in
978	978		Section 26-103 of this title, by a school d istrict during the 2017 -
979	979		2018 school year was receiving a sa lary above the step level
980	980		indicated by the State Min imum Salary Schedule for the 2017-2018
981	981		school year, the pers on shall receive a salary increase amount equal
982	982		to the amount indicated in subsection A of this section for the step
983	983		level indicated for the person, provided they remain employed by the
984	984		same district, unless the hours or the duties of th e certified
985	985		personnel are reduced p roportionately.
986	986		SECTION 3. NEW LAW A new section of law to be codified
987	987		in the Oklahoma Statut es as Section 18-114.17 of Title 70, unless
988	988		there is created a duplication in numbering, reads as follows:
989	989		A. Beginning with the 202 9-2030 school year, certified
990	990		personnel, as defined in Section 26 -103 of this title, in the public

1271	1271		retirement benefits such that the teacher’s salary would be less
1272	1272		than the minimum salary s chedule.
1273	1273		C. Any of the degrees referred to in this section shall be from
1274	1274		a college recognized by the State Board of Education. The Board
1275	1275		shall accept teaching experience from out-of-state school districts
1276	1276		that are accredited by the state board of educati on or appropriate
1277	1277		state accrediting agency for the districts. The Board shall accept
1278	1278		teaching experience from out -of-country schools that are accredited
1279	1279		or otherwise endorsed by the a ppropriate national or regional
1280	1280		accrediting or endorsement authority. Out-of-country certification
1281	1281		documentation in a language other than English shall be a nalyzed by
1282	1282		an educational credential evaluation serv ice in accordance with
1283	1283		industry standards and g uidelines and approved by the State
1284	1284		Department of Education. The person seeking to have credit granted
1285	1285		for out-of-country teaching experience shall be respo nsible for all
1286	1286		costs of the analysis by a credential evaluation service. The Board
1287	1287		shall accept teaching experience from primary and se condary schools
1288	1288		that are operated by the United States Department of Defense or are
1289	1289		affiliated with the United States De partment of State.
1290	1290		D. For the purpose of state sala ry increments and retir ement,
1291	1291		no teacher shall be granted credit for more than five (5) years of
1292	1292		active duty in the mil itary service or out -of-state or out-of-

1345	1345		equivalent. Nothing in this section sh all prohibit boards of
1346	1346		education from crediting more years of experience on district salary
1347	1347		schedules than those allowe d for state purposes.
1348	1348		E. The State Board of Education shall recognize, for purposes
1349	1349		of certification and salary increments, all the year s of experience
1350	1350		of a:
1351	1351		1. Certified teacher who teaches in the educational program o f
1352	1352		the Department of Corrections, be ginning with fiscal year 1981;
1353	1353		2. Vocational rehabilitation counselor under the Depa rtment of
1354	1354		Human Services if the counselor was employ ed as a certified teach er
1355	1355		by the State Departme nt of Education when the Division of Vocational
1356	1356		Rehabilitation was trans ferred from the State Board of Career and
1357	1357		Technology Education or the State Board of Education to the Oklahoma
1358	1358		Public Welfare Commission on July 1, 1968;
1359	1359		3. Vocational rehabilitation counselor which were completed
1360	1360		while employed by the Department of Human Services if such counselor
1361	1361		was certified as a teacher or was eligible for certificat ion as a
1362	1362		teacher in Oklahoma;
1363	1363		4. Certified teacher which were completed wh ile employed by the
1364	1364		Child Study Center located at University Hospital, if the teacher
1365	1365		was certified as a teacher in Oklahoma; and
1366	1366		5. Certified school psychologist or psychometrist which were
1367	1367		completed while employed as a doctoral in tern, psychological

1432	1432		to the amount indicated in subsection A of this section for the step
1433	1433		level indicated for the person, provided they remain empl oyed by the
1434	1434		same district, unless the h ours or the duties of the certified
1435	1435		personnel are reduced p roportionately.
1436	1436		SECTION 4. This act shall become effective July 1, 2023.
1437	1437		SECTION 5. It being immediately necessary for the p reservation
1438	1438		of the public peace, health or safety, an emergency is hereby
1439	1439		declared to exist, by reason whereof thi s act shall take effect and
1440	1440		be in full force from and after its passage and approval.
