75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY Section 1, Chapter 11, O.S.L. 2022
77	77	(63 O.S. Supp. 2022, Section 1-731.4), is amended to read as
78	78	follows:
79	79	Section 1-731.4. A. As used in this section:
80	80	1. The terms “abortion” and “unborn child” shall have the same
81	81	meaning as provided by Section 1 -730 of Title 63 of the Oklahoma
82	82	Statutes; and
83	83	2. “Medical emergency” means a condition which cannot be
84	84	remedied by delivery of the child in which an abortion is necessary
85	85	to preserve the life of a pregnant woman w hose life is endangered by
86	86	a physical disorder, physical illness or physical injury including a

138	138	life-endangering physical condition caused by or arising from the
139	139	pregnancy itself.
140	140	B. 1. Notwithstanding any other provision of law, a person
141	141	shall not purposely perform or attempt to perform an abortion except
142	142	to save the life of a pregnant woman in a me dical emergency.
143	143	2. A person convicted of p erforming or attempting to perform an
144	144	abortion shall be guilty of a felony punishable by a fine not to
145	145	exceed One Hundred Thousand Dollars ($100,000.00), or by confinement
146	146	in the custody of the D epartment of Corrections for a term not to
147	147	exceed ten (10) years, or by such fine and imprisonment.
148	148	3. This section does no t:
149	149	a. authorize the charging or conviction of a wom an with
150	150	any criminal offense in the death of he r own unborn
151	151	child, or
152	152	b. prohibit the sale, use, p rescription or administration
153	153	of a contraceptive measure, drug or chemical if the
154	154	contraceptive measure, dr ug or chemical is
155	155	administered before the time when a pregnancy could be
156	156	determined through conven tional medical testing and if
157	157	the contraceptive measure, drug or chemical is sold,
158	158	used, prescribed or administered in accordance with
159	159	manufacturer instructio ns.
160	160	4. It is an affirmative defense to prosecution under this
161	161	section if a licensed physician pro vides medical treatment to a

215	215	SECTION 2. It being immediately necessary for the pr eservation
216	216	of the public peace, health or safety, an emer gency is hereby
217	217	declared to exist, by reason whereo f this act shall take effect and
218	218	be in full force from and after its passa ge and approval.
