27	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

29	56		SECTION 1. AMENDATORY 22 O.S. 2021, Section 60.2, as
30	57		amended by Section 6, Chapter 318, O.S.L. 2022 (22 O.S. Supp. 2022,
31	58		Section 60.2), is amended to read as follows :

33	59		Section 60.2. A. A victim of domestic abuse, a victim of
34	60		stalking, a victim of har assment, a victim of rape, any adult or
35	61		emancipated minor household member on behalf of any other family or
36	62		household member who is a minor or incompetent , any minor age
37	63		sixteen (16) or seventeen (17) years , or any adult victim of a crime
38	64		may seek relief under the provisions of the Protection from Domestic
39	65		Abuse Act.

41	93		1. The person seeking relief may file a petition for a
42	94		protective order with the distri ct court in the county in which the
43	95		victim resides, the c ounty in which the defendant resides, or the
44	96		county in which the domestic violence occurred. If the person
45	97		seeking relief is not a family or household member or an indivi dual
46	98		who is or has been in a dating relationship w ith the defendant, the

49	99		person seeking relief must file a complaint against the defenda nt
50	100		with the proper law enforcement agency before filing a petition for
51	101		a protective order with the district court . The person seeking
52	102		relief shall provide a copy of the complaint that was filed with the
53	103		law enforcement agency at the full hearing if the co mplaint is not
54	104		available from the law enforcement agency. Failure to provide a
55	105		copy of the complaint filed with the law enforcement agency shall
56	106		constitute a frivolous f iling and the court may assess atto rney fees
57	107		and court costs against the plaintiff pur suant to paragraph 2 of
58	108		subsection C of this section. The filing of a petition for a
59	109		protective order shall not require jurisdiction or venue of the
60	110		criminal offense if either the plaintiff or defendant r esides in the
61	111		county. If a petition has been filed in an action for divorce or
62	112		separate maintenance and either party to the action files a petition
63	113		for a protective order in the same county where the action for
64	114		divorce or separate maintenance is filed, th e petition for the
65	115		protective order may be heard by the court hearing the divorce or
66	116		separate maintenance action if:

68	144		a. there is no established protective order docket in
69	145		such court, or

71	146		b. the court finds that, in the int erest of judicial
72	147		economy, both actions may be heard together; provided,
73	148		however, the petition for a protective order,
74	149		including, but not limited to, a petition in which
75	150		children are named as petitioners, shall remain a
76	151		separate action and a separate order shall be entered
77	152		in the protective order action. Protective orders may
78	153		be dismissed in favor of restraining orders in the
79	154		divorce or separate maintenance action if the court
80	155		specifically finds, upon hea ring, that such dismissal
81	156		is in the best interests o f the parties and does not
82	157		compromise the safety of any petitioner.

84	158		If the defendant is a minor child, the petition shall be filed
85	159		with the court having jurisdiction over juvenile matters.

87	160		2. When the abuse occurs when the court is not open for
88	161		business, such person may request an emergenc y temporary order of
89	162		protection as authorized by Se ction 40.3 of this title.

93	163		B. The petition forms shall be provided by the clerk of the
94	164		court. The Administrative O ffice of the Courts shall develop a
95	165		standard form for the petition.

97	166		C. 1. Except as otherwise provided by this section, no filing
98	167		fee, service of process fee, attorney fees or any other fee or costs

99	195		shall be charged the plaintiff or victim at any time f or filing a
100	196		petition for a protective order whether a pr otective order is
101	197		granted or not granted. The court may assess court costs, service
102	198		of process fees, attorney fees, other fees and filing fees against
103	199		the defendant at the hearing on the petition, if a protective order
104	200		is granted against the defendant; pr ovided, the court shall have
105	201		authority to waive the costs and fees if the court finds that the
106	202		party does not have the ability to pay the costs and fees.

108	203		2. If the court makes specific findings that a petition for a
109	204		protective order has been filed frivolo usly and no victim exists,
110	205		the court may assess attorney fees and court costs against the
111	206		plaintiff.

113	207		D. The person seeking relief shall prepare the petition or, at
114	208		the request of the plaintiff, the court clerk or the victim-witness
115	209		coordinator, victim sup port person, and court case manager shall
116	210		prepare or assist the plaintiff in preparing the petition.

118	211		E. The person seeking a protective order may further request
119	212		the exclusive care, possession, or control of any animal owned,
120	213		possessed, leased, kept, or h eld by either the petitioner, defen dant
121	214		or minor child residing in the residence of th e petitioner or
122	215		defendant. The court may order the defendant to make no contact
123	216		with the animal and forbid the defendant from taking, transferring,
124	217		encumbering, conceali ng, molesting, attacking, striking,
125	218		threatening, harming, or otherwise disposing of th e animal.

127	246		F. A court may not require the victim to seek legal sanctions
128	247		against the defendant including, but not limited to, divor ce,
129	248		separation, paternity or criminal p roceedings prior to hearing a
130	249		petition for protective order.

132	250		G. A victim of rape, for cible sodomy, a sex offense,
133	251		kidnapping, assault and battery with a deadly weapon, child abuse,
134	252		or member of the immediate family of a victim of first-degree

137	253		murder, as such terms are defined in Section 40 of this title, may
138	254		petition, or have a petition filed on the victim’s behalf if the
139	255		victim is a minor, for an emergency temporary order or em ergency ex
140	256		parte order regardless of any relationship or scenario pursuant to
141	257		the provisions of this sectio n. The Administrative Office of the
142	258		Courts shall modify t he petition forms as necessary to effectuate
143	259		the provisions of this subsection.
