25	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

27	58		SECTION 1. AMENDATORY 63 O.S. 2021, S ection 1-701, is
28	59		amended to read as follows:

30	60		Section 1-701. For the purposes of Section 1 -701 et seq. of
31	61		this title:

33	62		1. "Hospital" means any institution, place, building or agency,
34	63		public or private, whether organized for profit or not, primarily
35	64		engaged in the maintenance and operation o f facilities for the
36	65		diagnosis, treatment or care of patie nts admitted for overnight stay
37	66		or longer in order to obtain medical care, surgical care,

38	94		obstetrical care, or nursing care for illness, disease, injury,
39	95		infirmity, or deformity. Except as otherwis e provided by paragraph
40	96		5 of this subsection paragraph 7 of this section, places where
41	97		pregnant females are admitted and receive care incident to
42	98		pregnancy, abortion or delivery shall be considered to be a
43	99		"hospital" within the meaning of this article, regardless of the
44	100		number of patients received or the duration of their stay. The term
45	101		"hospital" includes general medical surgical hospitals, specialized

48	102		hospitals, critical access and emergency hospitals, emergency
49	103		hospitals, rural emergency hospitals , and birthing centers;

51	104		2. "General medical surgical hospital " means a hospital
52	105		maintained for the purpose of providing hospital care in a broad
53	106		category of illness and injury;

55	107		3. "Specialized hospital " means a hospital maint ained for the
56	108		purpose of providing hospital care in a certain category, or
57	109		categories, of illness and injury;
58		-
59	110		4. "Critical access hospital " means a hospital determined by
60	111		the State Department of He alth to be a necessary provider of health
61	112		care services to residents of a rural community;

63	113		5. "Emergency hospital" means a hospital that provides
64	114		emergency treatment and stabilization services on a twenty -four-hour
65	115		basis that has the ability to admit and treat patients for short
66	116		periods of time;

68	144		6. "Rural emergency hospital" means a hospital that provides
69	145		emergency treatment and stabilization services for an average length
70	146		of stay of twenty-four hours or less;

72	147		7. "Birthing center" means any facility, pla ce or institution,
73	148		which is maintained or established prim arily for the purpose of
74	149		providing services of a certified midwife or licensed medical doctor
75	150		to assist or attend a woman in delivery and birth, and where a woman
76	151		is scheduled in advance to give bir th following a normal,
77	152		uncomplicated, low-risk pregnancy. Provided, however, lice nsure for
78	153		a birthing center shall not be compulsory;

80	154		7. 8. "Day treatment program" means nonresidential, partial
81	155		hospitalization programs, day treatment programs, and day ho spital
82	156		programs as defined by subsection A of Section 175. 20 of Title 10 of
83	157		the Oklahoma Statutes; and

87	159		9. a. "Primarily engaged" means a hospital shall be
88	160		primarily engaged, defined by this section and as
89	161		determined by the State Department of Health, in

92	162		providing to inpatients the following care by or under
93	163		the supervision of physicians:

95	164		(1) diagnostic services and therapeutic services for
96	165		medical diagnosis, treatment and care of injured,
97	166		disabled or sick persons, or

99	194		(2) rehabilitation services for the r ehabilitation of
100	195		injured, disabled or sick persons.

102	196		b. In reaching a determination as to whether an entity is
103	197		primarily engaged in providing inpatient hospital
104	198		services to inpatients of a hospital, the Department
105	199		shall evaluate the total facility operation s and
106	200		consider multiple factors as provided in subparagrap hs
107	201		c and d of this subsection.

109	202		c. In evaluating the total facility operations, the
110	203		Department shall review the actual provision of care
111	204		and services to two or more inpatients, and the
112	205		effects of that care, to assess whether the care
113	206		provided meets the need s of individual patients by wa y
114	207		of patient outcomes.
115		-
116	208		d. The factors that the Department shall consider for
117	209		determination of whether an entity meets the
118	210		definition of primarily engaged include, but a re not
119	211		limited to:
120		-
121	212		(1) a minimum of four inpatient beds,
122		-
123	213		(2) the entity's average daily census (ADC),
124		-
125	214		(3) the average length of stay (ALOS),

127	215		(4) the number of off-site campus outpatient

136	247		of the entity and the s cope of the services
137	248		offered,

139	249		(7) the volume of outpatient surg ical procedures
140	250		compared to the inpatient surgical procedures, if
141	251		surgical services are provided,

143	252		(8) staffing patterns, and
144		-
145	253		(9) patterns of ADC by day of the week .

147	254		e. Notwithstanding any other provision of this section,
148	255		an entity shall be considered prima rily engaged in
149	256		providing inpatient hospital services to inpatients if
150	257		the hospital has had an ADC of at least two (2) and an
151	258		ALOS of at least two (2) midnights ov er the past
152	259		twelve (12) months. A critical access hospital shall
153	260		be exempt from the ADC and ALOS determination. ADC
154	261		shall be calculated by adding the midnight daily
155	262		census for each day of the twel ve-month period and
156	263		then dividing the total number by days in the year. A
157	264		facility that has been operating for less than (12)
158	265		months at the time of th e survey shall calculate its
159	266		ADC based on the number of months the facility has
160	267		been operational, but not less than three (3) months.
