2758 SECTION 1. AMENDATORY 63 O.S. 2021, S ection 1-701, is

3060 Section 1-701. For the purposes of Section 1 -701 et seq. of

3362 1. "Hospital" means any institution, place, building or agency,
3463 public or private, whether organized for profit or not, primarily
3564 engaged in the maintenance and operation o f facilities for the
3665 diagnosis, treatment or care of patie nts admitted for overnight stay

3894 obstetrical care, or nursing care for illness, disease, injury,
3995 infirmity, or deformity. Except as otherwis e provided by paragraph
4096 5 of this subsection paragraph 7 of this section, places where
4197 pregnant females are admitted and receive care incident to
4298 pregnancy, abortion or delivery shall be considered to be a
4399 "hospital" within the meaning of this article, regardless of the
44100 number of patients received or the duration of their stay. The term
45101 "hospital" includes general medical surgical hospitals, specialized

48102 hospitals, critical access and emergency hospitals, emergency
49103 hospitals, rural emergency hospitals , and birthing centers;

51104 2. "General medical surgical hospital " means a hospital
52105 maintained for the purpose of providing hospital care in a broad
53106 category of illness and injury;

55107 3. "Specialized hospital " means a hospital maint ained for the
56108 purpose of providing hospital care in a certain category, or
57109 categories, of illness and injury;

59110 4. "Critical access hospital " means a hospital determined by
60111 the State Department of He alth to be a necessary provider of health
61112 care services to residents of a rural community;

63113 5. "Emergency hospital" means a hospital that provides
64114 emergency treatment and stabilization services on a twenty -four-hour
65115 basis that has the ability to admit and treat patients for short
66116 periods of time;

68144 6. "Rural emergency hospital" means a hospital that provides
69145 emergency treatment and stabilization services for an average length
70146 of stay of twenty-four hours or less;

72147 7. "Birthing center" means any facility, pla ce or institution,
73148 which is maintained or established prim arily for the purpose of
74149 providing services of a certified midwife or licensed medical doctor
75150 to assist or attend a woman in delivery and birth, and where a woman
76151 is scheduled in advance to give bir th following a normal,
77152 uncomplicated, low-risk pregnancy. Provided, however, lice nsure for
78153 a birthing center shall not be compulsory;

80154 7. 8. "Day treatment program" means nonresidential, partial
81155 hospitalization programs, day treatment programs, and day ho spital
82156 programs as defined by subsection A of Section 175. 20 of Title 10 of
83157 the Oklahoma Statutes; and

87159 9. a. "Primarily engaged" means a hospital shall be
88160 primarily engaged, defined by this section and as
89161 determined by the State Department of Health, in

95164 (1) diagnostic services and therapeutic services for
96165 medical diagnosis, treatment and care of injured,

99194 (2) rehabilitation services for the r ehabilitation of
100195 injured, disabled or sick persons.

102196 b. In reaching a determination as to whether an entity is
103197 primarily engaged in providing inpatient hospital
104198 services to inpatients of a hospital, the Department
105199 shall evaluate the total facility operation s and
106200 consider multiple factors as provided in subparagrap hs
107201 c and d of this subsection.

109202 c. In evaluating the total facility operations, the
110203 Department shall review the actual provision of care
111204 and services to two or more inpatients, and the
112205 effects of that care, to assess whether the care
113206 provided meets the need s of individual patients by wa y
114207 of patient outcomes.

116208 d. The factors that the Department shall consider for
117209 determination of whether an entity meets the
118210 definition of primarily engaged include, but a re not
119211 limited to:

121212 (1) a minimum of four inpatient beds,

123213 (2) the entity's average daily census (ADC),

125214 (3) the average length of stay (ALOS),

127215 (4) the number of off-site campus outpatient

136247 of the entity and the s cope of the services
137248 offered,

139249 (7) the volume of outpatient surg ical procedures
140250 compared to the inpatient surgical procedures, if
141251 surgical services are provided,

143252 (8) staffing patterns, and
144-
145253 (9) patterns of ADC by day of the week .

147254 e. Notwithstanding any other provision of this section,
148255 an entity shall be considered prima rily engaged in
149256 providing inpatient hospital services to inpatients if
150257 the hospital has had an ADC of at least two (2) and an
151258 ALOS of at least two (2) midnights ov er the past
152259 twelve (12) months. A critical access hospital shall
153260 be exempt from the ADC and ALOS determination. ADC
154261 shall be calculated by adding the midnight daily
155262 census for each day of the twel ve-month period and
156263 then dividing the total number by days in the year. A
157264 facility that has been operating for less than (12)
158265 months at the time of th e survey shall calculate its
159266 ADC based on the number of months the facility has
160267 been operational, but not less than three (3) months.

163297 Department to demonst rate compliance with state
