75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 22 O.S. 2021, Section 152, as
77	77	amended by Section 1, Chapter 174, O.S.L. 2022 (22 O.S. Supp. 2022,
78	78	Section 152), is amended to read as follows:
79	79	Section 152. A. Prosecutions for the crim es of bribery,
80	80	embezzlement of public money, bonds, securities, assets or property
81	81	of the state or any county, school district , municipality or other
82	82	subdivision thereof, or of any misappropriation of public money,
83	83	bonds, securities, assets or property of the state or any county,
84	84	school district, municipal ity or other subdivision thereof,
85	85	falsification of public records of the st ate or any county, school
86	86	district, municipality or other subdivision thereof, and conspiracy
87	87	to defraud the State of Oklahoma or any county, school district,

140	140	purpose shall be commenced wit hin seven (7) years after the
141	141	discovery of the crim e; provided, however, prosecutions for the
142	142	crimes of embezzlement or misappropr iation of public money, bonds,
143	143	securities, assets o r property of any school district, including
144	144	those relating to student acti vity funds, or the crime of
145	145	falsification of public records of any independent school district,
146	146	the crime of criminal conspiracy, the crime of embezzlement pursuant
147	147	to Sections 1451 through 1461 of Title 21 of the Oklahoma Statutes,
148	148	the crime of False Pers onation or Identity Theft pursu ant to
149	149	Sections 1531 through 1533.3 of Title 21 of the Oklahoma Statutes,
150	150	the financial exploitatio n of a vulnerable adult pursuant to
151	151	Sections 843.1, 843.3 and 843.4 of Title 21 of the Oklahoma
152	152	Statutes, or Medicaid fraud pu rsuant to Section 1005 of Title 56 of
153	153	the Oklahoma Statutes, shall be commenced within five (5) years
154	154	after the discovery of the c rime.
155	155	B. Prosecutions for criminal violations of a ny state income tax
156	156	laws shall be commenced within five (5) years after the commission
157	157	of such violation.
158	158	C. 1. Prosecutions for sexual crimes against children,
159	159	specifically rape or forcible sodomy, sodo my, lewd or indecent
160	160	proposals or acts against chil dren, involving minors in pornography
161	161	pursuant to Section 886, 888, 1111, 1 111.1, 1113, 1114, 1021.2,
162	162	1021.3, 1040.12a or 1123 of Title 21 of the Oklahoma Statutes, child

214	214	abuse pursuant to Section 843.5 of Title 21 of the Oklahoma
215	215	Statutes, and child traff icking pursuant to Section 866 of Title 21
216	216	of the Oklahoma Statutes shall may be commenced by the forty-fifth
217	217	birthday of the alleged victim at any time. Prosecutions for such
218	218	crimes committed against vic tims eighteen (18) years of age or older
219	219	shall may be commenced within twelve (12) years after the discovery
220	220	of the crime. As used in this paragraph, "discovery" means the date
221	221	that a physical or sexually related crime involving a victim
222	222	eighteen (18) years of age or older is reported to a law enforcement
223	223	agency at any time.
224	224	2. However, prosecutions Prosecutions for the crimes listed in
225	225	paragraph 1 of this subsection may be commenced at any time after
226	226	the commission of the offense if:
227	227	a. physical evidence is collected and preserved that is
228	228	capable of being tested to obtain a profile from
229	229	deoxyribonucleic acid (DNA), and
230	230	b. the identity of the offender is subsequently
231	231	established through the use of a DNA profile using
232	232	evidence listed in subparagraph a of this paragraph.
233	233	A prosecution under this exception mu st be commenced within
234	234	three (3) twelve (12) years from the date on which the identity of
235	235	the suspect is established by DNA testing.

287	287	3. No prosecution under this subsection shall be based upon the
288	288	memory of the victim that has been recovered through psych otherapy
289	289	unless there is some evidenc e independent of such repressed memory.
290	290	4. Any person who knowingly and willfully makes a fals e claim
291	291	pursuant to this subsection or a claim that the person kn ows lacks
292	292	factual foundation may be reported to local law e nforcement for
293	293	criminal investigation and, upon conviction, shall be guilty of a
294	294	felony.
295	295	D. Prosecutions for criminal violations of any provision of the
296	296	Oklahoma Wildlife Conservation Code shall be commenced within three
297	297	(3) years after the commission of such offense.
298	298	E. Prosecutions for the crime of criminal fraud or workers '
299	299	compensation fraud pursuant to Section 1541.1, 1541.2, 1662 or 1663
300	300	of Title 21 of the O klahoma Statutes shall commence within three (3)
301	301	years after the discovery of the crime, but in no event greater than
302	302	seven (7) years after the commission of the crime.
303	303	F. Prosecution for the crime of false or bogus check pursuant
304	304	to Section 1541.1, 1541. 2, 1541.3 or 1541.4 of Title 21 of the
305	305	Oklahoma Statutes shall be commenced within five (5) y ears after the
306	306	commission of such offense.
307	307	G. Prosecution for the crime of solicitation fo r murder in the
308	308	first degree pursuant t o Section 701.16 of Title 21 of t he Oklahoma
309	309	Statutes shall be commenced within seven (7) years after the
310	310	discovery of the cri me. For purposes of this subsection,

362	362	"discovery" means the date upon which the crime is ma de known to
363	363	anyone other than a person involved in the solicitation.
364	364	H. In all other cases a prosecu tion for a public offense must
365	365	be commenced within three (3) yea rs after its commission.
366	366	I. Prosecution for the crime of accessory after the fact must
367	367	be commenced within the same statute of li mitations as that of the
368	368	felony for which the person acted as an accessory.
369	369	J. Prosecution for the crime of arson pursuant to Section 1401,
370	370	1402, 1403, 1404 or 1405 of Title 21 of the Oklahoma Statutes shall
371	371	be commenced within seven (7) years after the c ommission of the
372	372	crime.
373	373	K. Prosecutions for criminal violations in which a deadly
374	374	weapon is used to commit a felony or prosec utions for criminal
375	375	violations in which a deadly weapon is used in an attempt to commit
376	376	a felony shall be commenced within seven ( 7) years after the
377	377	commission of the crime.
378	378	L. Prosecutions for the crime of human trafficking pursuant to
379	379	Section 748 of Title 21 of the Oklahoma Statutes shall be commenced
380	380	within three (3) years after discovery of the crime. For purposes
381	381	of this subsection, "discovery" means the date upon which the crime
382	382	is reported to a law enforcement agency.
383	383	SECTION 2. This act shall become effe ctive November 1, 2023.
