74+limitation on appointees; permitting appointing

4583 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4684 SECTION 1. AMENDATORY 59 O.S. 2021, Section 481, is
4785 amended to read as follows:
4886 Section 481. A. A State Board of Medical Licensure and
4987 Supervision hereinafter referred to as the “Board”, is hereby re-
5088 created, to continue until July 1, 2024, in accordance with the
5189 provisions of the Oklahoma Sunset Law.
5290 B. The Board shall be composed of seven (7) five allopathic
5391 physicians licensed to practice m edicine in this state and represent
54-the public, two physician assistants licensed to practice medicine
55-in this state, and four (4) two lay members. All members of the
56-Board shall be residents of this state .
57-C. 1. The physician members of the Board shall be graduates of
58-legally chartered medical schools recognized by the Oklahoma State
59-Regents for Higher Education or the Liaison Council on Medical
60-Education. The physician members shall have actively practiced as

146+C. 1. The physician members of the Board shall be graduates of

88150 licensed physicians continuously in this s tate for the three (3)
89151 years immediately preceding their appointment to the Board . All
90152 members of the Board shall be residents of this state and sha ll be
91153 appointed by the Governor as provided for in Section 482 of this
92154 title. All present members of the B oard shall continue to serve for
93155 the remainder of their current terms.
94156 2. The physician assistant members of the Board shall be
95157 graduates of accredited physician assistant program s recognized by
96158 the Board. The physician assistant members shall have actively
97159 practiced as licensed physician assistants continuously in this
98160 state for the three (3) years immediately preceding their
99161 appointment to the Boar d.
100162 D. Members shall be appointed as follows:
101163 1. The following five members shall be appointe d by the
102164 Governor:
103165 a. three physician members , and
104166 b. two lay members;
105-2. The following two memb ers shall be appointed by the
106-President Pro Tempore of the Senate:
107-a. one physician member, and
108-b. one physician assistant member ; and
109-3. The following two members shall b e appointed by the Speaker
110-of the House of Representatives:

218+2. The following two memb ers shall be appointed by the
219+President Pro Tempore of the Senate:
220+a. one physician member, and
221+b. one physician assistant member ; and
222+3. The following two members shall b e appointed by the Speaker

140226 SECTION 2. AMENDATORY 59 O.S. 2021, Section 482, is
141227 amended to read as follows:
142228 Section 482. Physician members A. Members of the State Board
143229 of Medical Licensure and Supervision shall be appo inted for terms of
144230 seven (7) four (4) years. The lay members of the Board shall serve
145231 terms coterminous with that of the Governor and until a qualified
146232 successor has been duly appointed and Each member shall serve at the
147233 pleasure of the Governor his or her appointing authority and may be
148234 removed or replaced without cause . No member shall be appointed to
149235 serve more than two complete consecutive terms.
150236 B. Each physician member shall hold office un til the expiration
151237 of the term for which appointed or until a qualified successor has
152238 been duly appointed. An appointment shall be made by the Governor
153239 appointing authority within ninety (90) days after the expiration of
154240 the term of any member or the occurrence of a vacancy o n the Board
155241 due to resignation, death, or any caus e resulting in an unexpired
156-term. The appointment of allopathic physicians shall be made from a
157-list of three names submitted to the Governor by the Oklahoma State
158-Medical Association. The Asso ciation may submit names of members or
159-nonmembers of the Asso ciation
160-C. 1. In selecting physician appointees, the appointing
161-authority may consider recommendations from a statewide organization
162-representing physicians, a state chapter of a natio nal organization

197307 D. No member of the Board shall be a stockholder in or full -
198308 time salaried or full -time geographic membe r of the faculty or board
199309 of trustees of any medica l school. A member of the Board shall be
200310 prohibited from voting on any issue in which the member has a direct
201311 financial interest.
202312 SECTION 3. This act shall become effective November 1, 20 23.
