7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 26 O.S. 2021, Section 3 -101, is
7777 amended to read as follows:
7878 Section 3-101. A. No election required to b e conducted by any
7979 county election board shall be s cheduled for a day other than
8080 Tuesday.
8181 B. Except as otherwi se provided by law, no regular or special
8282 election to fill an elective office shall be held by any county,
8383 school district, technology center sch ool district, municipality,
8484 fire protection distri ct or other political subdivision autho rized
8585 to call elections except as follows:
8686 1. The second Tuesday of February March in any year other than
8787 a presidential election year ;

139139 2. The first Tuesday of Apri l in any date of the Presidential
140140 Preferential Primary election in a pre sidential election year, as
141141 set forth in Section 20 -101 of this title;
142142 3. The date of any regularly scheduled statewide state or
143143 federal election in an even-numbered year;
144144 4. The second Tuesday of September June and the second Tuesday
145145 of August in an odd-numbered year;
146146 5. The second Tuesday of November in an odd-numbered year; and
147147 6. The second Tuesday of June of an odd -numbered year for a
148148 special election to fill a vacancy .
149149 C. Except as otherwise provided by law or by Section 1 of this
150150 act, no an election for any purpose other than to fill a vacancy in
151151 an elective office shall may only be held by any county, school
152152 district, technology center school district, municipality, fire
153153 protection district or other political subdivision authorized to
154154 call elections except on:
155155 1. The second Tuesday of January, February, May, June, July,
156156 August, September, October and November and the first Tuesday in
157157 March and April in odd-numbered years; provided, a municipality with
158158 a population in excess of two hundred fifty thousand (250,000)
159159 persons, according to the most recent federal decennial censu s, may
160160 also hold an election on the second Tuesday of December in odd-

213213 2. The second Tuesday of January and February, the first
214214 Tuesday in March and April, the last Tuesday in J une, the fourth
215215 Tuesday in August, and the first Tuesday af ter the first Monday in
216216 November of any even -numbered year.
217217 D. In the event that a regular or speci al election date occurs
218218 on an official state holiday, the election shall be scheduled for
219219 the next following Tuesday. In the event that any day of a
220220 candidate filing period occurs on a Saturday, Sunday or a ny official
221221 state holiday, that day of the filing period shall be scheduled for
222222 the next business day.
223223 E. Notwithstanding any other provision of law or any provision
224224 of a municipal charter, any municipali ty, school district,
225225 technology center district, co unty, rural fire protection district,
226226 or any other entity seeking to hold a regular or special election to
227227 be conducted by a county election board on the same date as a
228228 regular or special federal or state election, shall file the
229229 resolution calling for the election with the county election board
230230 secretary no later than seventy-five (75) days prior to the election
231231 date. A candidate filing period of three (3) days, if so required
232232 by the resolution, shall beg in no later than ten (10) days following
233233 the deadline to file the resolution with the secretary of t he county
234234 election board; provided, the filing period for such municipal
235235 office may be scheduled on the same dates as the filing period for
236236 state or federal office to be filled at such election.

288288 F. Any school district, technology center district,
289289 municipality, including any municipality governed by charter, rural
290290 fire protection district or any other entity seeking to hold a
291291 special election for the purpose of filling a vacancy shall schedule
292292 a candidate filing period of three (3) days to begin not more th an
293293 twenty (20) days following the date the resolution calling the
294294 election is required to be file d with the secretary of the county
295295 election board.
296296 SECTION 2. This act shall become effective November 1, 2023.
