75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 26 O.S. 2021, Section 3 -101, is
77	77	amended to read as follows:
78	78	Section 3-101. A. No election required to b e conducted by any
79	79	county election board shall be s cheduled for a day other than
80	80	Tuesday.
81	81	B. Except as otherwi se provided by law, no regular or special
82	82	election to fill an elective office shall be held by any county,
83	83	school district, technology center sch ool district, municipality,
84	84	fire protection distri ct or other political subdivision autho rized
85	85	to call elections except as follows:
86	86	1. The second Tuesday of February March in any year other than
87	87	a presidential election year ;

149	149	C. Except as otherwise provided by law or by Section 1 of this
150	150	act, no an election for any purpose other than to fill a vacancy in
151	151	an elective office shall may only be held by any county, school
152	152	district, technology center school district, municipality, fire
153	153	protection district or other political subdivision authorized to
154	154	call elections except on:
155	155	1. The second Tuesday of January, February, May, June, July,
156	156	August, September, October and November and the first Tuesday in
157	157	March and April in odd-numbered years; provided, a municipality with
158	158	a population in excess of two hundred fifty thousand (250,000)
159	159	persons, according to the most recent federal decennial censu s, may
160	160	also hold an election on the second Tuesday of December in odd-
161	161	numbered years; and

213	213	2. The second Tuesday of January and February, the first
214	214	Tuesday in March and April, the last Tuesday in J une, the fourth
215	215	Tuesday in August, and the first Tuesday af ter the first Monday in
216	216	November of any even -numbered year.
217	217	D. In the event that a regular or speci al election date occurs
218	218	on an official state holiday, the election shall be scheduled for
219	219	the next following Tuesday. In the event that any day of a
220	220	candidate filing period occurs on a Saturday, Sunday or a ny official
221	221	state holiday, that day of the filing period shall be scheduled for
222	222	the next business day.
223	223	E. Notwithstanding any other provision of law or any provision
224	224	of a municipal charter, any municipali ty, school district,
225	225	technology center district, co unty, rural fire protection district,
226	226	or any other entity seeking to hold a regular or special election to
227	227	be conducted by a county election board on the same date as a
228	228	regular or special federal or state election, shall file the
229	229	resolution calling for the election with the county election board
230	230	secretary no later than seventy-five (75) days prior to the election
231	231	date. A candidate filing period of three (3) days, if so required
232	232	by the resolution, shall beg in no later than ten (10) days following
233	233	the deadline to file the resolution with the secretary of t he county
234	234	election board; provided, the filing period for such municipal
235	235	office may be scheduled on the same dates as the filing period for
236	236	state or federal office to be filled at such election.
