75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. NEW LAW A new section of law to be codified
77	77	in the Oklahoma Statutes as Section 4263 of Title 74, unl ess there
78	78	is created a duplication in numbering, reads as follows:
79	79	A. Except as provided by subsection B of this section, no
80	80	elected official within three (3) months prior to a n election in
81	81	which the elected official ’s name will appear on the ballot shall
82	82	use or allow to be used such official ’s name, image, likeness , or
83	83	voice in a public service announcement or in an advertisement or
84	84	other promotional message created or purchase d using public funds.
85	85	B. Nothing in this sectio n shall apply during a declared state
86	86	disaster or emergency. For purposes of this section a “declared
87	87	state disaster or emergency ” means an event:

139	139	1. For which a Governor ’s state of emergency proclamation has
140	140	been issued;
141	141	2. For which a Presidenti al Major Disaster or Emergency
142	142	Declaration has been issued; or
143	143	3. Such as another disaster or emergency event within the state
144	144	for which a good-faith response effort is requir ed and for which
145	145	another authorized official of the state designates such eve nt as a
146	146	disaster or emergency.
147	147	SECTION 2. This act shall become effective November 1, 2023.
