9191 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKL AHOMA:
9292 SECTION 1. AMENDATORY 63 O.S. 2021, Secti on 330.53, is
9393 amended to read as follows:
9494 Section 330.53. A. The Oklahoma State Board of E xaminers for

147147 or certifications to qualified p ersons as long-term care
148148 administrators, and shall establish qualification criteria for each
149149 type of long-term care administrator.
150150 B. No license or certification shall be issued to a person as a
151151 long-term care administrator unless:
152152 1. The person shall ha ve submitted evidence satisfactory to the
153153 Board that the person is:
154154 a. not less than twenty -one (21) years of age, and
155155 b. of reputable and res ponsible character; and
156156 2. The person shall have submitted e vidence satisfactory to the
157157 Board of the person’s ability to supervise the defined facility type
158158 in which he or she is licensed or certified to serve as a long -term
159159 care administrator.
160160 C. 1. All persons currently licensed or certified or lawfully
161161 serving as an administrator in their defined facility type shall be
162162 permitted to continue to serve in their cu rrent capacity under their
163163 current terms of authorization. The Board may promulgate rules
164164 pursuant to Section 330.57 of this title to address future
165165 certification and licensure requ irements for all long -term care
166166 administrator types without effect on the licensure or certification
167167 status of those currently certified or licensed. The Board shall
168168 not include a requirement for a four-year degree in any futu re
169169 licensing or certification requirements for assist ed living
170170 administrators, residential care or administrators, adult day care

223223 rules are promulgated, current licens ure and certification processes
224224 and standards shall remain in place.
225225 2. For licensure or certification of nursing facility
226226 administrators, two (2) years of experience a s a certified assistant
227227 administrator of, or three (3) years of management experience at, a
228228 nursing facility, assisted living center, residential care home, or
229229 adult day care center shall substitute for requirement of completion
230230 of a four-year degree, provided the licensee meets all other
231231 requirements in state law or in rules of t he Board.
232232 D. The Oklahoma State Board of Examiners for Long-Term Care
233233 Administrators shall , on or before July 1, 2017, promulgate rules
234234 permitting eligible applicants to sit for the state standards
235235 examination at a testing facil ity using procedures approved by the
236236 National Association of Long-Term Care Administrator Board,
237237 including but not lim ited to the use of electronic or online methods
238238 for examination.
239239 E. 1. The Oklahoma State Board of Examiners for Long-Term Care
240240 Administrators shall grant assistant administrator certification to
241241 any applicant who:
242242 a. has obtained a high school diploma, and
243243 b. has passed the state standards examination.

295295 2. The Board shall grant full licensure as a long-term care
296296 administrator to any applicant currently certified as an assistant
297297 administrator who:
298298 a. has completed the required coursework offered by the
299299 Board,
300300 b. has completed a training program approved by the
301301 Board, and
302302 c. meets all other qualifications for licensure of long -
303303 term care administrators.
304304 F. 1. The Oklahoma State Board of Examiners for Long-Term Care
305305 Administrators shall grant a provisional license within ten (10)
306306 days of receiving the application to any applicant who:
307307 a. is licensed as a long -term care administrato r in
308308 another state,
309309 b. has passed a nationally recognized examination for
310310 long-term care administrat ors, and
311311 c. has been recently hired or offered a position as a
312312 long-term care administrator at a facility licen sed by
313313 the State Department of Health.
314314 2. A provisional licensee shall have all the same rights as a
315315 long-term care administrator licensed by the Board.
316316 3. Upon issuance of a provisional license, t he Board shall
317317 determine if the provisional licensee meet s the criteria for
318318 licensure by endorsement as provi ded by rules of the Board. If the

370370 provisional licensee meets the qualification criteria for full
371371 licensure, the Board shall grant a full long-term care facility
372372 administrator license to the provisional licensee not later than
373373 thirty (30) days after issuance of the provisional license and shall
374374 revoke the provisional license upon issuance of the full license.
375375 If the Board determines the provisional licensee does not meet
376376 qualification criteria for full li censure, the Board shall revoke
377377 the provisional license.
378378 G. 1. The Oklahoma State Board of Examiners for Long-Term Care
379379 Administrators shall approve one or more organizations or agencies
380380 to provide the training program requ ired by the Board. Each such
381381 organization or agency shall meet such requirements as may be
382382 prescribed by rules of the Board, and the curriculum required by the
383383 organization or agency shall not exceed the curriculum required by
384384 the Board.
385385 2. In addition to such approved organizations or agencies, the
386386 Board may offer the training program; provided, that the curriculum
387387 of the training program offered by the Board shall meet the s ame
388388 requirements as those imposed by the Board on training programs
389389 provided by other organizations and agencie s, and the curriculum of
390390 the training program offered by the Board shall not exceed
391391 curriculum requirements imposed by the Board on training programs
392392 provided by other organizations and agencies .

444444 3. The Board shall ensure that at all times there is at least
445445 one training program offered by an organization or agency as an
446446 alternative to the training program offered by the Board .
447447 H. The Oklahoma State Board of Examiners for Long -Term Care
448448 Administrators shall promulg ate rules to implement the provisions of
449449 this section.
450450 SECTION 2. This act shall become effective November 1, 202 3.
