91	91	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKL AHOMA:
92	92	SECTION 1. AMENDATORY 63 O.S. 2021, Secti on 330.53, is
93	93	amended to read as follows:
94	94	Section 330.53. A. The Oklahoma State Board of E xaminers for
95	95	Long-Term Care Administrat ors shall have authori ty to issue licenses

148	148	administrators, and shall establish qualification criteria for each
149	149	type of long-term care administrator.
150	150	B. No license or certification shall be issued to a person as a
151	151	long-term care administrator unless:
152	152	1. The person shall ha ve submitted evidence satisfactory to the
153	153	Board that the person is:
154	154	a. not less than twenty -one (21) years of age, and
155	155	b. of reputable and res ponsible character; and
156	156	2. The person shall have submitted e vidence satisfactory to the
157	157	Board of the person’s ability to supervise the defined facility type
158	158	in which he or she is licensed or certified to serve as a long -term
159	159	care administrator.
160	160	C. 1. All persons currently licensed or certified or lawfully
161	161	serving as an administrator in their defined facility type shall be
162	162	permitted to continue to serve in their cu rrent capacity under their
163	163	current terms of authorization. The Board may promulgate rules
164	164	pursuant to Section 330.57 of this title to address future
165	165	certification and licensure requ irements for all long -term care
166	166	administrator types without effect on the licensure or certification
167	167	status of those currently certified or licensed. The Board shall
168	168	not include a requirement for a four-year degree in any futu re
169	169	licensing or certification requirements for assist ed living
170	170	administrators, residential care or administrators, adult day care

223	223	rules are promulgated, current licens ure and certification processes
224	224	and standards shall remain in place.
225	225	2. For licensure or certification of nursing facility
226	226	administrators, two (2) years of experience a s a certified assistant
227	227	administrator of, or three (3) years of management experience at, a
228	228	nursing facility, assisted living center, residential care home, or
229	229	adult day care center shall substitute for requirement of completion
230	230	of a four-year degree, provided the licensee meets all other
231	231	requirements in state law or in rules of t he Board.
232	232	D. The Oklahoma State Board of Examiners for Long-Term Care
233	233	Administrators shall , on or before July 1, 2017, promulgate rules
234	234	permitting eligible applicants to sit for the state standards
235	235	examination at a testing facil ity using procedures approved by the
236	236	National Association of Long-Term Care Administrator Board,
237	237	including but not lim ited to the use of electronic or online methods
238	238	for examination.
239	239	E. 1. The Oklahoma State Board of Examiners for Long-Term Care
240	240	Administrators shall grant assistant administrator certification to
241	241	any applicant who:
242	242	a. has obtained a high school diploma, and
243	243	b. has passed the state standards examination.

295	295	2. The Board shall grant full licensure as a long-term care
296	296	administrator to any applicant currently certified as an assistant
297	297	administrator who:
298	298	a. has completed the required coursework offered by the
299	299	Board,
300	300	b. has completed a training program approved by the
301	301	Board, and
302	302	c. meets all other qualifications for licensure of long -
303	303	term care administrators.
304	304	F. 1. The Oklahoma State Board of Examiners for Long-Term Care
305	305	Administrators shall grant a provisional license within ten (10)
306	306	days of receiving the application to any applicant who:
307	307	a. is licensed as a long -term care administrato r in
308	308	another state,
309	309	b. has passed a nationally recognized examination for
310	310	long-term care administrat ors, and
311	311	c. has been recently hired or offered a position as a
312	312	long-term care administrator at a facility licen sed by
313	313	the State Department of Health.
314	314	2. A provisional licensee shall have all the same rights as a
315	315	long-term care administrator licensed by the Board.
316	316	3. Upon issuance of a provisional license, t he Board shall
317	317	determine if the provisional licensee meet s the criteria for
318	318	licensure by endorsement as provi ded by rules of the Board. If the

370	370	provisional licensee meets the qualification criteria for full
371	371	licensure, the Board shall grant a full long-term care facility
372	372	administrator license to the provisional licensee not later than
373	373	thirty (30) days after issuance of the provisional license and shall
374	374	revoke the provisional license upon issuance of the full license.
375	375	If the Board determines the provisional licensee does not meet
376	376	qualification criteria for full li censure, the Board shall revoke
377	377	the provisional license.
378	378	G. 1. The Oklahoma State Board of Examiners for Long-Term Care
379	379	Administrators shall approve one or more organizations or agencies
380	380	to provide the training program requ ired by the Board. Each such
381	381	organization or agency shall meet such requirements as may be
382	382	prescribed by rules of the Board, and the curriculum required by the
383	383	organization or agency shall not exceed the curriculum required by
384	384	the Board.
385	385	2. In addition to such approved organizations or agencies, the
386	386	Board may offer the training program; provided, that the curriculum
387	387	of the training program offered by the Board shall meet the s ame
388	388	requirements as those imposed by the Board on training programs
389	389	provided by other organizations and agencie s, and the curriculum of
390	390	the training program offered by the Board shall not exceed
391	391	curriculum requirements imposed by the Board on training programs
392	392	provided by other organizations and agencies .

448	448	Administrators shall promulg ate rules to implement the provisions of
449	449	this section.
450	450	SECTION 2. This act shall become effective November 1, 202 3.
