5548 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5649 SECTION 1. AMENDATORY 70 O.S. 2021, Sect ion 6-101.6b, is
5750 amended to read as follows:
5851 Section 6-101.6b. A. For purposes of this section, “teacher”
5952 means the term as defined in paragraph 1 of Sectio n 1-116 of Title
6053 70 of the Oklahoma Statutes this title, and “support employee” means
6154 the term as defined in paragraph 8 of Section 1-116 of this title.
6255 B. No school district shall prohibit or take disciplinary
6356 action against teachers or support employees for:
57+1. Disclosing public information to correct what the teacher or
58+support employee reasonably believes evidences a violation of the
59+Oklahoma Constitution or law or a rule promulgated pursuant to law;
60+2. Reporting a violation of the Oklahoma Constitut ion or state
61+or federal law; or

91-1. Disclosing public information to correct what the teacher or
92-support employee reasonably believes evidences a violation of the
93-Oklahoma Constitution or law or a rule promulgated pursuant to law;
94-2. Reporting a violation of the Oklahoma Constitut ion or state
95-or federal law; or
9688 3. Taking any of the above actions without giving prior notice
9789 to the teacher’s or support employee’s supervisor or anyone else in
9890 the teacher’s relevant chain of command.
9991 C. For the purposes of this section, “reporting” means
10092 providing a spoken or written account to a supervising teacher,
10193 administrator, school board m ember, representative from the State
10294 Department of Education, law enforcement official, district
10395 attorney, and/or parent or legal guardian of a st udent directly
10496 impacted by the actions.
10597 D. Each school district shall prominently post or publish a
10698 copy of this section of law in locations where it can reasonably be
10799 expected to come to the attention of all teachers and support
108100 employees.
109101 E. Nothing in this sectio n shall be construed to allow a
110102 teacher or a support employee to violate students’ or parents’
111103 rights to confidentiality and protection under the Family
112104 Educational Rights and Privacy Act of 1974 (FERPA).
113105 SECTION 2. This act shall become e ffective July 1, 2023.
106+SECTION 3. It being immediately necessary for the preserva tion
107+of the public peace, health, or safety, an emergency is hereby
108+declared to exist, by reason whereof thi s act shall take effect and
109+be in full force from and after its passage and approval.
