85	85	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
86	86	SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -242.4, is
87	87	amended to read as follows:
88	88	Section 1-242.4. The Maternal Mortality Review Committee shall
89	89	be composed of twenty-five (25) twenty-four (24) members, or their
90	90	designees, as follows:
91	91	1. Eighteen of the memb ers shall be:

228	228	2. Seven Six of the members shall be appointed by the State
229	229	Commissioner of Health to serve for two-year terms and shall be
230	230	eligible for reappoint ment. The members shall be persons having
231	231	training and experience in matters related to maternal mortality and
232	232	severe maternal morbidity. The members shall be appointed from th e
233	233	following positions:
234	234	a. a physician who is a member o f the Oklahoma State
235	235	Medical Association,
236	236	b. a physician who is a member of the Oklahoma
237	237	Osteopathic Association,
238	238	c. a current law enforcement officer who is employed by a
239	239	local or county law enforceme nt agency,
240	240	d. a maternal-fetal medicine physician,
241	241	e. an individual who has be en affected by pregnancy -
242	242	related or pregnancy -associated deaths, severe

296	296	f. an emergency medical te chnician, and
297	297	g. a home-visiting program director .
298	298	Every two (2) years the Com mittee shall elect from among its
299	299	membership a chair and a vice-chair vice chair. The Committee shall
300	300	meet at least quarterly and may meet more frequently as necessary as
301	301	determined by the chair .
302	302	SECTION 2. NEW LAW A new section of law to be codified
303	303	in the Oklahoma Statutes as Section 1 -702f of Title 63, unless there
304	304	is created a duplication in numbering, reads as follows:
305	305	A hospital or licensed bir thing center shall make a reasonable
306	306	and good faith effort to report to the Office o f the Chief Medical
307	307	Examiner, within seventy -two (72) hours after the death occurs, any
308	308	maternal death that occurs in the hospital or licensed birthing
309	309	center during pregna ncy or within one (1) y ear of termination of
310	310	pregnancy.
311	311	SECTION 3. AMENDATORY 63 O.S. 2021, Section 938, is
312	312	amended to read as follows:
313	313	Section 938. A. All human deaths of the types listed herein
314	314	shall be investigated as provide d by law:
315	315	1. Violent deaths, whether apparently homicidal, s uicidal, or
316	316	accidental;
317	317	2. Deaths under suspicious, unusual or unnatural circumstances;

370	370	public health;
371	371	4. Deaths unattended by a licensed physician for a fatal or
372	372	potentially-fatal potentially fatal illness;
373	373	5. Deaths that are medically unexpected and that occur in the
374	374	course of a therapeutic procedure;
375	375	6. Deaths of any persons detained or occurring in custody of
376	376	penal incarceration the Department of Corrections ; and
377	377	7. Deaths of persons whose bodies are to be cremated,
378	378	transported out of the state, donated to educational entities, to
379	379	include limited portions of the body, or otherwise made ultimately
380	380	unavailable for pathological study ; and
381	381	8. Maternal deaths th at occur during pregnancy or within one
382	382	(1) year of termination of pregnancy reported by a hospital or
383	383	licensed birthing center under Section 2 of this act .
384	384	B. The Chief Medical Examiner shall state on the certificate of
385	385	death of all persons whose death w as caused by execution pursuant to
386	386	a lawful court order that the cause of death was the execution of
387	387	such order.
388	388	SECTION 4. AMENDATORY 63 O.S. 2021, Section 939, is
389	389	amended to read as follows:
390	390	Section 939. A. Except as otherwise provided by law, the Chief
391	391	Medical Examiner shall produce records, documents, evidence or other
392	392	material of any nature only upon the order of a court of competent

444	444	jurisdiction. An interested party or litigant in a civil or
445	445	criminal action may make applic ation for an order to produce such
446	446	materials. The court, after notice to all parties , including the
447	447	Chief Medical Examiner, and a hearing on the application, may, upon
448	448	the showing of good cause, direct the release of a copy or any part
449	449	of such material. In addition, the court may also direct the
450	450	payment of reasonable costs by the requesting party for the
451	451	production of the material. The production of such material shall
452	452	take place at the Office of the Chief Medical Examiner unless, upon
453	453	a showing of good cause, specifically ordered otherwise by the
454	454	court.
455	455	B. Notwithstanding subsection A of this section, the Chief
456	456	Medical Examiner may, to the extent allowed under state law, share
457	457	records, documents, evidence or other material of any nature with
458	458	the Maternal Mortality Review Committee for the purpose of aiding
459	459	the Committee in carrying out its duties under the Maternal
460	460	Mortality Review Act.
461	461	SECTION 5. This act shall become effective November 1, 202 3.
