55 | 48 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA: |

56 | 49 | | SECTION 1. AMENDATORY 61 O.S. 2021, Section 327, as |
---|
57 | 50 | | amended by Section 47, Chapter 238, O.S.L. 2022 (61 O.S. Supp. 2022, |
---|
58 | 51 | | Section 327), is amended to read as follows: |
---|
59 | 52 | | Section 327. A. Unless procedures for state agency real |
---|
60 | 53 | | property transactions are otherwise specifically provided for by |
---|
61 | 54 | | law, no state agency shall sell, lease, exchange, or otherwise |
---|
62 | 55 | | dispose of such real prop erty subject to its jurisdiction, or lease, |
---|
63 | 56 | | purchase or otherwise acquire real property subject to its |
---|
64 | 57 | | jurisdiction, except as authorized by subsection L of this section |
---|
65 | 58 | | and as otherwise provided for in this section. As used in this |
---|
95 | 87 | | B. 1. Every state agency shall request the Office of |
---|
96 | 88 | | Management and Enterprise Services to dispose of rea l property upon: |
---|
97 | 89 | | a. legislative authorization, |
---|
98 | 90 | | b. authorization by the Long-Range Capital Planning |
---|
99 | 91 | | Commission, or |
---|
100 | 92 | | c. a determination, in writing, by the Office of |
---|
101 | 93 | | Management and Enterprise Servi ces or the state agency |
---|
102 | 94 | | that a parcel of real property subject to its |
---|
103 | 95 | | jurisdiction is no long er needed. |
---|
104 | 96 | | 2. Upon the request of the state agency to dispose of real |
---|
105 | 97 | | property, the Office of Management and Enterprise Services shall |
---|
106 | 98 | | estimate the value of the property, and: |
---|
107 | 99 | | a. for properties with an estimated value of gre ater than |
---|
108 | 100 | | Twenty-five Thousand Dollars ($25,000.00), obtain at |
---|
109 | 101 | | least one complete appraisal made by a person |
---|
110 | 102 | | certified by the Real Estate Appraiser Board of the |
---|
111 | 103 | | Oklahoma Insurance Department, wh o shall ascertain: |
---|
112 | 104 | | (1) the present fair value of the property, |
---|
113 | 105 | | (2) the present value of the i mprovements on such |
---|
114 | 106 | | property, and |
---|
115 | 107 | | (3) the actual condition of the improvements on the |
---|
116 | 108 | | property, |
---|
146 | 137 | | published for at least one (1) day in a newspaper of |
---|
147 | 138 | | general statewide circulatio n authorized to publish |
---|
148 | 139 | | legal notices, and weekly for thr ee (3) consecutive |
---|
149 | 140 | | weeks in a newspaper of general circulation published |

150 | 141 | | in the county or counties in which the property is |
---|
151 | 142 | | located. The notice shall contain the legal |
---|
152 | 143 | | description of each parcel of real property to be |
---|
153 | 144 | | offered for sale, the appraised value thereof, the |
---|
154 | 145 | | time and location of the sale or opening of the bids, |
---|
155 | 146 | | and terms of the sale including the fact that no |
---|
156 | 147 | | parcel of property shall be sold for less than ninety |
---|
157 | 148 | | percent (90%) of the apprais ed value of the real |
---|
158 | 149 | | property; provided, in lieu of such procedure, the |
---|
159 | 150 | | information may be published electronically on the |
---|
160 | 151 | | Office of Management and Enterprise Services’ website |
---|
161 | 152 | | if the notice of sale an d instructions on accessing |
---|
162 | 153 | | the public information are published in a newspaper of |
---|
163 | 154 | | general circulation in the co unty or counties in which |
---|
164 | 155 | | the property is located weekly for three (3) |
---|
165 | 156 | | consecutive weeks, |
---|
166 | 157 | | c. offer the property through electronic auction, public |
---|
167 | 158 | | auction or sealed bids withi n three (3) weeks after |
---|

198 | 188 | | bid of less than ninety percent ( 90%) of the average |

202 | 192 | | with Section 908 of Title 62 of the Oklahoma Sta tutes, |

204 | 194 | | electronic auction provided proper public no tice is |
---|
205 | 195 | | given in compliance with this section and the property |
---|
206 | 196 | | has been approved for liquidation by the Long-Range |
---|
207 | 197 | | Capital Planning Commission. The Office of Management |
---|
208 | 198 | | and Enterprise Services is authorized to reject all |
---|
209 | 199 | | bids, |
---|
210 | 200 | | e. if the property has an es timated value of less than |
---|
211 | 201 | | Twenty-five Thousand Dollars ($25,000.00), the Office |
---|
212 | 202 | | of Management and Enterprise Services may establish |
---|
213 | 203 | | the value through market co mparison and may dispose of |
---|
214 | 204 | | the property based on estimated va lue without |
---|
215 | 205 | | obtaining a certified appraisal; provided, however, |
---|
216 | 206 | | the sale shall comply with all other requirements o f |
---|
217 | 207 | | statute, and |
---|
248 | 237 | | property owner for not less than ninety percent (90%) |
---|
249 | 238 | | of fair market value, as determined in com pliance with |
---|
250 | 239 | | this section. All sales costs, including any required |
---|
251 | 240 | | surveys and appraisals, shall be at the expense of the |
---|
252 | 241 | | buyer. |
---|
253 | 242 | | 3. The cost of the appraisal required by the provisions of this |
---|
254 | 243 | | section, together with other necessary expenses incurred pursu ant to |
---|
255 | 244 | | this section, shall be paid by the state agency for which the real |
---|
256 | 245 | | property is to be sold from funds available to the state agency for |
---|
257 | 246 | | such expenditure. All monies received from the sale o r disposal of |
---|
258 | 247 | | the property, except those monies necessary to pay the expenses |
---|
259 | 248 | | incurred pursuant to this section, shall be deposited in the |
---|
260 | 249 | | Maintenance of State Buildings Revolving Fund unless otherwise |
---|
261 | 250 | | provided by law. |
---|
262 | 251 | | 4. The Office of Management and Enterprise Services may dismiss |
---|
263 | 252 | | from consideration any appraisal found to be incomplete or flawed. |
---|
264 | 253 | | C. Unless otherwise provided by law, the O ffice of Management |
---|
265 | 254 | | and Enterprise Services shall review and ap prove state agency real |
---|
266 | 255 | | property transactions. A state agency shall not lease or acquire |
---|
267 | 256 | | real property, or lease, dispose of or transfer state-owned real |
---|
268 | 257 | | property until the Office provides not ice of transaction approval to |
---|
299 | 287 | | property, or lease, dispose o f or transfer state-owned real |
---|
300 | 288 | | property. If the state agency i ntends to lease or acquire real |
---|
301 | 289 | | property, the state age ncy shall state the intended use of the real |
---|
302 | 290 | | property, and shall provide the Office with required telework |

303 | 291 | | documentation. Within thirty (30) days of receipt, the Office shall |
---|
304 | 292 | | provide notice of transac tion approval or disapproval to th e state |
---|
305 | 293 | | agency. |
---|
306 | 294 | | D. The provisions of this section shall not apply to the lease |
---|
307 | 295 | | of office space or real property subject to supervision of the |
---|
308 | 296 | | Commissioners of the Land Office, institutions comprising The |
---|
309 | 297 | | Oklahoma State System of Higher Education, or district boards of |
---|
310 | 298 | | education. |
---|
311 | 299 | | E. 1. The Office of Management and Enterprise Services shall |
---|
312 | 300 | | maintain a comprehensive inventory of state-owned real property and |
---|
313 | 301 | | its use excluding property of the public schools and p roperty |
---|
314 | 302 | | subject to the jurisdiction of the Commissioners of the Land Office. |
---|
315 | 303 | | 2. Each state agency shall, within thirt y (30) days of the |
---|
316 | 304 | | closing date for lands newly acquired, provide to the Office a list |
---|
317 | 305 | | of records, deeds, abstracts and other title instru ments showing the |
---|
318 | 306 | | description of and relating to any and all such lands or interests |
---|
319 | 307 | | therein. |
---|
350 | 337 | | counties, school districts, or agencies thereof, or D epartment of |
---|
351 | 338 | | Transportation rights -of-way. |
---|
352 | 339 | | 4. A state agency that sells or otherwise disposes of land |
---|
353 | 340 | | shall notify the Office within thirty (30) days of the disposition |
---|
354 | 341 | | closing date. |
---|
355 | 342 | | F. This section shall not be construed to authorize any state |
---|
356 | 343 | | agency, not otherwise authorized by law, to sell, lease, or |
---|
357 | 344 | | otherwise dispose of any real property owned by the state. |
---|
358 | 345 | | G. The Office of Management and Enterprise Services and the |
---|
359 | 346 | | Secretary of the Commissioners of the Land Office, or designee, as |
---|
360 | 347 | | provided in subsection L of this section may provide services to |
---|
361 | 348 | | sell, transfer, trade or purchase real property for other state |
---|
362 | 349 | | agencies. |
---|
363 | 350 | | H. The Director of the Office of Management and En terprise |
---|
364 | 351 | | Services shall, pursuant to the Administrative Procedures Act, |
---|
365 | 352 | | promulgate rules to effect procedures necessar y to the fulfillment |
---|
366 | 353 | | of its responsibilities under this section. |
---|
367 | 354 | | I. The Oklahoma Ordnance Works Authority and its lands, and the |
---|
368 | 355 | | Northeast Oklahoma Public Facilities Authority, the Oklahoma |
---|
369 | 356 | | Historical Society, the Oklaho ma Department of Transportation , the |
---|
370 | 357 | | Oklahoma Turnpike Authority, institutions comprising The Oklahoma |
---|
401 | 387 | | application of this section for any real property disposed of prior |
---|
402 | 388 | | to November 1, 2006. |
---|
403 | 389 | | J. Unless otherwise provided for by l aw, the procedures |
---|
404 | 390 | | established pursuant to this section for the sale or exchange of |
---|
405 | 391 | | real estate or personal property as authorized pursuant to Sections |
---|
406 | 392 | | 2222 and 2223 of Title 74 of the Oklahoma Statutes shall be followed |
---|
407 | 393 | | unless the sale is to an entity of state government. |
---|
408 | 394 | | K. The Director of the Office of Management and E nterprise |
---|
409 | 395 | | Services shall contract with experts, professionals or consultants |
---|
410 | 396 | | as necessary to perform the duties of the Office. Selections shall |
---|
411 | 397 | | be made using the qualifications-based procedures established in |
---|
412 | 398 | | Section 62 of this title and the rules promulg ated by the Director |
---|
413 | 399 | | for the selection of construction managers and design consultants. |
---|
414 | 400 | | L. 1. No state agency shall sell, lease, exchange, or |
---|
415 | 401 | | otherwise dispose of such real property su bject to its jurisdiction, |
---|
416 | 402 | | or lease, purchase or otherwise acquire rea l property subject to its |
---|
417 | 403 | | jurisdiction, until such agency or the Office of Management and |
---|
418 | 404 | | Enterprise Services acting on the agency’s behalf has presented to |
---|
419 | 405 | | the Secretary of the Commissi oners of the Land Office, or designee, |
---|
420 | 406 | | all information collected pursu ant to subparagraph a of paragraph 2 |
---|
421 | 407 | | of subsection B of this section, and provided the Secretary of the |
---|
452 | 437 | | 2. The Secretary of the Commissioners of the Land Office or |
---|
453 | 438 | | designee may decline to provide such a proposal; provided such |
---|
454 | 439 | | notice of decline is communicated to the Office of Mana gement and |
---|
455 | 440 | | Enterprise Services in written or electronic form. Upon the |
---|
456 | 441 | | reception of such notice of decline by the Office of Management and |
---|
457 | 442 | | Enterprise Services, the twenty-calendar-day period otherwise |
---|
458 | 443 | | required by this subsection shall be deemed to have ex pired. |
---|
459 | 444 | | SECTION 2. This act shall become effective November 1, 2023. |
