4853 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4954 SECTION 1. AMENDATORY 74 O.S. 2021, Section 5017.1, is
5055 amended to read as follows:
5156 Section 5017.1. A. The Oklahoma Department of Commerce shall
5257 have the authority to e stablish, administer and enforce state and
5358 federal energy conservation programs including, but not limited to,
5459 implementing The Energy Conservation Act of 1975 (P.L. 94 -163),
5560 National Energy Extension Service Act (P.L. 95 -39, 42 U.S.C. Section
5661 7001 et seq.) and the National Conservation Policy Act (P.L. 95 -
5762 619), except as otherwise provided by law.
5863 B. The Energy Conservation Services Division of the Oklahoma
5964 Corporation Commission is hereby abolished. All personnel,
60-equipment, files, fixtures, funds, furn iture, publications and
61-supplies, and all duties, functions, authority and contra ctual

92+equipment, files, fixtures, funds, furn iture, publications and
93+supplies, and all duties, functions, authority and contractual
8894 obligations that relate to the Energy Conservation Services Division
8995 of the Oklahoma Corporation Commission are hereby transferred to and
9096 vested in the Oklahoma Department of Commerce.
9197 C. Employees transferred to the Oklahoma Department of Commerce
9298 shall be classified and subject to the provisions of the Merit
9399 System of Personnel Administration as provided for in the Oklahoma
94100 Personnel Act. The salaries, grade and/or cl ass of the employees
95101 transferred shall be adjusted to be com mensurate with comparable
96102 positions in the Oklahoma Department of Commerce.
97103 D. The full-time-equivalent employee positions funded through
98104 the federal energy conservation programs outlined in this section
99105 shall terminate upon the exhaustion of said the federal funding.
100106 E. The Department shall make publicly available on its website,
101-to be updated annually, information related to federa l, state,
102-local, and tribal energy efficiency incentive programs. The
103-information provided shall include, but not be limited to:
