7575 BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 80 O.S. 2021, Section 1 01, is
7777 amended to read as follows:
7878 Section 101. A. The Legislature may review any exec utive order
7979 issued by the President of the United States , federal agency rule or
8080 federal congressional action to dete rmine the constituti onality of
8181 such action. Upon recommendation from the Legislature, the Attorney
8282 General, through the State Reserved Powers Protection Unit, shall
8383 review such action by the federal government to determine the
8484 constitutionality of the action and whether the state should seek an
8585 exemption from the application of the action or seek to have the
8686 action declared unconstitutional by a court of competent

138138 jurisdiction and prevent, prohibit or enjoin enforcement of the
139139 unconstitutional order, rule or action.
140140 B. Should the Attorney General decline to pursue action based
141141 upon the determination of the Legislature, the Legislature may by a
142142 majority vote initiate an action to seek an exemption from the
143143 application of the action or seek to have the action declared
144144 unconstitutional by a court of competent jurisdiction and prevent,
145145 prohibit or enjoin enforcement of the unconstitutional order, rule
146146 or action.
147147 C. Notwithstanding any other provision of law, the state,
148148 county, political subdivision or any other publicly funded
149149 organization shall not implement , adopt or enforce any order,
150150 federal agency rule or federal congressional action declare d
151151 unconstitutional by a court of competent jurisdiction under
152152 subsection A or B of this section including, but not li mited to:
153153 1. Pandemics or other health emergencies ;
154154 2. The regulation of natural r esources, including oil and
155155 natural gas;
156156 3. The regulation of the agriculture industry;
157157 4. The use of land;
158158 5. The regulation of the financial sector as it relates to
159159 environmental, social or governance standards;
160160 6. The regulation of the constitution al right to keep and bear

213213 7. The regulation of education;
214214 8. The regulation of marr iage;
215215 9. The regulation of interscholastic, intramural or other
216216 extracurricular sports sponsored by an institution of higher
217217 education, a school district or a charter school; or
218218 9. 10. Any other powers reserved by the State of Oklahoma or
219219 the people of Oklahoma.
220220 SECTION 2. This act shall become effective November 1, 2023.
