75	75	BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 80 O.S. 2021, Section 1 01, is
77	77	amended to read as follows:
78	78	Section 101. A. The Legislature may review any exec utive order
79	79	issued by the President of the United States , federal agency rule or
80	80	federal congressional action to dete rmine the constituti onality of
81	81	such action. Upon recommendation from the Legislature, the Attorney
82	82	General, through the State Reserved Powers Protection Unit, shall
83	83	review such action by the federal government to determine the
84	84	constitutionality of the action and whether the state should seek an
85	85	exemption from the application of the action or seek to have the
86	86	action declared unconstitutional by a court of competent

139	139	unconstitutional order, rule or action.
140	140	B. Should the Attorney General decline to pursue action based
141	141	upon the determination of the Legislature, the Legislature may by a
142	142	majority vote initiate an action to seek an exemption from the
143	143	application of the action or seek to have the action declared
144	144	unconstitutional by a court of competent jurisdiction and prevent,
145	145	prohibit or enjoin enforcement of the unconstitutional order, rule
146	146	or action.
147	147	C. Notwithstanding any other provision of law, the state,
148	148	county, political subdivision or any other publicly funded
149	149	organization shall not implement , adopt or enforce any order,
150	150	federal agency rule or federal congressional action declare d
151	151	unconstitutional by a court of competent jurisdiction under
152	152	subsection A or B of this section including, but not li mited to:
153	153	1. Pandemics or other health emergencies ;
154	154	2. The regulation of natural r esources, including oil and
155	155	natural gas;
156	156	3. The regulation of the agriculture industry;
157	157	4. The use of land;
158	158	5. The regulation of the financial sector as it relates to
159	159	environmental, social or governance standards;
160	160	6. The regulation of the constitution al right to keep and bear
161	161	arms;

220	220	SECTION 2. This act shall become effective November 1, 2023.
