77199 SECTION 1. AMENDATORY 63 O.S. 2021, Section 2-101, as
78-last amended by Section 1 of Enrolled House Bill No. 1987 of the 1 st
79-Session of the 59th Oklahoma Legislature (63 O.S. Supp. 2022,

99239 2. “Agent” means a peace officer appointed by and who acts on
100240 behalf of the Director of the Oklahoma State Bureau of Narcotics and
101241 Dangerous Drugs Control or an authorized person who acts on behalf
102242 of or at the direction of a person who manufactures, distributes,
103243 dispenses, prescribes, administers or uses for scientific purposes
104244 controlled dangerous substances but does not include a common or
105245 contract carrier, public warehouser or employee thereof, or a person
106246 required to register under the Uniform Controlled Dangerous
107247 Substances Act;

109248 3. “Board” means the Advisory Board to the Director of the
110249 Oklahoma State Bureau of Narcotics and Dangerous Drugs Control;

112250 4. “Bureau” means the Oklahoma State Bureau of Narcotics and
113251 Dangerous Drugs Control;

115252 5. “Coca leaves” includes cocaine and any compound,
116253 manufacture, salt, derivative, mixture or preparation of coca
117254 leaves, except derivatives of coca leaves which do not contain
118255 cocaine or ecgonine;

120256 6. “Commissioner” or “Director” means the Director of the
121257 Oklahoma State Bureau of Narcotics and Dangerous Drugs Control;

123284 7. “Control” means to add, remove or change the placement of a
124285 drug, substance or immediate precursor under the Uniform Controlled
125286 Dangerous Substances Act;

127287 8. “Controlled dangerous substance” means a drug, substance or
128288 immediate precursor in Schedules I through V of the Uniform
129289 Controlled Dangerous Substances Act or any drug, substance or
130290 immediate precursor listed either temporarily or permanently as a
131291 federally controlled substance. Any conflict between state and
132292 federal law with regard to the particular schedule in which a
133293 substance is listed shall be resolved in favor of state law;

137294 9. “Counterfeit substance” means a controlled substance which,
138295 or the container or labeling of which without authorization, bears
139296 the trademark, trade name or other identifying marks, imprint,
140297 number or device or any likeness thereof of a manufacturer,
141298 distributor or dispenser other than the person who in fact
142299 manufactured, distributed or dispensed the substance;

144300 10. “Deliver” or “delivery” means the actual, constructive or
145301 attempted transfer from one person to another of a controlled
146302 dangerous substance or drug paraphernalia, whether or not there is
147303 an agency relationship;

149304 11. “Dispense” means to deliver a controlled dangerous
150305 substance to an ultimate user or human research subject by or
151306 pursuant to the lawful order of a practitioner, including the
152307 prescribing, administering, packaging, labeling or compounding

153334 necessary to prepare the substance for such distribution.
154335 “Dispenser” is a practitioner who delivers a controlled dangerous
155336 substance to an ultimate user or human research subject;

157337 12. “Distribute” means to deliver other than by administering
158338 or dispensing a controlled dangerous substance;

160339 13. “Distributor” means a commercial entity engaged in the
161340 distribution or reverse distribution of narcotics and dangerous
162341 drugs and who complies with all regulations promulgated by the
163342 federal Drug Enforcement Administration and the Oklahoma State
164343 Bureau of Narcotics and Dangerous Drugs Control;

166344 14. “Drug” means articles:

168345 a. recognized in the official United States Pharmacopeia,
169346 official Homeopathic Pharmacopoeia of the United
170347 States, or official National Formulary, or any
171348 supplement to any of them,

173349 b. intended for use in the diagnosis, cure, mitigation,
174350 treatment or prevention of disease in man or other
175351 animals,

179352 c. other than food, intended to affect the structure or
180353 any function of the body of man or other animals, and

182354 d. intended for use as a component of any article
183355 specified in this paragraph;

188384 15. “Drug-dependent person” means a person who is using a
189385 controlled dangerous substance and who is in a state of psychic or
190386 physical dependence, or both, arising from administration of that
191387 controlled dangerous substance on a continuous basis. Drug
192388 dependence is characterized by behavioral and other responses which
193389 include a strong compulsion to take the substance on a continuous
194390 basis in order to experience its psychic effects, or to avoid the
195391 discomfort of its absence;

197392 16. “Home care agency” means any sole proprietorship,
198393 partnership, association, corporation, or other organization which
199394 administers, offers, or provides home care services, for a fee or
200395 pursuant to a contract for such services, to clients in their place
201396 of residence;
202-
203397 17. “Home care services” means skilled or personal care
204398 services provided to clients in their place of residence for a fee;
205-
206399 18. “Hospice” means a centrally administered, nonprofit or for-
207400 profit, medically directed, nurse-coordinated program which provides
208401 a continuum of home and inpatient care for the terminally ill
209402 patient and the patient’s family. Such term shall also include a
210403 centrally administered, nonprofit or for-profit, medically directed,
211404 nurse-coordinated program if such program is licensed pursuant to
212405 the provisions of the Uniform Controlled Dangerous Substances Act.
213406 A hospice program offers palliative and supportive care to meet the
214407 special needs arising out of the physical, emotional and spiritual

215434 stresses which are experienced during the final stages of illness
216435 and during dying and bereavement. This care is available twenty-
217436 four (24) hours a day, seven (7) days a week, and is provided on the
218437 basis of need, regardless of ability to pay. “Class A” Hospice
219438 refers to Medicare-certified hospices. “Class B” refers to all
220439 other providers of hospice services;

224440 19. “Imitation controlled substance” means a substance that is
225441 not a controlled dangerous substance, which by dosage unit
226442 appearance, color, shape, size, markings or by representations made,
227443 would lead a reasonable person to believe that the substance is a
228444 controlled dangerous substance. In the event the appearance of the
229445 dosage unit is not reasonably sufficient to establish that the
230446 substance is an “imitation controlled substance” imitation
231447 controlled substance, the court or authority concerned should
232448 consider, in addition to all oth er factors, the following factors as
233449 related to “representations made” in determining wheth er the
234450 substance is an “imitation controlled substance” imitation
235451 controlled substance:

237452 a. statements made by an owner or by any other person in
238453 control of the substance concerning the nature of the
239454 substance, or its use or effect,
240-
241455 b. statements made to the recipient that the substance
242456 may be resold for inordinate profit,

244483 c. whether the substance is packaged in a manner normally
245484 used for illicit controlled substances,

247485 d. evasive tactics or actions utilized by the owner or
248486 person in control of the substance to avoid detection
249487 by law enforcement authorities,

251488 e. prior convictions, if any, of an owner, or any other
252489 person in control of the object, under state or
253490 federal law related to controlled substances or fraud,
254491 and
255-
256492 f. the proximity of the substances to controlled
257493 dangerous substances;
258-
259494 20. “Immediate precursor” means a substance which the Director
260495 has found to be and by regulation designates as being the principal
261496 compound commonly used or produced primarily for use, and which is
262497 an immediate chemical intermediary used, or likely to be used, in
263498 the manufacture of a controlled dangerous substance, the control of
264499 which is necessary to prevent, curtail or limit such manufacture;

268500 21. “Laboratory” means a laboratory approved by the Director as
269501 proper to be entrusted with the custody of controlled dangerous
270502 substances and the use of controlled dangerous substances for
271503 scientific and medical purposes and for purposes of instruction;

273504 22. “Manufacture” means the production, preparation,
274505 propagation, compounding or processing of a controlled dangerous
275506 substance, either directly or indirectly by extraction from

277534 of chemical synthesis or by a combination of extraction and chemical
278535 synthesis. “Manufacturer” includes any person who packages,
279536 repackages or labels any container of any controlled dangerous
280537 substance, except practitioners who dispense or compound
281538 prescription orders for delivery to the ultimate consumer;

283539 23. “Marijuana” means all parts of the plant Cannabis sativa
284540 L., whether growing or not; the seeds thereof; the resin extracted
285541 from any part of such plant; and every compound, manufacture, salt,
286542 derivative, mixture or preparation of such plant, its seeds or
287543 resin, but shall not include:
288-
289544 a. the mature stalks of such plant or fiber produced from
290545 such stalks,
291-
292546 b. oil or cake made from the seeds of such plant,
293547 including cannabidiol derived from the seeds of the
294548 marijuana plant,
295-
296549 c. any other compound, manufacture, salt, derivative,
297550 mixture or preparation of such mature stalks (except
298551 the resin extracted therefrom), including cannabidiol
299552 derived from mature stalks, fiber, oil or cake,
300-
301553 d. the sterilized seed of such plant which is incapable
302554 of germination,

304555 e. for any person participating in a clinical trial to
305556 administer cannabidiol for the treatment of severe

313587 f. for any person or the parents, legal guardians or
314588 caretakers of the person who have received a written
315589 certification from a physician licensed in this state
316590 that the person has been diagnosed by a physician as
317591 having Lennox-Gastaut syndrome, Dravet syndrome, also
318592 known as severe myoclonic epilepsy of infancy, or any
319593 other severe form of epilepsy that is not adequately
320594 treated by traditional medical therapies, spasticity
321595 due to multiple sclerosis or due to paraplegia,
322596 intractable nausea and vomiting, appetite stimulation
323597 with chronic wasting diseases, the substance
324598 cannabidiol, a nonpsychoactive cannabinoid, found in
325599 the plant Cannabis sativa L. or any other preparation
326600 thereof, that has a tetrahydrocannabinol concentration
327601 of not more than three-tenths of one percent (0.3%)
328602 and that is delivered to the patient in the form of a
329603 liquid,

331604 g. any federal Food-and-Drug-Administration-approved drug
332605 or substance, or

334632 h. industrial hemp, from the plant Cannabis sativa L. and
335633 any part of such plant, whether growing or not, with a
336634 delta-9 tetrahydrocannabinol concentration of not more
337635 than three-tenths of one percent (0.3%) on a dry-
338636 weight basis which shall only be grown pursuant to the
339637 Oklahoma Industrial Hemp Program and may be shipped
340638 intrastate and interstate;
341-
342639 24. “Medical purpose” means an intention to utilize a
343640 controlled dangerous substance for physical or mental treatment, for
344641 diagnosis, or for the prevention of a disease condition not in
345642 violation of any state or federal law and not for the purpose of
346643 satisfying physiological or psychological dependence or other abuse;
347-
348644 25. “Mid-level practitioner” means an Advanced Practice
349645 Registered Nurse as defined and within parameters specified in
350646 Section 567.3a of Title 59 of the Oklahoma Statutes, or a certified
351647 animal euthanasia technician as defined in Section 698.2 of Title 59
352-

354648 of the Oklahoma Statutes, or an animal control officer registered by
355649 the Oklahoma State Bureau of Narcotics and Dangerous Drugs Control
356650 under subsection B of Section 2-301 of this title within the
357651 parameters of such officer’s duties under Sections 501 through 508
358652 of Title 4 of the Oklahoma Statutes;

360653 26. “Narcotic drug” means any of the following, whether
361654 produced directly or indirectly by extraction from substances of

368685 preparation of opium, coca leaves or opiates,

370686 c. cocaine, its salts, optical and geo metric isomers, and
371687 salts of isomers,

373688 d. ecgonine, its derivatives, their salts, isomers and
374689 salts of isomers, and
375-
376690 e. a substance, and any compound, manufacture, salt,
377691 derivative or preparation thereof, which is chemically
378692 identical with any of the substan ces referred to in
379693 subparagraphs a through d of this paragraph, except
380694 that the words “narcotic drug” narcotic drug as used
381695 in Section 2-101 et seq. of this title shall not
382696 include decocainized coca leaves or extracts of coca
383697 leaves, which extracts do not contain cocain e or
384698 ecgonine;

386699 27. “Opiate” or “opioid” means any Schedule II, III, IV or V
387700 substance having an addiction-forming or addiction-sustaining
388701 liability similar to morphine or being capable of conversion into a
389702 drug having such addiction-forming or addiction -sustaining
390703 liability. The terms do not include, unless specifically designated
391704 as controlled under the Uniform Controlled Dangerous Substances Act,

2207+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
2208+SECTION 9. AMENDATORY 63 O.S. 2021, Section 2-101, as
2209+amended by Section 4, Ch apter 265, O.S.L. 2022 (63 O.S. Supp. 2022,
2210+Section 2-101), is amended to read as foll ows:
2211+Section 2-101. As used in the Uniform Controlled Dangerous
2212+Substances Act:
2213+1. “Administer” means the direct application of a controlled
2214+dangerous substance, whether by injection, inhalation, ingestion or
2215+any other means, to the body of a patient, animal or research
2216+subject by:
2217+a. a practitioner (or, in the presence of the
2218+practitioner, by the authorized agent of the
2219+practitioner), or
2220+b. the patient or research subject at the direction and
2221+in the presence of the practitioner;
2222+2. “Agent” means a peace officer appointed by and who acts on
2223+behalf of the Director of the Oklahoma State Bureau of Narcotics and
2224+Dangerous Drugs Control or an authorized person who acts on behalf
2225+of or at the direction of a person who manufactures, distributes,
2226+

2252+dispenses, prescribes, administers or uses for scientific purposes
2253+controlled dangerous substances but does not include a common or
2254+contract carrier, public warehouser or employee thereof, or a person
2255+required to register under the Uniform Controlled Dangerous
2256+Substances Act;
2257+3. “Board” means the Advisory Board to the Director of the
2258+Oklahoma State Bureau of Narcotics and Dangerous Drugs Control;
2259+4. “Bureau” means the Oklahoma State Bureau of Narcotics and
2260+Dangerous Drugs Control;
2261+5. “Coca leaves” includes cocaine and any compound,
2262+manufacture, salt, derivative, mixture or preparation of coca
2263+leaves, except derivatives of coca leaves which do not contain
2264+cocaine or ecgonine;
2265+6. “Commissioner” or “Director” means the Director of the
2266+Oklahoma State Bureau of Narcotics and Dangerous Drugs Control;
2267+7. “Control” means to add, remove or change the placement of a
2268+drug, substance or immediate precursor under the Uniform Controlled
2269+Dangerous Substances Act;
2270+8. “Controlled dangerous substance” means a drug, substance or
2271+immediate precursor in Schedules I through V of the Uniform
2272+Controlled Dangerous Substances Act or any drug, substance or
2273+immediate precursor listed either temporarily or permanently as a
2274+federally controlled substance. Any conflict between state and

2301+federal law with regard to the particular schedule in which a
2302+substance is listed shall be resolved in favor of state law;
2303+9. “Counterfeit substance” means a controlled substance which,
2304+or the container or labeling of which without authorization, bears
2305+the trademark, trade name or other identifying marks, imprint,
2306+number or device or any likeness thereof of a manufacturer,
2307+distributor or dispenser other than the person who in fact
2308+manufactured, distributed or dispensed the substance;
2309+10. “Deliver” or “delivery” means the actual, constructive or
2310+attempted transfer from one person to another of a controlled
2311+dangerous substance or drug paraphernalia, whether or not there is
2312+an agency relationship;
2313+11. “Dispense” means to deliver a controlled dangerous
2314+substance to an ultimate user or human research subject by or
2315+pursuant to the lawful order of a practitioner, including the
2316+prescribing, administering, packaging, labeling or compounding
2317+necessary to prepare the substance for such distribution.
2318+“Dispenser” is a practitioner who delivers a controlled dangerous
2319+substance to an ultimate user or human research subject;
2320+12. “Distribute” means to deliver other than by administering
2321+or dispensing a controlled dangerous substance;
2322+13. “Distributor” means a commercial entity engaged in the
2323+distribution or reverse distribution of narcotics and dangerous
2324+drugs and who complies with all regulations promulgated by the
2325+

2352+Bureau of Narcotics and Dangerous Drugs Control;
2353+14. “Drug” means articles:
2354+a. recognized in the official United States Pharmacopeia,
2355+official Homeopathic Pharmacopoeia of the United
2356+States, or official National Formulary, or any
2357+supplement to any of them,
2358+b. intended for use in the diagnosis, cure, mitigation,
2359+treatment or prevention of disease in man or other
2360+animals,
2361+c. other than food, intended to affect the structure or
2362+any function of the body of man or other animals, and
2363+d. intended for use as a component of any article
2364+specified in this paragraph;
2365+provided, however, the term “drug” drug does not include devices or
2366+their components, parts or accessories;
2367+15. “Drug-dependent person” means a person who is using a
2368+controlled dangerous substance and who is in a state of psychic or
2369+physical dependence, or both, arising from administration of that
2370+controlled dangerous substance on a continuous basis. Drug
2371+dependence is characterized by behavioral and other responses which
2372+include a strong compulsion to take the substance on a continuous
2373+basis in order to experience its psychic effects, or to avoid the
2374+discomfort of its absence;

2401+16. “Home care agency” means any sole proprietorship,
2402+partnership, association, corporation, or other organization which
2403+administers, offers, or provides home care services, for a fee or
2404+pursuant to a contract for such services, to clients in their place
2405+of residence;
2406+17. “Home care services” means skilled or personal care
2407+services provided to clients in their place of residence for a fee;
2408+18. “Hospice” means a centrally administered, nonprofit or for-
2409+profit, medically directed, nurse-coordinated program which provides
2410+a continuum of home and inpatient care for the terminally ill
2411+patient and the patient’s family. Such term shall also include a
2412+centrally administered, nonprofit or for-profit, medically directed,
2413+nurse-coordinated program if such program is licensed pursuant to
2414+the provisions of the Uniform Controlled Dangerous Substances Act.
2415+A hospice program offers palliative and supportive care to meet the
2416+special needs arising out of the physical, emotional and spiritual
2417+stresses which are experienced during the final stages of illness
2418+and during dying and bereavement. This care is available twenty-
2419+four (24) hours a day, seven (7) days a week, and is provided on the
2420+basis of need, regardless of ability to pay. “Class A” Hospice
2421+refers to Medicare-certified hospices. “Class B” refers to all
2422+other providers of hospice services;
2423+19. “Imitation controlled substance” means a substance that is
2424+not a controlled dangerous substance, which by dosage unit
2425+

2451+appearance, color, shape, size, markings or by representations made,
2452+would lead a reasonable person to believe that the substance is a
2453+controlled dangerous substance. In the event the appearance of the
2454+dosage unit is not reasonably sufficient to establish that the
2455+substance is an “imitation controlled substance” imitation
2456+controlled substance, the court or authority concerned should
2457+consider, in addition to all oth er factors, the following factors as
2458+related to “representations made” in determining wheth er the
2459+substance is an “imitation controlled substance” imitation
2460+controlled substance:
2461+a. statements made by an owner or by any other person in
2462+control of the substance concerning the nature of the
2463+substance, or its use or effect,
2464+b. statements made to the recipient that the substance
2465+may be resold for inordinate profit,
2466+c. whether the substance is packaged in a manner normally
2467+used for illicit controlled substances,
2468+d. evasive tactics or actions utilized by the owner or
2469+person in control of the substance to avoid detection
2470+by law enforcement authorities,
2471+e. prior convictions, if any, of an owner, or any other
2472+person in control of the object, under state or
2473+federal law related to controlled substances or fraud,
2474+and
2475+

2501+f. the proximity of the substances to controlled
2502+dangerous substances;
2503+20. “Immediate precursor” means a substance which the Director
2504+has found to be and by regulation designates as being the principal
2505+compound commonly used or produced primarily for use, and which is
2506+an immediate chemical intermediary used, or likely to be used, in
2507+the manufacture of a controlled dangerous substance, the control of
2508+which is necessary to prevent, curtail or limit such manufacture;
2509+21. “Laboratory” means a laboratory approved by the Director as
2510+proper to be entrusted with the custody of controlled dangerous
2511+substances and the use of controlled dangerous substances for
2512+scientific and medical purposes and for purposes of instruction;
2513+22. “Manufacture” means the production, preparation,
2514+propagation, compounding or processing of a controlled dangerous
2515+substance, either directly or indirectly by extraction from
2516+substances of natural or synthetic origin, or independently by means
2517+of chemical synthesis or by a combination of extraction and chemical
2518+synthesis. “Manufacturer” includes any person who packages,
2519+repackages or labels any container of any controlled dangerous
2520+substance, except practitioners who dispense or compound
2521+prescription orders for delivery to the ultimate consumer;
2522+23. “Marijuana” means all parts of the plant Cannabis sativa
2523+L., whether growing or not; the seeds thereof; the resin extracted
2524+from any part of such plant; and every compound, manufacture, salt,
2525+

2552+resin, but shall not include:
2553+a. the mature stalks of such plant or fiber produced from
2554+such stalks,
2555+b. oil or cake made from the seeds of such plant,
2556+including cannabidiol derived from the seeds of the
2557+marijuana plant,
2558+c. any other compound, manufacture, salt, derivative,
2559+mixture or preparation of such mature stalks (except
2560+the resin extracted therefrom), including cannabidiol
2561+derived from mature stalks, fiber, oil or cake,
2562+d. the sterilized seed of such plant which is incapable
2563+of germination,
2564+e. for any person participating in a clinical trial to
2565+administer cannabidiol for the treatment of severe
2566+forms of epilepsy pursuant to Section 2-802 of this
2567+title, a drug or substance approved by the federal
2568+Food and Drug Administration for use by those
2569+participants,
2570+f. for any person or the parents, legal guardians or
2571+caretakers of the person who have received a written
2572+certification from a physician licensed in this state
2573+that the person has been diagnosed by a physician as
2574+having Lennox-Gastaut syndrome, Dravet syndrome, also
2575+

2601+known as severe myoclonic epilepsy of infancy, or any
2602+other severe form of epilepsy that is not adequately
2603+treated by traditional medical therapies, spasticity
2604+due to multiple sclerosis or due to paraplegia,
2605+intractable nausea and vomiting, appetite stimulation
2606+with chronic wasting diseases, the substance
2607+cannabidiol, a nonpsychoactive cannabinoid, found in
2608+the plant Cannabis sativa L. or any other preparation
2609+thereof, that has a tetrahydrocannabinol concentration
2610+of not more than three-tenths of one percent (0.3%)
2611+and that is delivered to the patient in the form of a
2612+liquid,
2613+g. any federal Food-and-Drug-Administration-approved drug
2614+or substance, or
2615+h. industrial hemp, from the plant Cannabis sativa L. and
2616+any part of such plant, whether growing or not, with a
2617+delta-9 tetrahydrocannabinol concentration of not more
2618+than three-tenths of one percent (0.3%) on a dry-
2619+weight basis which shall only be grown pursuant to the
2620+Oklahoma Industrial Hemp Program and may be shipped
2621+intrastate and interstate;
2622+24. “Medical purpose” means an intention to utilize a
2623+controlled dangerous substance for physical or mental treatment, for
2624+diagnosis, or for the prevention of a disease condition not in
2625+

2652+satisfying physiological or psychological dependence or other abuse;
2653+25. “Mid-level practitioner” means an Advanced Practice
2654+Registered Nurse as defined and within parameters specified in
2655+Section 567.3a of Title 59 of the Oklahoma Statutes, or a certified
2656+animal euthanasia technician as defined in Section 698.2 of Title 59
2657+of the Oklahoma Statutes, or an animal control officer registered by
2658+the Oklahoma State Bureau of Narcotics and Dangerous Drugs Control
2659+under subsection B of Section 2-301 of this title within the
2660+parameters of such officer’s duties under Sections 501 through 508
2661+of Title 4 of the Oklahoma Statutes;
2662+26. “Narcotic drug” means any of the following, whether
2663+produced directly or indirectly by extraction from substances of
2664+vegetable origin, or independently b y means of chemical synthesis,
2665+or by a combination of extraction and chemical synthesis:
2666+a. opium, coca leaves and opiates,
2667+b. a compound, manufacture, salt, derivative or
2668+preparation of opium, coca leaves or opiates,
2669+c. cocaine, its salts, optical and geo metric isomers, and
2670+salts of isomers,
2671+d. ecgonine, its derivatives, their salts, isomers and
2672+salts of isomers, and
2673+e. a substance, and any compound, manufacture, salt,
2674+derivative or preparation thereof, which is chemically
2675+

2702+subparagraphs a through d of this paragraph, except
2703+that the words “narcotic drug” narcotic drug as used
2704+in Section 2-101 et seq. of this title shall not
2705+include decocainized coca leaves or extracts of coca
2706+leaves, which extracts do not contain cocain e or
2707+ecgonine;
2708+27. “Opiate” or “opioid” means any Schedule II, III, IV or V
2709+substance having an addiction-forming or addiction-sustaining
2710+liability similar to morphine or being capable of conversion into a
2711+drug having such addiction-forming or addiction -sustaining
2712+liability. The terms do not include, unless specifically designated
2713+as controlled under the Uniform Controlled Dangerous Substances Act,
2714+the dextrorotatory isomer of 3-methoxy-n-methyl-morphinan and its
2715+salts (dextromethorphan). The terms do include the racemic and
2716+levorotatory forms;
2717+28. “Opium poppy” means the plant of the species Papaver
2718+somniferum L., except the seeds thereof;
2719+29. “Peace officer” means a police officer, sheriff, deputy
2720+sheriff, district attorney’s investigator, investigato r from the
2721+Office of the Attorney General, or any other person elected or
2722+appointed by law to enforce any of the criminal laws of this state
2723+or of the United States;

2750+30. “Person” means an individual, corporation, government or
2751+governmental subdivision or agency, business trust, estate, trust,
2752+partnership or association, or any other legal entity;
2753+31. “Poppy straw” means all parts, except the seeds, of the
2754+opium poppy, after mowing;
2755+32. “Practitioner” means:
2756+a. (1) a medical doctor or osteopathic physicia n,
2757+(2) a dentist,
2758+(3) a podiatrist,
2759+(4) an optometrist,
2760+(5) a veterinarian,
2761+(6) a physician assistant or Advanced Practice
2762+Registered Nurse under the supervision of a
2763+licensed medical doctor or osteopathic physician,
2764+(7) a scientific investigator, or
2765+(8) any other person,
2766+licensed, registered or otherwise permitted to
2767+prescribe, distribute, dispense, conduct research with
2768+respect to, use for scientific purposes or administer
2769+a controlled dangerous substance in the course of
2770+professional practice or research in this state, or
2771+b. a pharmacy, hospital, laboratory or other institution
2772+licensed, registered or otherwise permitted to
2773+distribute, dispense, conduct research with respect
2774+

2803+33. “Production” includes the manufacture, planting,
2804+cultivation, growing or harvesting of a controlled dangerous
2805+substance;
2806+34. “State” means the State of Oklahoma or any other state of
2807+the United States;
2808+35. “Ultimate user” means a person who lawfully possesses a
2809+controlled dangerous substance for the person’s own use or for the
2810+use of a member of the person’s household or for administration to
2811+an animal owned by the person or by a member of the person’s
2812+household;
2813+36. “Drug paraphernalia” means all equipment, products and
2814+materials of any kind which are used, intended for use, or fashioned
2815+specifically for use in planting, propagating, cultivating, growing,
2816+harvesting, manufacturing, comp ounding, converting, producing,
2817+processing, preparing, testing, analyzing, packaging, repackaging,
2818+storing, containing, concealing, injecting, ingesting, inhaling or
2819+otherwise introducing into the human body, a controlled dangerous
2820+substance in violation o f the Uniform Controlled Dangerous
2821+Substances Act including, but not limited to:
2822+a. kits used, intended for use, or fashioned specifically
2823+for use in planting, propagating, cultivating, growing
2824+

2857+c. isomerization devices used, intended for use, or
2858+fashioned specifically for use in increasing the
2859+potency of any species of plant which is a controlled
2860+dangerous substance,
2861+d. testing equipment used, intended for use, or fashioned
2862+specifically for use in identifying, or in analyzing
2863+the strength, effectiveness or purity of controlled
2864+dangerous substances,
2865+e. scales and balances used, intended for use, or
2866+fashioned specifically for use in weighing or
2867+measuring controlled dangerous substances,
2868+f. diluents and adulterants, such as quinine
2869+hydrochloride, mannitol, mannite, dextrose and
2870+lactose, used, intended for use, or fashioned
2871+specifically for use in cutting controlled dangerous
2872+substances,

2954+(5) roach clips, meaning objects used to hold burning
2955+material, such as a marijuana cigarette, that has
2956+become too small or too short to be held in the
2957+hand,
2958+(6) miniature cocaine spoons and cocaine vials,
2959+(7) chamber pipes,
2960+(8) carburetor pipes,
2961+(9) electric pipes,
2962+(10) air-driven pipes,

2999+shall not include separation gins intended for use in preparing tea
3000+or spice, clamps used for constructing electrical equipme nt, water
3001+pipes designed for ornamentation in which no detectable amount of an
3002+illegal substance is found or pipes designed and used solely for
3003+smoking tobacco, traditional pipes of an American Indian tribal
3004+religious ceremony, or antique pipes that are th irty (30) years of
3005+age or older;
3006+37. a. “Synthetic controlled substance” means a substance:
3007+(1) the chemical structure of which is substantially
3008+similar to the chemical structure of a controlled
3009+dangerous substance in Schedule I or II,
3010+(2) which has a stimulant, depressant, or
3011+hallucinogenic effect on the cent ral nervous
3012+system that is substantially similar to or
3013+greater than the stimulant, depressant or
3014+hallucinogenic effect on the central nervous
3015+system of a controlled dangerous substance in
3016+Schedule I or II, or
3017+(3) with respect to a particular person, which such
3018+person represents or intends to have a stimulant,
3019+depressant, or hallucinogenic effect on the

3051+b. The designation of gamma butyrolactone or any other
3052+chemical as a precursor, pursuant to Section 2-322 of
3053+this title, does not preclude a findin g pursuant to
3054+subparagraph a of this paragraph that the chemical is
3055+a synthetic controlled substance.
3056+c. “Synthetic controlled substance” does not include:
3057+(1) a controlled dangerous substance,
3058+(2) any substance for which there is an approved new
3059+drug application,
3060+(3) with respect to a particular person any
3061+substance, if an exemption is in effect for
3062+investigational use, for that person under the
3063+provisions of Section 505 of the Federal Food,
3064+Drug and Cosmetic Act, Title 21 of the United
3065+States Code, Section 355, to the extent conduct
3066+with respect to such subst ance is pursuant to
3067+such exemption, or
3068+(4) any substance to the extent not intended for
3069+human consumption before such an exemption takes
3070+effect with respect to that substance.

3097+d. Prima facie evidence that a substance containing
3098+salvia divinorum has been en hanced, concentrated or
3099+chemically or physically altered shall give rise to a
3100+rebuttable presumption that the substance is a
3101+synthetic controlled substance;
3102+38. “Tetrahydrocannabinols” means all substances that have been
3103+chemically synthesized to emulate the tetrahydrocannabinols of
3104+marijuana, specifically including any tetrahydrocannabinols derived
3105+from industrial hemp;
3106+39. “Isomer” means the optical isomer, except as used in
3107+subsections C and F o f Section 2-204 of this title and paragraph 4
3108+of subsection A of Section 2-206 of this title. As used in
3109+subsections C and F of Section 2-204 of this title, “isomer” isomer
3110+means the optical, positional or geometric isomer. As used in
3111+paragraph 4 of subsection A of Section 2-206 of this title, the term
3112+“isomer” isomer means the optical or geometric isomer;
3113+40. “Hazardous materials” means materials, whether solid,
3114+liquid or gas, which are toxic to human, animal, aquatic or plant
3115+life, and the disposal of which materia ls is controlled by state or
3116+federal guidelines;
3117+41. “Anhydrous ammonia” means any substance that exhibits
3118+cryogenic evaporative behavior and tests positive for ammonia;
3119+42. “Acute pain” means pain, whether resulting from disease,
3120+accidental or intentional trauma or other cause, that the

3147+practitioner reasonably expects to last only a short period of time.
3148+“Acute pain” Acute pain does not include chronic pain, pain being
3149+treated as part of cancer care, hospice or other end-of-life care,
3150+or pain being treated as part of palliative care;
3151+43. “Chronic pain” means pain that persists beyond the usual
3152+course of an acute disease or healing of an injury. “Chronic pain”
3153+Chronic pain may or may not be associated with an acute or chronic
3154+pathologic process that causes continuous or intermittent pain over
3155+months or years;
3156+44. “Initial prescription” means a prescription issued to a
3157+patient who:
3158+a. has never previously been issued a prescription for
3159+the drug or its pharmaceutical equivalent in the past
3160+year, or
3161+b. requires a prescription for the drug or its
3162+pharmaceutical equivalent due to a surgica l procedure
3163+or new acute event and has previously had a
3164+prescription for the drug or its pharmaceutical
3165+equivalent within the past year.
3166+When determining whether a patient was previously issued a
3167+prescription for a drug or its pharmaceutical equivalent, th e
3168+practitioner shall consult with the patient and review the medical
3169+record and prescription monitoring information of the patient;

3196+45. “Patient-provider agreement” means a written contract or
3197+agreement that is executed between a practitioner and a patien t,
3198+prior to the commencement of treatment for chronic pain using an
3199+opioid drug as a means to:
3200+a. explain the possible risk of development of physical
3201+or psychological dependence in the patient and prevent
3202+the possible development of addiction,
3203+b. document the understanding of both the practitioner
3204+and the patient regarding the patient-provider
3205+agreement of the patient,
3206+c. establish the rights of the patient in association
3207+with treatment and the obligations of the patient in
3208+relation to the responsible use, discontinuation of
3209+use, and storage of opioid drugs, including any
3210+restrictions on the refill of prescriptions or the
3211+acceptance of opioid prescriptions from practitioners,
3212+d. identify the specific medications and other modes of
3213+treatment, including physical therapy or exercise,
3214+relaxation or psychological counseling, that are
3215+included as a part of the patient-provider agreement,
3216+e. specify the measures the practitioner may employ to
3217+monitor the compliance of the patient including, but
3218+not limited to, rand om specimen screens and pill
3219+counts, and
3220+

3246+f. delineate the process for terminating the agreement,
3247+including the consequences if the practitioner has
3248+reason to believe that the patient is not complying
3249+with the terms of the agreement. Compliance with the
3250+“consent items” shall constitute a valid, informed
3251+consent for opioid therapy. The practitioner shall be
3252+held harmless from civil litigation for failure to
3253+treat pain if the event occurs because of nonadherence
3254+by the patient with any of the provisions of the
3255+patient-provider agreement;
3256+46. “Serious illness” means a medical illness or physical
3257+injury or condition that substantially affects quality of life for
3258+more than a short period of time. “Serious illness” Serious illness
3259+includes, but is not limited to, Alzheimer’s disease or related
3260+dementias, lung disease, cancer, heart failure, renal failure, liver
3261+failure or chronic, unremitting or intractable pain such as
3262+neuropathic pain; and
3263+47. “Straw person or party” means a third party who is put up
3264+in name only to take part in a transaction. This term includes but
3265+is not limited to a n ominal party to a transaction, one who acts as
3266+an agent for another for the purpose of taking tit le to property and
3267+executing whatever documents and instruments the principal may
3268+direct respecting the property, or a person who purchases property
3269+

3295+for another to conceal the identity of the real purchaser or to
3296+accomplish some purpose otherwise not allowed; and
3297+47. 48. “Surgical procedure” means a procedure that is
3298+performed for the purpose of structurally altering the human body by
3299+incision or destruction of tissues as part of the practice of
3300+medicine. This term includes the diagnostic or therapeutic
3301+treatment of conditions or disease processes by use of instruments
3302+such as lasers, ultrasound, ionizing, radiation, scalpels, probes or
3303+needles that cause localized alteration or transportation of live
3304+human tissue by cutting, burning, vaporizing, freezing, suturing,
3305+probing or manipulating by closed reduction for major dislocations
3306+or fractures, or otherwise altering by any mechanical, thermal,
3307+light-based, electromagnetic or chemical means.
3308+SECTION 10. AMENDATORY 63 O.S. 2021, Section 2-110, is
3309+amended to read as follows:
3310+Section 2-110. The Director of the Oklahoma State Bureau of
3311+Narcotics and Dangerous Drugs Control may empl oy attorneys, who
3312+shall be unclassified employees of the state, or contract with
3313+attorneys, as needed. These at torneys may advise the Director, the
3314+Oklahoma State Bureau of Narcotics and Dangerous Drugs Control
3315+Commission and Bureau personnel on all legal matters and shall
3316+appear for and represent the Director, the Commission and Bureau
3317+personnel in all administrat ive hearings and all litigation or other
3318+proceedings which may arise in the discharge of their duties. At

3346+Drugs Control Commission, such attorney shall assist the district
3347+attorney or the Attorney General in prosecuting charges of violators
3348+of the Uniform Controlled Dangerous Substances Act or any felony
3349+relating to or arising fr om a violation of the Unifo rm Controlled
3350+Dangerous Substances Act. Attorneys for the Bureau who have been
3351+certified by the Council on Law Enforcement Education and Training
3352+to carry a weapon or have been issued a handgun license pursuant to
3353+the provisions of the Oklahoma Self -Defense Act shall be allowed to
3354+carry weapons pursuant to paragraph 3 of subsection A of S ection
3355+1272 of Title 21 of the Oklahoma Statutes. Th ese attorneys,
3356+pursuant to this provision, shall not be considered eligible to
3357+participate in the Oklahoma Law Enforce ment Retirement System. If a
3358+conflict of interest would be created by such attorney representing
3359+the Director, the Commission or Bureau p ersonnel, additional counsel
3360+may be hired upon approval of the Oklahoma State Bureau of Nar cotics
3361+and Dangerous Drugs Control Commission.
3362+SECTION 11. AMENDATORY 63 O.S. 20 21, Section 2-304, is
3363+amended to read as follows:
3364+Section 2-304. A. A registration, pursuant to Section 2-303 of
3365+this title, to manufacture, distribute, dispense, prescribe,
3366+administer or use for scientific purposes a controlled dan gerous
3367+substance shall be lim ited, conditioned, denied, suspended,
3368+annulled, or revoked by the Director of the Oklahoma State Bureau of

3396+registrant:
3397+1. Has materially falsified any application filed pursuant to
3398+the Uniform Controlled Dangerous Substances Act or required by t he
3399+Uniform Controlled Dangerous Substanc es Act. It shall be unlawful
3400+to knowingly and willfully:
3401+a. make false statements, include false data or omit
3402+material information on an application for a
3403+registration with the Oklahoma State Bureau of
3404+Narcotics and Dangerous Drugs Control, or
3405+b. provide false data or omit material information in any
3406+records or reports required by rule or law to be
3407+created, maintained or submitted to the Bureau .
3408+Any registrant or applicant for a registration or any official,
3409+agent or employee of any registrant or applicant for a registration
3410+who violates the provisions of this paragraph shall be guilty of a
3411+misdemeanor and additionally subject to administrative action ;
3412+2. Has been found guilty of, entered a plea of guilty or
3413+entered a plea of nolo contendere to a misdemean or relating to any
3414+substance defined herein as a controlled dangerous substance or any
3415+felony under the laws of any state or the United States;
3416+3. Has had his or her federal registration retired, suspended
3417+or revoked by a competent federal authority and i s no longer
3418+authorized by federal la w to manufacture, distribute, dispense,

3446+dangerous substances;
3447+4. Has failed to maintain effective controls against the
3448+diversion of controlled dangerous su bstances to unauthorized persons
3449+or entities;
3450+5. Has prescribed, dispensed or administered a controlled
3451+dangerous substance from schedules other than those specifi ed in his
3452+or her state or federal registration;
3453+6. Has had a restriction, suspension, revoc ation, limitation,
3454+condition or probation placed on his or her professional license or
3455+certificate or practice as a result of a proceeding pursuant to the
3456+general statutes;
3457+7. Is abusing or, within the past five (5) years, has abused or
3458+excessively used drugs or controlled dangerous sub stances;
3459+8. Has prescribed, sold, administered or ordered any controlled
3460+substance for an immediate family member, himself or herse lf;
3461+provided that this shall not apply to a medical emergency when no
3462+other doctor is availa ble to respond to the emergency ;
3463+9. Has possessed, used, prescribed, dispensed or administered
3464+drugs or controlled dangerous substances for other than legitimate
3465+medical or scientific purposes or for purposes outsid e the normal
3466+course of his or her profes sional practice;
3467+10. Has been under the influence of alcohol or another
3468+intoxicating substance which adversely affected the central nervous
3469+

3496+such degree the person was impaired during the per formance of his or
3497+her job; or
3498+11. Has violated any federal law relating to any controlled
3499+substances, any provision of the Uniform Controlled Dangerous
3500+Substances Act or any rules of the Oklahoma State Bureau of
3501+Narcotics and Dangerous Drugs Control.
3502+B. In the event the Director suspends or revokes a registration
3503+granted under Section 2-303 of this title, all controlled dangerous
3504+substances owned or possessed by t he registrant pursuant to such
3505+registration at the t ime of denial revocation or suspension or the
3506+effective date of the revocation order, as the case may be, may in
3507+the discretion of the Director be impounded and preserved . All
3508+controlled dangerous substa nces not impounded or preserved by the
3509+Director shall be maintained by the registrant . No disposition,
3510+purchase, distribution , sale, or transfer may be made of substances
3511+impounded and preserved until the time for taking an appeal has
3512+elapsed or until all appeals have been concluded unless a court,
3513+upon application therefor, orders the sale of p erishable substances
3514+and the deposit of the proceeds of the sale with the court. Upon a
3515+revocation order becoming final, all such co ntrolled dangerous
3516+substances shall be forfeited to the state or otherwise considered
3517+waste and submitted to a licensed was te disposal service for
3518+destruction pursuant to Section 430 of this title.

3545+C. The Drug Enforcement Administration shall promptly be
3546+notified of all orders suspendi ng or revoking registration and all
3547+forfeitures of controlled dangerous substances.
3548+D. In lieu of or in addition to any other remed ies available to
3549+the Director, if a finding is made that a registrant has committed
3550+any act in violation of federal law rela ting to any controlled
3551+substance, any provision of the Uniform Controlled Dangerous
3552+Substances Act or any rules of the Oklahoma Stat e Bureau of
3553+Narcotics and Dangerous Drugs Control, the Director is hereby
3554+authorized to assess an administrative penalty not to exceed Two
3555+Thousand Dollars ($2,000.00) for each such act . The provisions of
3556+this subsection shall not apply to violations of s ubsection G of
3557+Section 2-309D of this title. Nothing in this section shall be
3558+construed so as to permit the Director of the State Bureau of
3559+Narcotics and Dangerous Drugs Control to assess administrative fines
3560+for violations of the provisions of subsection G of Section 2-309D
3561+of this title.

3564+Section 2-305. A. Before denying, suspending or revoking a
3565+registration, refusing a renewal of registration or taking

3596+registrant an order to show cause why registration should not be
3597+denied, revoked or suspended or why the renewal should not be
3598+refused. The order to show ca use shall contain a statement of the
3599+basis therefor and shall call upon the applicant or registrant to
3600+appear before the appropriate person or agency at a time and place
3601+within thirty (30) days after the date of service of the order, but
3602+in the case of a denial or renewal of registration the sho w cause
3603+order shall be served within thirty ( 30) days before the expiration
3604+of the registration. These proceedings shall be conducted in
3605+accordance with the Administrative Procedures Act without regard to
3606+any criminal prosecution or other proceeding . Proceedings to refuse
3607+renewal of registration sh all not abate the existing registr ation
3608+which shall remain in effect pending the outcome of the
3609+administrative hearing In addition to any other remedies provided
3610+for by law, the Director shall issue a written order to be served on
3611+the parties before annull ing, conditioning, suspending or revoking
3612+any registration that the Director has reason to believe is
3613+operating inconsistent with any provision of Section 2-303 of this
3614+title, pursuant to Section 2 -304 of this title or otherwise where
3615+there has been a violation of any federal law , any rule or
3616+regulation of the Drug Enforcement Administration, any provision of

3646+B. The Director shall suspend , without an order to show cause,
3647+any registration simultaneously with the institution of proceedings
3648+under Section 2-304 of this title, if h e or she finds there is
3649+imminent danger to the public health or safety which warrants this
3650+action. The suspension shall continue in effect until the
3651+conclusion of the proceedings, including judicial revie w thereof,
3652+unless sooner withdrawn by the Director or dissolved by a court of
3653+competent jurisdicti on The written order shall state with
3654+specificity the nature of the violation or basis for the action.
3655+The Director may impose any disciplinary action authoriz ed by the
3656+Uniform Controlled Dangerous Substances Act or rules of the Oklahoma

3659+C. Any written order issued pursuant to the provisions of this
3660+section shall become a final order unless the registrant requests an
3661+administrative hearing in accordance with the rules and regulations
3662+promulgated by the Director within thirty (30) days of issuance.
3663+Upon such request, the Director shall promptly initiate
3664+administrative proceedings and serve formal notice of the
3665+proceedings pursuant to S ection 309 of Title 75 of the Oklahoma
3666+Statutes. Nothing in this section shall be construed so as to

3694+for registration.
3695+D. The Director may authorize the Deputy Director or the
3696+General Counsel of the Oklahoma State Bureau of Narcotics and
3697+Dangerous Drugs Control to initiate any individual proceed ings under
3698+this title. Nothing in this section shall be construed so as to
3699+delegate the authority of the Director to issue a final agency order
3700+adverse to a party.
3701+E. All proceedings shall be conducted in accord ance with the
3702+Administrative Procedures Act and the rules and regulations of the
3703+Oklahoma State Bureau of Narcotics and Dangerous Drugs Control
3704+without regard to any criminal prosecution o r other proceeding.
3705+Proceedings to refuse renewal, revoke, or suspend a registration
3706+shall not abate the exist ing registration which shall remain in
3707+effect pending the outcome of those administrative proceedings.
3708+This abatement shall not apply when the D irector finds there is an
3709+imminent danger to the public hea lth or safety requir ing an
3710+immediate suspension.
3711+The Director may delegate to an administrative hearing o fficer
3712+the authority to conduct hearings and recommend action for final
3713+agency orders in acc ordance with the rules and regulations of the
3714+Oklahoma State Bureau of Narcotic s and Dangerous Drugs Control.
3715+F. The Director may issue an order immediately suspen ding a
3716+registration, without notice or a hearing, when he or she finds

3743+there is imminent dan ger to the public health or safety which
3744+warrants this action. The suspension shall continue in effect until
3745+the conclusion of any administrative proceedings, incl uding judicial
3746+review thereof, unless sooner withdrawn by the Director or dissolved
3747+by a court of competent jurisdiction. The order shall state the
3748+existence of an emerge ncy requiring action be taken that the
3749+Director deems necessary to meet the emergency . Such action may
3750+include, but is not limited to, ordering the registrant to
3751+immediately cease and desist operations. The order shall be
3752+effective immediately upon issua nce. Any person to whom the order
3753+is directed shall comply immediately with the prov isions of the
3754+order. The Director may assess a penalty not to exceed Ten Thousand
3755+Dollars ($10,000.00) per day of noncompliance with the order. In
3756+assessing such a penal ty, the Director shall consider the
3757+seriousness of the violation and any efforts to c omply with
3758+applicable requirements. Upon application to the Director, the
3759+registrant shall be offered a hearing within thirty (30) days of the
3760+issuance of the order.
3761+G. In lieu of or in addition to any other remedies available to
3762+the Director, if a findi ng is made that a registrant has committed
3763+any act in violation of federal law relating to a ny controlled
3764+substance, any provision of the Uniform Contr olled Dangerous
3765+Substances Act or any rules of the Oklahoma State Bureau of
3766+Narcotics and Dangerous Drugs Control, the Director is hereby

3794+Thousand Dollars ($5,000.00) per day for each such a ct. The
3795+provisions of this subsection shall not apply to violations of
3796+subsection G of Section 2 -309D of this title. Nothing in this
3797+section shall be construed so as to permit the Director of the State
3798+Bureau of Narcotics and Dangerous Drugs Control to a ssess
3799+administrative fines for violations of the provisions of subsection
3800+G of Section 2-309D of this title.
3801+If a judge of competent jurisdiction finds probable cause that a
3802+registrant has possesse d, transferred, sold, or offered for sale any
3803+controlled dangerous in violation of this act, all controlled
3804+dangerous substances in Schedule I of Section 2 -204 of this title
3805+and all controlled dangerous substances in Schedules II, III, IV,
3806+and V that are not in properly labeled containers in accordance with
3807+this act then in the posse ssion of the registrant shall be deemed
3808+contraband and shall be seized and summarily forfeited pursuant to
3809+Section 2-505 of this title. Samples shall be retained of all
3810+controlled dangerous substances seized in accordance with Section 2-
3811+508 of this title as required. The Director is authorized to assess
3812+an eradication or destruction fine not to exceed Fifty Thousand
3813+Dollars ($50,000.00) against the registrant.
3814+H. Upon an annulment, revocation, or denial of a registration
3815+the Director may prohibit the reg istrant or applicant from
3816+reapplying for registration for a period up to five years f ollowing

3844+not be used as grounds to contest the validity of the annulment,
3845+revocation, or denial of a registration.
3846+SECTION 13. AMENDATORY 63 O.S. 2021, Section 2 -322, is
3847+amended to read as follows:
3848+Section 2-322. A. No person or business shall possess, se ll,
3849+manufacture, transfer, or otherwise furnish any of the following
3850+precursor substances without first having a permit or license issued
3851+by the Director of t he Oklahoma State Bureau of Narcotics and
3852+Dangerous Drugs Control, except as provided in Section 2 -327 of this
3853+title:
3854+1. D-Lysergic acid;
3855+2. Ergotamine and its salts;
3856+3. Ergonovine and its salts;
3857+4. Methylamine;
3858+5. Ethylamine;
3859+6. Phenyl-2-Propanone;
3860+7. Phenylacetic acid and its salts;
3861+8. Ephedrine, its salts, optical isomers and salts of optica l

3907+B. Upon completion of an application for a license pursuant to
3908+Section 2-323 of this title, or a permit pursuant to Section 2 -324
3909+of this title, the Director of the Oklah oma State Bureau of
3910+Narcotics and Dangerous Drugs Control shall either grant or deny
3911+such license or permit. A denial of an application for a permit or
3912+license shall be handled as provided by Section 2 -325 of this title.
3913+SECTION 14. AMENDATORY 63 O.S. 2021, Section 2 -325, is
3914+amended to read as follows:
3915+Section 2-325. A. A license or permit, obtained pursuant to
3916+Sections 5 Section 2-323 or 6 2-324 of this act title, shall be

3944+that the licensee or pe rmit holder has:
3945+1. Materially falsified any application filed pursuant to this
3946+act Section 2-321 et seq. of this title or required by this act the
3947+Precursor Substances Act ;
3948+2. Been convicted of a misdemeanor relating t o any precursor
3949+substance defined in Section 4 2-322 of this act title or any felony
3950+under the laws of this stat e or the United States; or
3951+3. Failed to maintain ef fective controls against the diversion
3952+of said the precursors to unauthorized persons or ent ities.
3953+B. Before denying annulling, suspending, or revoking a lice nse
3954+or permit, the Director shall cause to be ser ved upon the applicant,
3955+licensee, or permit holder an order to show cause why a license or a
3956+permit should not be denied annulled, suspended, or revoked. The
3957+order to show cause shall contain a s tatement of the basis therefor
3958+and shall call upon the applicant, licensee, or permit holder to
3959+appear before the appropriate person or agency at the time and place
3960+within thirty (30) sixty (60) days after the date of service of the
3961+order. The proceedings shall be c onducted in accordance with the
3962+Administrative Procedures Act without regard to any criminal
3963+prosecution or other proceeding. Nothing in this section shall be
3964+construed so as to require an individual proceeding for the denial
3965+of a new license or permit.

4000+SECTION 15. AMENDATORY 63 O.S. 2021, Section 2-406, is
4001+amended to read as follows:
4002+Section 2-406. A. It shall be unlawful for any registrant
4003+knowingly or intentionally:
4004+1. To distribute, other than by dispensing or as otherwise
4005+authorized by this act Section 2-101 et seq. of this title, a
4006+controlled dangerous substance classified in Schedules I or II, in
4007+the course of his legitimate business, except pursua nt to an order
4008+form as required by Section 2 -308 of this title;
4009+2. To use in the course of the manu facture or distribution of a
4010+controlled dangerous substance a registration number which is
4011+fictitious, revoked, suspended or issued to another person;
4012+3. To acquire or obtain possession of a controlle d dangerous
4013+substance by misrepresentation, fraud, forg ery, deception or
4014+subterfuge;

4042+omit any material information from, any application, report, or
4043+other document required to be kept or filed under this act, or any
4044+record required to be kept by this act Section 2-101 et seq. of this
4045+title; and
4046+5. To make, distribute, or possess any punch, die, plate,
4047+stone, or other thing designed to print, imprint, or reproduce the
4048+trademark, trade name, or other identifying mark, imprint, or device
4049+of another or any likeness of any of the foregoing upon any drug or
4050+container or labeling thereof so as to render such dru g a
4051+counterfeit controlled dangerous substance; and
4052+6. To purchase, attempt, endeavor and conspire or endeavor or
4053+conspire to obtain and purchase o r obtain or purchase, any license
4054+or registration required to distribute , possess, prescribe, or
4055+manufacture any controlled dangerous substance, on behalf of or at
4056+the request or demand of any person, through the use of a straw
4057+person or party as defined in Section 2-101 of this title.
4058+B. Any person who violates this section is guilty of a felony
4059+punishable by imprisonment for not more than twenty (20) years or a
4060+fine of not more than Two Hu ndred Fifty Thousand Dollars
4061+($250,000.00), or both.
4062+C. Any person convicted of a second or subsequent violation of
4063+this section is punishable by a term of imprisonment twic e that
4064+otherwise authorized and by twice the fine otherwise authorized.
